07/19/1965d9 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, 'ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, JULY 19, 1965 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by the Mayor, Herbert H. Behrel, at 8:15 P.M. The meeting opened with a prayer by Rev. Ross Ludeman, pastor of the Westminister Presbyterian Church, and the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Ald. French, Martin, Rateike, Szabo, Bolek, Leer, Shillington, Figard, Czubakowski. Ald. Swanson arrived at 8:29 P.M. Present also were City Clerk Rohrbach, Atty. DiLeonardi, Police Chief Kennicott, Fire Marshall Arndt, Superintendent of Public Works Warnicke, Building Commissioner, Regnell,&City Engineer Fletcher. There being a quorum present, the meeting was in order. MINUTES: It was moved by Ald. Shillington, seconded by Ald. Rateike, that the Minutes of the regular meetin(D of July 6, 1965, be approved after the following corrections are made:, Page two, second paragraph under CITY ATTORNEY RETAINED IN TAX INJUNCTION PROCEEDINGS: Change Soo Line Railroad to Chicago & Northwestern Rail- road and in line three remove the word "no" and insert "withdrawn its". Motion carried. OPEN BIDS: Section 56 C.S. rehabilitation Seegers Road. It was moved by Alderman Martin, seconded by Alder- man Leer, that the Clerk open bids on Section 56 C.S., NFT, .for new traffic signals at Thacker and Wolf and of existing signals at Oakton and White, and Wolf and The following bids were received: H -H Electric Co., River Grove, I11. $37,815.71 Commercial Light Company, Chicago, I11. 40,646.58 - Contracting & Material Co., Evanston, I11. 40,957.20 It was moved by Alderman French, seconded by Alderman Bolek, to refer the above bids to City Engineer, Streets and Traffic, and Finance Committees. Motion Carried. OFFICIAL REPORTS: The Clerk submitted reports of the following to be placed on file: Chief Kennicott's second quarter report, City Comptroller's six months report, City Treasurer, and minutes of the meeting of the Des Plaines Human Relations. Commission of June 10, ,1965. Police Dept. acquires German Shepherd dog gram is complete. Progress report 4'1 Watermain & Pumping Station Spread of Dutch Elm Disease Police Chief Kennicott reported that the Pdlice Department has acquired a German Shepherd dog from the Chicago Police Department and will prove very valuable to the department when the training.pro.. City;Engineer reported that the %%'" watermain is half -way under the expressway. Also that work has begun on the: excavation for the pumping station and the concrete should be poured before the month is ended. ° Superintendent of Public Works Warnicke reported that an unprecedented number of trees are plagued with Dutch Elm Disease in the City of Des Plaines this year. He suggested that in order to facilitate removal of these trees at a faster rate, the ordinance be amended and reworded. It was moved by Alderman Leer, seconded by Shillington that the City Attorney confer with the Superintendent of Public Works for the proper wording and amending of the City's Dutch Elm Disease Ordinance. Motion carried. iv Page 2 , 7/1905 Favorable Master's deport ,- Robert rilich,guilder, Zoning case City Attorney DiLeonardi repdrted that the master -in -chancery's findings were in favor of the City of Des Plaines in the Robert Krilich, Builder, Zoning Case. COMMITTEE REPORTS: Alderman Martin, Chairman of the Municipal Approve Street Grant Development Committee made the following and Dedication - report: "Your Committee on Municipal Develop.. Touhy-Mannheim Industrial ment•has investigated the street grant and Subdivision dedication of the Touhy-Mannheim Industrial Subdivision and has found the above=has been approved by the Plan Commission subject to Commonwealth Edison Company approval of certain easements. We, your Committee on Municipal Develop- ment therefore recommend that the Mayor and City Clerk sign said plat of grant and dedication subject totobtaining Commonwealth Edison Company signatures for easements and the Mayor and City Clerk to complete the administrative details." It was moved by Alderman Martin, seconded by Alderman French, to authorize the Mayor and City Clerk to sign said plat in conformance with the abobe report. Motion carried. Kurntze's offer of Alderman Martin, Chairman of the Municipal settlement in zoning Development Committee made the following case. report: "Your Committee on Municipal Develop.. ment has investigated Kuntze's offer.of settlement of the Boning case and has found another offer has been re- ceived for complete settlement. Route #83 frontage will remain C2 Commercial. We, your Committee on Municipal Development therefore recommend that the City Attorney be hereby authorized to reduce the agreement for settlement in writing. We hereby recommend the City Council approve settlement subject to Zoning -Board hearing and legal written settlement." It was moved by Alderman Martin, seconded by Alder- man French that the above report be concurred in. Motion carried. Certify four policemen Alderman Figard, Chairman ofl the Police in Augusts Committee made the following', report: - '"Your Committee :on Police request council concurrance to have the Policezand Fire Commission certify four police- men in August. This is in accordance with our Police expansion program as set up in the 1965 appropriations." It was moved by Alderman Figard, seconded by Alderman