The-regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:00 P.M. The meeting opened with a prayer by Father Hanley of st. Stephen's Church followed by the pledge of allegiance to the flag. ROLL CALL : Roll Call indicated the following aldermen present: Prickett, Wright, Bolek, Leer, Shillington, Figard, Czubakowski, Wagner, Swanson, French, Bonaguidi, Rateke, Szabo. Absent was Alderman Martin. Present also were City Comptroller Bliet~, Police Chief Kennicott, Police Captain Hint~, Fire Marshall Arndt, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, Assistant Commissioner of Publ~ic Works Schwab, City Engineer Fletcher, Civil Defense Director Arthur, and City Attorney Robert J. DiLeonardi. TROPHY PRESENTATION VANGUARDS APPROVAL OF MINUTES: -- appfoved as published. OPEN BIDS: Section #4 -Storm Sewer Bowler & DiPaolo ·Co. Brautigam Co. Mr. Tom Barrett, Business Manager of the Vanguards, presented the City of Des Plaines with the traveling trophy won by the Vanguards Drum Corps at Madison, Wisconsin. REPORTS CF CITY OFFICIALS: The Clerk submitted reports of Sewer Construction Fund; Health Department for October, 1966; Building Commissioner's Report for mo•th of October, 1966 and Minutes oft he Des Plaines Public Library Board to be placed on file. A Report of City Comptroller City Comptroller Blietz reported that the City of Des Plaines is one of the largest retail sales areas in the State of Illinois with total Sales Tax, Collections from~August, 1965 thru July, 1966, of $4,055,764.46. A breakdown in percentages showed the following: General Merchandise, 8.5%; Food, 21.3%; Ilrinking and Eating Places, 5.1%; Apparel, 2.3%; Furniture, 1.6%; Lumber, Building and Hardware, 16.7%; Automotive, 25.8%; Miscellaneous Retail, 9.0%; Miscellaneous,12.2%; Manufacturers, 7.5%. Report of Oity Engineer City Engineer Fletcher reported on the progress of the pumping station, stating that he .expects completion before the ground freezes. He further reported that the storm sewer project is being delayed by the public -utilities in some areas and that a meeting was held with the representatives this -morning. ( Report of City Attorney City Attorney DiLeonardi reported that suits had been filed against Kuntze and A. Rogers for moving tenants into their buildi.ngs without certificates of occupancy and the Court has fined Mr. Kuntze $1,000 but Mr. A. Rogers has until November 15th to 'answer the charges, City Attorney DiLeonardi further reported that sµit has been filed against the Metropolitan Sanitary District regarding the proposed location of the Sewage Treatment Plant. City Attorney DiLeonardi reported 1109 he attended th~ h~arings on Cook _....._,.,__ ____ .......,~------------County Zoning Dockets #982, 983, 1109, 1107, and 1108, and has prepared resolutions objecting and protesting to the applications for rezoning on aforementioned dockets. It was moved by Alderman French and seconded by Alderman Szabo that Council adopt a resolution objecting to Cook County .-Zoning Dockets #982, 983, and 1109. It was moved by Alderman French and seconded by Alderman Wagner to concur in Municipal Development Committee's recommendation that the plat of dedication of a small portion of land for · a public street south of Algonquin Road and west of Mt. Prospect Road, known as Doreen Drive, be approved and the Mayor and City Clerk be authorized to execute same. It was moved by Alderman Shillington and seconded by AU.derman Leer that the Plat be referred back to Municipal Development Committee for further ( study. Motion Carried. KOLTON'S RESUBDIVISION It was moved by Alderman French and Locust Avenue ·seconded by Alderman Wagner that Council concur in Municipal Develop- ment Committee's recommendation that the Mayor and City Clerk be authorized to execute the plat of Kolton•s Resubdivision after the necessary corrections are made on the face of the plat with respect to the numbering of the lots and naming of the street. Motion Carried. Zoni rJ5 Cases 66-29-R and 66-30-R -Progress Report Alderman Frenc·h, Chairman of the Municipal Development Committee, reported that said Committee is working hard to try to determine the sentiment of the community with regards to Zoning Cases 66-29-R and 66-30-R on property located on Algonquin Road east of .the C & NW between Thacker and Algonquin and that the Committee is in receipt of a letter from the developer regard- ing changes to be developed on the original petition. These Cases will be rep6rted at a future date• Zoning Case 66-27-R -. l942 Lee Street -Valiguet . Progress Report Alderman French, Chairman of the Municipal Development Committee, reported that said Committee has reviewed Zoning Case 66-27-R - on property located at 1942 Lee Street owned by A. w. Valiquet and requests that the matter be re- fer~ed to the City Attorney to determine the full legal ramifications of the request for rezoning from legal non-conforming to M-1 Restricted Manufacturing District as well as submit a legal opinion on the petition .submitted by the adjoining property owners. Zoning Case 66-28-SU Route 83 south of Dempster Julius Gilman It was moved by Alderman French and seconded by Alderman Prickett that council concur with Municipal Development Committee's recommendation that the petition for special use known as -Zoning Case 66-28-SU for coin operated car wash to be located on Route 83, south