CALL TO ORDER. The meeting was called to order by Mayor G. Walter Pflughaupt,
who presided with Aldermen Jo nson:, Hansen, Wolf, Vavrinek, Kehe, Baines, Harm, Mckay,
Halverson, and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the reports of Building Inspec-
tor Frank Scharri'nghausen, E ctrical Inspector Art Rieck, and City Clerk report of
receipts for the month of October. The Clerk also reported receiving a copy of a letter
from City Attorney Frank Opeka, which he was instructed to write to Mr. Rosenthal.

Dear Mr. Rosenthal:
Your letter of October 9th addressed to the Mayor of the City of Des
Plaines was referred to me fo reply after it was read et a regular meeting of the
Council.
First, I wish o advise that the reason you have received no formal
communication from the Water ommittee, to whom your letter of September 9th was
referred, is due to the fact hat the Committee has endeavored to compel an adjust-
ment of any claims that might exist and for that reason called the meeting to which
you were invited and apparent could not attend. A subsequent meeting was to be
arranged to suit your convenience, but no date has been agreed upon.
I wish to direct your attention to the fact that the City of Des Plaines
entered into•a contract with arry A. Dooley, the owner of the subdivision directly
across from the high school a d also with the Green Fields Homes, Inc., the owner of
the subdivision adjoining the high school to the south. The agreements provided for
the construction of a new mai from the city limits to their properties, thru which
they would be serviced with w ter for which they have made application. The agree-
ments further provided that tney are to procure the necessary easements and rights
of way. Water when supplied %ill be supplied thru a meter installed at the City
limits. To date no such appl'cation has been made nor such meter installed.
Up to the pres nt time no request has been made with the City for water
service to either of the subd visions to which you refer in your letter. I might add
that the City of Des Plaines as made use of the main in question, when it was com-
pelled to secure an emergency supply of water from Park Ridge and in so doing acted
within its authority under the purported contract to which you refer.
The records indicate that your clients have abandoned the use of -this
main for some 17 years, durin which period the City of Des Plaines, to maintain
proper circulation of water, iaintained•water in said mains, especially in view of the
fact that on several occasions it was found necessary to connect with the Park Ridge
system for an emergency supply of water.
You are informed that the City of Des Plaines issued no permits to any
one to tap on this main, for the reason that the City of Des Plaines has no authority
to issue any such permits beyond its corporate limits and especially in view of the
fact that they are not the owners or lessers of said main.

You are further advised that the City of Des Plaines placed no meters
in any structure or building that abuts the existing water main, has sold'no water
services to any properties abutting said main and has no intention of doing so until
the subject matter is disposed of.
This is also to advise you that a search of the city records fails to
disclose any agreement that may have been executed pursuant to authority appearing
in the minutes of the council proceedings.
If any one is using water from this main, the City authorities are un-
aware of that, inasmuch as there is no record of any application for service or that
any water is being used.

Inspector Scharringhausen stated in his report that the building per-
mits issued for this year have already exceeded the peak year for permits (1943) by
$34,315.85. The total to date is: • 1,719,957.85.

City Engineer Fletcher reported that the railroad crossing installation
cas finally started, and he hoped that they would complete all the crossings, weather

COMMITTEE REPORT. Alderman Halverson, Chairman of the.Water Committee,
reported that they were going to start flushing hydrants and mains. --The pressure of'
water at all hydrants taken before and after flushing. All hydrants would be numbered,
and a,chart kept for future information.

Sirs:
Pursuant to law, your Zoning Board of Appeals, sitting as a Commission,
held a public meeting at the hour of 8:30 PM on the 7th day of October, 1947, in the
Council Chambers, Municipal Building, Des Plaines, Illinois.
The properties involved are as follows:
(A) All lots facing Alies Avenue between Harding and Perry Streets.
(B) All lots facing Perry Street on the north side except the north-
west corner of Lee and Perry Streets now zoned as commercial.
(C) All lots in Des Plaines Center division that have not already
been zoned - namely - the lots on the north side of Willow Street,.
east of Graceland Avenue; all lots of (Spruce) Oak Street, and all
lots on Brown Street on the south side of that street.
The purpose of this meeting was to re -zone the above described proper-
ties from its present Class A single family residential classification, to the classi-
fication of Class B. multiple family dwellings.
While the original application to the city for rezoning of this property
onsisted of quite a few signatures, there were only a few people who showed up at the
hearing. It developed at the hearing that the legal description of the properties in-
volved was not very clear and there, was considerable discussion as to just what property
was involved for reclassification.
After due consideration, the Zoning Board of Appeals of the City of Des
Plaines, sitting as a Commission,decided to deny the application, but further suggests
that if the applicants are really interested in this reclassification that the proper
legal descriptions of the properties involved, be submitted for a new hearing.

