Council Minutes 06-15-20MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD VIA ZOOM VIDEO CONFERENCE ON MONDAY, JUNE 15, 2020 CALL TO The regular meeting of the City Council of the City of Des Plaines, Illinois, was called ORDER: to order by Mayor Bogusz at 7:01 p.m. The meeting was lived -streamed via: http://desplaines.org/accessdeplaines and played on DPTV Channel 17 on Monday, June 15, 2020. ROLL CALL: Roll call indicated the following Aldermen present: Lysakowski, Moylan, Rodd, Zadrozny, Chester, Smith, Goczkowski. Absent: Brookman. A quorum was present. Also present were: City Manager Bartholomew, Assistant City Manager/Director of Finance Wisniewski, Director of Public Works and Engineering Oakley, Director of Community and Economic Development McMahon, Fire Chief Anderson, Police Chief Kushner, and General Counsel Friedman. PRAYER AND The prayer was offered by Alderman Zadrozny followed by the Pledge of Allegiance PLEDGE: to the Flag of the United States of America. PUBLIC The City of Des Plaines continues to follow social distancing requirements and COMMENT: Governor Pritzker's Stay -at -Home Order. In response to the risks created by the COVID- 19 outbreak, Governor Pritzker issued Executive Order 2020-07 on March 16, 2020, suspending the Open Meetings Act provision relating to in-person attendance by the members of the public body. Tonight's meeting is allowed to be conducted via video conferencing. Public comments were allowed to be e-mailed to publiccomments@desplaines.org or phoned in to the City Clerk's Office by 5:00 pm on Monday, June 15, 2020. One public comment was received and distributed to the City Council prior to tonight's meeting and is included as Exhibit A. MAYORAL On March 16, 2020, a Declaration of Civil Emergency for the City of Des Plaines ANNOUNCEMENT related to the COVID-19 emergency was authorized. The Declaration provided that: (1) the City may enter into contracts for the emergency purchase of goods and services; (2) the City Manager may implement emergency staffing protocols pursuant to the City's respective collective bargaining agreements; and (3) directed City officials and employees to cooperate with other government agencies. In accordance with Illinois statutes, the Mayor's Declaration lasted only for a period of seven days, unless it was extended by action of the City Council. At each subsequent City Council meeting, the City Council, by motion, extended the Declaration until the next adjournment of the next special or City Council meeting. Moved by Rodd, seconded by Moylan, to extend the Mayor's March 16, 2020 Declaration of Civil Emergency until the end of the next regular, special, or emergency meeting of the City Council. Page 4 of 6 06/15/20 COMMUNITY SERVICES — Alderman Goczkowski, Chairman CONSIDER As part of the FY2020 Budget, City Council allocated $160,000.00 for disbursement GRANT to social service agencies that provide services to Des Plaines residents in need. The RECIPIENTS/ Health and Human Services Division (HHS) has solicited and evaluated grant requests 2020 SOCIAL from social service agencies that serve the Des Plaines community. SERVICES PROGRAM: This year 36 agencies submitted applications requesting funding through the City of Des Plaines. Agency interviews originally scheduled for March 23- March 31, 2020 were cancelled due to the ramifications of COVID-19 and the "Stay at Home Order." In an attempt to expedite the Social Service Funding process, HHS conducted telephone interviews in April. All of the agencies expressed gratitude for the City's program and stressed how valuable local support is for leveraging funding from other sources, which strengthens their service capabilities for our residents. Even during the pandemic, our agencies continue to provide services to our residents by implementing online video technology for activities, support groups and meetings, conducting intakes over the phone/computers, limiting office hours with appointments only or curbside food/meal disbursement. HHS continues to utilize a point system to assist with the allocation of the funds based on the number of Des Plaines residents served, the percentage of Des Plaines clients served within the agency/program, the program budget, the abundance or scarcity of a service, the frequently referred agencies to address resident's needs, and staff feedback. In 2019, Health and Human Services staff received over 2,175 office visits/calls for information/referral and various services. These agencies and the services they provide assist in meeting the needs of our residents. Staff recommended approval of Resolution R-115-20. LEGAL & LICENSING — Alderman Brookman, Chairman CONSIDER Vice Chair Smith summarized a memorandum dated June 8, 2020. AUTHORIZING CARRY -OUT At the June 1, 2020 City Council meeting, options to provide financial relief to business LIQUOR AND establishments within the City were discussed, including business Page 5 of 6 06/15/20 EXTENDING registrations/licenses and liquor license fees collected. Council members requested that LIQUOR LICENSE an item be placed on the Legal and Licenses Committee agenda to consider creating a DUE DATE: payment plan for liquor license fees as well as to discuss other business registration fees. On May 5, 2020 Mayor Matthew J. Bogusz, in his authority as Liquor Commissioner, extended the payment of all City liquor licenses fees from June 30 to July 30, 2020. Then on June 3, 2020 Governor Pritzker signed Public Act 101-0631 into law. Among other provisions, P.A. 101-0631 amends the Illinois Liquor Control Act for certain liquor license holders whose business operations were suspended in any capacity due the Governor's Executive Orders during the COVID-19 crises to temporarily defer the payment of liquor license fees for a period of 180 days to December 31, 2020. The City's liquor license renewal fees range from $300 to $6,000. Revenue generated by liquor license fees is approximately $230,000 per year. Public Act 101-0631 also allows currently issued state liquor licenses to be automatically renewed and extended for 120 days, notwithstanding their renewal date. The extended renewal date is based upon the most recent liquor license application for renewal that was received and approved by the State Liquor Commission. City business registration renewals begin on January 1st of each year and are due on January 31st. Fees range from $55 to $560. The City receives approximately $248,000 in revenue each year through business registration fees. As of June 3, 2020 only 100 business have not filed for renewal. Public Act 101-0631 also amends the Liquor Control Act to temporarily allow for the sale of mixed drinks for carry -out and delivery. The Act allows local municipalities to prohibit or further restrict the sale of to -go mixed drinks. This authority by the State to sell mixed drinks for carry -out and delivery is scheduled to expire on June 2, 2021. On June 8, 2020 Mayor Matthew J. Bogusz executed a Supplemental Order that authorizes alcoholic beverage licensees to sell mixed drinks for carry -out and delivery. This order will terminate concurrently with the state of emergency associated with the COVID-19 pandemic by rescission of Governor Pritzker's statewide declaration of emergency or its lapsing without replacement; or the repeal of this Supplemental Order by my direction or motion of the City Council. The City's General Counsel determined that in order for liquor license holders to be allowed to sell mixed drinks for carry -out and delivery on an ongoing basis, the City Council should ratify the Mayor's order through a resolution and extend the deadline through and until the one-year sunset included in Public Act 101-0631. Staff recommended approval of Resolution R-117-20. Discussion will be held during the budget planning session to determine if assistance can be provided for business license fees.
