Behrel at 8:15 P.Mj The meeting opened with a prayer read by City Clerk Bo Eleanor Rohrbach followed by ~h~ pledge of allegiance to the. flag 0 ( . ROLL CALL:-Roll Call indicated the following aldermen , . . present: Bolek, Figard, Czubakowski, Wagner, Swanson~ French, Martin, Bonaguidi, Rateike, Szabo, Prickett. Present also were City Comptroller Blietz, Marshall of Police Kennicott, Fire Marshall Arndt, Commissione~ of Public Works Warnicke, Building Commissioner Schuepfer, City Engineer Fletcher, Health Officer Branding, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett and seconded by Alderman Swanson that the Minutes of the regular meeting of December 20, 1965 be approved as writteno Motion Carriedo REPORTS OF CITY OFFICIALS: The Clerk submitt€d written reports of the Health Department for 1965, and Monthly and Yearly reports of the Building Department, to be placed ·on file. Report of Police Chief: Marshall of Police Kennicott reported that the Police Department has apprehended the driver of the 1966 Buick Wildcat who hit Alderman Shillington in a "Hit and Hun" Accident early Jap.uary 1, 1966. Alderman Bonaguidi and Figard commended the Police Deparfment highly for the work they have accomplished in this case with unanimous commendation from all aldermen present 0 Police Chief Kennicott also reported that the di~apidated house on Algonquin Road has been boarded up, using the City's powers to correct any nusiance problem in the absence of demolishingo Report of Commissioner of Public Works clock to remove the four Commissioner of Public Works reported that during the last two weeks there have been a number of watermain breaks and also that the ,Street Department worked around the inches of snow that fell December 24tho Report of City Attorney: City·Attorney DiLeonardi reported that the Circuit Judge approved the Master's Report concerning the Car Wash in favor of the Gity 0 He also reported that the Golden Manor decree was directed in the City's favoro The Margret Street case will be before the Supreme Court January 18tho City Attorney DiLeonardi reported that Police Officers Schwiesow and Ziemet are being sued in a second case in Federal Courto It was moved by Alderman Fnmch and seconded by Alderman Szabo that the City Attorney defend said poljce officers in the Fed~ral Court CaseQ Motion CarriedQ City Attorney DiLeonardi suhmitt~d to all Aldermen a Memorandum regarding the necessity of amendment td the zoning ordinance to disalJow infringements on easements for their consideration 0 He further reported that a copy of the Resol11tion passed at the regular meeting of December 20, 1965, regarding the proposed Metropolitan Sanitary District Sewage Treatment Plant had been sent to said MPtropolitan Sanitary Districto REPORTS OF COMMITTEES: ZONING CASE 65-34--R 1318,1322,1360 Lee Street Herman,Love & Schwartz Alderman Martin, Chairman of the Municipal Development Committee, reported that said Committee has investigated Zoning Case 65-34-R, on property located at 1318, 1322, 1360 Lee Street, owned by Herman, Love & Schwartz, and has found that a Zoning Hearing was held December 7, 1965 regarding the rezonjng of these lots on Lee Street between Forest Avenue and Vannuren Streets~ and recommend that the Mayor and City Council authorize the Zoning cltange from R-2 to C-2 and authorize the City Attorney to draw the necessary Zoning OrdinanreG -, Page tw.o 1/3/66 101 REPOHTS OF COMMITTEES: (Continued) Zoning Case 65-34-R (Con t;i_nued) ZONING CASE 65-35-R 1159 Algonquin Rd. Sterner-Berlin (Ziehn) It was moved by Alderman Martin and seconded by Alderman French that Council concur in said report. Motion Cai_::rj~. Alderman Martin, Chairman of the Municipal Development C.ommittee, reported that said Committee has investigated Zoning Case 65-35-R on propert¥ located at 1159 Algonquin Road, owned by Sterne;r-Berlin (Petitioner, Ziehn) and has found that the Zonipg request was for C-2 pommercial from R-2 and a variation from a twenty-five foot setback to a five foot frontage setback •. The Zoning Board of Appeals heard the Case on December 7, 1965, and recommended the 7 oning change. The neighpors of subject property have filed objec- tions with the City Council since the hearing. We, your Committee on Municipal Deveiliopment therefore recommend that the subsequent evidence filed regarding this change of 'oning proved that the change is not in the puhlic interest and the property is an encroachment of Commercial into the Residential Area. The Committee recommends that the Zoning change be ~enied. It was moved by Alderman Martin and seconded by Alderman Swanson that Council concur in said report. Motion Carried. OAKVILW TERRACE SUBDIVISION Aldennan Martin, Chairman of the Municipal Development Committee, gave the following report: ~Your Committee on Municipal ( ., Development has investigated Oakview Terrace Subdivision (Field Home Ruilders) and had .found jt consists of twenty- one lots and is located approximately 220 feet north of Rand Road, one block east of River Road and bound by Grove and llawthorne Lane. The Subdivision was approved by the Des Plaines Plan Commission November 8, 1965. We, your Committee on Municipal Development therefore recommend that t~e Oakview Terrace Subdivision Plat be approved and that the Mayor and City Clerk be hereby autl1orized (to sign said Plat upon the posting of necessary Bond or Cash for improvements and recording." Attached to above report was a Letter of Easement for Storm Sewer dated December 28, 1~65 from Mr. and Mrs. George Eck. Alderman Bo-lek, Chairman of the License Health and Inspection eommittee, reported that said Committee has investigated the request for a Class E Liquor License received from Mr. Niek · and Mrs. :Marlclyn Amelio, owners of Nick's ~a Cantina Restaurant nnd has found the restaurant does not have seventy-five seating capacity and therefore does not pomply with City of Des Plaines Ordinance, Said License llealth and Inspection Committee recommends that the License be denied. It was moved by Alderman Prickett and ' seconded by Alderman Martin that the City -not cross Potter Road in its annexation program and recognize Potter Road as the Eastern boundary of the City of Des Plaines. Motion Carried.
