CENTER, Monday, January 21, 1980
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines was called to order by Mayor Herbert H.
Volberding at 8:00 P.M. in the Council Chambers, Des Plaines
Civic Center, on January 21, 1980.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Kolinski, Dwiel, Kehe, Ensign, Henkes, Prellberg,

The meeting opened with prayer by Rev. David W. Jones,
pastor of the First Presbyterian Church, followed by the
Pledge of Allegiance to the flag.
Moved by Kehe, seconded by Sarlo, to approve the Minutes
of the regular meeting held January 7, 1980, as published.

Moved by Ward, seconded by Seitz, to adopt the following
resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $2.99,385.70.

Moved by Koplos, seconded by Sarlo, to adopt the recommenda-
tion of Water and Sewer Committee that the City authorize
the Layne -Western Company, Inc. to make all the necessary
repairs to the bronze bowl assembly removed from Water
Well #4 for the estimated amount of $14,965.37, as stipulated
in proposal dated January 4,1980, and that the bid
advertising procedure be waived. Upon roll call, the vote was

ation of Building Control and Inspection Committee that
the request of Mr. James Ray at 374 S. Anita Street to
install an 8 foot fence along Mt. Prospect Road, be denied.

Moved by Ensign, seconded by Koplos, to adopt the recom-
mendation of Building Control and Inspection Committee
that the letter of credit for Thalmann Subdivision,
Emerson Street, (subdivision bond), be extended for one
year by Council resolution under the condition as set forth
in said letter of credit. Motion declared carried.
Moved by Ensign, seconded by. Meyer, to adopt Resolution
R-6-80, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DES PLAINES EXTENDING THE EXPIRATION DATE OF THE LETTER OF
CREDIT, FOR ONE (1) YEAR, FOR THE THALMANN SUBDIVISION.
Motion declared carried.
Moved by Ensign, seconded by Tomaszewski, to adopt the
recommendation of Building Control and Inspection Committee
that letter of credit (subdivision bond) be extended for
one (1) year by Council resolution under the conditions
as set forth in said letter of credit. Motion declared
carried.
Moved by Ensign, seconded by Tomaszewski, to adopt Resolution
R-7-80, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DES PLAINES EXTENDING THE EXPIRATION DATE OF THE LETTER
OF CREDIT FOR ONE (1) YEAR, FOR SZCZESNY'S THIRD ADDITION
SUBDIVISION. Motion declared carried.
Moved by Ensign, seconded by Meyer, to adopt the recommenda-
tion of Building Control and Inspection Committee that the
letter of credit for Windy Point Subdivision, be forfeited
to the City of Des Plaines and that Frank A. Stape Builders
be held in default, said action to be taken by resolution,
for the following reasons:
1. The easements for Public Utilities were changed and
new easements were created without prior Council approval.
The City of Des Plaines has not accepted these easements
and therefore has presently no authority to do work within
them should such work be required.
2. If the Mayor and City Engineer have the authority to
change these easements without Council approval, then Council
action on the original plat of survey is meaningless and
every subdivision so acted upon, not only in Des Plaines,
but in the State of Illinois, has no validity and nullifies
the requirement of Council approval.
3. If the Mayor and City Engineer do not have the authority
to change the action of the Council, then this action of
changing the easements on their part is invalid and their
signatures have been affixed to a meaningless document.
4. In June, 1977 a request for final inspection was
submitted to the Metropolitan Sanitary District by the �

This statement appeared over each signature: "I Hereby
certify that the project has been completed and approved;
and that to the best of my knowledge and belief, there has
been no violation of Federal, State or Local laws, rules,
regulations and ordinances applicable to this project."
5. In June, 1977, when these statements were made the
original plat of survey was in force. The new purported
and revised plat of survey of this subdivision was not
filed until December 1, 1977.
6. Therefore, we find the storm sewers were installed off
of the original easements and that the attempt to change
these easements was made after the fact in an illegal manner
to make the new locations of the sewers seem legal.

Roy Palmer, representing Frank R. Stape Builders, to
address the City Council.

DES PLAINES FINDING THE WINDY POINT SUBDIVISION IN DEFAULT
OF THEIR LETTER OF CREDIT. Upon roll call, the vote was:

Committee to remove all parking meters in the downtown
area, in zones where no -fee parking exist, City Attorney
to draft necessary ordinances regarding parking restrictions.

of Police Committee to enter into agreement with Scranton-
Gilette Communications for an Off Street Traffic Enforcement
Agreement at 380 Northwest Highway. Motion declared carried.
Moved by Kehe, seconded by Henkes, to adopt the recommendation
of Police Committee to award the bid for Emergency Lights
and Sirens to the low bidder, Constable Equipment Co., Inc.
in the amount of $15,864.86. Upon roll call, the vote was:

tion of Municipal Development Committee to concur in
Zoning Case 79-67-A for a text amendment providing for
Sheltered Care Centers in the C-4 District, allowing
the Des Plaines 12 Step House Committee to file petition
for special use in C-4 District previous to passage of
the necessary ordinance. Motion declared carried.

of Municipal Development Committee not to participate
in the 1980/81 application for Community Development
Bloc Grant funding. Motion declared carried.
Moved by Meyer, seconded by Erbach, to adopt the recommenda-
tion of Municipal Development Committee to pay invoice
submitted by Mr. Richard Beebe, in the amount of $1,175.00
for work in connection with the proposed transportation

MAINTENANCE be authorized to prepare specifications for bidding for
janitorial services for the first floor of the Police
Building, and also to add a line item of $18,000 in the
1980 Police Management Budget under Contractual Services.

THE UNIFORM ALLOWANCES FOR ALL UNIFORMED POLICE PERSONNEL

Department to Motorola Communications and Electronics, Inc.
in the amount of $1,085.00 per month. Upon roll call,

to VFW to hold their Annual Parade on Friday, June 20.

Request of Transcontinental Development Corporation for
approval to allow a temporary sales office building on
the north side of Rand Road between North Elk Boulevard
and Grove Avenue was referred to the Municipal Development
Committee
Moved by Seitz, seconded by Sarlo, to concur with Mayor's
appointment of Mrs. Donna McAllister to the Public Employees
Labor Relations Board, to fill vacancy caused by resignation
of Mr. R. H. Fiddelke, term to expire November 19, 1982.

ORDINANCE Moved by Erbach, seconded by Sarlo, to reconsider the motion
Z-2-80 to pass Ordinance Z-2-80, AN ORDINANCE GRANTING A SPECIAL
1717 Rand Rd. USE TO OPERATE A POST -SECONDARY EDUCATIONAL INSTITUTION
IN C-1 COMMERCIAL DISTRICT, CASE NO. 79 -77 -SU (1717 Rand Rd.)
City Attorney and City Clerk advised the Mayor and City
Council that "Robert's Rules of Order", the parliamentary
rules of the City Council, state that the motion to reconsider
cannot be applied to the vote on this motion, as the vote
taken at the meeting held January 7, 1980, caused something
to be done in the form of publication of the ordinance,
the issuance of a Zoning Certificate, and certified copy
of the ordinance having been sent to the petitioner.
Then moved by Koplos, seconded by Meyer, to amend Section
3 of Ordinance Z-2-80, as follows:
"No medical treatment or methadone treatment shall be
administered at this location." Motion to amend declared
carried.
Moved by Koplos, seconded by Meyer, to pass Ordinance Z-2-80
as amended. Upon roll call, the vote was:
