MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER,' MONDAY, JULY 2, 1984 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor John E. Seitz at 8:07 P.M. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center. ROLL CALL:1 Roll Call indicated the following aldermen present: Muehlenbeck, Kolinski, Volberding, Kehe, Martin, Wetter, Schneck, Kisslinger, Adams, Hardiman, Dini, Chiropolos, Ward, Zanca. Aldermen Gebert and Addante were absent. Also present were: City Treasurer Swanson, City Comptroller Blietz, Commissioner of Public Works Matula, Police Chief Alfano, Fire Chief Gedroic, Municipal Development Department Director Richardson, City Engineer Shrake, Human Resources & Services Department Acting Director Schaer, Administrative Assistant Taylor, and City Attorney Smith. PRAYER AND PLEDGE: The opening prayer was given by Associate Pastor Merlin Mather, First Methodist Church, followed by the Pledge of Allegiance to the Flag. PRESENTATION Mayor Seitz presented a plaque of appreciation to Alderman TO ALDERMAN Kenneth Kehe who will be resigning effective Midnight.on KENNETH KEHE: Thursday, July 5, 1984, after serving as alderman of the Second Ward from 1971 to 1975 and 1977. to the present. Mayor Seitz expressed the City's gratitude for Alderman Kehe's many years of faithful and loyal service. Kinney Associates, Inc., 801 Davis Street, Evanston, IL, for additional work performed on Transit Center/Bus Bays, in the amount of $4,974.15; and Telander Bros. Contractors, Inc., 8151 S. Western Avenue, Chicago, IL 60620, for expenses incurred due to revised changes in Bus Bay/Taxi-Commuter Lane construction work, in the amount of $15,554. These items were previously approved at the Council meeting of June 18, 1984. FENCE Moved by Hardiman, seconded by Volberding, to adopt the VARIATION, recommendation of the Building Code Committee to deny 1826 LINDEN: request for variation to allow a fence installed in the front yard without a permit to remain. Moved by Hardiman, seconded by Volberding, to adopt the VARIATION, recommendation of the Building Code Committee to grant 1395 FOREST: variation to allow a solid fence to extend beyond the building line to the sidewalk near the southeast corner of the property located at 1395 Forest Avenue. Motion declared carried. BACKFLOW.. Moved by Martin, seconded by Hardiman, to adopt the PREVENTER: recommendation of the Building Code Committee that Paragraph 36.17-2(f) of the City's Building Code be amended to read as follows: "Backflow preventers shall be installed as required by the latest edition of the Illinois State Plumbing Code. The requirement for backflow prevention devices on fire safety systems shall not be retroactive except in the case of those systems containing anti -freeze or other chemicals or where no detecto check is installed or where the altera- tions or repair to a structure exceed 50 percent of the value of the structure as provided under Paragraph 4.7-5(a of this ordinance." Backflow preventers are required on water service lines in new, remodeled or existing commercial or industrial buildings.where, in the opinion of the Plumbing Inspector and the Director of Municipal Development Department, dangerous chemicals/products/ materials are used or produced or where cross connections cannot be corrected by other means. This requirement may be limited to service lines for individual suites or other limited areas where, in the judgement of the Plumbing Inspector and Director of Municipal Development, the installation of an approved backflow device in such an area is adequate to protect the potable water supply." And City Attorney be authorized to draft necessary ordinance. Motion declared carried. CABLENET: Moved by Adams, seconded by Kehe, to adopt the recommendation of the License & Judicial Committee that Mayor and City Clerk be authorized to sign agreement with City's Franchisee, Cablenet, Inc., as follows: 1. Cablenet, Inc. agrees to provide to the City of Des Plaines and place in the Des Plaines access studio in the form of equipment the equivalent of $10,000, and what that equipment shall be and the varification that it is in fact valued at $10,000 or thereabouts, shall be determined by whomever the City of Des Plaines designates. 2. Cablenet, Inc. agrees that on or after passage of this agreement, that any Des Plaines' Cablenet customer, whose total service is interrupted for 24 continuous hours or longer, shall, from that point on, receive a daily credit versus their monthly billing. 3. Cablenet, Inc. agrees to, as quickly as practical, bury all "snow -drop" cable. CONSTRUCTION Moved by Schneck, seconded by Chiropolos, to adopt the OF MAPLE ST. recommendation of the Public Works Committee to award the GARAGE: bid for the construction of a garage and wall at the Maple Street Pumping Station to the lowest bidder, Cornell and Fornell, Inc., 30 N. River Road, Des Plaines, in the amount of $51,984, and bid bonds/checks be returned to the 'unsuccessful bidders. GARBAGE Moved by Chiropolos, seconded by Schneck, to adopt the PICKERS: recommendation of the Public Works Committee that residents who witness acts of garbage picking may write down the license number and type of vehicle and notify City's License Officer who will notify these offenders by letter of their violation to City ordinance and that further violation would result in a warrant for their arrest. Motion declared carried. FREEDOM OF INFORMATION: Moved by Adams, seconded by Kehe, to adopt the recommendation of the License & Judicial Committee that City establish rules and regulations for release of its public and personnel records with respect to the Freedom of Information Act, which became effective on July 1, 1984 and that Resolution R-23-84 be adopted at appropriate time this evening. PURCHASE OF Moved by Martin, seconded by Chiropolos, to adopt the WATER METERS: recommendation of the Engineering Committee to authorize the purchase of 150 5/8", 50 3/4", 6 1", 2 2" and 1 3" water meters from Badger Meter, Inc., 4545 W. Brown Deer Road, Milwaukee, WI, 53223, for a total amount of $12,650.20, waiving the usual bid procedures. Moved by Kolinski, seconded by Kisslinger, to adopt the recommendation of the Municipal Development Committee to allow easement encroachment of 42' over patio and roof at property located at 1316 Wayne Drive, and City Attorney to draft necessary resolution to include Hold Harmless clause which would be recorded against the property, and authorize Mayor to sign. Motion declared carried. Mayor Seitz recommended that Joseph P. Bonk serve the unexpired term of Alderman Kenneth Kehe, who is resigning effective 12 Midnight on Thursday, July 5, 1984.
