MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE CITY COUNCIL CHAMBERS, DES PLAINES CIVIC CENTER, MONDAY, May 4, 1981 CALL TO ORDER: The regular meeting of the City Council was called to order by Herbert H. Volberding, Sr., at 8 P.M. in the City Council Chambers, Des Plaines Civic Center. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Kolinski, Dwiel, Kehe, Ensign, Whetstone, Prellberg, Kisslinger, Birchfield, Erbach, Tomaszewski, Sarlo, Meyer, Seitz, Ward, Egan. Ernest Grant, pastor of First Congregational Church, followed by the Pledge of Allegiance to the flag. Moved by Tomaszewski, seconded by Sarlo, to approve the Minutes of the regular meeting held April 20, 1981, as published. Correction: Page Three, last paragraph change "one 3/4 ton four wheel drive pick-up"to "two 3/4 ton four-wheel drive pick-ups"; Add Alderman Kehe to Aye roll call votes, pages two thru seven. Following corrections, motion declared carried. Moved by Sarlo, seconded by Tomaszewski, to approve the Minutes of the two special meetings held Tuesday, April 28, 1981, as published. OKTOBERFEST Moved by Erbach, seconded by Tomaszewski, to adopt the Herbert H.- recommendation of Building and Grounds Committee that Behrel City Council approve use of Herbert H. Behrel Parking Parking Plaza for Oktoberfest on August 14, 15, 16, 1981 as Plaza requested by Des Plaines Area Jaycees, subject to the following requirements: 1. Des Plaines Area Jaycees will provide a packer truck, small mobile dumpsters, and 55 gallon drums; professional cleaning service and portable toilets as indicated in letter dated April 24, 1981 2. Packer truck shall be parked in Ellinwood Satellite Parking Lot 3. Mini -carnival shall close at 10:00 P.M. each evening 4. Jaycees will adhere to all requirements regarding sales of beer and wine as set forth by the Mayor as Liquor Commissioner 5. Behrel Parking Plaza by Des Plaines Jaycettes for Arts and Crafts Show, August 14, 15, 16, 1981. ELECTRICAL Moved by Erbach, seconded by Sarlo, to adopt the recommenda- WORK tion of Building and Grounds Committee that the Building CIVIC CENTER Department prepare the proper specifications for electrical sork in the Civic Center, to be reviewed and approved by the Committee prior to advertising for bids. RESIGNATION Moved by Koplos, seconded by Sarlo, to accept resignation -Ald. John Seitz of Alderman John E. Seitz, Seventh Ward, due to fact that he will be seated in the Office of Mayor at this meeting. Motion declared carried. VETO Mayor Herbert H. Volberding, Sr. submitted his veto ORDINANCES message vetoing Ordinances M-24-81, M-25-81, and M-26-81 M-24-81 passed at the Special Meeting held April 28, 1981. M-25-81 Discussion was held relative to the legality of the message M-26-81 being submitted by Mayor Volberding at a meeting held on the same day that the Mayor elect assumes the Office of Mayor. City Attorney Smith stated for the record that in 1979, Chapter 24 of Illinois Revised Statutes was amended to allow municipalities to adopt an ordinance to change the beginning of the term of officials elected in April, under the new election consolidation laws, from the first meeting held in April following the election to the first meeting, either special or regular, in May and in his opinion the term of Mayor Elect Seitz began at 8 P.M. this evening. City Attorney further recommended that the City Council decide at this meeting whether or not the veto is valid or not and that it could occur. He stated that the City Council has two options: 1) not recognize the veto, or 2) to reconsider the ordinances at the next meeting and override the veto. Discussion followed as to whether or not it would be possible to reconsider the ordinances at this meeting to which City Attorney replied that the City's ordinance requires that reconsideration take place at the meeting following the meeting at which the veto message is read. Moved by Meyer, seconded by Koplos, that City Council rule the veto "not valid". Upon roll call, the vote was: AYES: - 7 - Koplos, Kisslinger, Birchfield, Sarlo, Meyer, Seitz, Ward NAYS: 9 - Kolinski, Dwiel, Kehe, Ensign, Whetstone, Prellberg, Erbach, Tomaszewski, Egan ABSENT: 0 - None Motion declared lost. ADJOURNMENT: Moved by Kehe, seconded by Ensign, that the meeting of the City Council adjourn until following the swearing- in -ceremony for newly elected officials. Motion declared carried.
