MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE ELEANOR ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, FEBRUARY 1, 1982 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor John E. Seitz at 8:06 P.M., in the Eleanor Rohrbach Memorial Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Muehlenbeck, Kolinski, Dwiel, Kehe, Ensign, Wetter, Prellberg, Kisslinger, Adams, Erbach, Tomaszewski, Dini, Chiropolos, Bonaguidi, Ward, Egan. Also present were: City Treasurer Swanson, City Comptroller Blietz, Administrative Assistant Taylor, Commissioner of Public Works Matula, Acting Health Director McIntosh, Fire Chief Gedroic, Police Chief Alfano, Building Commissioner Trost, Planning and Zoning Director Richardson, Acting City Engineer Crowley, Environmental Officer Lindahl, and City Attorney Smith. PRAYER AND PLEDGE: PRESENTATION, BEAUTIFICATION COMMISSION AWARDS: MINUTES: LIABILITY INSURANCE: BILLS PAYABLE: The meeting opened with prayer by Pastor James Bouman of the Immanuel Lutheran Church, followed by the Pledge of Allegiance to the Flag. John Brennan, Chairman of the Beautification Commission, presented "Business For Beauty" awards to: Holy Family Hospital, 100 N. River Road; Refrigeration Service Engineers Society, 960 Rand Road; Teletronics Video Service, 2440 S. Wolf Road, and "Improved For Beauty" awards to: Rollies Restaurant, 1900 E. Touhy Avenue and Maaco Auto Painting, 1001 N. Northwest Highway. Mayor Seitz congratulated these firms for winning the awards and then expressed the City's appreciation and gratitude to the Beautification Commission, which works without pay, to make our community look the best it can. Moved by Tomaszewski, seconded by Ward, to adopt the Minutes of the regular meeting of the City Council held January 18, 1982, as published. Correction: Page Two, paragraph 5, line 2, add "/Plumpers" after Tas Tee Dawg, and line 4, add "/Plumpers" after Dawg. Following corrections, motion to approve declared carried. Moved by Ward, seconded by Ensign, to approve an increase of $1,500 in the annual fee charged by R. L. Kautz to handle our liability claims to now total $19,080 annually. Upon roll call, the vote was: AYES: 15-Muehlenbeck, Kolinski, Dwiel, Kehe, Ensign, Wetter, Prellberg, Kisslinger, Adams, Erbach, Tomaszewski, Dini, Chiropolos, Bonaguidi, Ward. Moved by Ward, seconded by Prellberg, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $529,437.53. Upon roll call, the vote was: AYES: 16-Muehlenbeck, Kolinski, Dwiel, Kehe, Ensign, Wetter, Prellberg, Kisslinger, Adams, Erbach, Tomaszewski, Dini, Chiropolos, Bonaguidi, Ward, Egan. TEXT AMENDMENT CABLE TV EASEMENT PROVISIONS WOLF & CENTRAL ROADS LITIGATION LIQUOR LICENSE, CHATEAU RAND 900 E. RAND RD. III LIQUOR LICENSE, COLUMBUS FOOD MART 1651 RAND RD. 2/1/82 PAGE TWO 201. Moved by Ward, seconded by Ensign, to approve the 1982 Administrative Budget submitted by the Mayor with an adjusted increase of $16,178, as recommended by the Finance Committee, which totals $22,929,246. Upon roll call, the vote was: AYES: - 16-Muehlenbeck, Kolinski, Dwiel, Kehe, Ensign, Wetter, Prellberg, Kisslinger, Adams, Erbach, Tomaszewski, Dini, Chiropolos, Bonaguidi, Ward, Egan NAYS: - 0 -None ABSENT: 0 -None Motion declared carried. Moved by Erbach, seconded by Kisslinger, to adopt the recommendation of the Municipal Development Committee, to concur with the Zoning Board of Appeals, to grant the rezoning of property located at 769 Holiday Lane from R-2 Single Family Residence to C-2 Commercial, and City Attorney be authorized to draft the necessary amendment to ordinance. Motion declared carried. Moved by Erbach, seconded by Kisslinger, to adopt the recommendation of the Municipal Development Committee, to concur with the Zoning Board of Appeals and the Plan Commission, to approve text amendment to Zoning Ordinance creating special use for congregate living center in Commercial Districts, with change in requested parking requirements from 1 per 4 units to 1 per 3 units, and grant the special use requested in this zoning case, and authorize City Attorney to prepare the necessary ordinance. Motion declared carried. Moved by Erbach, seconded by Tomaszewski, to adopt the recommendation of the Municipal Development Committee that the City Attorney be authorized to prepare the necessary ordinance to amend