'MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, AUGUST 1, 1983 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor John E. Seitz at 8:10 P.M., in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Muehlenbeck, Kolinski, Volberding, Kehe, Martin, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Dini, Chiropolos, Ward, Zanca. Alderman Addante was absent. Also present were: City Treasurer Swanson, City Comptroller Blietz, Commissioner of Public Works Matula, Police Chief Alfano, Fire Captain Buckley, Acting Health Director McIntosh, Acting City Engineer Crowley, Municipal Development Department Director Richardson. Administrative Assistant Taylor, and City Attorney Smith. PRAYER AND PLEDGE: MINUTES: The opening prayer was given by Pastor Merlind Mather, First United Methodist Church, followed by Pledge of Allegiance to.the Flag. Moved by Dini, seconded by Muehlenbeck, to approve Minutes of the regular meeting of the City Council held July 18, 1983, as published. Correction: Page One, Roll Call should indicate Aldermen Volberding and Chiropolos as present. Following correction,. motion declared carried. BILLS PAYABLE: Moved by Ward, seconded by Muehlenbeck, to adopt the IMPOUNDING FEE FOR DOGS/CATS: INDUSTRIAL DEVELOPMENT REVENUE BOND, CHICAGO AERIAL SURVEY, INC.: following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLA_INES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Rand Road, for a fee of $5.00 per day per dog, and $4.00 per day per cat. ZONING CASE Moved by Adams, seconded by Zanca, to adopt the 83 -17 -SU, recommendation of the Municipal Development Committee 259 CENTRAL: to grant special use for a nursery school in R-2 Single (Poko Loko Family Residential District at 259 Central Road, Richard Nursery School) and Bonnie Clatch/Church of the Master. Moved by Chiropolos, seconded by Eardiman, to defer. Moved by Adams, seconded by Kisslinger, to adopt the recommendation of the Municipal Development Committee to grant recuestecVariation from the required hours of operation of 7:00 A.M. to 7:00 P.M. to 6:30 A.M. to 7:00 P.M.; to deny requested variation re signs; to modify the three remaining requested variations to allow no more than 80 children. CONTRACT FOR Moved by Zanca, seconded by Kisslinger, to adopt the TRANSIT recommendation of the Municipal Development Committee CENTER: to approve the contract with A. M. Kinney Associates, Inc., Evanston, IL, to design the Des Plaines Trans- portation Center, in the amount of $28,873. City to be reimbursed by IDOT. ZONING CASE 83-19-V, 606 POTTER: Moved by Kisslinger, seconded by Kolinski, to adopt the recommendation of the Municipal Development Committee to concur with the the Des Plaines Zoning Board of Appeals to grant variation to allow parking in the required front yard, subject to correcting a drainage problem and relocating a Commonwealth Edison pole from the existing driveway at 606 Potter Road (Kerry Levin, etal) in C-2 Commercial District, and City Attorney to draft necessary ordinance. Motion declared carried. ZONING CASE Moved by Kisslinger, seconded by Zanca, to adopt the 82 -38 -R -A -SU, recommendation of the Municipal Development Committee RIDING ACADEMY that property at northwest corner of Golf and East GOLF & E. RIVER River Roads (George and Anna Nuber, contract purchasers) ROADS: be rezoned from R-2 Single Family Residence to C-2 Commercial upon annexation to the City and approve text amendment permitting equine riding academy. Motion withdrawn. Moved by Kisslinger, seconded by Zanca, to adopt the recommendation of the Municipal Development Committee that property at northwest corner of Golf and East River Roads (George and Anna Nuber, contract purchasers) be rezoned from R-2 Single Family Residence to C-2 Commercial upon annexation to the City; approve text amendment permitting equine riding academy and special use subjectto petitioner connecting to City water and sewer, and City Attorney to draft necessary ordinance. UTILITY ACCEPTANCE BY CITY, FOUR COLUMNS LTD.: SEWER SYSTEM EVALUATION STUDY: 8/1/83 PAGE THREE 27 Moved by Kolinski, seconded by Zanca, to adopt a substitute motion that property at northwest corner of Golf and East River Roads (George and Anna Nuber, contract purchasers) be rezoned from R-2 Single Family Residence to C-2 Commercial .:_upon annexation to the City; approve text amendment permitting equine riding academy and special use subject to petitioner not being required to connect to City water and sewer but that a covenant be placed on the property to run with the land that in the event there was any other annexation in that area the cost for extending the water and sewer would be shared by property owners. Moved by Martin, seconded by Chiropolos, to adopt the recommendation of the Engineering Committee that City accept maintenance, ownership and jurisdiction of certain water and sewer public improvements requested by Four Columns, Ltd., for their property on Touhy Avenue, west of the Chicago and North Western Railroad tracks. Moved by Martin, seconded by Ward, to adopt the joint recommendation of the Engineering and Finance Committees that as a result of the sewer system evaluation study conducted by RJN Environmental Associates, Inc., Wheaton, IL, the City: - -continue with SSES and rehab design with completion by October, 1983. --authorize RJN Environmental Associates, Inc. to prepare plan of study and contract for design of sanitary relief sewers. - -institute a user charge at 20% of the water rate to cover normal sewer maintenance in accordance with USEPA requirements. --increase user charge in the future to account for debt retirement of the local share of rehabilitation. Authorize the City Attorney to draft necessary ordinance.
