MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE
CITY OF DES PLAINES, ILLINOIS',
HELD IN THE COUNCIL ROOM, CITY
HALL, TUESDAY, SEPTEMBER 7,1965
CALL TO ORDER: The regular meeting of the City Council of the
City of Des Plaines was called to order by the
Mayor, Herbert H. Behrel, at 8:07 P.M. The
meeting opened with a prayer read by City Clerk Rohrbach and the pledge
of allegiance to the flag.
ROLL CALL: Roll Call indicated the following aldermen
present:. Alderman Shillington, Figard, Wagner,
Swanson, Martin, Bonaguidi, Rateike, Szabo,
Prickett, Wright, Bolek, Leer.
Present also were City Clerk Rohrbach, City Attorney DiLeonardi, City
Comptroller, Blie4, Police Chief Kennicott, Commissioner of Public Works
Warnicke, Building Commissioner Renell, and Mr. Roland Flibtcher.
There being a quorum present, the meeting was in order.

OPEN BIDS: Salt
It was moved by Alderman Prickett and seconded
by Alderman Wright that the Minutes of the
regular. meeting of August 16, 1965 be approved.
Motion Carried.
It was moved by Alderman Prickett and seconded
by Alderman Shillington that the City Clerk
open,the bids submitted for Salt for the 1965.

by Alderman Martin that the City Clerk open

the pavement, curb, gutter and the Railroad

AWARD_ BID: MFT Section It was moved by Alderman Rateike and seconded
61 CS - Howard Avenue by Alderman Bonaguidi to award the bid for
MFT Section 61CS to Allied Asphalt Paving Co.,
low bidder of $45,099.10, and that cashiers
checks and or bid bonds Mayer Paving & Asphalt Company and Arcole
Midwest Corporation be returned but the Rock Road Construction Company
check to be returned when the contract for Allied Asphalt Paving Company
is signed. On Roll Call the vote was:

REPORTS OF CITY OFFICIALS: The Clerk submitted reports of the Health
Officer, Jean Branding, and Building
Commissioner F. J. Regnell to be placed on
file. Mr. Regnell thanked everybody in
City Council and Administration Heads for the cooperation he has received.
He is sorry he cannot continue for reasons he cannot disclose. He stated
he certainly has learned a lot and he hopes not at the expense of the City
of Des Plaines.
Pre -Annexation Agreement City Attorney DiLeonardi submitted to all
Willie Property aldermen and city officials a written
memorandum concerning the Willeeproperty
pre -annexation agreement stating the re..
Oired hearing has been scheduled for 8:00 P.M. September 20, 1965 in
the Council Chambers immediately preceding the regularly scheduledsCouncil
meeting. Copies of said Pre..Annexation agreement also submitted to
Aldermen and City Officials.
Mayor as presiding officer City Attorney DiLeonardi read a portion of
Deciding Vote Chapter 24, Section 3-11.14, with reference
to the vote of the Mayor. "He shall not vote
on any ordinance, resolution or motion except: (1) where the vote of the
aldermen has resulted in a tie; or (2) where one half of the aldermen
elected have voted in favor of an ordinance, resolution or motion even
though there is no tie vote; or (3) where a vote greater than a majority
of the corporate authorities is required by this Code to adopt an ordinance,
resolution or motion. In each instance specified, the mayor shall vote."
REPORTS OF COMMITTEES':
Committee Meeting Alderman Martin, Chairman of the Municipal
Development, Committee set a meeting of said
Committee for Wednesday, September:8, 1965, in the Mayor's office at
8 P.M. to discuss with Fairview Civic Association the possible annexation
of Bluett Subdivision located north of Central Road, west of Wolf Road.
Police Dog Ranger: Alderman Figard, Chairman of the Police
Committee made the following report: "Your
Committee on Police has investigated Police Dog Ranger and has found
many well known authorities 'on the German Shepherd breed of dogs and
well qualified persons on the use of this breed for Police Work recommend
that the dog be allowed to remain with the Officer working with him. We
your Committee or Police therefore,rec`ommend the .dog Ranger be permitted
to stay with the officer in charge." Alderman Figard moved that Council
Concur in said report, sedonded by Alderman Shillington. Motion carried.
Purchase Riot Helmets Alderman Figard, Chairman of the Police-
fotJ'olice Officers Committee made the following report: "Capt.
Spyrison of our reserve police called regarding
the possibility, of obtaining Riot Helmets for his officers. In discussing
this with Chief•Kennicott, he states we currently have fifty regular
officers and 31 reserve officers «. total number of 81 with only 24 helmets."
It was moved by Alderman Figafd and seconded by Alderman Martin that
Council authorize` the purchase of `eighteen 0'8) additional Riot Helmets
at a cost of V12.'00 each - to'tal cost $216.`Q0,