of Dempster, be granted a• restricted by the Zoning Board of Appeals and the Plan Commission and the City Attorney be authorized to draft the necessary amendment to the Zoning Ordinance. Motion Carried, Zoning Case 66-32-R - Middle States Telephone Co. & Northwestern Mutual Life Insurance Co. a pre-annexation hearing on ~. E. CornAr of Lee & Touhv. Alderman French, Chairman of the Municipal Development Committee, reported that said Committee recommends that the City Attorney take the necessary steps to effect Zoning Case 66-32-R -property located at Page four 265 11/7/66 Health Department to Alderman Bolek, Chairman of the License provide Home Health Health and Inspection Committee, reported Services -Medicare as follows: "The Board of Health of the , City of Des Plaines has passed a resolu- tion approving the establishment of a Home Health Agency for the pnJ:pose of offering skilled nursing service and other therapeutic services to those citizens within the corporate limits of Des Plaines who are eli- gible for such benefi~s under the Health Insurance for the Aged Act, commonly known as Medicare and with the proper expansion of the Health Department of the City of Des Plaines, the Health Department could qualify and become accredited as a Home Health Agency and be re-imbursed r-1 for such services by the Social Security Administration." It was moved by Alderman Rateike and seconded by Alderman Wagner that Council adopt the resolution appro- priating $32,000 for traffic lights at the intersection of Maple & Touhy from the City's allotment of MFT funds. Motion Carried, It was moved by Alderman Rateike and seconded by Alderman Shillington to Concur with Traffic Commission's recom- mendation to install yield signs for Leahy Circle to yield to Kathleen Drive, and the City Attorney to draft the necessary amendment to the ordinance. Motion Carried. It was moved by Alderman Rateike and seconded by Alderman Figard that Council concur in Streets and Traffic Committee's recommendation to remove two parking meters on the north side of Prairie east of Grace- ( land Avenue to allow westbound traffic on Prairie to pass through intersection. It was moved by Alderman Bonaguidi and seconded by Alderman Figard to amend the motion to include ~he removal of one parking meter on the south side of Prairie east of Graceland. It was moved by Alderman Figard and seconded by Alderman Czubakowski that Council concur with Water Committee's recommendation I that the City of Des Plaines ·contribute a total of $1500 to the DAMP Commission. It was moved by Alderman Figard and seconded-by Alderman Rateike that Council adopt the resolution authqrizing, empowering and directing the City Attorney to negotiate on behalf of the City with t4e owners of the property located on Algonquin Road, commonly known as the Egan Property, for the future expansion of the facilities for the Public liorks Department and in the event that the City Attorney is unable to agree with the owners upon the compensation to be paid therefor, The City Attorney is empowered and directed to institute proceedings in Ctrcu~t Court to acquire title to above property. Elk Blvd. was referred to the Municipal Development Committee for study and repott. The propesed amendment to the Building Code having to do with the moving of buildings was referred to the City Attorney to draft the necessary ordin- ance. It was moved by Alderman Prickett and seconded by Alderman Szabo to authorize the City A~torney to attend the hearing November 18, 1966, at Des Plaines City Hall on Cook County Zoning Docket #1111 on property located 900 feet North of Golf Road and approximately 415 feet West of East River Road. Motion Carriedo The petitions conta~ning 96 signatures of adjoining property owners objecting to the rezoning of property on Algon- ~uin Road known as Cases 66-29-R and 66-30-R were referred to the City Attorney to determine their legality and then to the Municipal Development Committee. The proposed vacation of Chicago Avenue was referr ed to the Municipal Development Committee for study and report. It was moved by Alderman Rateike and seconded by Alderman Prickett to accept the resignation of Irving Moehling from ·'the <Plan Commission and direct Mayor Behrel to write a letter of commendation for his many years of service to the City of Des Plaines. Motion Carried, It was moved by Alderman Prickett and secondeo by Alderman Szabo that Council concur in Mayor Behrel's appointment of Herman Divito to the Plan Commission to replace Kent Nichols for the unexpired term to April 30, 1967 and appointment of James A. Fouse to replace Irving Moehling for the unexpired term to April 30, 1967. Motion Carried. It was moved. by Alderman Wright and seconded by Alderman Figard that Council concur in Mayor Behrel's appointment of Savena Gorsline and Melvin T. Vincent to the Library Board -terms to expire June 30, 1969. Motion Carried. It was moved by Alderman Leer and seconded by Alderman Czubakowski that Council concur in Mayor Behrel's appointment of Dr. Wm. Earl Brehm as chairman of the Human Relations Commission until December 31, 1967. MOTION CARRIED. It was moved by Alderman Wright and seconded by Alderman Wagner that Council concur in Mayor Behrel's appointment of Gilbert Rudiger to the Traffic Commission to replace Herman DiVito for the unexpired term ending April 30, 1968.
