ALDERMAN AORAVA brought the attention of the hazard at Algonquin and Des Plaines Avenur due to the accident causing the death of an eight year `old child. He suggested that the City Council contact the'State and County of- ficials and'have a fo{br-way stop made at that intersection. Alderman Vavrinek Aid the Chicago Moto Club should also be contacted. Alderman Halverson said he would see the Chic go Motor Club. After considerable discussion, the motion was made by Alderman ehe and seconded by Alderman Morava that the City Clerk communicate with the ptate and County officials. WATER COMMITTEE REPORT: Alderman' reported that construction 'had been started on he new well house; ZONING VIOLATION:- 1575 Jefferson - rear of 1540 Park Place: The Building Inspector m -de the following inspection report on the above: 599 ( BLDG. INSPECTOR'S REPORT CONT' D.) I have investigated and have found that the barn on Lot #33 E. A. Thomas. Subdivision Sections 17-41-12. The correct street number is 1575 Jef- ferson Street - owned by Axel D. Peterson:' This property is zoned as Residence Area District "B" Multi -family, and is adjacent to an alley abutting Commercial property now used for Sears' Farm store. Sears are now using this barn to store small farm machinery and parts all metal, no inflammable material. Once a week a large truck delivers a load Of this machinery and un- loads into this barn; during the week smaller trucks take out some of this ma- chinery. `•P.S. REPORT ON REQUESTS OF SAFETY COUNCIL: Chief Becker reported that a check had been made from February 27th to March 16th on speeding of automobiles on gorthwest Highway at Cumberland Station and Traffic. Circle, bit found no ,,', violations ofspeeding.' He also reported a check of the number of commuters (24 getting off the late trains at the Cumberland Station fbr the same oeriodend el)found there was a total of 193 people. Of these there were 19 women; 5 went north and 14 went south. C4 The Mayor requested the City Clerk to inform the Safety Council of the report. Chief Becker reported that the persons dumping ashes in the al- ley were hating the ashes removed. Gentlemen: The matter of the letters from E. A. Behn, Jr., E. A. Behn, Sr., and W. R. Williams regarding the annexation of their lots to the City of Des Plaines has been referred to me for consideration and report. I have examined the plat of the subdivision`a.nd find that the lots do not adjoin each other and do not abutt the city limits of the City of Des glaines at any point. BUTLER BILL CASE REPORT: the Clerk read the following report: March 14, 1947 Mayor and City Council Des Plaines, Illinois. Gentlemen: The Sunre epi Court of Illinois on V ednesday ,"March 12th, rendered its decision in the c se of Grace Anderson vs. C ity of Park ?idge,et al, in which it sustained the consItituti.onality of the so-called "Butler Bills" and interpreted Section 162a of the Revenue Act of 1939 as amended. The foregoing case was a test case to dispose of the confusion and misinterpretation existing as to the proper method of levying and extending taxes under. Section 162a of the Revenue code, and particularly as to the meaning of paragraphs 1 and 2 of said section. The Court held that paragraphs 1 and 2 are to be considered together thus enabling municipalities to function. This con- clusion was reached to adjust the situation wherein the ceiling was lower than the floor. The minimum tax rate during the transition period was the basic con- sideration and of primary moment. The Butler bills are applicable to all city fiends except library and bond and interest funds. The Library tax rate was not reduced by the Butler bills. The bond and•interest levies are not affected under any circumstances inasmuch as the rates for that purpose are extended so as to produce the amount needed to pay such bonds and interest. The 1946 Levy was prepared under the direction of the undersigned who adopted the views expressed by the Supreme Court. Former levies were similarly prepared. It has been charged in one of the local newspapers' that the levies for the past four years were illegal under the Butler. lawl The Butler bills were note enacted until 1945 to become effective in 1946. The 1946 tax levy for general corporate purposes amounted to $54483.00. Under the But- ler bills as interpr ted by the Supreme Court, this city could have levied $53,707.78. The sam= applies to the remaining funds. In the a:gregate, the City of Des Plaines could have levied an ad- ditional $12,000.00 nder the provisions of the Butler bills. Gentlemen: March 17, 1947 VACATION OF PORTION OF RIVER DRIVE Quite some time ago, Mr. Clarence Hunting of Des Plaines requested your Hon- "' orable Body to vacate a portion of River Drive lying between Algonquin Road and Stewart Drive. At that time your Council` requested Mr. Hunting to quit claim to the city a strip If land to provide ingress and egress for the public, from Algonquinlbad to•the Des Plaines River, which Mr. Hunting at that time did not desire to do. • Mr. Hunting has conferred with me in this' matter and I am fully satisfied that he was not either properly advised or fully informed of all the angles to the proposition. However, he is now willing to quit claim to the city a strip of land fifteen feet in width, adjacent to Algonquin Road, which will provide a permanent means of ingress and egress to the public to reach the river for fishing, boating, ice skating or other sports. In view of the fact that Mr. Hunting is now willing to cooperate �. with the city in this respect, I will appreciate very much having your Honorable Body refer this matter to the proper committee so that I maymeet with them and discuss all the details of this tr.ansaction,..thereby making it possible for the proper committee to make a complete report to the Council concerning our request. City Engineer Fletcher made . a verbal report on the flood condition, saying the County would install a ,larger pump in Cumberland Terrace which would help that district.
