12/20/196592 d.2/20/65 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, DECEMBER 20, 1965 CALL TO alDER: The regular meeting of the City Council of the City of Des Plaines was calledto order by Mayor Herbert H. Behrel at 8:10 P.M. The meeting opened with a prayer read by City Clerk Eleanor Rohrbach followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Prickett, Wright, Bolek, Leer, Shillington, Figard, Czubakowski, Wagner, Swanson, French, Martin, Rateike, Szabo. Present also were City Comptroller Blietz, Marshall of Police Kennicott, Fire Marshall Arndt, Commissioner of Public Works Warnicke, Acting Building Commissioner Schuepfer, City Engineer Fletcher, Health Officer Branding, and. City Attorney DiLeonardie There being a quorum present, the meeting was in,order.. YOUTH APPRECIATION WEEK Essays written by the youth participating in ESSAY AWARDS: Youth Appreciation Wdek onithe theme "What Youth Appreciation Week meant to me" were judged by Alderman Leer, Alderman Czubakow- ski, and the Mayor. Awards wer,e,gaiven by Mayor Behrel to first place winner Linda McMahon of Sacred Heart of Mary School, second place winner Andrea Farmer of Forest View High School, third place winner Kathy McLaughlin of Sacred Heart of Mary School and honorable mention was given the essay of Judy Bevaqua of Sacred Hedart of Mary School. MINUTES: It was moved by Alderman Pickett and seconded by Alderman Rateike that the Minutes of the regular meeting of December 6, 1965, be approved as written. A correction was made on Page five as follows: Paragraph six concerning the Resolution to State Highway Department, line six, Mt. Prospect Rd. changed to Wolf Road. Motion Carried. REPORTS OF CITY OFFICIALS: The Clerk submitted written reports of the City Treasurer and City Comptroller Alderman Shillington's complaint that Kuntze Building Corporation is operating a commercial office at Elmhurst Road and Kathleen Drive for purposes of renting and selling real estate - said office located in a Multi -family zone - was referred to the Building Control and Inspection Committee for study and report. ADOPT RESOLUTION protest- Alderman Bolek requested that City Engineer ing to location of Fletcher speak on the status of the proposed. Metropolitan Sanitary Sewage Treatment Plant tolbe constructed District Sewage Treatment in or near Des Plaines by the Metropolitan Plant Sanitary District, stating that a signed petition had been submitted to him by residents and property owners in the area of York Road, between Oakton Street and the Toll road, objecting to said proposed site. It was moved. by Alderman Bolek and seconded by Alderman Leer that the City Council of the City of Des Plaines adopt a resolution objecting to the proposed location of the Metropolitan Sanitary District Sewage Treatment plant being located within the corporate limits of the City of Des Plaines at the proposed location of the southeast corner of Oakton and York Road (commonly known as Rt. 83 or Elmhurst Road) on five points as follows: 1. The 100 acres is zonedindustrial which increases the City's tax base for supporting schools and government; 2. Depreciation of residential property values in the area, 3. Seriously questioning the item of undesirable odors, 4. A signed petition by the large number of property owners in the area, and 5. The use of a Sewage Treatment Plant is not permitted according to Zoning Ordinance on property located east of York Road south of Oakton to the Toll Road, said property; presently zoned M-1, Restricted. City Attorney's Report City Attorney reported that the Rooming House violators on Dover Drive and Dover Lane, had been served notice and have until January llth to file. He further reported that he has received communi- cation from the City's Insurance Company denying responsibility to defend Police Officer Schwiesow.and therefore he will defend in the case. City Attorney reported a tender of the Ander- son --Miller property had been received to be used as a Retention Basin. There is a problem in accepting title in its present form and he will contact their attorneys this week. City Attorney stated that a case came before Traffic Court this morning relating to Section 10-8-2 of the City Code and suggests a sentence be added making it'unlawful to make unnecessary noise when operating a vehicle. t ►. City Attorney reported that two resolutions have been prepared for Council's Consideration - one opposing Variation on Zoning Docket #981 and the other accepting the contract with Elk Grove Fire Protection District. The Contracts with Nort# Maine, South Maine, and Hawthorne Fire Protection Dijtricts have not been reviewed, but will be reported at the next meeting. REPORTS OF COMMITTEES: Kolton-Tracy Resubdivision Alderman Martin, Chairman of the Municipal Development Committee, reported that said Committee has investigated the Kolton-Tracy Resubdivision and has found that this tract consists of twelve lots bounded by Howard Street on the North, Welwyn Street on the east and Birch Street on the west, all twelve lots are single family lots meeting all requirements. We recommend. that Kolton-Tracy Resubdivision Plat be approved per plan commission report of November 11, 1965, and that the Mayor and City Clerk hereby authorized to sign said plat after necessary cash or bonds are posted for-improve-- ments. It was moved by Alderman Martin and. seconded by Alderman French that Council concur in said report. Motion Carried. Zoning Case 65-31R Alderman Martin, Chairman of the Murocipal Allied Asphalt Paving Co. Development Committee, reported that said & Milburn Bros., Inc. Committee has investigated Zoning Case 65-31R and recommend passage of Ordinances Z-20-65 and Z-21-65 rezoning property owned by Allied Asphalt Paving Co. and Milburn Bros., Inc., located on Higgins west of Mt. Prospect Road, upon annexation. It was moved by Alderman Martin and seconded by Alderman Wright that Council concur in said,r.eport. Motion Carried. Zoning Case 65.32R Alderman Martin, Chairman of the Municipal