CALL TO OilDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting opened with a prayer by Rev. Wappler of St. Martin's Episcopal Church followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Prickett, Wright, Bolek, Leer, Shillington, Figard, Czubakowski, Wagner, Swanson, French, Martin, Bonaguidi, Rateike, Szabo. Present also were City Comptroller Blietz, Marshall of Police Kennicott, Police Captain Hintz, Fire Marshall Arndt, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi. - There being a quorum present, the meeting was in order. PRE-ANNEXATION HEARING: Middle States Tel. Co. S. E. Corner Lee & Touhy The City Clerk read the Legal Notice of Public Hearing before the corporate authorities of the City of Des Plaines on a proposed written pre-annexation agree- ment between the City of Des Plaines, and tp·e Northwestern Mutual Life Ins ranee Company, a Wisconsin corpora- tion and Middle States Telephone Company of Illinois, an Illinois Corpora- tion~ rezoning property located at the southeast corner of Lee and Touhy Avenues upon annexation -said notice published in the Des Plaines Suburban Times, December a, 1966. There were no persons requesting to be heard, and it was moved bylAlderman Martin and seconded by Alderman Prickett that the Pre-Annexation Agreement be taken under advisement by this Council. Motion Carried. MINUTES: It was moved by Altterman Prickett and seconded by Alderman W~ig~t that the Minutes of the regular meeting of December 5, 1966, b~ approved as published. The Clerk submitted a correction on page five, paragraph 4, scratching the word "rates" and inserting "the franchise fees" and SQratching all words following Middle States Telephone Company. MOTION CARRIED and the minutes were approved as corrected. REPORTS OF CITY OFFICIALS: The Clerk submitted the report of the City Treasurer for the month of November, 1966, to be placed on file. City Engineer Fletcher gave a progress report on the water reservoir aqd storm sewer projects. Memo -Validity of Protests on rezoning "Boeckenhauer" property vote will be required to pass COMMITTEE REPORTS: 1801; R~nd .Rd. re-zoning City Attorney DiLeonardi submitted to the City Council a memorandum containing his opinion as to the validity of the .protests on rezoning the "Boeokenhauer" property, stating that a two-thirds the re-zoning ordinance. It was moved by Alderman Rateike and seconded by Alderman Wright to reconsider the action of the Council on the re- zoning of property located at 1801 Rand Road. Alderman French, Chairman of the Municipal Development Committee, set a meeting of said Committee for 8 P.M., January 5th. Oak Leaf Commons It was moved by .Alderman French and Subdivision seconded by Alderman Prickett that Council concur in Municipal De v elopment Committee's recommendation to approve the plat of Oak Leaf Commons Subciivision and authorize the Mayor and City Clerk to execute same. After considerable discussion, it was moved by Alderman Bolek and seconded by Alderman Leer to defer action for a two week period of aforementioned subdivisien. (See Minutes of this meeting on Page 9 ). Zoning Cases 66-29-R and , 66-30-R "Boeckei:ihauer" property ( II 6 t-• It was moved by Alderman French and seconded by Alderman Prickett that Council concur in Municipal Development Committee's recommend- ation to grant petitioner Julius Cohen , , , re-zoning of property located on Thacker Stre~t, just .east of .the c.c & Nlv tracks from R-2 to R-4 and C-2 per petitione~•s recen~ request. After discussion, it was moved by Alderman Leer and seconded by Alderman Shillington to defer action for two weeks on the aforementioned report. Request of John H. Boeckenhauer Police Committee Meeting North Maine Fire Protection District The letter from John H. Boeckenhauer requesting a meeting with the Municip a l Development Committee to review the plans to re-zone aforementioned property was referred to the Municipal Development Committee for study and report. Alderman Figard, Chairman, se; a meeting of the Police Committee, for January 4th, at 7:30 P.M. with the City Attorney. Alderman Rateike, Chairman of the Fire Committee, read to Council the letter received from w. F. Levander, Attorney for North Maine Fire Protection District expressing the District Trustees desire · to propose a contract with the City showing a consideration to be paid on a basis of $1,000 per week, without reference to the number of calls made in the District. It was moved by Alderman Rateike and seconded by Alderman Figard that Council concur with Fire Committee's recommendation to provide North Maine Fire Protection District with fire protection for a period of ninety days beginning J~nuary 1, 1967, wi.th the charges for said service to b e negotiated before the next Council Meeting. Motion