Leer, for Council Concurrance in this report. Motion carried. Progress Report Alderman Rateike, Chairman of the Fire Fire Contracts Review Committee, made a progress report on the review of Fire Contracts with North Maine; Hawthorne Rand, and South Maine, stating their attorneys and trustees must confer. Also that Park Ridge Manor volunteered a raise., Committee Alderman Bolek, Chairman of the License, Meeting Health and Inspection Committee, announced that this committee would meet'on July 29th, at 8 -P.M. to discuss the awarding of liquor licenses and taxi -cab licenses. Purchase five (5) Alderman French, Chairman of the Streets radios. and Traffic Committee, made the following joint report of the Streets and Traffic, . Sanitation, and Finance Committees: "Your Committee on Streets and Traffic, Sanitation and Finance has investigated the purchase of five radios•.three for the street department, one for•the sanitation department and 'one fox the water department. Your Committees have investigated the above and found each unit costs approximately $540.00 and authorization is needed by department heads to exceed routine $500.00 authorization. - We, therefore recommend that authorization be granted to department heads tm make the requested expenditures for the required radios without bids. Forestview Lanes Alderman French, Chairman of the Streets and Bowl Driveways Traffic Committee, made the following report: !'Your Committee on Streets and Traffic has investigated Forestview Lanes Bowl Driveways and has found (1) Access to Des Plaines Avenue 3500 feet sodith.of Touhy Avenue requested through two 24' drives. (2) Access is necessary and advisable and (3) there is no need to require council action for such access.. We, your Committee on Streets and Traffic therefore recommend: (1) Superintendent of Public Works be authorized to issue permits for two 24' driveways as indicated on plat plan submitted with this report, and (2) council approve resolution that Superintendent of Public Works be authorized to approve all permits for driveways" up to 35' in size for Commercial and Industrial areas. A change in ordinance is required to effect this change and the City Attorney is requested•to draw up this ordinance to amend 9-3R.2." It was moved by Alderman French, seconded by Alderman Martin authorizing the City Attorney to draft the necessary ordinance. Motion carried. Motion carried. - - Temporary authority It was moved by Alderman French, seconded by to sign driveway Alderman Martin, that the Superintendent of permits Public Works be granted temporary authority to.issue driveway permits without council action not to exceed'35' for Commercial and Industrial uses and 16' for residential areas. Motion carried. Visibility of corners Greenview & Wolf Rds. "Children Crossing" signs at Wolf & Greenview and Prairie & Rose Ave. and the Traffic Commission Ordinance M-13.65' ` Alderman French, Chairman of the City Code Anti -Litter Committee, made the following report: "Your Committee on City Code has investigated the license fees on page nine of Ordinance M-13..65, and has found the City Attorney recommends: 1 year fee $100, 2 to 3 months fee - $50 1 week fee $5 and 1 day fee $2. We, your Committee on City Code therffore recommend amounts be, entered in'Section 10.d, page nine of Ordinance M-13..65 and included in second reading of this ordinance." It was moved by Alderman French, seconded by Czubakowski, that license fees be con- curred in. Motion carried. Swanson voted "NotQ. It was moved by Alderman French and seconded by Alderman Shillington that the visibility of corners at Greenview and Wolf Rodds and the need for "Children Crossing" signs at Wolf and Greenview and Prairie and Rose Avenues be referred to the County Highway Department for study and report. Motion carried. r• OVAL OF BILLS, PAYABLE Alderman Swanson, member of the Finance Committee, presented the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total:$123,127.78: It was moved by Alderman Swanson, seconded by Alder- man French to adopt the resolution. The bill from Yates, Fisk, Haider, &:Burke was questioned to which Mr. Burke addressed the Council, explaining the legal fees involved. Mr. Burke stated that his hope for the future is that his 101 page report of objections to the Master's 300 page report will bring about successful conclusions to this case with Chicago & Northwestern Railwoad. Ordinance M.13..65 It was moved by Alderman Czubakowski and Anti -Litter seconded by Alderman ShillIngton to adopt the Anti•.Litter Ordinance M-13.65. After discussion it was moved by Alderman Martin and seconded by Alderman Rateike to table the previous motion. Motion carried. City Attorney stated that he wo uld research the City Code Book and rewrite the Anti - Litter ordinance. NAYS: ABSENT: Ordinance T-20-65 No .;parking in excess of 15 minutes on West Side of Center, Street from Southerly line of alley between Ashland and Oakwood, south to Oakwood. Motion carried. Resolution: Mayor and City Clerk sign agreement be- tween city and Chicago and Northwestern, Railway Co. re 89 water main. It was moved by Alderman Rateike, seconded py Alderman Figard, that the Mayor and City Clerk be authorized to sign that certain license agreement between the,City of Des Plaines and the Chicago and Northwestern Railway Company re 8" water main under the railway company's freight line tracks near Graceland Avenue.