the City Code to include the City's cable TV franchisee in easement uses as required under Section 9-12-6(N). Moved by Bonaguidi, seconded by Erbach, to adopt the recommendation of the City Code & Judiciary Committee that because of time requirement the Wolf & Central Roads litigation be referred to Klein, Thorpe and Jenkins, Ltd. Upon roll call, the vote was: AYES: - 15-Muehlenbeck, Kolinski, Dwiel, Kehe, Ensign, Wetter, Prellberg, Kisslinger, Adams, Erbach, Tomaszewski, Dini, Chiropolos, Bonaguidi, Ward, NAYS: - 1 -Egan ABSENT: 0 -None Motion declared carried. Moved by Kisslinger, seconded by Kehe, to adopt the recommendation of the License and Inspection Committee, to grant a Class G (Banquet Hall) liquor license to the Chateau Rand, 900 E. Rand Road, and authorize the City Attorney to draft the necessary ordinance. Motion declared carried. Moved by Kisslinger, seconded by Dwiel, to adopt the recommendation of the License and Inspection Committee, to grant a previously denied Class B Liquor License to Columbus Food Mart (Koutavas Enterprises, Inc.). The applicant has provided sufficient documentation to the Committee to reverse their previous denial. The Committee further recommends that all department heads closely monitor this operation to insure all necessary compliance prior to granting of this license. City Attorney to draft the necessary ordiance. Motion declared carried. ROHRBACH MEMORIAL 2/1/82 PAGE THREE Moved by Kisslinger, seconded by Kehe, to grant permission to the Des Plaines Mall Merchants Association to conduct a "Shopper's Bingo" in the Mall on Saturday, afternoon, February 20, 1982, under the condition that they meet all legal requirements of the City. Motion declared carried. Moved by Dwiel, seconded by Kehe, to adopt a resolution to honor Mrs. Florence Jannusch, 1266 Center Street, for her 27 years of faithful service to the community as a school crossing guard. Mrs. Jannusch will retire on February 12, 1982. Moved by Kesslinger, seconded by Kehe, to pass Ordinance M-2-82, AN ORDINANCE AMENDING SECTION 6-2-5 OF CHAPTER 2 TITLE VI, OF THE DES PLAINES CITY CODE PROVIDING FOR THE LICENSING OF LOTTERIES AND RAFFLES. Moved by Chiropolis, seconded by Kolinski, to amend the Ordinance to delete the $10.00 fee, Section 6-2-5(I), thereby making the prize up to but not exceeding $1,000 at no fee and all other fees remaining the same as indicated in subject section. Motion to amend declared carried. Alderman Egan moved to further amend this Ordinance to delete non-profit organizations from paying any fees. Motion was not seconded. Alderman Wetter reported to the Council that the Bertha Eleanor Rohrbach Memorial Committee has chosen nationally known artist Walter Parke to paint an oil portrait of Des Plaines' late City Clerk to hang in the Council Chamber named in her honor. The portrait will be presented to the city by friends of the late City Clerk including members of Soroptimist International of Des Plaines. Moved by Tomaszewski, seconded by Wetter, to hold the regularly scheduled Council meeting on Monday, February 15, 1982, even though it is one of the City's legal holidays. Motion declared carried. Moved by Tomaszewski, seconded by Dini, to pass Ordinance T-1-82, AN ORDINANCE AMENDING SECTION 10-7-4 OF THE DES PLAINES CITY CODE, HAVING TO DO WITH YIELDING THE RIGHT-OF-WAY TO TRAFFIC, AND ADDING THERETO THE INTER- SECTION OF HIGHLAND DRIVE AND ASH STREET. Alderman Ward expressed his concern that ordinances are being waived First Reading without sufficient justification and this procedure should not be used without such justification. Moved by Tomaszewski, seconded by Dini, to withdraw the motion. (Ordinance T-1-82 held on First Reading) Moved by Kisslinger, seconded by Prellberg, to waive First Reading and place on passage Ordinance T-2-82. Motion declared carried. Alderman Ward voted no. Moved by Kisslinger, seconded by Prellberg, to pass Ordinance T-2-82, AN ORDINANCE AMENDING SECTION 10-5-18 'OF THE DES PLAINES CITY CODE, DELETING THEREFROM DULLES ROAD (FROM BRADLEY TO ELMHURST ROAD) AND ADDING THERETO DULLES ROAD (FROM BRADLEY TO BEAU DRIVE); AND FURTHER AMENDING SCHEDULE I OF SECTION 10-5-4 OF THE DES PLAINES CITY CODE, ADDING THERETO "ALONG THE NORTH SIDE OF DULLES ROAD, BETWEEN BEAU DRIVE AND ELMHURST ROAD" AS NO PARKING AT ANY TIME.
