OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD IN
THE COUNCIL CHAMBERS, CIVIC CENTER,
MONDAY, February 20, 1978
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Volberding
at 8:00 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Szabo, Sullivan, Kehe, Ensign, Leer, Brannigan,
Kisslinger, Birchfield, Erbach, Kraves, Sarlo, Meyer,.
Seitz, Abrams, Ward.
Also present were: City Treasurer Swanson, City Comptroller Assistant Placko,
Commissioner of Public Works Schwab, Assistant City Engineer Perl, Director
of Zoning and Planning Richardson, Acting. Building Commissioner Trost,
Fire Chief Corey, Police Chief Hintz, Health Director Branding, Deputy
Fire Chief Clark, Environmental Officer Lindahl, Senior Citizen Coordinator
Tapson, and City Attorney Hug.
PRAYER &
PLEDGE
MINUTES:
The meeting opened with prayer by Rev. Lloyd Walters,
Pastor of First Christian Reformed Church, followed by
the Pledge of Allegiance to the flag.
Moved by Erbach, seconded by Sarlo, to approve the Minutes
of the regular meeting held February 6, 1978, as published.
Motion declared carried.
DAWN COURT Alderman Abrams announced that he would abstain from voting
SUBDIVISION and refrain from making any statements relative to Dawn
Court Subdivision, as is the attorney for the family
involved in transfer of property recited in said subdivision.
BILLS PAYABLE Moved by Ward, seconded by Seitz, to adopt the recommendation
of Finance and Insurance Committee to adopt the following
resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY
AUTHORIZED TO MAKE PAYMENT FOR SAME: Total, $150,759.31.

COMMUNITY Moved by Ward, seconded by Abrams, to adopt the recommenda-
DEVELOPMENT tion of the majority of the Finance and Insurance Committee
BLOCK GRANT that the Administration finalize the City's application
FUNDS for review at the Public Hearing to be held February 28,
APPLICATION 1978, for Community Development Block Grant Funds, in order
that the City Council can make a decision at the March 6,
1978, meeting. This recommendation followed a preliminary
report on the findings of the Committee. Alderman Seitz
made a minority report, stating he did not agree with
with items 5 thru 9 of the proposed list of activities
and believe the City could prepare a housing assistance
on its own. Upon roll call, the vote was:
AYES: - 7 - Sullivan, Kisslinger, Birchfield, Erbach, Kraves
Abrams, Ward
NAYS: 9 - Koplos, Szabo, Kehe, Ensign, Leer, Brannigan,
Sarlo, Meyer, Seitz

Moved by Szabo, seconded by Leer, to adopt the recommendation
of Municipal Development Committee to grant the request of
J. R. Gottlieb & Associates, Inc. to grant an extension of
the Planned Unit Development zoning for parcels which were
acquired by the Des Plaines Mall Corporation, City Attorney
to draft necessary amendment to the ordinance. Motion
declared carried. Alderman Koplos abstained from voting
as he is a stockholder in the First National Bank of Des e"
Plaines.

tion of Municipal Development Committee to deny the
petition for text amendment to the Zoning Ordinance to
allow game rooms and arcades and similar uses in the
Commercial District regulations. Motion declared carried.
Moved by Sarlo, seconded by Birchfield, to adopt the
recommendation of Streets and Traffic Committee to authorize
Mayor and City Clerk to execute an Addendum to the Joint
Agreement for FAUS project, Rand/Central/Mt. Prospect
Roads dealing with traffic signal maintenance. Upon roll
call, the vote was:

Brannigan, Kisslinger, Birchfield, Erbach.

The letter from the Safety Chairman of Orchard Place PTA
requesting installation of sidewalks on the west side of
Maple Street from Touhy Avenue to Pratt Avenue was referred
to the Streets and Traffic Committee.
Moved by Leer, seconded by Koplos to adopt the recommendation
of Building Control and Inspection Committee to deny the
request for a 144 sq. foot sign at 1227 Elmhurst Road and
the sign company ask the owner to accept a small sign meeting
the 120 sq. ft. requirement. Motion declared carried.
Moved by Leer, seconded by Koplos, to adopt the recommendation
of Building Control and Inspection Committee to deny the
request for an over -sized sign at 795 W. Golf Road and
request the sign company to redesign the sign. Motion
declared carried.
Moved by Leer, seconded by Meyer, to adopt the recommendation
of Building Control and Inspection Committee to allow the
use of trailer as an office at 1407 Redeker Road for a
period of six months upon receipt of a letter from the owner
agreeing to this time period. Motion declared carried.
Moved by Leer, seconded by Meyer, to adopt the recommendation
of Building Control and Inspection Committee to deny the
request of Dry Storage Co. for relief from the Building Code
not allowing spiral stairs. Motion declared carried.
Moved by Leer, seconded by Koplos, to adopt the recommendation
of Building Controls and Inspection Committee to authorize
City Attorney to draft ordinance to adopt Chicago Masonry
Institute Code by reference, to include engineered designed
concrete masonry walls. Motion declared carried.
Moved by Meyer, seconded by Kraves, to adopt the recommenda-
tion of Health and Welfare Committee to adopt Ordinance
M-4-78, re the Senior Citizens Advisory Council upon second
reading later in the meeting. Motion declared carried.
Moved by Meyer, seconded by Ensign to adopt the recommendation
of Health and Welfare Committee to authorize Senior Citizen
Coordinator to file the application for renewal of grant
to fund the Senior Citizen Dental clinic for another year,
to September 30, 1979. Motion declared carried.
Moved by Koplos, seconded by Sarlo, to adopt the recommenda-
tion of Water and Sewer Committee to award the contract for
the purchase of lime to the Marblehead Lime Co. at the rate
of $45.18 per ton. Upon roll call, the vote was:

