01/07/2019MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, JANUARY 7, 2019 CALL TO The regular meeting of the City Council of the City of Des Plaines, Illinois, was called ORDER: to order by Mayor Bogusz at 7:01 p.m. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, January 7, 2019. ROLL CALL: Roll call indicated the following Aldermen present: Lysakowski, Robinson, Rodd, Sayad, Brookman, Chester, Smith, Charewicz. A quorum was present. CITIZEN Resident Garland Armstrong expressed his concern regarding motorists traveling in PARTICIPATION: the wrong direction on Graceland Avenue and Lee Street. Resident Wayne Serbin expressed his concern regarding the homeless in the downtown area, particularly at the Metra Station. Will Soderberg of the Des Plaines Art Council announced art scholarship applications are available and due March 31, 2019. CITY CLERK City Clerk Tsalapatanis announced the approved minutes of November 19, 2018 ANNOUNCEMENTS inadvertently omitted Item 1 of the Consent Agenda. The amended minutes were included in tonight's City Council packet. CONSENT AGENDA: City offices will be closed Monday, January 19, 2019 for Martin Luther King day. Upon voice vote, motion declared carried. COMMUNITY DEVELOPMENT — Alderman Sayad, Chair (Cont.) CONSIDER AMENDMENT TO CITY CODE/ PLAN/ZBA APPLICATION FEES AND ADD ZONING VERIFICATION FEE: Page 7 of 14 1/07/19 Community and Economic Development Director McMahon reviewed a memorandum dated December 12, 2018. The City of Des Plaines is requesting Text Amendments to the 1998 Des Plaines Zoning Code, as amended, to amend Section 12-3-1A.6 to amend the Planning and Zoning Board (PZB) Applications Fees and to add a fee associated with Zoning Verification Letters. So far in 2018, Community and Economic Development (CED) received 96 PZB applications. The application requests range from minor variations to large planned unit developments and each case takes staff time to process, review, compose a staff report, follow through with implementing any conditions tied with each case and close out the file. Additionally, the fees associated with these applications have been the same since 1998. As such, CED staff researched the fees from other communities and compared them against Des Plaines' application fees. Des Plaines contains three different fees for the minor, standard and major variation applications. The City does not differentiate between residential and non-residential districts; however, several other communities breakdown their fee structure based on land use. Des Plaines' minor variation fee is $85. It is recommended to increase this amount $150 for minor and $250 for standard variations. The average major/non-residential variation fee charged is $332.50 and Des Plaines charges $220 for major variations. It is recommended to increase this amount to $350. Des Plaines' conditional use fee does not differentiate between residential and non- residential. As such, there is only one fee that applies for all of our conditional use requests. Opposite to the research for variation application fees, many other nearby communities only charge one fee for a conditional use request regardless of the zoning district as well. The average conditional use application fee charged is $526.67. Des Plaines's conditional use fee is currently $385. CED staff recommends to increase this fee to $500 as this is one of the most requested applications that go to the Planning and Zoning Board as well as City Council which takes more staff time to process and close out. After researching rezoning and text amendment application fees from nearby communities, it is became apparent that the fees charged widely vary. The City of Des Plaines charges the least amount for a map amendment (rezoning) or a text amendment. The average rezoning/text amendment application fee charged is $620. Des Plaines's text amendment and rezoning application fee is currently $220. CED staff recommends to increase this fee to $500. Planned Unit Developments (PUDs) are one of the rarest applications that applicants apply under; however, these requests are typically the most time consuming given the size of project and their inherent complexities. The average PUD application fee charged is $1,379. Des Plaines's PUD fee is currently $770. CED staff recommends to increase this fee to $1,500. Zoning Verification Letters, sometimes referred to as Zoning Certificates, are an infrequent request that generally come from an appraiser or attorney requesting staff (Cont.) CONSIDER AGMT /DES PLAINES HISTORY CENTER/ FUNDING HISTORICAL SOCIETY: CONSIDER AGMT /DES PLAINES SENIOR CENTER/ MEALS ON WHEELS: Page 8 of 14 1/07/19 to verify specific information on a particular property. The City of