OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL ROOM, CITY HALL,
MONDAY, MAY 20, 1968.
CALL TO ORDER: The regular_ meeting of the City Council of the City of
Des Plaineswas called to order by Mayor Herbert H.
Behrel at 8:32 P.M. The meeting opened with a prayer
by Rev. Robert Prater, First Methodist Church of Des Plaines, followed
by the pledge of allegiance to the flag.
ROLL CALL:
Roll Call indicated the following aldermen present:
Rateike, Szabo, Prickett, Wright, Bolek, Leer, Figard,
Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi,
Seitz, Shillington, Michaels.
Also present were: City Comptroller Blietz, Police Chief Hintz, Building
Commissioner Schuepfer, Fire Captain Haag, Commissioner of Public Works
Warnicke, Assistant Commissioner of Public Works Schwab, City Engineer
Fletcher, and City Attorney DiLeonardi.
There being a quorum present, the meeting was in order.

It was moved by Alderman Prickett, seconded by Alderman
Rateike, to approve the minutes of the regular meeting
of May 6, 1968. A correction was made on Page one in
the Roll Call to indicate Alderman Figard was present.
Motion declared Carried.
It was moved by Alderman Swanson, seconded by Alderman
Prickett, to concur with Municipal Development Committee's
recommendation to concur with.the Zoning Board in Case
68-21-R property located on the South side of Oakton,
West of Elmhurst Road, and grant rezoning from M-1 to
M-2 upon annexation to the City of Des Plaines. The
City Attorney is authorized to prepare the amendment to
the Zoning Ordinance and the Annexation Ordinance.
Motion declared Carried.
It was moved by Alderman Swanson, seconded by Alderman
Prickett, to concur with Municipal Development Committee's
recommendation to concur with the Zoning Board in Case
68-22-R property located on Elmhurst Road, South of
Oakton, and grant rezoning from B-2 to C-2 upon annexation
to the City of Des Plaines. The City Attorney is authorized
to prepare the amendment to the Zoning Ordinance and the
Annexation Ordinance. Motion declared Carried.
It was moved by Alderman Swanson, seconded by Alderman
Prickett, to concur with Municipal Development Committees
recommendation to accept the appraised value for all
vacated streets and alleys in the Farrell Park Sub-
division for the amount of $2,600.00 from Wm. L. Kunkel &
Company, Realtors. Kunkel agrees also to pay $100.00,
the cost of the appraisal report made by Smith & Pipenhagen,
for the vacation plats necessary to propertly record the
vacation of said streets and alley and attorney fees
incurred by the City of Des Plaines in connection there-
with. Upon roll call, the vote was:

It was moved by Alderman Swanson, seconded by
Alderman Prickett, to concur with Municipal
Development Committee's recommendation that
part of Lot 2 in Parkwood Subdivision be made a
part of Lot 1 in W. J. O'Brien Subdivision, mid
authorize that the Mayor and City Clerk sign the
plat. Motion declared Carried.
It was moved by Alderman Swanson, seconded by
Alderman Prickett, to concur with Municipal
Development Committee's recommendation to concur
with the Zoning Board in Case 68-23-R property
located at 2127 Miner Street and grant rezoning
from R-2 to C-1, and authorize the City Attorney
to prepare the Amendment to the Zoning Ordinance.
Motion declared Carried.
It was moved by Alderman Swanson, seconded by
Alderman Thomas, to concur with Municipal
Development Committee's recommendation to concur
with the Plan Commission for dedication of part
of the East side of Mt. Prospect Road, South of
Central .and: -North of Wisconsin Drive, and
authorized that the Mayor and City Clerk sign
the plat. Motion declared Carried.
It was moved by Alderman Swanson, seconded by
Alderman Thomas, to concur with the Municipal
Development Committee's recommendation for
vacating a portion of an alley situated between
Thacker Street and Ashland Avenue between Center
Street: on the West and Cora Street on the East.
After considerable discussion, Aldermen Bolek and
Rateike requested action be deferred till the
next meeting.
It was moved by Alderman Swanson, seconded by
Alderman Prickett, to concur with the Municipal
Development Committee's recommendation to concur
with the Zoning Board in Case 68-26-R property
located at 965 E. Rand Road and grant rezoning
from R-2 to C-2, formerly B-4 under Cook County
zoning involuntarily annexed to the City and
authorized City Attorney to prepare the necessary
ordinance. Motion declared Carried.
It was moved by Alderman Swanson, seconded by
Alderman Thomas, to concur with the Municipal
Development Committee's recommendation to concur
with the Zoning Board in Case 68-20-R property.,.
located at 875 E. Rand Road and grant rezoning
from2-2 to C-2 upon property involuntarily
annexed, and authorize the City Attorney to prepare
the necessary ordinance. After Alderman Sabo
questioned subject property:should be M-1, City
Attorney Di-Leonardi advised petitioner should sign
an agreement for a non -conforming use in C-2.
Building Commissioner Schuepfer advised C-2 was
on both sides of subject property so M-1 would not
be feasible. Aldermen Szabo and Seitz requested
action be deferred till the next meeting.