To certify three It was moved by Alderman Figard and seconded
Policemen by Alderman Bonaguidi to request the Board of
Police and Fire Commission to certify three
additional policemen included in last appro-
priation. Mayor` voted Aye. Motion carried.
Deny Franchise Alderman Bolek, Chairman of the License, Health
Des Plaines Cable TV Inc. and Inspection Committee made the following
report:: "The •request for a franchise - Des

Plaines Cable TV, Inc. - for twenty-five years with an option to renew
for twenty-five years was referred to this committee. We feel that the
City is not in a position to grant the franchise and if so, it should be
on a bid basis." It was moved by Alderman Bolek and seconded by Alderman
Bonaguidi to DENY application for said franchise. Motion Carried,
Progress Report Alderman Bolek, Chairman of the License
United Mbtor Coach Co. Health and Inspection Committee, reported
` that United Motor Coach Company is in the
Iprocess of making an ihvestigation of their financial reports as well as
the Urban Transportation problefms. They state that there has been a
decline of 7% in the number'of patrons as well as a decline of 7% in
revenue. They do financially well in'peak periods and plan to look for
methods df promotion of their bus service. The License Health and
Inspection Committee plan to hold•a public hearing to determine how the
public feels and hope to receive adequate support from the newspapers
to get the ,information to the citizens.
Approve Driveway Permit Alderman Rateike, member of the Streets and
Deckbrand Building Traffic Committee made the following report:
"The driveway permit for Deckbrand Building Vie..,
fifty feet into North side of Jar.y s,(Sfisr.,leeP r;, v;
was referred to our committee. We have investigated and found access to
Jarvis near Wolf is needed` and therefore recommend Commissioner of Public
Works be authorized td issue necessary permit." Alderman Rateike moved,
seconded by Alderman Bonaguidi, that said report be concurred in.

Everett & Dean Sts. Alderman Rateike, member of the Streets and
Riverview intersections Traffic Committee made the following report:
Bittersweet between Oakton "The following matter was referred to your
& Mannheim cone Way) Committee: (1) Everett & Dean Streets
Ash & Mannheim ' (2) Riverview intersections (Orchard East to
Des Plaines) (3) Bittersweet between Oakton &
` Mannheim (one-way) and (4) Pedestrian controlled

signal at Ash & Mannheim. Your Committee 'has investigated the above and
has found further investigation is necessary. We therefore recommend
these intersections be.studied by the Traffic Commission to determine if
(3) Bittersweet changed to one way north would -prevent Mannheim accidents
and (4) if pedestrian controlled signal at Ash and Mannheim is utilized by
crossing guard." It was moved by Alderman Rateike and seconded by Alderman
Bonaguidi that Council Concur in this treport. Motion Carried.
Intersection at Alderman Rateike, member of the Streets and
Mannheim & Prospect Traffic Committee made the following report:
"Your Committee has investigated the intersex.
tion at Mannheim and Prospect and has found
(1) State will approve signals at intersection at city expense (2)esti-
mated expenditure of MFT funds would be approximately $25,000 and (3)
state requests that if control is installed at this intersection, Ash &
Mannheim pedestrian controlled signal will be eliminated. We recommend
that (1) the Mayor attempt to get State financial assistance for proposed
signal and eliminate demand for removal of signal at Mannheim & Ash and
(2) Council authorize Mayor & City Clerk & City Engineer to initiate use
of MFT funds to install signals 'even though we may ultimately reduce our
request because State will participate." It was moved by Alderman Rateike
and seconded by Alderman Prickett that Council concur in this report.

was referred to the Streets and Traffic
Committee for study and report.

property located at Hillwell & Sunset. It was
moved by Alderman Martin, seconded by Alderman Figard to hire'an appraiser
to appraise said property as is and offer vacant lots at auction - the
purchaser of same to remove the old building. On Roll Call the Vote was:

Subdivision �1°1'." It was moved by Alderman Bonaguidi, seconded by Alderman
Figard that Council concur in this report and the CityIClerk be authoriped
to advertise for returnable October 6, 1965., for_the.proposed sewer
connection in Craig Manor Subdivision. Motion Carried,