Des Plaines does not charge for this type of request. CED staff suggested to add a nominal fee of $35 to recoup some costs and to better track the number of zoning verification letter requests. The Planning and Zoning Board met on December 11, 2018 to consider the text amendment. City staff explained the proposed changes and the rationale to each amendment. The Planning and Zoning Board recommended (4-0) that the City Council approve the proposed text amendments. Staff recommended approval of Ordinance Z-1-19. Moved by Rodd, seconded by Charewicz, to recommend to the City Council approval Amendments to Various Sections of the Des Plaines Zoning Ordinance to Update Planning and Zoning Board Application Fees and to Add a Zoning Verification Fee; and further recommended that Ordinance Z-1-19, be adopted at appropriate time this evening. Upon voice vote, motion declared carried. COMMUNITY SERVICES — Alderman Chester, Chair Assistant City Manager/Director of Finance Dorothy Wisniewski explained that during the 2019 Budget deliberations the Des Plaines History Center requested a $50,000 subsidy from the City for the administration of the History Center programs as well as special events. The Des Plaines History Center is a 501(c)(3), nonprofit organization that operates through the work of paid staff and volunteers, under the guidance and supervision of a Board of Trustees. The History Center serves in many ways as a community center, is open to the public, and provides programs, exhibits, and access to research in historical archival collections. Philip Mohr, Executive Director of the Des Plaines History Center provided an overview of 2018 including fund-raising efforts, programs, and visitor attendance. Mr. Mohr thanked the Council for their support. Moved by Charewicz, seconded by Brookman, to recommend to the City Council approval of an Agreement with the Des Plaines History Center regarding funding of the Historical Society in the Amount of $50,000; and further recommended that Resolution R-19-19, be adopted at appropriate time this evening. Upon voice vote, motion declared carried. Assistant City Manager/Director of Finance Dorothy Wisniewski explained during the 2019 Budget deliberations the Des Plaines Community Senior Center requested a $37,500 subsidy from the City for the Meals on Wheels program which was approved by the City Council. The Meals on Wheels program continues to sustain aging -at- home practices, provide critical nourishment for program participants, and maintain necessary outreach and monitoring for the City's most vulnerable residents. CONSIDER AGMT /DES PLAINES PARK DISTRICT AND SENIOR CENTER/SENIOR CENTER FUNDING: CONSIDER AGMT /DES PLAINES COMMUNITY CENTER/HEALTH & HUMAN SUPPORT SERVICES: Page 9 of 14 1/07/19 Steve Samuelson, President of the Frisbie Senior Center, recapped the Meals on Wheels program and provided the number of meals delivered in 2018 and proposed figures for 2019. Moved by Charewicz, seconded by Sayad, to recommend to the City Council approval of an Agreement with the Des Plaines Community Senior Center Regarding the Meals on Wheels Program in the Amount of $37,500; and further recommended that Resolution R-20-19, be adopted at appropriate time this evening. Assistant City Manager/Director of Finance Dorothy Wisniewski explained during the 2019 Budget deliberations the Des Plaines Senior Center requested a $50,000 subsidy from the City for the Senior Center programs, of which $50,000 was authorized in the budget. The Des Plaines Community Senior Center serves Des Plaines seniors through intellectually enriching, socially engaging, and physically energizing programs and volunteer opportunities Steve Samuelson, President of the Frisbie Senior Center, reviewed the programs offered at the Des Plaines Senior Center. Moved by Brookman, seconded by Rodd, to recommend to the City Council approval of an Agreement with the Des Plaines Park District and Des Plaines Community Senior Center Regarding funding of the Senior Center in the amount of $50,000; and further recommended that Resolution R-21-19, be adopted at appropriate time this evening. Upon voice vote, motion declared carried. Alderman Smith abstained. Assistant City Manager/Director of Finance Dorothy Wisniewski requested City Council approval for the Interlocal Agreement between the City of Des Plaines and the Des Plaines Community Senior Center (a.k.a. the Frisbie Senior Center), as well as authorize an annual subsidy funding in the amount of $40,000. Senior centers serve as a gateway to the nation's aging network by connecting older adults to community services that can help them stay healthy and independent. To maintain operations, senior centers must leverage resources from a variety