MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, JULY 18, 1988 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines, Illinois, was called to order by Mayor John E. Seitz at 8:07 P.M. in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center on Monday, July 18, 1988. ROLL CALL: Roll Call indicated the following Aldermen present: Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt. Aldermen Muehlenbeck and Hervas were absent. Also present were: City Treasurer Fredricks, City Comptroller Peters, Commissioner of Public Works Matula, Fire Chief Clark, Police Chief Kozenczak, Municipal Development Director Pagones, Acting City Engineer Kaszuba, Human Resources and Services Director Donahue, and City Attorney Smith. PRAYER AND PLEDGE: The opening prayer was given by Chaplain Tim Wepner, Oakton Pavillion Nursing Home, followed by the Pledge of Allegiance to the Flag. INTRODUCTION: Fire Chief Clark introduced Thomas Farinella as the new Deputy Fire Chief replacing George Lechner who recently retired. MINTUES: Moved by Sarlo, seconded by Bonk, to approve Minutes of the regular meeting of the City Council held July 5, 1988, as published. Motion declared carried. BILLS PAYABLE: Moved by Schneck, seconded by Muehlenbeck, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total: $320,555.42. ZONING CASE 88-29-R, 1771 RAND: Moved by Schneck, seconded by Gebert, to delete Warrant 60929 in the amount of $410 and place it on the August 1, 1988 Register of Bills. Upon roll call, the vote was: AYES: 14 -Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt NAYS: 0 -None ABSENT: 2-Muehlenbeck, Hervas Motion declared carried. Moved by Gebert, seconded by Kisslinger, to adopt the recommendation of Municipal Development Committee to concur with Des Plaines Zoning Board of Appeals re Case 88-29-R to grant request to rezone from R-2 Single Family Residence District to R-4 Multi Family Residence District for property located at 1771 Rand Road, and City Attorney be authorized to draft necessary ordinance. Motion declared carried. ZONING CASE 88-30-R, 1215 HARDING: PARKING RESTRICTION/ WAYNE DRIVE: STAFF CON- STRUCTION MGR./ STORM WATER & SEWER IMPROV.: PARKING RESTRICTION/ FOREST AVE.: DRIVEWAY/ 1408 HEATHER: LANDSCAPING/ SITE OF VIET. VET. MEMORIAL MOVING WALL: PURCHASE OF FIRE HOSE: 20. 7/18/88 PAGE TWO Moved by Gebert, seconded by Kisslinger, to adopt the recommendation of Municipal Development Committee to concur with Des Plaines Zoning Board of Appeals re Case 88-30-R to grant request to rezone from C-2 Commercial District to R-5 Multi -Family District for property located at 1215 Harding Avenue, and City Attorney be authorized to draft necessary ordinance. Moved by Chiropolos, seconded by Christiansen, to adopt recommendation of Engineering Committee that there be no parking on the north side of Wayne Drive from 8 A.M. to 5 P.M., Monday through Friday, from 1216 Wayne Drive to 1248 Wayne Drive, and City Attorney be authorized to draft necessary ordinance. Motion declared carried. Moved by Chiropolos, seconded by Christiansen, to adopt recommendation of Engineering Committee that a Staff Construction Manager with an Assistant be hired for a 3 -year period to oversee the construction phase of the Storm Water and Sewer Improvements. Upon roll call, the vote was: AYES: 14 -Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt NAYS: 0 -None ABSENT: 2-Muehlenbeck, Hervas Motion declared carried. Moved by Christiansen, seconded by Sarlo, to adopt recommendation of Engineering Committee that there be no parking on the south side of .the 1500 block of Forest Avenue from 8 A.M. to 6 P.M., daily, and City Attorney be authorized to draft necessary ordinance. Motion declared carried. Moved by Sarlo, seconded by Hardiman, to adopt the recommendation of the Building Code Committee to grant request to allow oversize driveway apron from 16' to 21' at 1408 Heather Lane. Motion declared carried Moved by Bonk, seconded by Childers to adopt recommen- dation of Public Works Committee that the Comptroller, at the direction of the Mayor, negotiate with Lindemann'. Garden Center for the purchase of 12 trees and 60 bushes for the site of the Vietnam Veterans Memorial Moving Wall on Ellinwood Street at a cost not to exceed $3,100. Upon roll call, the vote was: AYES: 14 -Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt NAYS: 0 -None, ABSENT: 2-Muehlenbeck, Hervas Motion declared carried. Moved by Hardiman, seconded by Healy, to adopt recommen- dation of the Public Safety Committee.to award contract for the purchase of twenty (20) 100' lengths of 5" large diameter hose to the bidder who met the specifications, Dolton Fire Equipment Sales, 14414 Irving Avenue, Dolton, IL, in the amount of $13,000. Upon roll call, the vote was: AYES: 14 -Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt NAYS: 0 -None ABSENT: 2-Muehlenbeck, Hervas Motion declared carried. SHELF PRICE MARKING: 21. 7/18/88 PAGE THREE Moved by Adams, seconded by Wetter, to adopt recommen- dation of License & Judicial Committee to grant request from Dominick's Finer Foods and Jewel Food Stores to allow shelf price marking in food stores, that fines of. $500 for an error rate of 5% per $100 for the first offense and $1,000thereafter in any 12 -month period be imposed, and City Attorney be authorized to draft necessary ordinance with consultation of License Officer Hinde. Resident Patricia Homeyer, 1683 White Street, addressed the Council and expressed her disapproval of shelf price marking. Motion declared carried on the vote. Alderman Christiansen voted no. LIQUOR Moved by Adams, seconded by Schiro, to deny request LICENSE that Section 5-34-19 of the City Code re liquor license RESTRICTIONS: restrictions within one hundred feet (100') of any church or school be changed to conform with the State Statutes. Moved by Gebert, seconded by Wetter, to defer this matter to the next Council meeting on August 1, 1988. ORDINANCE Moved by Sarlo, seconded by Bonk, to adopt Ordinance Z-9-88 Z-9-88, AN ORDINANCE GRANTING A PLANNED UNIT DEVELOPMENT REZONING; AND REZONING UNDER THE ZONING ORDINANCE OF THE CITY OF 395 W. TOUHY: DES PLAINES, ILLINOIS. (CASE NO. 88 -24 -PUD -R, 395 W. TOUHY AVENUE). Upon roll call, the vote was: AYES: 14 -Childers, Christiansen, Bonk, Healy, Wetter, Schneck, Kisslinger, Adams, Hardiman, Gebert, Sarlo, Chiropolos, Schiro, Haupt NAYS: 0 -None ABSENT: 2-Muehlenbeck, Hervas Motion declared carried. ALDERMEN At the request of Alderman Childers, Mayor Seitz APPEARING directed the City Attorney to prepare a written opinion BEFORE/ regarding aldermen appearing before and/or attending ATTENDING meetings of the Des Plaines Zoning Board of Appeals. ZB MEETINGS: ORDINANCE Placed on First Reading was Ordinance M-24-88, AN M-24-88 ORDINANCE AMENDING SECTION 9-7-7 OF THE DES PLAINES PARKWAY TREE CITY CODE, TO INCREASE THE RESIDENT COST TO $50.00 FOR REPLACEMENT PARKWAY TREE REPLACEMENT. McConnell to the Library Board replacing Kenneth Reese, term to expire June 30, 1991. Motion declared carried.