It was moved by Alderman Swanson, seconded by
Alderman Prickett, to concur with the Municipal
Development Committee's recommendation for the
City Attorney to petition the Zoning Board for
a Public Hearing for a Text Amendment on Planned
Units. It was moved by Alderman Thomas, seconded
by Alderman Bonaguidi that said subject be re-
ferred back to the Municipal Development Committee
for further study and report. Motion declared
Carried.
Alderman Swanson, Chairman, set a meeting of the
Municipal Development Committee with Rolf Campbell
from Tec -Search, Inc. May 28, 1968 at 7:30 P.M.
The Deputy Clerk read a letter from the North
Maine Fire Protection District regarding payment
of $20,000.00 to the City for fire service to
North Maine Fire Protection District to be re-
ceived within ten days after receipt of the
Township Collectors draft.
It was moved by Alderman Rateike, seconded by
Alderman Shillington to concur with Fire Committee
recommendation to authorize the City Attorney to
draft contract correction. Correction being to
write off the balance due of 1967 and rewrite
the contract for: 1968 at $800.00 per week retro-
active to January 1, 1968. Said contract being
extended to December 31, 1968 or until their fire
station is open whichever is first. On Roll Call,
the vote was:

1968 to Robert Young, Inc., but was subsequently
determined that it did not meet the specifications;
therefore the purchase order was cancelled. Upon

Works Warnicke's recommendation to accept the
cdrtified Maintenance Agreement with Murphy and
Miller, Inc., for complete protection on equipment
and agrees to pay in the sum of $142.25 per month
beginning with the effective date of the agreement;
payable in twelve monthly installments. Upon
roll call, the vote was:

Commissioner of Public Works Warnicke::was directed
to research the contract with Murphy & Miller, Inc.,
to ascertain whether the Police Department is
covered by the same contract.
An application for Liquor License at 783 Lee Street
was referred to the License, Health and Inspection
Committee. It was moved by Bolek, seconded by
Leer, not to consider the request at this time.
Alderman Michaels expressed the opinion that the
petitioner should not be denied. After discussion
among the Aldermen, Mayor Behrel and City Attorney
DiLeonardi, Alderman Bolek and Alderman Leer with-
drew their motion and second and said application
was referred to Committee.
It was moved by Alderman Swanson, seconded by
Alderman Szabo, to concur with the Sanitation
Committee's recommendation to authorize the
Mayor, City Comptroller and Sanitation Committee
to negotiate the terms for a new contract for
refuse disposal with John Sexton Sand and Gravel
Corp. Motion declared Carried.
It was moved by Alderman Leer, seconded by
Alderman Hinde, to concur with Streets and Traffic
Committee's recommendation to award the bid, 79 -CS
for the improvement of Graceland Avenue, Brown
Street, Jefferson Street and other streets North
of City Hall to the low bidder, Arcole Midwest
Corporation in the amount of $244,740.15, and
return the checks and/or bonds of the unsuccessful

After careful study of the Burke Report, it was
moved by Alderman Leer, Seconded by Alderman
Hinde for Council concurrence with the Streets
and Traffic Committee, Parking Lots Committee
and Traffic Commission that the State Highway
Department make a traffic count at Thacker and
River Road for possible request for a traffic
light at this intersection. Motion declared
Carried.
After careful study of the Burke Report, it was
moved by Alderman Leer, seconded by Alderman
Bolek for Council concurrence with the Streets
and Traffic Committee, Parking Lots Committee
and Traffic Commission that proper request be
made to the State and County Highway Departments
and the Belt Line Railroad for study into im-
provements to better handle the flow of traffic
around the Central Business District, such as,
1. Thacker Street Bridge over the Des Plaines
River with link up to Dempster and 2. An under-
pass at Thacker and Belt Line Railroad or an
underpass at Algonquin and Belt Line Railroad, West
of Wolf Road. Motion declared Carried.
After careful study of the Burke Report, it was
moved by Alderman Leer, seconded by Alderman Hinde
for Council concurrence with the Streets and
Traffic Committee, Parking Lots Committee and
Traffic Commission that the City Engineer make a
study for improving the interstion of Jefferson,
Pearson and River Road and also study the possible
improvement of Prairie Avenue such as diverting it
into Thacker Street. Motion declared Carried.
Alderman Szabo requested that the Traffic
Commission conduct a traffic study for "No Parking"'
on the East side of Garland Place, from Rand Road
to Miner Street.
Petition from residents on Campbell Avenue re-
questing that the street be returned to a two-way
street, was referred to the Traffic Commission
for study and report.
It was moved by Alderman Figard, seconded by
Alderman Czubakowski, to authorize the Mayor and
City Clerk to enter into a contract with Master
Leakfinders on a four-year program on behalf of the
City of Des Plaines. The four-year program would
divide the City into four sections for leakfinding.
The City Attorney was advised to check into a
cancellation clause on the contract.

