Upon voice vote, motion declared carried COMMUNITY DEVELOPMENT — Alderman Rodd, Chair On advice of Legal Counsel Items 2a and 2b will considered as one vote. Economic Development Coordinator Ainsworth reviewed a memorandum dated July 30, 2019. The petitioner, Liston & Tsantilis, P.C., is requesting a Final Planned Unit Development (PUD) a Final Plat of Subdivision, Major Variations for Off Street Parking and Subdivision Variations to allow for the construction of a new freestanding restaurant building, the construction of a new parking lot, and constructing various other improvements on the property. The current property owner, Andrew Saunders, Marine Higgins Center, LLC, is proposing and undergoing a multi-million dollar renovation and partial redevelopment of the existing office building property at 1700 Higgins Road as well as vacant land that is currently owned by the Village of Rosemont. With all lots combined, the property encompasses 7.276 acres in land area. The westernmost lot is unimproved; however, the current property owner of 1700 Higgins Road contains an active purchase agreement for this lot which gives the property owner unified control over this lot and the 1700 Higgins Road property. The property owner proposes to conduct the following enhancements to the existing property and the vacant property to the west that is owned by the Village of Rosemont: Construction of an approximately 6,000 square foot Class A sit-down restaurant; Construction of a brand-new business incubator space within the existing office building to assist emerging businesses find office space within the O'Hare office sub -market (Phase I was recently completed); Construction of a new 88 space off street parking lot on the vacant parcel; (Cont.) Page 4 of 11 08/19/19 - Significant infrastructure upgrades to all properties including the addition of stormwater detention facilities to accommodate run-off; and - Construction of a new bridge over Willow Creek to connect the office building property to the new off street parking lot. The petitioner has submitted variance requests associated with this development consisting of reducing the off street parking requirement. The petitioner has also submitted a Final Plat of Subdivision in order to re -subdivide the existing lots into five new lots to reflect the redevelopment of this property. The Planning and Zoning Board met on July 9, 2019 to consider the proposal. The Planning and Zoning Board recommended (4-0) that the City Council approve of the request with the seven conditions found in the staff report. Staff recommended approval of Z-21-19 subject to seven conditions found in the staff report. Mariner Higgins Centre, LLC, the applicant and owner of 1700 W. Higgins Road has also filed an application requesting a City resolution in support of its Class 7b Tax Incentive application based on substantial rehabilitation and new construction. As part of this application, the City and the Developer will need to enter into Redevelopment Agreement to ensure that all components of the project are completed in a timely manner. The subject properties encompass 7.276 acres of land that is improved with one office building totaling 139,000 square feet, a surface parking lot associated with the office building, and a vacant property that is currently owned by the Village of Rosemont. Some long-term tenants have left the building in the past 12 months partly due to the age of the building. However, the applicant is proposing to invest over $10,000,000 into the entire property with the following elements: To qualify for a Class 7b, the property has to fall within a redevelopment or area conservation area. Since this area is not within such an established area, a separate resolution needs to be adopted declaring the area blighted. The applicant is applying under Substantial Rehabilitation and New Construction. Assessment of Tax Impact Scenarios: 1. Estimate Property Taxes as -is with vacancy relief: $538,488 2. Estimated Property Taxes with proposed improvements without a 7b: $1,592,923 3. Estimated Property Taxes with proposed improvements with a 7b: $1,210,622 Finally, to ensure that the applicant constructs all identified improvements, a Redevelopment Plan has been prepared. This Redevelopment Plan lays out the specific projects associated with this redevelopment project as well as identifies specific terms that the applicant must meet. There is a five-year time limit to construct all elements of the project to ensure the continued support for the Class 7b. (Cont.) CONSIDER FINAL PLAT OF SUBDIVISION/ 1275 LEE STREET: Page 5 of 11 08/19/19 As such, three resolutions must be adopted by the City Council for the property to be classified with a Class 7b Property Tax Abatement and for the rest of this investment to take place. The Class 7b requires the City to first determine that the property is a blighted area, which is provided as R-145-19. The second resolution, R-146-19, provides the City's support and consent for the