CALL TO ORDER: The regular meeting of the City Council of the
City of Des Plaines was called to order by the
Mayor, Herbert H. Behrel, at 8:05 P.M. The

Roll Call indicated the following aldermen
present: Alderman French, Martin, Bonaguidi,
Szabo, Prickett, Wright,`Bolek, Leer, Shillington,
Figard, Czubakowski, Wagner.
Present also were City Clerk Rohrbach, City Attorney DiLeonardi, Police
Chief Kennicott, Fire Marshall Arndt, City Comptroller Blietz, Commissioner
of Public Works Warnicke, Building Commissioner Regnell, and City Engineer
Fletcher.
There being a quorum present, the meeting was in order.

Open Bids: Thermo-
plastic stiiping
It was moved by Alderman Prickett and seconded
by Alderman Wright that the Minutes of the
regular meeting of August 2, 1965 be approved.
Motion carried.
It was moved by Alderman Bonaguidi and seconded
by Alderman French that the City Clerk open the
bids for theThermoplasticstxiping of streets.
Only one bid was received from Perma-Line Midwest Corporation in the
amount of $18,785.50. It was moved by Alderman Figard and seconded
by Alderman French to refer said bid to Streets and Traffic Committee,
Finance Committee, Commissioner of Public Works and'City Engineer.
Motion carried.

It was moved by Alderman Borauidi and seconded
by Alderman Wagner that the City Clerk open the

It was moved by Alderman French and seconded by Alderman Wagner to refer

City Council recessed for ten minutes for committees to consider bids.
REPORTS OF `CITY OFFICIALS.: The Clerk submitted reports of the
following to be placed on file: City Treasurer,
and City Comptroller's Budget Report, Statement of Cash Receipts, 1964
Water Construction Account, and Motor Fuel Tax Account.
Building Code Books Building Commissioner Regnell,reported he had
received a partial shipment of the new building
code books. Three copies were handed to the City
Clerk`to be placed on file and copies were distributed to all aldermen.
He suggested that any former building code books, excepting the Suburban
Building Code, be repealed with the adoption of the new book.

City Attorney DiLeonardi reported
that he had contacted the Insurance
Company of North America to determine
if they would defend Police Officers
`James Willison and Roland Harz in
personal injury suits. He stated that
said insurance company would pay any
judgements against the city in so far
as the negligence count, and would be willingtto defend the entire
case at no cost to the city on both counts - negligence and intentional.
It was moved by Alderman Prickett and seconded by Alderman Martin to
accept the Insurance Company of North America's offer to defend the
City on both counts and relieve the City Attorney of responsibility.
After considerable discussion the Council mutually agreed to continue
to retain the City Attorney in this case, as per minutes of July 6th
meeting, and Alderman Prickett and Alderman Martin withdrew their
motion.
`Cook County Zoning
City Attorney DiLeonardi reported he
Dockets #904, 905, 906 had attended the Cook County Zoning
Hearing on Dockets #904, 905, and
906, on the approximately 50 acres
of land located on the Northeast Corner of Linneman Road and Algonquin
Road. An Amendment to the original zoning request was granted the
applicant, Kenroy Realtors, Inc., to change twenty acres to B3 General
Business District, and the balance of the property consisting of 39.3
acres to M1 Restricted Manufacturing. It was moved by Alderman
Shillington and seconded by Alderman Wagner to file objections to
rezoning said property from R4 Single Family to M1 and B3., on the
basis of apparent inadequate storm sewers.
On Roll Call,the vote was:

Agreement - Settlement It was moved by Alderman Martin and
in Kuntze Zoning Case seconded by Alderman Prickett to
authorize the Mayor and City Clerk
to execute an agreement between LaSalle National Bank, not individually
but as Trustee under Trust Agreement No. 28982, Eric W. Kuntze, owner,
and the City of Des Plaines . copy of said agreement attached hereto.
On Roll Call, the vote was:

Approve Forest Manner
Plat of Vacation Alderman Martin, Chairman of the_Munici..
pal development Committee made the follow-
ing report: "Your Committee on Municipal
Develppment has investigated Plat of Vacation for Forest Manner Subdivi-
sion and has found that said subdivision is.within .11 miles of the City
Limits of the City of Des Plaines and consists of 24 single family lots
on the east side of Lee Street, north of Foundry Road,property is
presently owned by Trustees of School District #26 and is to be developed
for a school site. We, your Committee on Municipal Development there-
fore recommend that the Mayor and City Clerk are hereby authorized to
sign said Plat of Vacation." It was moved by Alderman Martin and
seconded by Alderman Prickett that Council concur in this report. Motion.,

Municipal Development Committee, set
a joint meeting with Streets and Traffic, Finance, Parking Lots, and
Municipal Development Committee for August 31, 1965, at 8 P.M.
Progress Report
License Health and
Inspection Committee
Alderman Bolek, Chairman of the License
Health and Inspection Committee, stated
that United Motor Coach Company is
collecting facts and figures on revenues
and compiling data on their problems in operating within the City of
Des Plaines, and this committee will meet with them in the near future.
Also that plans are being made to write a new License and Inspection
-Ordinance.
Intersection of Prospect Alderman French, Chairman of the Streets
and Mannheim Roads and Traffic Committee made the following
report: " The Aldermen of the Fifth Ward,
the Mayor, and the Streets and Traffic Committee has investigated the
intersection of Prospect and Mannheim Roads (Rout?12.45) and has found
(1) Dangerous intersection where one child fatality and two serious
injuries occurred simultaneously (2)(Intersection under State jurisdiction
(3) 2900 petitioners and 12 civic organizations as well as Safety Council
request action. We, your Committee on Streets and Traffic therefore
recommend that the Mayor immediately wbtd a vigorous demand for action
by the State Highway Department for installation of traffic signals."
It was moved by Alderman French and seconded by Alderman Wagner that -
Council concur in this report. Motion carried. Mayor Behrel read a
letter from Francis S. Lorenz, Director of State Department of Public
Works and Buildings in which he explained the State's current highway
improvement program. Alderman Czubakowski turned over' to the Mayor
facts and statistics she compiled on accidents, violations, etc.
in the area of Prospect and Mannheim Roads.

To prohibit parking of Alderman French, Chairman of the Streets
Tractor -Trailers and Traffic Committee, made the following
teport: "Your Committeeion Streets and
Traffic has investigated the parking of-tractor..trailers on residential
streets and has found the Traffic Commission report reads that a City
ordinance does not restrict of prohibit tractor»trailer pafking on
residential streets and recommend that consideration be given to adoption
of restrictive ordinance. We, Your committee on Streets and Traffic
therefore recommend that the City Attorney draw up an ordinance, if
legallyzpossible prohibiting overnight parking of vehicles exceeding
5,000 pounds unloaded weight. Additionally, if unhooked tractor can
be prevented from overnight parking' include this restriction in the
ordinance." It was moved by Alderman French and seconded by Alderman
Czubakowski that Council concur in this- report. Motion carried.

AGREEMENT
THIS AGREEMENT, made and entered into this day of
August, A.D., 1965, by and between LA SALLE NATIONAL BANK, not in-
dividually but as Trustee under Trust Agreement No. 28982, ERIC W.•
KUNTZE (hereinafter referred collectively as "the owners") and the
CITY OF DES PLAINES, a Municipal corporation .(hereinafter referred
to as "the City",
W ITNESSET H:
WHEREAS, there is pending in the Appellate Court of Illinois,
First District, under docket No. 50516, the case of LA SALLE NATIONAL
BANK, as Trustee under Trust Agreement No. 28982, vs. THE CITY OF
DES PLAINES, an appeal by the City from a decree of the Circuit Court
of Cook County involving the constitutionality of the zoning of those
parcels of real estate hereinafter referred to as Parcels A and B; and
WHEREAS, it is the intention of the parties hereto to settle
their differences concerning the property which is the subject matter
of said proceeding (hereinafter referred to as Parcels A and 'B) and
adjoining property (hereinafter referred to as Parcels C and D).
NOW THEREFORE, in consideration of the premises and the
mutual covenants herein contained, it is hereby mutually agreed by
and between the parties hereto as follows:
1. The City agrees to permit the Owners to erect eighty-
four (84) apartment units upon the following described real'estate
referred to as Parcel"."A" on exhibit 'A' attached hereto, which said
exhibit is made a part hereof by reference thereto.

