MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE ELEANOR ROHRBACH
MEMORIAL COUNCIL CHAMBERS, DES PLAINES
CIVIC CENTER, MONDAY, AUGUST 6, 1990
CALL TO ORDER: The regular meeting of the City Council of the City
of HDes'Plaines, Illinois, was called to order by
Mayor D. Michael Albrecht at 8:05 P.M. in the
Eleanor Rohrbach Memorial Council Chambers, Des
Plaines Civic Center on Monday, August 6, 1990.
ROLL CALL:
Roll call indicated the following Aldermen present:
Childers, Wetter, Schneck, Hardiman, Sarlo, Haupt.
Alderman Christiansen was absent.
Also present were: City Treasurer Fredricks, City Manager Asaro, City
Comptroller Peters, Commissioner of Public Works Matula, Fire Chief
Clark, Police Chief Storm, Municipal Development Director Pagones,
City Engineer Oakley, Human Resources and Services Director Panouses,
and City Attorney Kolman.
PRAYER AND
PLEDGE:
The opening prayer was given by City Clerk McAllister,
followed by the Pledge of Allegiance to the Flag.
PRESENTATION: Plaques of appreciation were given by Frank W.
Rzeszutko, President of the Des Plaines Chamber of
Commerce and Pat Kotnaur, Executive Director,
Des Plaines Chamber of Commerce, to Police Chief Jack
Storm, Commissioner J. Matula and ESDA Representative,
George Weizmann, for their outstanding assistance durinc
the Chamber's Lake Park Festival and July 4th Parade.
MINUTES:
Moved by Sarlo, seconded by Childers, to approve
Minutes of regular meeting of the City Council held
July 16, 1990, as published. Motion declared carried.
Moved by Sarlo, seconded by Schneck, to approve
Minutes of executive session of the City Council held
July 16, 1990. Motion declared carried.
Moved by Sarlo, seconded by Hardiman, to approve
Minutes of special meeting of the City Council held
July 27, 1990, as published. Motion declared carried.
Moved by Sarlo, seconded by Hardiman, to approve
Minutes of executive session of the City Council held
July 27, 1990. Motion declared carried.
BILLS PAYABLE: Moved by Schneck, seconded by Childers, to adopt
the following resolution: BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE
FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE
MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO
MAKE PAYMENT FOR SAME. Total: $993,014.69. Upon roll
call, the vote was:
AYES: 7 -Childers, Wetter, Schneck, Hardiman, Sarlo,
Chiropolos, Haupt

HOLD HARMLESS Moved by Schneck, seconded by Sarlo, to adopt the
AGREEMENT/ recommendation of Finance Committee that Mayor be
PARKING LOT #1: authorized to execute hold harmless agreement with
PlainsBank of Illinois to allow public parking in the
parking lot adjacent to City Parking Lot 01 during
re -surfacing and tank removal on Lot #1 and additional
signage be installed indicating these temporary
arrangements. Upon roll call, the vote was:

