MONDAY, January 16, 1978
CALL TO ORDER: The regular meeting of the City Council of the City of Des
Plaines was called to order by Mayor Herbert H. Volberding
at 8:09 P.M.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Sullivan, Kehe, Brannigan, Kisslinger, Birchfield,
Kraves, Sarlo, Meyer, Seitz, Abrams, Ward. Absent were
Aldermen Szabo, Ensign, Leer, and Erbach.
Also present were: City Treasurer Swanson, City Comptroller Blietz,
Commissioner of Public Works Schwab, Assistant City Engineer Perl, Director
of Zoning and Planning Richardson, Acting Building Commissioner Trost,
Fire Chief Corey, Police Chief Hintz, Health Director Branding, Environmental
Officer Lindahl, and City Attorney Hug.
PRAYER & The meeting opened with prayer by Father John Phinnes, pastor
PLEDGE of St. Mary's Catholic Church, followed by the Pledge of
Allegiance to the flag.
MINUTES:
Moved by Sarlo, seconded by Meyer, to approve the Minutes
of the regular meeting held January 3, 1978, as published.
Motion declared carried.
BILLS Moved by Ward, seconded by Sarlo, to adopt the following
PAYABLE resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED
TO MAKE PAYMENT FOR SAME. Total, $237,583.84. (#9204 in
the amount of $1,381.45 deleted). Upon roll call, the vote was:

Birchfield, Kraves, Sarlo, Meyer, Seitz, Abrams,

UNEMPLOYMENT Moved by Ward, seconded by Sarlo, to adopt the recommendation
INSURANCE of Finance and Insurance Committee that City Council select
the re -imbursement option for unemployment insurance stop-
loss insurance and direct City Comptroller to notify the
State of Illinois by January 31, 1978. Motion declared carried.
Moved by Ward, seconded by Sarlo, to adopt the recommendation
of Finance and Insurance Committee to purchase unemployment
compensation insurance from Stewart -Smith Mid America with
a loss fund of $47,280, at a two year premium of $3.244.00
and further to retain Martin Boyer Companies as consultant
at a fee of $1,290.00 per year. Upon roll call, the vote
was:

EMPLOYEES Moved by Ward, seconded by Sarlo, to adopt the recommendation
CHRISTMAS of Finance and Insurance Committee to approve the expenditure
PARTY up to $2500 for an employee's Christmas Party next year.

Moved by Sarlo, seconded by Koplos, to adopt the recommendation
of Streets and Traffic Committee to accept the bid for the
road grader from Robert Albrecht in the amount of $3,600.00.
Upon roll call, the vote was:

of Streets and Traffic Committee to delete Pennsylvania
Avenue from Dover to Oakton from the snow route ordinance,
City Attorney to draft necessary ordinance. Motion
declared carried.
Moved by Seitz, seconded by Sarlo, to adopt the recommendation
of Fire and Civil Defense Committee to award the bid for
ambulance to Midwest Ambulance Sales in the amount of
$28,450.00. Upon roll call, the vote was:

Birchfield, Kraves, Sarlo, Meyer, Seitz, Abrams,
Ward, Mayor Volberding

Moved by Abrams, seconded by Meyer, to adopt the recommendation
of City Code and Judiciary Committee to approve retaining
Robert DiLeonardi as Corporation Counsel for the year 1978
at an annual fee of $22,500, such sum to be allocated to
his fees as they occur during the year. Upon roll call,, the
vote was:

Birchfield, Kraves, Sarlo, Meyer, Seitz, Abrams,

Moved by Abrams, seconded by Koplos, to suspend the rules
and consider the matter of suit - John Luety, Thomas Richard,
Ralph Tovar and Ronald Diehl VS City of Des Plaines, Chief
of Police Arthur F. Hintz, Alderman Kenneth A. Kehe, Alderman
Robert M. Kraves, Alderman Carmen J. Sarlo, Alderman Alan M.
Abrams and Des Plaines Joint Committee comprised of its City
Code Committee and Police Committee - complaint for
declaratory relief in the police investigation matter, and
direct City Attorney Hug and Corporation Counsel DiLeonardi
to defend the named defendants in the suit. Upon roll call,
the vote was:

Birchfield, Kraves, Sarlo, Meyer, Seitz, Abrams,

The meeting scheduled for Tuesday, January 17, 1978, was
cancelled and Chief Hintz directed to inform police officers
not to be present.