Carried. -City Attorney to draft the necessary amendment. Prairie Ave & Fourth Ave. It was moved by Alderman Martin and ( seconded by Alderman Swanson to concur in Streets and Trafftc Committee's recommendation to defer action on the .petition for e four way stops at the intersection of Prairie Avenue and Fourth Avenue until the widening and storm sewer projects are completed. Motion Carried. Alderman Martin requested that the Police Department observe the speeding traffic on Prairie Avenue from First Avenue to Wolf Road. Award. Bid -Section #5. Storm Sewer It was moved by Alderman Bonaguidi and seconded by Alderman Martin that Council concur in Sewer Committee's recommendation to award the bid for Section #5 •I the Storm Sewer Program to the low bidder in the amount of $559,713.00, H. s. Cassidy Co., and the checks or bonds of the unsuccessful bidders be returned. Motion Carried, It was moved by Alderman Wright and seconded by Alderman Wagner to concur with Parking Lots Committee's recommendation to increase the non-resident parking fee for Lots 2 and 5 in the City of Des Plaines to $25.00 Motion Carried. Alderman Rateike voted Nay. Ordinance M-32-66 Alderman Wright read Ordinance M-32-66, Non-Resident Parking Perntits having to do with the ·increase to $25 for ' non-resident parking permits. It was moved by Alderman Wright and seconded by Alderman Wagner to place said Ordinance on passage. Motion Carried. After considerable discussion, it was moved Burke re fees by Alderman Bonaguidi and second.ad by r---Alderman Leer that Council accept the letter of Attorney John T. Burke in which he states that his future charges for handling the North Western case in the Illinois Appellate Court, including the cost of printing of the Reply Brief shall not exceed $990; also that Council pay the bill received for professional services in the amount of $8,627.95. It was moved by Alderman Martin and seconded. by Alderman Prickett that Council concur -with Special Flood Control Committee's recommendation to accept the recommendation of City Engineer F~tcher regarding a retention basin on the Oak Leaf Commons Property. City Engineer Fletcher recommends that the owner provide an underground storage rather than an open pond at" the developers expense as well as providing some rain water retention until the storm sewer on Oakton Street is completed. Motion Carried. APPROVAL OF BILI.1S PAYABLE: Alderman Brickett, Chairman of the Finance Committee, presented the following resolu- tion: BE IT RESOLVED BY THE CITY OF DES 'PLAINES ,THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total: $169,424•86. It was moved by Alderman Prickett and seconded by Alderman Swanson that the aforesaid resolution be adopted. It was moved by Alderman Prickett and seconded by Alderman Martin to adopt the yearly resolution with State Department of Public Works and Buildings for the Construction on State Right of Way. MOTION CARRIED. The Electrical Agreements received from the Department of Public Works and Buildings regarding traffic signal installations at Lee Street and Touhy Avenue were re- ferred to the Streets and Traffic Committee for study and report. It was moved by Alderman Figard and seconded by Alderman Shillington that Council concur with the Des Plaines Zoning Board of Appeals in Case 66-39-A and authorize the City Attorney to draft the necessary amendment to the Zoning Ordinance to amend Section ~.G.2 (b) (i). Motion Carried. The Plat of Street Deiication of Oakton and Lee Streets was referred to the Munici- par Development Comm'i ttee for study and report. The P~at of Birch Street Dedication for the westerly 33' was referred to the Municipal Development Committee for study and report. It was moved by Alderman Rateike and seconded by Alderman Figard to authorize the Mayor and City Clerk to execute the agreement between the City of Des Plaines and South Maine Fire Protection District for· 1967 City to receive $1000 for services rendered from January 1, 1967 through December 31, 1967 Motion Carried. The engineering report on water and sewer facilities in the Pleasant Manor Estates was referred to the City Engineer and Water Committee for study and report. Mayor Behrel read the letter received from the Department of Housing & Urban Develop- ment in which they deny the City's request for their participation in the Storm Sewer Program. It was moved by Alderman Figard and seconded by Alderman Swanson that Council concur in Mayor Behrel's appointment of Mr. George Mott and Mr. Frank Fager for a three year term to the Human Relations Commission - terms to expire December 31, 1969. MOTION CARRIED. The request for a study of parking on Maple Street from Howard to Oakton Streets was referred to the Police Department and Traffic Commission for -study and report.
