MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, TUESDAY, JULY 19, 1994 CALL TO ORDER: The Special Meeting of the City Council of the City of Des Plaines was called to order by Mayor Ted Sherwood at 7:00 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Tuesday, July 19, 1994. ROLL CALL: Roll call indicated the following aldermen present: Beauvais, Christiansen, Elstner, Kisslinger, Curley, Sarlo, Chiropolos, Haupt. Also present were City Manager Douthwaite, Director of Community Development D'Onofrio and City Attorney Wiltse. PURPOSE: DISCUSSION: Mayor Sherwood announced that the purpose of the Special Meeting was to discuss the matter of Zoning Case 94-25-A and 94-26-A, 1000 E. Northwest Highway/The Salvation Army. Mayor Sherwood declared that the City council was now resolved into a committee of the Whole. COMMUNITY DEVELOPMENT Alderman Sarlo, Chair Director of Community Development D'Onofrio gave a brief overview of the request from The Salvation Army for a map and text amendment to permit the operation of an adult rehabilitation center on property located at 1000 Northwest Highway. Mr. D'Onofrio requested that when the votes are taken that they be taken in the following order: 1) text amendment; 2) map amendment; and 3) site plan. Attorney Richard s. Nikchevich, representing The Salvation Army, introduced Colonel Marcus Stilwell and other officials from The Salvation Army. Mr. Nikchevich distributed exhibit books to the City Council and then gave a brief overview of its contents. Mr. Nikchevich officially requested that if the vote on the text amendment is defeated, that a vote be taken on the map amendment. Alderman Sarlo asked the City Attorney to respond to this request. Attorney Wiltse stated that if the text amendment is defeated, the other two motions would be moot. Colonel Stilwell addressed the City Council and described the proposed 65-bed adult rehabilitation center and what it would encompass. Two individuals who have gone through a program at an adult rehabilitation center addressed the City Council describing their experiences. Colonel Stilwell presented to the City Council 1352 petition signatures in support of The Salvation Army's request. He stated that there is a desperate need for this type of facility in the community and it would have a minimal impact on local taxes; approximately $.61 per resident. Alderman Sarlo requested that all those in favor of the request speak first, not be repetitive and be brief. Ten people spoke in support of this request. DISCUSSION (Cont'd.) ZONING CASE 94-26-A 1000 N.W. HIGHWAY: Text Amendment ADJOURNMENT: 1 98. 7/19/94 PAGE TWO Alderman Sarlo then requested all those in opposition of the request speak, not be repetitive and be brief. Fifteen people spoke in opposition of this request. Mr. Nikchevich again officially objected to the decision not to allow a vote on all three issues before the City Council; the text amendment, map amendment and site plan. Alderman Chiropolos (alderman of the Ward in which the proposed project would be located) presented 250 petition signatures from the adjacent and immediate area of the proposed adult rehabilitation center in opposition of the request. Moved by Curley, seconded by Haupt, to concur with recommendation of Des Plaines Zoning Board of Appeals and recommend to the City Council, re Zoning Case 94-26-A, to grant request for Text Amendment to permit adult rehabilitation center in an Institutional District on property located at 1000 Northwest Highway. Motion declared failed (Aldermen Kisslinger, Curley, and Haupt voted yes; Aldermen Beauvais, Christiansen, Elstner, Sarlo, and Chiropolos voted no). Mayor Sherwood assumed the chair, and declared the City council back in session. Following discussion and action in Committee of the Whole, moved by Curley, seconded by Haupt, to concur with recommendation of Des Plaines Zoning Board of Appeals, re Zoning Case 94-26-A, to grant request for Text Amendment to permit adult rehabilitation center in an Institutional District on property located at 1000 Northwest Highway. Upon roll call, the vote was: AYES: 3-Kisslinger, Curley, Haupt NAYS: 6-Beauvais, Christiansen, Elstner, Sarlo, Chiropolos, Sherwood ABSENT: 0-None Motion declared failed. Moved by Beauvais, seconded by Elstner, that the Special Meeting of the City Council adjourn. Motion declared carried.