of sources such as federal, state and local governments. Des Plaines is experiencing and will continue to experience through 2030 an increase in residents over age 55. This translates to the largest demographic shift over the shortest time period and triggers the need for increased senior specific services. The Des Plaines Community Senior Center serves Des Plaines seniors through intellectually enriching, socially engaging, and physically energizing programs and volunteer opportunities. They offer a wide variety of services, such as daily social and recreational activities, on-going educational programming, one on one counseling options focusing on health, legal, employment, as well as others. The Senior Center works closely with the Health and Human Services Division (HHS) of the City. Over the past several years the City of Des Plaines has partnered with the Senior Center on the meals on wheels program, which has been very successful for the City. Through these intergovernmental partnerships the City along with the Senior Center are able to provide efficient and effective services to our residents. CONSIDER CITY CODE AMENDMENT/ SALE AND PURCHASE OF TOBACCO AND ALTERNATIVE NICOTINE PRODUCTS: CONSIDER CITY CODE AMENDMENT/ REMOVAL OF SNOW AND ICE/PUBLIC- RIGHT-OF-WAY: Page 10 of 14 1/07/19 Steve Samuelson, President of the Frisbie Senior Center, reviewed the programs and services offered at the Des Plaines Senior Center and answered questions. The Frisbie Senior Center staff has a general understanding of processes and procedures as a result of a past internship in the City's Health and Human Services Department. Moved by Sayad, seconded by Lysakowski, to recommend to the City Council approval of an Agreement with the Des Plaines Community Senior Center for the Provision of funding for Health and Support Services in the amount of $40,000; and further recommended that Resolution R-22-19, be adopted at appropriate time this evening. Upon voice vote, motion declared carried. Alderman Smith abstained. LEGAL AND LICENSING — Alderman Brookman, Chair Police Chief Kushner presented an amendment to Chapter 7 of Title 4 of The City of Des Plaines City Code which regulates the sale, use and possession of tobacco and alternative nicotine products to any person under the age of eighteen (18). Due to the significant health risks of both users of the Products and those in the vicinity of users, the amended city code would raise the minimum age of the sale, use and possession of products from eighteen (18) to twenty-one (21) which has been shown to reduce the use of Products. The proposed code change would also amend the alternative penalty if the minor is a first-time offender and is enrolled as a full-time student at a school located in the city. The court or administrative hearing officer may assign the offender to a diversion and education program that is approved by Maine Township High School District 207 or Township High School District 214. Staff recommended that the City Council approve Ordinance M-1-19. Alderman Brookman and Alderman Chester recommended stronger regulations to include enforcement and prohibiting possession under age 21. Moved by Brookman, seconded by Chester, to recommend to the City Council approval of an Amendment to Chapter 7 of Title 4 of the City of Des Plaines City Code Regarding the Sale and Purchase of Tobacco and Alternative Nicotine Products, as amended; and further recommended that Resolution M-1-19, be adopted at appropriate time this evening. Upon voice vote, motion declared carried. PUBIC SAFETY — Alderman Rodd, Chair Police Chief Kushner presented an Amendment to City Code Section 8-1-11 — Removal of Snow and Ice from Public Rights of Way. Numerous commercial properties do not comply with the current language in City Code Section 8-1-11 regarding the removal of snow and ice from public rights of way. Many commercial properties do not currently remove snow and ice from the public rights of way after a snow storm. Currently the only enforcement action the City can take is to fine the business for not complying with the ordinance. Amending City Code Chapter 8-1-11 to include language with detailed responsibilities that (Cont.) UNFINISHED BUSINESS: Page 11 of 14 1/07/19 commercial properties must comply with regarding snow and ice on public rights of way, and the penalties for non-compliance will help improve compliance. This amendment also gives the City more options to make sure the rights of way are clear for pedestrians, even if the commercial property does not remove the snow and ice. Staff recommended that the City Council approve Ordinance M-2-19. Discussion ensued on what the time frame and the snow accumulation amount should be for removal.