Moved by Szabo, seconded by Meyer, to adopt the recommendation
of Municipal Development and Building Control and Inspection
Committees not to implement Ordinance M-45-77, creating a
Municipal Development Department. Motion declared carried.

Moved by Kraves, seconded by Koplos, to reconsider motion
to adopt Ordinance B-2-77, AN ORDINANCE AMENDING ARTICLE
XXXVII OF THE BUILDING CODE HAVING TO DO WITH ELECTRICAL
REQUIREMENTS BY ADDING THERETO A NEW SECTION 37.11 ADOPTING
BY REFERENCE CHAPTER 86 OF THE CHICAGO ELECTRICAL CODE AND
BY REPEALING SECTION 37.3 HAVING TO DO WITH APPROVAL BY THE
COMMISSIONER. Motion declared carried. Moved by Szabo,
seconded by Koplos, to adopt the recommendation of Building
Control and Inspection Committee to amend the ordinance
as follows: By adding the following provision to the end
of Section 37.11-1: "Strike the existing period and add the
following language: "and except that the following sentence
shall be added to Section 86-22: after the effective date
of this ordinance, each new applicant for certification as
supervising electrician in the City of Des Plaines, and each
existing certified supervising electrician prior to renewal
of the certificate of registration of each electrical
contractor in the City of Des Plaines, shall be required to
take and pass an examination as provided for in this section
before each supervising electrician may be certified."

motion to adopt Ordinance B-2-77, as amended, the vote was:

Moved by Szabo, seconded by Koplos, to adopt the recommendation
of Building Control and Inspection Committee to authorize
City Attorney to draft necessary ordinance establishing
an appeals procedure in rule of electrical inspection
department of the Building Department with respect to
provisions of the Electrical Code. Motion declared carried.
Moved by Szabo, seconded by Meyer, to adopt the recommendation
of Building Control and Inspection Committee to adopt
Ordinance M-46-77 following second reading. Motion declared
carried. Moved by Kraves, seconded by Seitz, to adopt
Ordinance M-46-77, AN ORDINANCE AMENDING TITLE V OF THE CITY
CODE HAVING. TO DO WITH BUSINESS REGULATIONS BY REPEALING
CERTAIN SECTIONS HAVING TO DO WITH ELECTRICAL CONTRACTORS.

AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
DES PLAINES, ILLINOIS, CASE No. 77-58-R, property located
at 1745-55 Rand Road. Moved by Meyer, seconded by Sarlo,
to amend the motion to adopt conditioned upon the receipt
of declaration of restricted covenants. Motion to amend
declared carried. Upon roll call, on motion to adopt Ordinance
Z-33-77, the vote was:

AMENDING THE ZONING ORDINANCE OF THE CITY OF DES PLAINES,
ILLINOIS, CASE No. 77-47-R, rezoning property located at
the northeast corner of River and Central Roads to "I"
Institutional District.
Placed on First Reading was Ordinance Z-2-78, AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF DES PLAINES,
ILLINOIS, CASE NO. 77-63-R, property located at 2800 Des
Plaines Avenue.

of Ordinance Z-3-78, an ORDINANCE GRANTING A VARIATION UNDER
THE ZONING ORDINANCE OF THE CITY OF DES PLAINES, ILLINOIS,
CASE NO. 77-66-V, property located at 1464 Algonquin Road.

Moved by Koplos, seconded by Meyer, to amend Ordinance M-1-78
as follows: by adding the following sentence to the end
of Section 1:. "However, if any lot existing on the effective
date of this ordinance is sub -divided, each new lot shall
pay a connection fee prior to tapping on to said watermain
in the amount computed by multiplying the unit cost of $15.67
per foot by the number of feet on the shortest dimension
of each new lot. After the first year from the date of
this ordinance, the connection fees in Exhibit "A" will be
increased by 6% per year compounded annually." Motion

Letter from Mr. Richard F. Jaral for a Des Plaines livery
license was referred to License and Inspection Committee.
City Clerk notified Council that bids for Lime and Lime
Sludge Removal would be received January 31st in the City
Clerk's office at 3 P.M.
COOK CO. City Council requested that Director of Zoning and Planning
ZONING DOCKET attend the hearing on Cook Co. Zoning Docket 3080, amending
3080 the text of Cook County Zoning Ordinance.