According to our Code Book, the Council was ad-
vised by the City Attorney that bids should be
advertised because it is work being done.
Commissioner of Public Works Warnicke, stated
"Leakfinders" were economical with the most
modern equipment. Aldermen Ratieke and Shillington
requested action be deferred until the next meeting.
It was moved by Alderman Figard, seconded by
Alderman Michaels, to concur with the Water
Committee's recommendation to award the bid for
Lime to the low bidder, Linwood Stone Products
Company for the amount of $18.05 per ton for
Pebble Lime and $23.35 per ton for Hydrated Lime.

Alderman Bonaguidi presented a progress report
on the construction of the Golf Road and the Elmhurst
Road storm sewers and the Elmhurst Road sewer.
This report was placed on file. Regarding the
Elmhurst Road sewer, the ground on the East side
of the street is bad, and with many underground
utilities, progress has nbt been good. The Sewer
Committee recommends construction of the sewer
on the West side of the street with the following
provisions: 1. The cost of construction will
not be increased.. 2. Easements required may be
obtained. 3. State guarantees that no connections
will be permitted to this sewer after its con-
struction. It was moved by Alderman Bolek,
seconded by Alderman Figard, to authorize the
Mayor, City Engineer and Sewer Committee to solve
the problems and proceed with sewer project on
Route 83, on the West side of the street. After
a lengthy discussion by the Aldermen, Alderman
Bolek withdrew his motion.
It was moved by Alderman Szabo, seconded by
Alderman Shillington, to concur with the Building
Control and Inspection Committee's recommendation
to approve the sign request of Holiday Inn at
Touhy and Mannheim, height not to exceed 31 feet,
11 inches with no flashers, raceway or twinkling
lights allowed. Motion declared Carried.
Letter from the Building Commissioner regarding
Certificate of Occupancy was referred to the
Building Control and Inspection Committee and
the City Code Committee for study and report.

Private ParkinE It was moved by Alderman Wright, seconded by
371 and 373 Dover Lane Alderman Wagner, to concur with the Parking
Lots Committee's recommendation to help see
that the property located at 371 and 373 Dover
Lane gain access off Oakton, and to aid in the
developing of a private parking off-street lot.
Direct City involvement in this project, until
dedication, is not recommended. Motion declared
Carried.
Advertise for Bids
Tree Contract
It was moved by Alderman Leer, seconded by
Alderman Rateike, to advertise for bids returnable
July 8th at 10:00 A.M. for a new contract to
expire August 1, 1969 for the entire City tree
program. Specifications are to be drawn by
Commissioner of Public Works Warnicke with approval
of the Tree Committee. Motion declared Carried.

It was moved by AldermanMichaels, seconded by
Alderman Shillington, to concur with the City
Code Committee's recommendation to authorize
the City Attorney to amend the Fair Housing
Ordinance to remove the Mayor from the Real
Estate Brokers Review Board and that a local
resident be placed in his stead. Motion declared
Carried.
Alderman Czubakowski submitted the May report from
Richard G. Arthur, Director of the Des Plaines
Civil Defense Corps., reading as follows:
1. A copy of the Federal Guide for "Emergency
Preparedness", has been given to the Police, Fire
and City Clerk Office.
2. All the radio communication equipment was
delivered last Friday, May 17. Installation of
the radios and the radio antennas will start this
week. The 10-10 radio receiver for tornados and
severe weather for the Maine Township High School
was received today and will be placed into service
tommorrow, May 21, 1968.
3. A letter was sent out to all Department heads
informing them about the communications that are
proposed for the City. Also copies have been sent
to all Aldermen.
4. Four Radio receivers have been ordered out
for the following schools in School District 59,
Brentwood, Devonshire, High Ridge, and Einstein
Schools. These units will give them all tornado
and severeweather warnings.
5. A progress report has been sent to the Mayor
and the members of the Civil Defense Committee on
the progress of the 200 -bed disaster hospital. A
meeting has been confirmed for Monday, May 27th
at 8:00 P.M. in the City Council Chamber with
Mr. Harvey of the Department of Public Health,
members of the Civil Defense Committee, and we
would like to invite the Fire Chief, City Attorney,
Commissioner of Public Works, and all other in-
terested Aldermen.
6. Booklets for the Police Marshalls on Civil
Defense Police training have been ordered from the
State Agency and should arrive in the near future.

7. The film "Tornado" has been.. received and has
been shown to various civic groups, to the
school officials of District 62. A request from
them to assist in up dating their Tornado drills
in the schools will be completed in the near.
future.
8. A letter was sent to the Boy Scouts thanking
them for their assistance in delivering the
15,000 Tornado flyers in the community.

by Alderman Rateike that Resolution R-17-68 be
passed approving the proposed Pre -Annexation
Agreement between the City of Des Plaines and
the National Bank of Austin, as trustee et al
and authorizing and directing the Mayor and City
Clerk to sign the Pre -Annexation Agreement at
Oakton and Elmhurst with the owners. Upon roll
call, the vote was:
