Council Minutes 051666MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY MAY 16, 1966. 175 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Rehrel at 8:: 05 P .M • of the First to the .flag. The meeting opened with & prayer by Rev. Earl Brehm, pastor Congregational Church, fol_lqwed by the pledge of a Ile giance ROLL CALL: Roll Call indicated the fqllowing alderman present: Rateike, Prickett, Wright, Bolek, Leer, Shillington, Czubakowski, Wagner, Swanson, French, Martin, Bonaguidi. Alderman Szabo arrived a few minutes after Roll Call. Absent were Alderman Figard. Present also were Police Chief Kennicott, Police Captain Hintz, Fire Captain Haag, Fire Lieutenant Arthur, Building Co,mmissioner Schuepfer, Commissioner of Public Works Warnicke, Assistant Commissioner of Public Works Schwab, City Engineer Fletcher, _and City Attorney DiLeonardi. INTRODUCTION OF MISS DES PLAINES: Mr. Richard Seloover of the Des Plaines Jaycees presented to City C9uncil, Miss Des Plaines of 1966, Miss Margaret Grant, who expressed her desire to repre- sent Des Plaines for the coming year to the ·best of her ability. APPROVAL OF MINUTES: · It was--moved by Alderman Prickett and 116 5/16/66 Page two MINUTES (Continued) seconded by Alderman Rateike that the Minutes of the Regular Meeting of the City Council of-May 2, 1966, be approved as Written. A Oorrebtion was made on page five, paragraph one, changing the word gates to clockless meters and on -- page six, paragraph five, scratch the words "Class B". After corrections Motion Carried. Program 701 -Local Planning Assistance Mr. Rolf Campbell, representative of Tec- ~earch, reviewed the proposal for submission to the proper state and Federal authorities for matching funds under the 701 program for "Local Planning Assistance." for the City of Des Plaines. It was moved by Alderman Bolek and ~econded by Alderman Rateike that Council continue to study the proposal until the next Council meeting. Motion Carried. Alderman Czubakowski and Alderman Shillington voted No. Alderman Bonaguidi left the meeting during the discussion. REPORTS OF CITY OFFICIALS! The Clerk submitted the Comptroller's reports as follows to be placed on file: Statement of Cash Receipts from January 1 to April 30, 1966, and Statement of Appropriation expenditures from January 1, 1966 to April 30, 1966. Report of Captain Haag - Fire Department Captain Haag of the Fire Department repor~ed that the leaks in the tanks of the Shell Service Station, Algonquin & Lee, have been taken care of by replacing two tanks and that the Oil Companies were very cooperative. He also reported ~hat 28 firemen have completed the refresher and advance thirty-hour First Aid course and that during the storm approximately 200 calls were received regarding---f-looded basements. He fureher reported that Des Plaines fire department assisted Park Ridge in fighting the fire at the Apcoa Building and Mayor Behrel at this time read the letter received from the Pa-l!k-Ridge Fire Department thanking the Police and Fire Departments for their cooperation. Report of City Attorney Prolosed incorporation of Vil age of Golf Mill_ City Attorney DiLeonardi reported that the Court has ordered an election be held -- on May 31, 1966, to determine the success or defeat of the incprporation of the Village of Golf Mill, and suggests the City of Des Plaines be prepared to file a Quo-Warranto (By what authority) suit should the Incorporation pass. This possible action was referred to the Judiciary Committee for study and reporto Memo re 855 Rand Road ~City Attorney DiLeonardi submitted and rezoning reviewed the vote needed to re-zone the property located at 855 Rand :Road, stating that the usual majority of the corporate authorities (8 out of 15) is necessary for passage, rather than a favorable 2/3 of all aldermen.(10 out of 14). The Clerk read the letter. submitted by School District #62 at 8:15 P.M. tonite, in which they state their opposition to the reclassification at 855 Rand Road from R-2 to c-2. City Attorney stated that the letter has no legal effect on the votes required for passage. ( Acguisition of property \ 819 Graceland Avenue (City Attorney DiLeonardi reported that a letter of offer had been sent to the owner. of the property located at 819 Graceland Avenue for the expansion of the library and that an affirmative reply has .not been received within the twenty-day period allowed. The ~cessity of filing a condemnation suit was referred to the Library ~nd Building and Grounds Committee and City Attorney for further action. ( Acguisi tion of "Gray'~ property -proposed City Garage Site Roll Call: AYES: -13 -Alderman Rateike, Szabo, Prickett, Wright, Bolek, Leer, Shillington, Czubakowski, Wagner, It was moved by Alderman Prickett and seconded by Alderman Szabo to authorize and direct the Cit~ Attorney to make an offer in writing to the owners of the "Gray" property located on Algonquin Road and ~f refused, an effort be made ~o condemn the property ~o be used as a site for the New City Garage. Motion Carried. : Swanson, French, Martin, Mayor -NAYES: -0 -ABSENT: - 2 Report of Commissioner of Public Works Warnicke Page three 5/16/66 Commissioner of Public Works Warnicke reported that the last week's rainfall caused widespread damage and that most of 177 the dalnage was< caused by the Metropolitan Sanitary District backing into our sewers. He stated that he believed the problem serioas enough to \thoroughly discuss it with Mr.