applicant's Class 7b application for 1700 Higgins Road redevelopment. Finally, Resolution R-147-19 allows the City Manager to enter into a Redevelopment Agreement with the petitioner, to ensure that the private improvements are constructed within established time limits. Staff recommended approval of the three Resolutions associated with 1700 W. Higgins Road. Moved by Chester, seconded by Moylan to recommend to that Ordinance Z-21-19, R-145-19, R146-19 and R-147-19 to be adopted at the appropriate time this evening. Upon voice vote, motion declared carried. Director of Community and Economic Development Mike McMahon reviewed a memorandum dated July 30, 2019. In 2018, the applicant, Eric Nelson, received approval from City Council for a Conditional Use Permit to allow Motor Vehicle Sales, Auto Service Repair, and Auto Body Repair at 1275 Lee Street in the C-3 General Commercial District. The petitioner proposes to open a pre -owned dealership called Hey Cars which is currently operating out of Mount Prospect. Since obtaining the Conditional Use Permit, the petitioner has acquired the property and is applying for a Final Plat of Subdivision to fulfill one of the conditions of approval from the 2018 case, consolidate the three lots into one lot of record. The subject property is 2.93 acres in size and is comprised of three separate lots, which is currently improved with a vacant restaurant building, a parking lot, several unpaved areas and open space in the rear. As identified in the applicant's 2018 submittals, the petitioner proposes to rehab the existing single -story building and construct a single -story addition in the rear. The front portion of the building will be dedicated to auto sales, while the rear portion will be used for auto repair consisting of 16 service bays. In addition to the changes to the building, the petitioner proposes to install a new parking lot with 295 spaces. With regards to the Final Plat of Subdivision, the dimensions and the layout of the proposed plat generally matches the Tentative Plat of Subdivision that was presented to the Planning and Zoning Board and City Council in 2018. However, there was a condition in the 2018 approvals that all three existing lots be consolidated to the one lot of record and, as identified earlier in this staff report, the property size has been slightly reduced due to IDOT acquiring part of the property for roadway project. (Cont.) CONSIDER MAP AMEND, CU TO REZONE/ RECYCLING CENTER/ 1274 RAND ROAD: Page 6 of 11 08/19/19 The Planning and Zoning Board met on July 9, 2019 to consider the proposal. After hearing all testimony, the Planning and Zoning Board recommended (4-0) that the City Council approve of the request. Staff recommend approval of Resolution R-148-19. Moved by Brookman, seconded by Goczkowski to recommend approval of a Final Plat of Subdivision for 1275 Lee Street, Des Plaines, Illinois; and further recommend that Ordinance R-148-19 be adopted at the appropriate time this evening. Upon voice vote, motion declared carried. Director of Community and Economic Development Mike McMahon reviewed a memorandum dated July 30, 2019. The applicant, Robert Katz, has requested a Conditional Use, Map Amendment and Variations in order to bring a recycling center business into conformity with the Des Plaines Zoning Ordinance. He is the owner of Maine Scrap Metal which has operated on the subject property since 1996. Scrap metal/recycling centers are not a permitted use in the C-3 General Commercial District but the business was permitted to continuously operate a legal non -conforming use per Zoning Ordinance Code Section Title 12, Chapter 5: Nonconforming Uses and Structures. On January 10, 2018, a fire occurred on the property destroying a 12,295 square foot building. It was determined that the business could not reopen under the current operations plan and zoning because over 50% of the value of the building/structure on the property had been destroyed and an inspection by the Building Department determined that the buildings on the property were uninhabitable. The Business Registration for Maine Scrap Metal was revoked and signage was posted on site indicating that the buildings were uninhabitable. Maine Scrap Metal reopened soon after the fire and has remained open since. Thus, the Community and Economic Development Department delivered a letter to the subject property on January 29, 2018 stating that the business could not reopen until the property conforms to the use regulations in the Des Plaines Zoning Ordinance. Operations continued on the property and Staff did not receive an application from Maine Scrap Metal to address the zoning concerns detailed in the January 29, 2018 letter. Consequently, the City of Des Plaines filed a complaint with the Circuit Court of Cook County regarding Maine Scrap Metal on August 13, 2018. On February 8, 2019, Staff met with Maine Scrap Metal to discuss the steps required for the property to comply with the Zoning Ordinance. Staff met with