06/03/2019MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, JUNE 3, 2019 CALL TO The regular meeting of the City Council of the City of Des Plaines, Illinois, was ORDER: called to order by Mayor Bogusz at 6:34 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, June 3, 2019. ROLL CALL: Roll call indicated the following Aldermen present: Lysakowski, Moylan, Rodd, Zadrozny, Brookman, Chester and Goczkowski. Absent: Smith CLOSED SESSION: Moved by Brookman, seconded by Chester to enter into Closed Session to discuss Personnel. Upon roll call, the vote was: AYES: 7-Lysakowski, Moylan, Rodd, Zadrozny, Brookman, Chester, Goczkowski NAYS: 0 -None ABSENT: 1 -Smith Motion declared unanimously carried. The City Council recessed at 6:35 p.m. The City Council re -convened at 7:10 p.m. Roll call indicated the following Aldermen present: Lysakowski, Moylan, Rodd, Zadrozny, Brookman, Chester, Goczkowski. Absent: Smith. A quorum was present. Also present were: City Manager Bartholomew, Assistant City Manager/Director of Finance Wisniewski, Director of Public Works and Engineering Oakley, Director of Community and Economic Development McMahon, Fire Chief Wax, Police Chief Kushner, and General Counsel Friedman. PRAYER AND The prayer was offered by Alderman Rodd, followed by the Pledge of Allegiance PLEDGE: to the Flag of the United States of America. MANAGER'S City Manager Bartholomew announced that the Taste of Des Plaines is next REPORT: weekend, Friday June 14 and Saturday, June 15. Saturday night will be a musical tribute to Woodstock's 50th Anniversary. RECOGNITION: Des Plaines Arts Council President, Will Soderberg, expressed the Arts Council's appreciation for the City Council's continued support and introduced six recipients of a 2019 Arts Council Scholarship. Mr. Soderberg reported a ribbon cutting will take place at the Des Plaines History Center on June 15 to reveal a new mural by artist Jason Watts. Motion declared carried as approved unanimously under Consent Agenda. Moved by Brookman, seconded by Goczkowski, to Approve Resolution R-110-19, A RESOLUTION APPROVING TRANSFER OF FUNDS FROM THE GENERAL FUND CONTINGENCY ACCOUNT TO THE WATER SYSTEM FUND AND THE WATER METERS FUND FOR THE PURCHASE AND INSTALLATION OF ADDITIONAL SENSUS WATER METERS FROM CORE & MAIN, LP. CONSIDERATION OF TEXT AMENDMENTS: CONSIDERATION OF MAJOR VARIATION/ WALL SIGN/ 1365 LEE STREET: Page 4 of 7 06/03/19 Moved by Goczkowski, seconded by Brookman, to recommend to the City Council approval of the June 3, 2019 — Warrant Register in the Amount of $6,224,606.72 and further recommend that Resolution R-113-19 be adopted at appropriate time this evening. Upon voice vote, motion declared carried COMMUNITY DEVELOPMENT — Alderman Rodd, Chair Director of Community and Economic Development Mike McMahon reviewed a memorandum dated May 14, 2019. The City of Des Plaines is proposing several text amendments to the Des Plaines Zoning Ordinance which are as follows: • Amending the Planned Unit Development — Permitted Exceptions and Minimum Development Standards; • Amending Off Street Parking Requirements for the following items; • Amend the parking regulation for "Warehousing and Wholesaling"; • Add "Food Processing Establishment"; • Add "Shopping Center"; • Amending the Off Street Loading Requirement section; • Adding a new Permitted Land Bank Parking section; and • Amending or Adding the following terms to the Definition section of the Zoning Ordinance: • "Shopping Center"; and "Floor Area" The Planning and Zoning Board recommended (5-0) that the City Council approve the proposed Text Amendments. Staff recommended approval of Ordinance Z-13-19. Moved by Chester, seconded by Moylan to Approve Various Text Amendments to the City of Des Plaines Zoning Ordinance; and further approve Ordinance Z-13-19 be adopted at the appropriate time this evening. Upon voice vote, motion declared carried. Director of Community and Economic Development Mike McMahon reviewed a memorandum dated May 15, 2019. The petitioner, Lisa Neal of Doyle Signs, is requesting a major variation to allow for 152 square feet of wall signage at 1365 Lee Street. The subject property is located along Forest Avenue and is positioned behind an existing shopping center and vacant outlot, both located along Lee Street. The petitioner's request to allow a wall sign area of 152 square feet where only 125 square feet is permitted constitutes the need for a major variation to Section 12-11-6(B) of the 1998 Des Plaines Zoning Ordinance. The petitioner is requesting larger signs as the building is currently undergoing a remodel and footprint expansion. There is an existing monument sign at the southwest corner of 1387 Lee Street where the petitioner utilizes a panel for the subject business. An active sign easement agreement, established in 2005, allows Page 5 of 7 06/03/19 (Cont.) the subject business to have a panel on this sign. There is no request by the petitioner to increase the monument sign panel. CONSIDER TEXT AMENDMENTS REGARDING CITY CLERK: NEW BUSINESS: WARRANT REGISTER: Resolution R-113-19 The Planning and Zoning Board recommended (5-0) that the City Council approve the request without any conditions. Staff recommended approval of Ordinance Z-14-19. Moved by Brookman, seconded by Zadrozny to Approve the Variance Request to Exceed the Maximum Allowable Wall Sign Area at 1365 Lee Street; and further approve Ordinance Z-14-19 be adopted at the appropriate time this evening. Upon voice vote, motion declared carried. LEGAL AND LICENSING — Alderman Brookman, Chair City Manager Bartholomew and City Clerk Tsalapatanis presented text amendments to the City Code regarding the City Clerk's duties. The portion of the City Code that relates to City Clerks Qualifications, Authority and Principle Duties was drafted in 2002. In 2008 the City Council changed the City Clerk's position from full-time to part-time and adopted Ordinances M-39-08 and M-40- 08. Upon approval of the Ordinances, the City Code was not updated to reflect the job duties of a part-time position. Many of the responsibilities outlined in the City Code have been taken on by other departments. Staff recommended approval Ordinance M-15-19. Moved by Moylan, seconded by Zadrozny to Approve Amendments to the Des Plaines City Code Regarding Duties of the City Clerk; and further recommend approval of Ordinance M-15-19 at the appropriate time this evening. Upon voice vote, the motion was declared carried.