-Bacon. He further ad.ded that the disconnect ion of downspouts would aid in storm water drainage. An ordinance requiring the removal of down spouts from the sewers was referred to the City Attorney for study and report. I REPORTS OF COMMITTEES: Committee Meeting Alderman French, Chairman of Municipal Development Committee, set a meeting of said committee and the Council as a whole to meet with Tee-Search for Thursday, May 26th, at 8 P.M. Birch Street Dedication It was moved by Alderman French and seconded by Alderman Rateike, that Council concur in Municipal Development and Streets and Traffic Committee's report as follows: "The Board of Local Improvements and Plan Commi••ion have approved the dedication of 33' for Lots E, F, G, H, &~I, and 20• for Lot A to be ·used as a public ~way known as Birch Street, north of Touhy and the Munici- pal Development and Streets and Traffic Committees recommend that the Mayor and City Clerk be authorized to sign plat of dedication." Motion Carried, Adoption of National Fire Code Proposed licensing of fire extinguisher service- men Thacker Junior High School pro~rty I To install three fire dampers -City Hall Alderman Rateike, Chai nnan of the Fire Committee, requested that the letter addressed to Fire Chief Arndt from Lt. Arthur recommending the adoption of the National Fire Code for the City of Des Plaines we s referred to-the Building Control and Inspection Committee for study and report. Request granted. Alderman Rateike, (Chairman of the Fire Committee, requested that the letter addressed to Fire Chief Arndt from Lt. Arthur of the Bureau of Fire Prevention regarding the licensing of fire extinguisher service men be referred to the License, Health and Inspection Committee and City Attorney for study and report. Request Granted. It was moved by Aldernran Shillington and seconded by Alderman Szabo that Council concur in Building and Grounds recommendation that the Mayor ascertain from School Board #62 the purchas-e price of< the Thacker Junior High School property.· Motion Carried. It was moved by Alderman Rateike and seconded by Alderman Shillington that Council purchase a smoke detector system at a quoted price of $1,520 plus 15~. It was moved· by Alderman · Szabo and seconded by Alderman Prickett to table the motion for one meeting. Motion ~carried. It was moved by Alderman Bolek and seconded by Alderman Shillington that Council concur in Lipense, Health and Inspection Committee's re~o~1inendation that Liquor selling establish- 5/16/66 Page four ments be permi,tted to open at 12 noon on Sundays and that the City Attorney be authorized to draft the necessary amendment to the ordinance. Motion Carried. Aldermen Prickett, French, Wright "·~ and Leer voted No. Action deferred -Stop signs at Orchard & Riverview It was moved by Aider- man Martin and seconded by Alderman Prickett that Council concur. No Action -Forest Avenue from Mannheim to Wolf Rd. ·Alderman Martin, Chairman of the Streets and Traffic Committee, reported that said commit- tee recommends concurrence with Traffic Commission's study and recommendation to deny the petitioners' request for stop signs at the intersection of Orchard and Riverview. It was moved by Alderman French and seconded by Alderm~n Swanson to defer action for another meetingo Alderman Martin, Chairman. of the Streets and Traffic Committee, reported that the Traffic Commission recommends that no action be taken regarding the traffic flow on Forest Avenue ifrom Mannheim to 1volf Road until Touhy Avenue widening is completed and that streets and Traffic Committee recommends concurrence with the Traffic Oommission. It was moved by Alderman Martin and seconded _ by Alderman Rateike that Counci.l concur .in above report. Ordinance Z-7-66 rezoning property located at 855 Rand Road from R-2 to c-2 was placed on First Reading. The Clerk read th~ le~t•r submitted by the Cumberland East Ci vie Association requesting answers to questions raised by them concerni~g the rezoning. Ortinance Z-2-66, rezoning the property located at 6 and 30 North River Road, owned by Shawfrank and Fornell, from County M-2 to City M-2• upon annexation was placed on First Reading. Ordinance A-8-66, annexing property located at 6 and 30 North River Road was placed on First Reading. Ordinance B-3-66, amending Section 20.14-3e of the Building Code having to do with firestopping and attic spaces was placed on First Reading. The plat of Albert H. Ahren's .Subdivision and letter from the Plan Commission was referred to the Municipal Development Committee for study and report. The Plat of Szczesny•s Subd4Yision (First Addition) and letter from the Plan Commission was referred to the Municipal Development ·committee for study and report. The letter from the Association of 'Registered Nurses of Des Plaines, Illinois, requesting space in the new city garage, was referred to the Building and Grounds Committee for study and report. The Clerk submitted the letter from National Cystic Fibrosis Research Foundation requesting permission to conduct a "Door to Doortt march in Des Plaines. The Mayor read the letter received fnom Attorney DiLeonardi, member of the Board of Directors of the Des Plaines Community Chest, concerning Council's willing- ness to express a favorable attitude toward encouraging all major charitable fund-raising groups to join the Community Chest in an effort to make the Chest a ttone contribution" activity. It was moved by Alderman Prickett and seconded by Alderman Shillington to authorize and direct the City Attorney to draft the necessary resolution and investigate the ordinance adopted by neighboring Park Ridge. Motion Carried. MEMORIAL DAY PARADE The Clerk read the letter from The American Legion, Des Plaines Post No. 36, regarding the Memorial Day Parade and the Mayor encouraged all Council members to participate. Public Hearing -Illinois It was moved by Alderman Swanson and seconded Commerce Commission -by Alderman Prickett to authorize and direct the City Attorney •o attend the public hearing, May 31, 1966, at 10:00 A.M. before. the Illinois Commerce Commission regarding the application of Continental Air Transport Co., Inc. to operate between Barrington and the Chicago• O'Hare International Airport making a stop in Des Plaines. Motion Carried. Petition Owners of property Alderman Bolek submitted a petition signed across the alley from Oak by 47 property owners on Wicke, Webster Lane, Leaf Commons ( and Second Avenue, opposing-tfie erection of any building which would consist wholly or partially of apartments on property immediately adjacent to Wicke Avenue. --It was moved by Alderman BoleR and seconded by Alderman Leer to accept said petition and refer same to the Building Control and Inspection Committee, Building Commissioner and Zoning Adminis- trator and City Attorney.