Maine Scrap Metal representatives again on February 25, 2019 to discuss the map amendment, conditional use, and variance applications and the overall review process. On March 11, 2019, this application was received to bring this property into compliance with the Zoning Ordinance. Based on discussion at the June 11, 2019 Planning and Zoning Board Meeting, the applicant and staff met to further discuss the Site Plan and proposed improvements prior to the Planning Page 7 of 11 08/19/19 (Cont.) and Zoning Board making a recommendation. An updated Site Plan is now provided based on updated conversations. CONSIDER ZONING, REGULATIONS, AND LICENSING OF RECREATIONAL CANNABIS BUSINESSES: The petitioner is proposing to reconstruct a building on the same footprint on the building that was destroyed by the fire. The new building may be taller than the former building, but the height will be dependent on fire access. With the proposed rezoning to the M-2 zoning district, specific bulk regulations for the M-2 district will apply. The property shape is irregular which leads to several bulk regulation variances being requested. These variations will not allow the petitioner to expand the building past what was in existence prior to the January 2018 fire. The Planning and Zoning Board recommended (4-0) that the City Council approve the request with 16 conditions found in the staff report and the amendment to Condition 2C. Mr. Daniel Dowd, attorney for petitioner, answered questions from the aldermen and stated his client is fully aware of the conditions and will comply. Moved by Lysakowski, seconded by Zadrozny to recommend to Approve a map Amendment, Conditional Use, and Variations Request for the Property Located at 1274 Rand Road in Order to Rezone the Property from C-3 to M-2, Allow for a Recycling Center in the M-2 Zoning District, and Allow for Decreased Side and Rear Yard Setbacks for the Existing Buildings/Structures; and further recommend to approve Ordinance Z-22-19 at the appropriate time this evening. Upon voice vote, the motion carried. LEGAL & LICENSING — Alderman Brookman, Chair Alderman Brookman explained that this the third consecutive meeting on the discussion of the possibility of banning or allowing the sale of cannabis in the City of Des Plaines. The Cannabis Regulation and Tax Act which legalizes the sale, possession, and use of cannabis for recreational purposes by persons over the age of 21 in Illinois, begins on January 1, 2020. Although the sale and use of cannabis will be legal, possession and consumption will still be regulated. Alderman Brookman opposes the sale of cannabis in the city and believes that the residents should have a right to decide if recreational cannabis dispensaries should be allowed in the city. Since there is no deadline for municipalities to approve or decline the sale of cannabis within their community Alderman Brookman would like to revisit this topic in one-year to see how marijuana sales in other towns affect the other communities. Currently dispensaries are not permitted under the city's zoning ordinance. (Cont.) UNFINISHED BUSINESS: Page 8 of 11 08/19/19 Moved by Goczkowski, seconded by Rodd to direct staff to draft a Resolution to allow the Planning and Zoning Board to take steps to adopt regulations to allow the sale of marijuana within the City of Des Plaines. Each alderman expressed their opinion regarding the sale of cannabis in the City of Des Plaines. Substitute motion moved by Brookman to ban the sale of cannabis in the city for one-year. The motion died for lack of a second. Several residents and member of the Stevenson High School's Drug Prevention Catalyst Club urged City Council members to not allow the sale of cannabis in the city. Substitute motion moved by Brookman, seconded by Chester to direct Legal Counsel to take the necessary steps to add the question of whether to allow the sale of cannabis in the city on a referendum. Upon voice vote, the motion failed 2/6/0. Alderman Brookman requested a roll call vote. Discussion continued. Motion by Rodd, seconded by Goczkowski to Call for the Vote. By voice vote, motion carried. Substitute motion moved by Brookman, seconded by Chester to direct Legal Counsel to take the necessary steps to add the question of whether to allow the sale of cannabis in the city on a referendum. While there is not a specific deadline for a decision, staff would like the language to be specific in the city's zoning code by January 1, 2020. Ordinance Z-16-19 was approved on first reading. On July 15, 2019, Second Reading Ordinance Z-16-19 was on the City Council agenda for consideration but the petitioner was not present. Ordinance Z-16-19 was denied. At the August 5, 2019 City Council meeting a motion and a second was made to re -consider the vote of July 15, 2019. Legal Counsel Weiss stated the vote this evening is as if Z-16-19 is being considered as the Second Reading Ordinance Z-16-19. Mr. Capozzoli expressed his appreciation for reconsideration of this request.