2. The City agrees to permit the owners to erect fifty-
two (52) apartment units in buildings not to exceed two stories in
height upon the following described real estate referred to as Parcel
on Exhibit 'B' attached hereto, which said exhibit is made a part
hereof by reference thereto.
3. The City agrees to permit the owners to erect one hundred
thirty-eight (138) apartment units upon the following described real
estate referred to as Parcel "C" on Exhibit 'C' attached hereto, which
said exhibit is made a part hereof by reference thereto.
Inasmuch as said Parcel "C" .is not the subject matter of
pending litigation, it is agreed that the owners shall file their
petition before the Zoning Board of Appeals of the City of Des Plaines
requesting re -zoning to the Ru4 Multiple Family District and for a
variation to allow one hundred thirty-eight (138) apartment units and
that said Zoning Board of Appeals and the City Council will approve
said petition.
4. The owners, for themselves, their heirs, executors,
administrators, successors and assigns, agree that the following
described real estate referred to as Parcel "D" on exhibit 'B'
attached hereto, which said exhibit is made a part hereof by
reference thereto, shall, subject only to a change in zoning by
affirmative action of the City's Council, be restricted in use to
any one or more of the commercial uses, now or hereafter permitted
in the C-2 Commercial District classification of the Des Plaines
Zoning Ordinance of 1960, as amended, and for no other use whatsoever;
and Owners further agree, for themselves, their heirs, executors,
administrators, successors and assigns, not to seek re -zoning of all

or any part of said Parcel "D" for any other use, including multiple
family, and shall forever forbear the bringing of any legal proceed-
ing, at law or in equity, to attack such classification or to in any
manner seek authority to use said premises for any other purpose
whatsoever.
It is agreed that the undertaking of this paragraph
shall be construed to be a covenant running with the land and a
copy of this Agreement shall be attached to and be made a part of
the Order disposing of the litigation between the parties and shall
be binding upon subsequent grantees and all persons holding under
or assigns of the present owners.
5. It is understood and agreed that all zoning and building

laws and ordinances of the City will be complied with in the erection
of the aforesaid apartment units, except the requirement of square

feet of land area per dwelling unit, which shall be modified to
allow the construction of the stated number of apartment, units for
each parcel of real estate as stated hereinabove.
6., The City agrees to cease the prosecution of the appeal
aforesaid, and the owners agree not to pursue any action on the
appeal bond now on file in said case, and by these presents do
*hereby forever release any and all claims they have or may hereafter
acquire against the City and/or any of its officials, employees or
agents arising out of the aforesaid litigation, appeal or the
subject matter thereof. Both parties agree to execute a stipulation
to dismiss said appeal and to enter an Order, to which this contract
shall be attached as an exhibit, dismissing said appeal.

7. The owners agree that they shall take such steps as
shall be necessary to dedicate Beau Drive as a public street, as
laid out in the proposed Plat of Subdivision of Parcels A and B
as previously approved by the City of Des Plaines.

Mayor Behrel's oral report Mayor Behrel gave an oral report on
Meeting with -Vice President the Conference held in Washington, D.C.
Tubert H. Humphrey with Vice President Hubert H. Humphrey
and Mayors of Cities with thirty to
fifty thousand population. He stated he was very impressed with Vice
,Presidept'Humphrey's intense desire to have better communication with
:‘Urban Communities. The Mayors were taken on an interesting tour of
the White House, met with the various department heads of State in
the,afternoon.and attended a reception in the John Quincy Adams Room
in the evening.
Police Dog Ranger Alderman French presented a letter
addressed to Alderman Bonaguidi,
petition signed by 38 residents who
live in the vicinity of Scott Street near Laura Lane, and a statement
of Sixth Ward Aldermen concerning the housing of Police Dog Ranger.