Arthur Rodgers - 2750 Development Committee, reported that laid Des Plaines Avenue Committee has investigated Zoning Case 65-32R and recommend passage of Ordinance Z-22-65 rezoning property owned by Arthur Rodgers located at 2750 Des Plaines Avenue from M2 to Cl. It was moved by Alder- man Martin and'secdnded by Alderman French that Council concur in said report. Motion Carried. Elk Gr. -dye Fire`Protection Alderman Rateike, Chairman of the Fire District Contract `Committee, reported"that the Fire Committee has investigated the Elk Grove Fire Protection District contract and has found that the City Attorney has examined the contract and it has been approved by the Fire Chief. We, your Committee on Fire_therefore recommend that the resolution accepting said contract be approved." It was moved by Alderman Rateike and seconded by Alderman Shillington that Council concur in said report. Motion Carried. -- 94 12/20/65 Page 3 Emergency Power in Alderman Bolek, Chairman of the License Power Failures Health -and Inspection Committee, reported that he contacted Middle States Telephone Company concerning their preparedness for a power faiJeure. Middldt States Telephone Company initheir letter dated November 17,, 1965,, on file with City Clerk, stated they have two 75 kilowatt Diesel generators set -for automatic starting in the event of reduction or loss of commercial power. Alderman Leer stated that in the coming budget the Civil Defense Committee is appropriating funds for the, purchase of emergency power for City Hall. Streets & Traffic Alderman French, Chairman ,of the Streets Committee suggestion and Traffic Committee, stated that in the area where Mr. R. Beam was killed over the weekend, there are several homes without sidewalks and suggests all alderman do what they can to encourage the development of sidewalks so that construction may begin in spring. He further suggested that the Mayor request studies to be made of new traffic Conditions after the completion of Touhy Avenue, especially at the intersections of Scott and Maple where signalization may be necessary. To restrict parking Alderman French, Chairman iof the Streets and Debra Drive - Marshall Traffic Committee, made thle following report: to Lillian; 8th Ave from "Your Co*mittee on Streets and. Traffic has Princeton to Drake investigated (1) Debra Drive from Marshall to Lillian and (2) Eighth Avenue from Princeton to Drake and has found that the City Work crews find it difficult or impossible to work these half streets, the fire and sanitation apparatus is hampered by parked autos, and that side drives are available for -parking. We recommend an ordinance be drawn restrmcting parking on both sides of the indicated streets." It was moved by Alderman French and seconded by Alderman Martin that Council concur inesaid report. Motion Carried. 4 -.Way Stops at Dara Alderman French, Chairman of the Streets and James & Kathleen Dr. Traffic Committee, made:the following report: ".Your Committee on Streets and Traffic -has investigated the intersection of Dara James and Kathleen Drive and. recommend that four-way stop signs -be placed at said intersectithn and the City Attorney be authorized to draw an ordinance effecting this action." It, was moved. by Alderman French and seconded by Alderman e Shillington that Council concur in said report. Motion Carried. 1 Alderman Bolek's request for three-way stop at Webster Lane & Forest Ave. Alderman Bolek stated he ehad received a request from the Des Plaines Safety Council, Inc. for a three-way stop at the junction of Webster Lane and Forest Avenue. This letter was referred to the Traffic Commission for study and report. Approve Jewel Tea Co. Alderman Szabo, Chairman of the'Building, Control and. Inspection Committee, reported that said -committee has investigated the sign application of Jewel TleacCompany, 1411 Ellinwood Street, and recommend the sign be approved and the Building' Commissioner issue the necessary permit. It was moved ;by Alderman Szabo and seconded by Alderman Prickett that Council concur Iin said report. The letter from W. F. Levander, Attorney for the• owners, requesting a lot division of property located on the south side of Algonquin Road, west of Mt, Prospect Road was referred to the Plan Commission. The letter from Wm. L. Kunkel & Do., requesting approval of a proposed Su»division of lots located on the Northwest corner of Rand and Wolf was referred to the Plan Commission. Mayor Behrel read a letter received from Richard. and. Donna R. Barron requesting annexation to the City of Des Plaines. It was referred to the City Clerk to, secure properly signed Annexation Petition. Magor Behrel reportedthat he had received a request from School District #63 to pur- chase water from the City of Des Plaines, but added that no 'action is to be taken until after the School Board meeting January 12th. Mayor Behrel also submitted to Aldermen a memo regarding future plans for annexation, and. reported on the meeting held at Niles Village Hall regarding the proposed incorporation of the Village of Golf. It was moved by Alderman Figard and seconded by Alderman Wagner that Council concur in Mayor Behrel's ,appointment of Mr. Raymond Schuepfer as Building Commissioner effective January 1,'1966 - term to expire April 30, 1969. Motion Carried, Alderman Prickett read a petition from residents and property owners in the area of the City's dump site located on Algonquin Road, ojjecting to the dumping and burning of garbage. Said Petition was referred to the Sanitation Committee and Commissioner of Public Works for study and report. Mayor Behrel announced that a representative from School District #62 will present'a film presentation to City Council at their next meeting date, January 3, 1966, at 7:30 P. M. concerning the proposed Iroquois Junior High School. It was moved by Alderman Shillington and seconded by Alderman Rateike that the regular meeting of the City Council of the City of Des Plaines adjourn. Motion Carried, APPROVED BY ME THIS DXY OF
