Council Minutes 032166142 MINUTES OF THE REGULAR MEETING , < OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, MARCH 21, 1966• CALL TO ORDER: The regular meeting of the City Council · of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting :opened with a (prayer by Rev. Allen Fedder followed by the pledge of allegiance to the flag. ( ROLL . CALL: , Roll Call indicated the following aldermen present: Wagner, Swanson, French, Martin, Bonaguidi, ·Rateike, Szabo, Prickett, Bolek, Figard.-: Absent ~ere Aldermen Czubakowski, Wright, Leer, Shillington. Present also were City Comptroller Blietz, Police Chief Kennioott, Fire Marshall Arndt, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi •. There being a quorum present, the meeting was in order. MINUTES: OPEN BIDS: New Auto -Fire Dept. It was moved by Alderman Prickett and seconded by Alderman Rateike that the minutes of the regular meeting of March 7, 1966, be approved as written. Motion Carried. Motion Carried.· Alderman Bonaguidi requested a five minute recess to consider above bids. Request granted. Alderman Bonaguidi, Chairman of the Sewer Committee, reported that said Committee and Finance Committee had found the low bidder to be Town and Country Services, Inc~ and recommends the bid be awarded to same at a cost of $4.75 per basin and the Mayor and City Clerk be authorized to sign the necessary contract. It was moved by Alderman Bonaguili and seconded by Alderman Prickett that Council award the bid to Town and Country .Services. The Clerk submitted reports of City Comptroller Blietz, Annual Report of Fire Prevention Bureau, and Minutes of the Des Plaines Human Relations Commission meeting of February 10th to be placed on file. Report of City Comptroller City Comptroller Blietz reported that the County Clerk's office has released the City's Tax and has found it to be lower than 1964. The 1963 Tax rate was .560, 1964 Tax rate was .542 and in 1965 the Tax rate is .532. He further reported that .the Assessed Valuation has increased $27,ooo,ooo. By way of com-. parison, Sales Tax collected for December, 1965 was $59,713.73 and for December of 1964, $46,160.93. Report of City Engineer City Engineer Fletcher reported that the new City Maps were placed on the desks oft he Aldermen tonite and requested that Aldermen submit to him corrections they deem necessary. The ossible annexation of the wthorne-Ran• area was referred by the Mayor e City Engineer to determine if the ~rea which is completely surrounded by the City of Des Plaines is less than sixty acres, Report of City Attorney City At_torney DiLeonardi submitted a written memorandum regarding Cook County Zoning Dockets Cook Co. Zoning 999 and 1000 stating that the applicant was Dockets 999 & 1000 granted a continuance subject to the outcome of the City of Des Plaines decision concerning annexation. It was moved by cAlderman Martin and seconded by Alderman Brench to refer the :matter of possible annexation of vacant land located on the Northwest Corner of Elmhurst Road and Oakton Street to t~e Munici- pal Development Committee for study and report. Motion Carried, City Attorney DiLeonardi submitted a written memorandum regarding Cook County Zoning Dockets #1003, 1015, and 1019 public hearings. It was moved, after considerable discussion, that no objections be filed with the Cook County Zoning Board of Appeals and that the Zoning Board and County Clerk be so notified. Motion Carried. Zoning Dockets #1027, 1028, & 1029 Page three 3/21/66 City Attorney DiLeonardi reported he had attended the Public Hearing on Cook C~unty Zoning Docket #1018 on property located on the north side of Golf Road, approximately 403 feet east of Potter Road, and that the developer has asked for a zoning ch~nge from R3 to R6 for multi-family dwellings. City Attorney submitted a written ... orandum of the public hearings held on Cook County Zoning Dockets #•R~t,0 l028, and 1029, on property located p~ Wheeling Road on Foundry Road and Euclid Avenue approximately 10,000 feet from Craig Manor, to aldermen and city officials and reviewed same. It was moved by Alderman Bonaguidi and seconded by Alderman Martin that the City Council of the City .of Des Plaines object to the rezoning on Dockets #1027, 1028, and _io29 and said objections be forwarded to the Cook County Zoning Board of Appeals and the County