Chiropolos, Haupt

FENCE Moved by Schneck, seconded by Hardiman, to adopt the
VARIATION/ recommendation of Building Code Committee to grant
2935 CRAIG: request to install 8' high fence on property located
at 2935 S. Craig Drive. Motion declared carried.
STAIRWAY Moved by Schneck, seconded by Hardiman, to adopt the
DISTANCE/ recommendation of Building Code Committee to grant
OTIS PROJECT: request from Otis Company to allow use of N.F.P.A.
code for stairway distance of 200' instead of City's
requirement of 150' for the Phase 1 parking garage
only for their project on Ellinwood Street (variation
to be included in revised PUD ordinancd). Motion
declared carried.
DRIVEWAY Moved by Schneck, seconded by Hardiman, to adopt the
VARIATION/ recommendation of Building Code Committee to grant
865 S. GOLF request for 28' driveway with a 34' flare at the
CUL DE SAC: curb for property located at 865 S. Golf Cul De Sac.
Motion declared carried.
PATIO Moved by Schneck, seconded by Hardiman, to adopt the
VARIATION/ recommendation of Building Code Committee that
736 YORKSHIRE: entire concrete patio (both sides of house) must be
removed and before new patio is layed the City
Engineer to determine how drainage problem can be
alleviated, and a fine of $500 be levied against
property owner for doing work without a permit and
exceeding allowed lot coverage, for property located
at 736 Yorkshire Lane. Motion declared carried.
FENCE Moved by Schneck, seconded by Hardiman, to adopt the
VARIATION/ recommendation of Building Code Committee to grant
1396 BROWN: request for 6' high solid privacy fence on property
located at 1396 Brown Street. Motion declared
carried.
ZONING CASE Moved by Sarlo, seconded by Childers, to adopt the
90 -31 -PUD recommendation of the Committee of the Whole,
1485 ELLINWOOD: to grant request for variations to Planned Unit
Development by Otis Company for property located at
1485 Ellinwood Street as follows (variations to be
included in revised PUD ordinance, Z-1-90):
1. 8'-6' x 18'-0" parking stall from the required
9'-0" x 19'-0" parking stall size.
2. 24'-0" side driveways in the parking areas from
the required 25'-0" driveway width.
3. Shared parking to be used to fulfill the
residential towers parking requirements.
4. Parking spaces located beneath ramps to have a
4'-0" clearance at the nose of the car (and maintain
a full 7'-0" clearance above the passenger cab) from
the 7'-0" ceiling height required.
5. Utilize a portion of the decorative roof struct-
ure (which will house mechanical operations) for smal
loft mezzanines for the three center apartments on
the top (19th) floor, from the requirement that the
roof top structure solely house mechanical equipment.
6. Dwelling unit below the third floor above ground
level from the limitation prohibiting dwelling units
below the third floor above ground level.
7. Front of 0 feet from the required front yard of
five feet.

Moved by Sarlo, seconded by Haupt, to adopt the
recommendation of Municipal Development Committee to
concur with recommendation of Des Plaines Zoning
Board of Appeals re Case 90-37-V to grant request for
variation to permit erection of addition to existing
garage which would encroach 1' into the required 5'
sideyard with the stipulation that the garage and
addition do not exceed required 720 square feet for
property located at 1690 Cora Street, and City
Attorney be authorized to draft necessary ordinance.

Moved by Sarlo, seconded by Haupt, to adopt the
recommendation of Municipal Development Committee to
concur with recommendation of Des Plaines Zoning
Board of Appeals re Case 90-36-V to grant request for
variation to permit erection of a 20' x 36' garage
which deviates from the maximum dimensions of 24' x
30' for property located at 1411 Van Buren Street,
and City Attorney be authorized to draft necessary
ordinance., Motion declared carried.
Moved by Sarlo, seconded by Haupt, to adopt the
recommendation of Municipal Development Committee to
concur with recommendation of Plan Commission to
approve plat of McKay-Nealis Resubdivision, 2250
(Lot 1) and 2256 (Lot 2) Sprucewood Avenue, and Mayor
and City Clerk be authorized to execute same.

Moved by Schneck, seconded by Sarlo, to adopt the
recommendation of the Committee of the Whole to
allocate an additional $80,000 to accommodate the
nutrition site in the new Park District Community
Center ($800,000 was approved on March 19, 1990
through intergovernmental agreement with Des Plaines
Park District). Upon roll call, the vote was:
AYES: 6 -Childers, Wetter, Schneck, Sarlo,
Chiropolos, Haupt
NAYS: 1-Hardiman

Moved by Haupt, seconded by Sarlo, to adopt the
recommendation of License & Judicial Committee that
the Law Department's Quarterly Report be accepted
as presented. Motion declared carried.
Moved by Wetter, seconded by Hardiman, to adopt the
recommendation of Community Services Committee that
dog runs or enclosures for dogs be located at back
end of property, not closer than 10' of back lot
line; fines of $50 per day be assessed if defication
in yard is allowed to accumulate and not cleaned on
a regular basis; notice of these rules be provided
to owners when they purchase their dog licenses; and
City Attorney be authorized to draft necessary
ordinance. Motion declared carried.
Moved by Wetter, seconded by Hardiman, to adopt the
recommendation of Community Services Committee that
dogs not be allowed in City -owned parks and City
Attorney be authorized to draft necessary ordinance.