Retain Benjamin Lange Alderman Bonaguidi, Chairman of the Sewer
Co. - proposal on the Committee, made the following reptrt: "We,
proposed sewer bonds -your Committee on Sewers, recommend that City
Council retain Benjamin&Lange Company for
the purpose of securing a proposal on the
proposed sewer bonds." It was moved by Alderman Bonaguidi and seconded
by Alderman Figard that the Council request Benjamin&Lang, bond consultants,
to submit a proposal as to costs of the proposed Sewer Bond Referendum.
Motion Carried.
Committee Meeting
Alderman Szabo, Chairman of the Building
Control & Inspection Committee, set a meeting
for September 8, 1965 at 7 P.M.
Award Bid for.Salt Alderman Wright, Chairman of the Parking Lots
Committee gave the following report: "Your
Committee on Streets & Traffic, Parking Lots,
and Finance have investigated the Salt Bids and have found Diamond Crystal
Salt Co. low bidder of $12.20 per ton. We, your Committee on Streets & Traffic
Parking Lots and Finance therefore recommend that the bid for Salt be
awarded to Diamond Crystal Salt Co." It was moved by Alderman Wright
seconded by Alderman Martin that Council Concur in this report.

Approve Ellinwood St.( Alderman Wright, Chairman of the Parking
Plan Lots Committee, gave the following report:
"The Chicago li Northwestern Railroad right
of way'property between Lee & Pearson Street
on the(northside of Ellinwood Street was referred to the Streets &
Traffic Committee, Parking Lots, Finance, and Municipal Development
Committees, and your committees have investigated and found the appraised
value is $24,750.00, this is in the best interest of the City and traffic
flow, and Tec -Search, Inc., City Planners, strongly recommend and approve
the Ellinwood Street Plan. We., your Committees, recommend negotiations
be made for purchase of this -property with Chicago & Northwestern
Railroad not to exceed $24,750.00." It was moved by Alderman Wright,
seconded by Alderman Bonaguidi that Council concur in this report.

Elm Tree Disease
Alderman Wagner, Chairman of the Elm Tree
Dis-ease Committee reported the committee
had studied Ordinance M-21-65 and will
recommend an amendment after second reading. Also reported the Elm Tree
Disease Committee had -discussed the fifty-fifty cooperation of replanting
trees on the parkway and they believe it is to the City's benefit to
stay with the procedure of furnishing trees - the entire cost to be borne
by the City. Alderman. Martin requested that an investigation be made
to determine if the use of Bidrin for innoculation of trees in Des
Plaines could be made by our City Forester. Alderman Leer asked for
Council approval to ask Mr. Bishop, City Forester, to explain this.
City Forester Bishop stated that Bidrin has been used by the tree trade
for approximately four years and is not a proven method of saving. elm
trees. It is( a preventative to keep beatles off trees, is very danger-
ous(to use* and causes(blitters and swelling if it touches the kkin.
He stated that until it is a proven product the City of Des Plaines
should use a "Hands Offs" program, until professors of the State of
Illinois have proven it a perfect method.
APPROVAL OF BILLS PAYABLE: Alderman Prickett, Chairman of the Finance
Committee, presented the following resolution:

Mayor Behrel reported he has written a
letter of congratulations to Littlefuse,
Inc. Also that he is diligently searching
for a man to head a Citizens Committee of Redevelopment of downtown
Des Plaines. He spoke on the need for a Storm Sewercprogram and requested
that each alderman select ten capable residents in his ward willing to
spearhead public relations work on the Storm Sewer Referendum when the
need arises.

PRE -ANNEXATION AGREEMENT
PUBLIC HEARING:
CORPORATE AUTHORITIES
OF CITY OF DES PLAINES.&

LAND CORPORATION.
Attorney DiLeonardi announced: "This is a public hearing on the
proposed pre..annexation agreement on the Wille Farm property located
on the southeast corner of Algonquin and Elmhurst Road." City Attorney
read the legal notice of said public hearing published in excess of
fifteen days.
Mr. Heinz Zupke, 670 W. Elizabeth Lane questioned the zoning of
one portion of the property stating that "sometime ago at a zoning
hearing in Chicago a,statement was made that the corner would be used
for office structures. In one portion of the pre -annexation agreement
it states that car laundries and/or car washes are permitted and the
single family residences could be on top of it".
Attorney DiLeonardi, stated at the Cook County zonig hearing,.the
owner saw fit to rezone said property to B3, but the court voted to
sustain Single Family on part of said property. He further stated that
the owners have the right to use the property for any C2 purpose and he
ha6 no idea what they intend to be.
Mr. Samuel Brott, 6722 Dempster Street, Morton Grove, I1j. stated
that the car wash is an implied use, but that the portion of the property
to be rezoned C2 commercial would not be improved for at least two .years.
It was moved by Alderman Martin and seconded by Alderman Leer that
the matter of the Pre -Annexation Agreement of the Wille Property be
taken under advisement. Motion Carried.