Some time ago you wrote to this Department requesting that we,copsider
re-routing State Highway Illinois Route 62. This office has given your request consider-
able thought and study and has relayed your request to our Springfield office for an
opinion of the above subject.
• The final conclusion drawn by both our Springfield office and this office
was that -it would not be advisable to relocate the route in question as it is believed
that traffic is more adequately served by the numbered system which is now in effect.
In conclusion, I wish to state that the Department has been waiting for
the City to agree to widen the existing eighteen foot pavement and does not contemplate
making any changes on this route at present.

feeder mains and appurtenances, which plans and specifications were prepared and sub-
mitted by E. N. Fletcher, ciy engineer, acting as your agent, and which,plans, con-
sisting of 6 sheets, are des.gnated as "Feeder Mains Addition to Water System, City of
Des Plaines, Cook County, Iinois."
This authorit is granted in accordance with the provisions of Paragraph 3
of Section 55 of "An Act in is
to the Civil Administration of the State government
and to repeal certain acts therein named" (Approved March 7, 1917, in force July 1, 1917,
as amended) and subject to the provisions hereof.
The conditions of approval are:
1. This approval shall not be considered in any manner
affectin the title to the premises upon which arty of
the water works improvements in question are to be
located.
2.. This authority does not in any way release the city
from any liability for damage to person or property
caused by or resulting from the installation, main-
tenance, or operation of the water works improvements;
located nd constructed in accordance with the plans
and specifications herein referred to.
3. The State Department of Public Health, in issuing this
approval, has relied upon the statements and representa-
tions made by the city in the application herefor; and
in case any statement or representation in said applica-
tion is *ound to be incorrect this approval may be re-
voked without further notice, and the city thereupon
waives all rights thereunder.

4. There shall be no deviations from the plans and speci-
fications submitted with the application for this
approval unless revised plans and specifications therefor
shall first have been submitted to the State Department
of Public Health and a supplemental written approval •
issued therefor.
5. The State Department of Public Health, or any person
duly authorized by it, may, at any time during the
progress of the construction or the installation of
the water works system or any part thereof under authority
hereof, have the right and authority to inspect such work
during the progress thereof; and such Department or its
duly authorized agent shall have the authority at any
and all times after the erection or the installation of
such water works improvements to inspect the same or the
operation thereof.
6. This approval takes into consideration only the adequacy
and sanitary and mineral qualities of the public water
supply for drinking and general domestic use and not the
structural stability nor durability of any units or parts
of the water works that will not affect the quality of
the water nor the costs of construction and fihancial sound-
ness of the project; and it is assumed that the water works,
�/ when completed, will receive reasonable care, maintenace,
and operation.
7. The Department of Public Health shall be notified when the a

8. This permit is void after October 24, 1948, unless construc-
tion on this project has started on or prior to that date.

IIIwith alarm the increasing construction in the residentail areas of said Township
without adequate telephone communication facilities, and
WHEREAS, The Orchard Place Parent Teacher Association is likewise concerned with the
inadequacy of the telephone service in the Maine Township sub -division known as Glen
Acres, and
WHEREAS, said Orchard Place Parent Teacher Association believes that such lack of
telephone facilities is a fire hazard and.a danger to the public health, safety and
welfare of this community which has developed through both delays_of the Middle States
Telephone Company in extending its facilities and in the failure of said Company to
comply with its own policies of extension when individual telephone units are released.

Company as a public utility in the State of Illinois, to determine its adequacy and
the extent to which said Com any complies with statutes, -rules and regulations govern-

BE IT FURTHER RESOLVED: that if the facts of said investigation warrant, the Middle
States Telephone Company be ifrdered to show cause, at a public hearing to be held in
Des Plaines, or Park Ridge w thin said Maine Township, as to why its operating franchise
should not be revokes, and
BE IT FURTHER RESOLVED, that the facts of the investigation conducted by the Illinois
Commerce Commission be made vailable to the Orchard Place Parent'Teacher Association
in response to this Resolution.

Des Plaines.
I've been informed that it is customary to first write to the City Council
about this matter.
According to nr observation, there should be an opening in the near future,
because one of.the Veteran Cab's (Irvin L. Pharr) has joined 'Flash Radio' cab in Chicago.
Being a Veteran myself, and having driven a Tu -Tone Cab in this City for
two years, I would like to a ply for the license that has apparently been given up by
the former holder --Irvin L. Pharr. • • •

in Taxi -Cab licenses at pre ent, however, they may apply again at the first of the year
if they wish. The motion w4s voted upon by acclamation, whereupon the Mayor declared