Clerk. Motion 1Carriedo Cook Co. Zoning Docket #1014 City Attorney reported .on his attendance at the Public Hearing of Cook Co •. Zoning Docket #1014 on the approximately 13 acres of land located on the northwest corner of :Greenwood Avenue and Dempster Street, from B2 and R5 -to B4, stating that the applicant, Robert E~. Haskins plans i to construct a shopping district on first floor 'with apartments on remaining floors --also plans high rise apartments approximately twelve to fifteen stories in height. Upon cross examination it was learned that the applicant has made no real effort to develop the property under the present zoning. ~lie Village of Glenview and School District #63 ·opposed the rezoning and requested the Cook County Zoning Board to continue the case, as subject property has a pending petition with the Village of Ni les for •annexation and is also involved in the litigation for the possible incorporation of Golf Mill Village. Cook County Zoning Board of Appeals denied request. : It was moved by Alderman Wagner and seconded by Alderman S~abo ,that the City Council object to the above rezoning --said objections ·to be forwarded to the Cook County Zoning Board of Appeals and the Coutj.ty Clerk. Motion Carried, I Cook Co. Zoning Docket #1017 City Attorney DiLeonardi reported on his attendance at the Public Hearing of Cook County Zoning Docket #1017 on the 7i acres located on the North Side of Golf Road, west of Western Avenue, from R3 to R6, to construct multi-family dwelliµgs. He stated that the applicant plans to construct five story buildings for 250 to 260 m•lti-family units -one-half one- bedroom and the other half ·effeciency ppartments. It was moved by Alder- man Ssabo and seconded by Alderman Bonaguidi that the City Council object -to the proposed rezoning on ·Docket #1017 and and said objections be forwarded to the Cook County Zoning Board of Appeals and County Clerk. Motion Carried. Cook Co. Zoning Dockets #982 and 983 Ordinance Z-5-66 REPORTS OF COMMITTEES:· Zoning Case 66-5-R s.w. Corner Lee & Oakton City Attorney DiLeonardi reported that Cook County Zoning Dockets #982 and 983 have been continued until the app~icant is prepared to present their case 0 City Attorney DiLeonardi reported that he has prepared Ordinance Z-5-66 amending the zoning ordinance having to do with automobile laundries f or the Alderman's consideration under New Business. Alderman Martin, Chairman of the Municipal Development Committee, made the fellowing report of said committee: "Municipal Development Committee has investigated Zoning Case 66-5-R on ~roperty located at the southwest corner of Lee and Oakton and has found the property was the subject of a zoning hearing dated February 22, 1966, The proposed use is for a shopping center and office development. The zoning Board granted the change from R-2 to c.2. ' We recommend that City council · concur with the Zoning Beard of Appeals on the rezoning from R-2 to C-2 provided the owners are willing to covenant the property in the following manner: s. w. Gorner Lee & Oakton (Continued) Page four 3/21/66 1. That the development of the 25 acres .include a retention basin for storm sewer in accordance with City Engineer's specifications. 2. That traffic control at the intersection of Lee and Oakton 145 and particularly where Lee and Mannheim Road divide be approved by not only the State Hig~way Department, but also the Safety Commission and City Council of the City of Des Plaines. 3. That a green parkway area between Mannheim Road •hd the proposed shopping center parking lot be established to a minimum width of 5 feet fully landscaped. 4. That a minimum planting strip ot twenty feet be established on the South and West lines of .the subject property. 