ELEANOR ROHRBACH MEMORIAL COUNCIL
CHAMBERS, DES PLAINES CIVIC CENTER,
MONDAY, OCTOBER 21, 1985
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines, Illinois, was called to order by Mayor John
E. Seitz at 8:55 P.M. in the Eleanor Rohrbach Memorial
Council Chambers, Des Plaines Civic Center on Monday,
October 21, 1985
ROLL CALL:
Roll Call indicated the following Aldermen present:
Volberding, Bonk, Martin, Wetter, Schneck, Kisslinger,
Hardiman, Gebert, Sarlo, Chiropolos, Addante, Ward, Zanca.
Aldermen Muehlenbeck, Kolinski and Adams were absent.
Alderman Adams arrived at 8:57 P.M.
Also present were: City Treasurer Fredricks, City Comptroller Blietz,
Superintendent of Streets Kozlinka, Police Chief Kozenczak, Fire Chief
Clark, Municipal Development Department Acting Director Trost, Human
Resources and Services Department Acting Director Schaer, City Engineer
Schrake, Administrative Officer Taylor, and City Attorney Smith.
PRAYER AND
PLEDGE:
The opening prayer was given by Pastor Donald Hobbs
(Retired), followed by the Pledge of Allegiance to the
Flag.
PRESENTATION: On behalf of the City, Mayor Seitz accepted a Certificate
of Appreciation from Joyce Carter, Chairman of the Board
Des Plaines Special People, Inc., for assisting in the
purchase of lift van for the disabled of Des Plaines and
Maine Township.
MINUTES:
Moved by Bonk, seconded by Volberding, to approve Minutes
of the regular meeting of the City Council held October 7,
1985, as published. Motion declared carried.

lowest acceptable bidder meeting City's specifications, in
the amount of $55,741 with trade-in of 1979 unit. Upon
roll call, the vote was:

procedures because present equipment is not compatible

at $14.55 per yard for a total amount of $3,899.40. Upon

Moved by Ward, seconded by Martin, to amend the motion
deferred at the October 7, 1985 Council meeting to concur
with Des Plaines Zoning Board of Appeals to grant variation
for property located at 2093 Rand Road, to add "and the
approval recognizes the deferred responsibility of the
commercial property owner to install the fence at any time
in the future that the adjacent residential owner requests
that the fence be installed," and to authorize the City
Attorney to draft necessary ordinance. Motion declared
carried.on the amendment.

ADVERTISING Moved by Bonk, seconded by Addante, to adopt the
FOR BIDS FOR recommendation of the Public Works Committee that City
REPAIR OF Engineering be authorized to write specifications for
PARKING repair of the Civic Center and Behrel Parking Decks and
DECKS: to advertise for bids; bid return date to be determined at
a later time. Motion declared carried.

Moved by Bonk, seconded by Chiropolos, to adopt the
recommendation of the Public Works Committee to accept
proposal from VLS Protective Coatings, Inc., 690 First
Avenue, Des Plaines, IL, to high pressure clean and coat
the entire exterior of the Salt Shed (Dome) at the Public
Works Garage at a cost of $4,950, plus an additional $400
if a cherry picker is not available. Upon roll call, the
vote was:

MINER STREET recommendation of the Engineering Committee that City
STATE enter into agreement with IDOT for City's share of
AGREEMENT: improvements at intersection of Miner Street and River
Road in the amount of $160,575 WateruEunds/1986 Budget,
to replace existing 10" water main with new 16" water main
attached to bridge, relocate fire hydrants, pay all
engineering and construction costs of new water main, and
pay for traffic signal energy cost. Upon roll call, the

SIDEWALK recommendation of the Engineering Committee to award the
REPLACEMENT contract for the 1985 50/50 Sidewalk Replacement Program
PROGRAM: to Schroeder & Schroeder Co., 1421 Thayer Street, Mt.
Prospect, IL, 60056, in the amount of $67,557 ($33,778.50
from MFT Funds, $33,778.50 from public participation);
total MFT funds appropriated was $40,000, leaving a
difference of $6,221.50 to be used for contingency. Upon
roll call, the vote was:

& BROWN ST.: the recommendation of the Mayor and Traffic Commission that
three-way stop signs be placed at the intersection of
Laurel Avenue and Brown Street (one way west), and City
Attorney be authorized to draft necessary ordinance.

WARNING Moved by Chiropolos, seconded by Martin, to adopt the
SIGNS/BROWN recommendation of the Engineering Committee to concur with
& WASHINGTON the recommendation of the Traffic Commission that "Slow
STREETS: Children Playing" signs be installed �n appropriate
approaches to the alley area at Brown and Washington
Streets, and City Attorney be authorized to draft necessary
ordinance. Motion declared carried.
SEWER VALVE Moved by Martin, seconded by Sarlo, to adopt the
REPLACEMENT/ recommendation of the Engineering Committee that J. R.
RIVER ROAD & Myers Co., 3220 21st St., Zion, IL 60009, be authorized to
FARGO AVE.: replace sanitary sewer valve at River Road and Fargo
Avenue at a cost not to exceed $9,000, funds to come from
Sewer Rehabilitation Budget, and usual bid procedures be
waived; and current contract be extented to December 1,
1985 because of additional work Upon roll call, the

recommendation of the Building Code Committee to grant
variation to eliminate ceiling requirement in new building
at 1521 Lee Street (Pier I Imports) and complete sprinkler

recommendation of the Building Code Committee to grant
variation from Table 20.7-2 of the Building Code and
allow a supervised automatic sprinkler system in building
at 1700 Higgins Centre (Phillip I. Mappa Interests).

$7,250,000 ECONOMIC DEVELOPMENT REVENUE BONDS (DES PLAINES
INDUSTRIAL PARK VENTURE PROJECT), SERIES 1985, AND
AUTHORIZING AND APPROVING THE EXECUTION AND DELIVERY OF AN
INDENTURE OF TRUST, MORTGAGE AND LOAN AGREEMENT AND BOND
PURCHASE AGREEMENT, AND OTHER MATTERS IN CONNECTION THERE-
WITH. Upon roll call, the vote was:

replace with:
"-G. Warranty: In every sale of Single Family Residential
Property - Owner Occupied only, the Seller shall warrant,
or shall be presumed to have warranted, that at the time
of the closing of the sale of the property, that the
premises are in compliance with the Single Family Housing
Inspection checklist in subsection "J" below, unless the
seller has obtained and presented to the new owner a
Certificate of Occupancy." Motion declared carried.

M-53-85, as amended, AN ORDINANCE AMENDING CHAPTER 9, TITLE
VIII, OF THE DES PLAINES CITY CODE, ADDING THERETO A NEW
SUBSECTION 8-9-19 PERTAINING TO THE ISSUANCE OF OCCUPANCY
PERMIT WHEN PROPERTY IS TRANSFERRED.