Moved by Koplos, seconded by Sarlo, to adopt the recom-
mendation of Water and Sewer Committee that the City purchase
required water meters, as requested in Commissioner Schwab's
letter dated February 9, 1978, from the Badger Meter Co.
in the amount of $13,692.00, the usual bid advertising
procedure to be waived in this instance. Upon roll call,
the vote was:

Moved by Abrams, seconded by Kisslinger, to adopt the recom-
mendation of City Code and Judiciary Committee to settle
the suit - Police Officer John Luety Vs City of Des Plaines,
Police Chief Hintz and Lt. James Roel, settling the
Workmen's Compensation claim for $5,000 and receiving the
resignation of Officer Luety from the Police Department,
Corporation Counsel DiLeonardi authorized to proceed with
the settlement. Upon roll call, the vote was:

Kisslinger, Birchfield, Erbach, Kraves, Sarlo,

Moved by Erbach, seconded by Birchfield, to adopt the recom-
mendation of Special Employee Relations Committee to
approve the pay plan for Police Department Supervisors as
submitted in their letter of October, 1977, to remain within
the Pass/Fail system, pay commensurate with the pay step
be retained upon promotion, evaluations be conducted during
April and October and pay raises be effective May 1st of
each year. Moved by Szabo, seconded by Sullivan, to defer
action awaiting input from the City's consultants.
Moved by Erbach, seconded by Birchfield, to adopt the recom-
mendation of Special Employee Relations Committee to deny
the request of the Fire Department to accumulate 120 days
of sick leave. Motion declared carried.
Moved by Erbach, seconded by Kisslinger, to amend the City's
ordinance to allow for payment at 100% of pay rate for all
sick days accumulated over.60, payment at 50% of pay rate
for all sick days accumulated from 31 to 60, and no payment
for less than 31 days upon retirement for all non-union
employees, City Attorney to draft the necessary ordinance.
Moved by Szabo, seconded by Koplos, to amend that the
Administration requested to furnish cost figures, and the
City's consultants furnish information as to the effect
it would have on negotiations prior to Second Reading of
the ordinance. Motion to amend declared carried. Motion
as amended declared carried.
Moved by Erbach, seconded by Meyer, to adopt the recommenda-
tion of Special Employee Relations Committee that no
"Personal Days" be added to the employee benefit package
at this time. Motion declared carried.
Moved by Erbach, seconded by Birchfield, to adopt the recom-
mendation of the Special Employees Relations Committee to
allow employees who receive compensatory time to use said
time for any illnesses of one or two days duration; for
three days or more, the employee must use sick days and
when sick days accumulated are used, compensatory time may
be used. Moved by Szabo, seconded by Leer, to defer action.

DIALER Moved by Kisslinger, seconded by Meyer, to adopt the recom-
SECURITY mendation of License and Inspection Committee to authorize
SYSTEMS the City Attorney to draft an ordinance permitting the use
of Dialer Security Systems, at an annual fee for the user
of $10 per year and for commercial businesses installing
the_ system, the annual fee to be $100 per year, and to
hold the city harmless in all cases including the forced
entry into the premises, to keep the equipment in first
class condition at all times, to make a list of all installa-
tions and users and parties to be contacted, to penalize
or fine a user in case of false fire alarm and removal
from the system for 3 false alarms in a twelve month period,
the message to be short and legible and be subject to our
approval, the equipment to meet or exceed published standards
and the installation be subject to the city's inspection
and approval. Motion declared carried.
YOUTH Moved by Sullivan, seconded by Koplos, to suspend the rules
COMMISSION to allow the appointments to the Youth Commission to be
APPOINTMENTS taken up at this time. Motion declared carried.
Moved by Sullivan, seconded by Seitz, to concur with Mayor
Volberding's appointment of Mrs. Donna J. Becker, 1646
Linden Street, to the Youth Commission to fill the unexpired
term of Mr. Albin Lundquist, term to expire April 30, 1980.
Motion declared carried.

commendation to Mr. Albin Lundquist. Motion declared carried
Moved by Sullivan, seconded by Kehe, to concur with Mayor
Volberding's appointment of Mr. John Stine, principal of
Maple School to the Youth Commission, term to expire
April 30, 1981. Motion declared carried.