5. Contract purchasers and owners covenants not to apply for re- zoning to R-4 Multi-family use. . It was moved by Alderman Martin and seconded by Alderman Prickett that City Council concur in the above report. At this time a petition rendered by the surrounding property o"'ers and the Riverview civic Association Zoning-P lanning officer was presented by the City Clerk to the City Attorney who reviewed same. The City Att9rney r~quested that Mrs. John Yaccino, 1779 Cora Street, the Zoning-Planning officer of Riverview Civic Association clarify the intent of said petition. She --sta~ed from the floor that it was not the ( intent of the Riverview Civic Association and the surrounding property owners to .object to th~ rezoning from R-2 to C-2, but rather to the tra~fic flowing onto Lee-Mannheim from the proposed development. Said petition therefore was not considered as a protest to the re-zoning. It was moved by Alderman Bolek and seconded by Alde r man Szabo to table the motion to concur. ABSENT: -4 -Alderman Czubakowski, Wright, Leer, Shillington. Ther~ being six negative votes, Motion failed. The motion to concur was then put to the Alderman for a vote. Motion Carried. Zoning Case 66-4-R 4 855 Rand Road Alderman Martin, Chairman of the Muricipal Development Committee, reported that said committee has investigated Zoning Case 66-4-R and recommends Council concurrence : ,with the Des Plaines Zoning Board of Appeals i~ grantin~ the petition for reZDnipg of property located at 855 Rand ~oad from R~2 to C-~. It was moved by Aldennan Martin and seconded by Alderman Prickett that Council concur with the Zoning Board in said Case 66-4-R~ Alderman Bonaguidi questioned the City Attorney as to what effect changing ( this zoning m~ght have on the present suit question- ing the constitutionality o1 anne~ing property to the east. Attorney ntLeonardi st~ted that how this property is zoned won't affect the law suit. With consent of all alderman, former Alderman Davis spoke from the floor requesting ~ that Zoning Case 66-4-R be referred back to 1 Municipal Development Committee for further study, suggesting that School Board #62 be contacted for their opinion on what effect opening Fourth Avenue would have on the school located nearby. It was moved - by Alderma~ Bonaguidi and seconded by Alderman Swanson to table the motion. Motion Carried. Aldermen Prickett, Rateike, and French voted NO. Zoning Case 66-6R Alderman Martin, Chairman of the Municipal Development Committee, reported as follows: ~"Your Cpmmittee on Municipal Development has investigated Zoning Case 66-6-R on property located at 49 E. Oakton Street and has found this property is located on the south side of Oakton Street just east ot 49 E. Oakton . Street Mt. Prospect Road. It was 1ormerly used for a greenhouse business and is surrounded by manufacturing. It was moved by Alderman Martin and secon.ded by Alderman Prickett that Council concur in said report. Alderman Bolek's request that a sign be placed on the property petitioning to be re-zoned, containing the date of .Public Hearing, the requested Zoning Change, the proposed usage, and the petitioner's name and address was referred to the Municipal Development and Building Control & Inspection Committees for study and report. Alderman Figard, Chairman of the Police Committee, reported that said committee has investigated the bids received fo~ two (2) new automobiles for the Police Department and has found that the Des Plaines Motor Sales, Inc. meet the specifications and are the low bidders of 84,439 for two 1966 four-door Chevrolets and recommend the contract be awarded to the Des Plaines Motor Sales, Inc. It was moved by Alderman Figard and seconded by Alderman Swanson that Council concur in said report. Motion Carried Alderman Bolek set a meeting of the License, Health and Inspection Committee for March 31st at 8 P.M. to discuss the liquor license applications of Dowd, Dowd, and Dowd for their client and Holiday Inn. Also to meet with United Motor Coach concerning the adequacy of busy service and the feasibility of route revision and to discuss the bicycle license ordinance. Lids on garbage cans and improper containers Alderman Swanson, Chairman of the Sanitation Committee, requested suggestions from Aldermen regarding the-existing problem of residents using improper containers for garbage and not covering same. Alderman Rateike suggested a form letter be given residents when the Garbage ordinance is being violated and constant publicity in the newspapers. It was moved by Alderman Rateike and seconded by Alderman Swanson to concur in Mayor Behrel's recommendation to switch Committee chairman as follows: Alderman Martin to be Chairman of Streets and Traffic Committee and Alderman French Chairman of Municipal Development Committee and Alderman Wagner be appointed to serve on Municipal Development Committee to fill the vacancy of Alderman Martin. Motion Carried. Alderman Wagner voted NO.
