file with City Clerk) The motion was made by Alderman Prickett and seconded
by Tures to adopt the resolution. The Mayor put the question and the Clerk
called the roll with the following results: Ayes: Alderman Bell, McKay,
Rateike, Dunlap, Wright, Tures, Neff, Wexler, Figard, Prickett, Tistle and
Massman. Nays: None. The Mayor declared the motion carried.
PREMIER ROSE-BAUSKE REZONING. The Clerk read the recommendation of the
Zoning Board on the above. The Council allowed the following to speak:
Mr.K.Meyer, Attorney of School Board; Mr. F; Opeka, Attorney for Park
District; Mr. Lawton for Bauske;AIr. Mellman for Premier -Rose; Mr. Wyman,
President School Board; Mr. Brandel, purchaser of property.
Mr. K. Meyer presented an ordinance based on Plan Commission recommendation
and the Council placed some on first reading. The Park District requesting
the property they intend to purchase should be Residential not Industrial.
The Zoning Board recommendation was confusing and was referred to City Attorney
for classification.
ADJOURNMENT. In order to rush the rezoning for the School Board the motion
was made by Alderman Prickett and seconded by Bell to adjourn to Monday,
October 13, 1958 at 8:00 P.M. The motion was voted upon by'adclamation.

DES PLAINES, ILLINOIS HELD IN COUNCIL
ROOM, CITY HALL OCTOBER 11L1958 at 8:00 P.M.
CALL TO ORDER. The meeting was called to order by the City Clerk with Alderman
Bell, McKay, Dunlap, Tures, Wright, Neff, Wexler, Prickett and Massman responding
to roll call. The Clerk informed the Council the Mayor was out of the City
on business and a Mayor pro tem was to be appointed.. On motion by Alderman
Tures and second by Dunlap the Council approved the appointment of Alderman
Prickett as Mayor pro tem.
BAUSKE-PREMIER ROSE ZONING ORDINANCE. There being only nine Alderman, Mr. K.
Meyer asked to have the ordinance be deferred to next Monday s meeting. It '
was then suggested to discuss the ordinance and to find out about any other
agreements. Alderman Tistle and Rateike appeared at this time. Commissioner'
Feulner of the Park District presented a letter which the Clerk read regarding
the agreement made with Mr. Brandell regarding the lana which the Park District
desires. After considerable discussion the ordinance was referred to the
Attorney to make some changes and copies are to be given to the Aldermen
before next Monday's meeting.
REZONING RECOMMENDATION 10 to 1564 Park Place. The Clerk read the following

2 That the property to the east consists of the Chicago & North 'Western Railway
tracks and to the east of the tracks is the Meyer Coal & Material Company.

Chicago and Northwestern Railway property north of Thacker Street - Continued:

4. That to the south is "Commercial" and "Residential".
5. That to the west, the land is undeveloped with the exepption of the City '
Filtration plant at the south end near Thacker Street.
6. That the south 150 -feet fronting on Thacker Street should be zoned "Commercial"
for use as a convenience shopping center for the residents of the area.
7. That the Chicago and North Western Railway has promised to deed to the City
of Des ]Plaines the west ten feet of the property in question, except the portion
adjacent to the City Filtration Plant at the south end. This ten -foot strip '
may be landscaped with screening plantings and will act as a legal barrier to
traffic between the 'Industrial" area to the east and the "residential" area
to the west.
8., That in addition to the ten -foot strip to be deeded to the City of Des Plaines,
the Chicago and North Western Railway has promised to dedicate the contiguous 33
feet as a public Street.
9. That the present "Industrial I-2" zoning ordinance requires that, "' No
building shall be constructed closer than fifty feet from the front line of
said premises.'" the works "' front line of said premises'" in this case 'is
interpreted as meaning the easterly boundary of the 33 -foot strip to be dedicated
as a public street.
10. That the ten -foot strip to be deeded to the City, together with the
33 -foot strip to be dedicated as a public street; also, the fifty -foot
setback from the easterly boundary of said street (Totalling 93 feet)
should remain "Single Family Residential" and will effectively prevent any
future consideration of the property to the West`as "industrial"..
11. That the Chicago and North Western Railway has promised to deed to the
City of Des Plaines a well -site at or near the northwest corner of their
property.
12. That the property immediately adjacent to the railroad tracks and also
across the tracks from the Meyer Coal and Material Company is not suitable
for "Residential" use.
13. That the provisions of the "I-2 Light Industrial" use zoning ordinance
are such that the nearby residents will not be harmed by thproposed zoning
change.
14. That there were many objectors to "Industrial" zbning:'for the.entiretract.
15. That there was considerable animosity on the part of nearby residents
toward the operation of the Chicago and North Western Railway due to the
blockage of crossings and the noise of operation. The irritating characteristics
of railroad operation were not considered relevant to the land use of the
property but rather tended'to prove that the location of homes next to railroad
tracks should be avoided expecially when a, coal and material yard is on the
other side of the tracks.
16. The evidence introduced to prove the desirability of "Residential" use for
the property in question indicated that such homes would present'a planning
problem due to the proximity of the railroad tracks and the material yard.
17. That no evidence was introduced to show the decrease in value of single-
family homes presently adjacent to "Industrial" areas -such as homes on the
west side of NasonLane, the south side of Washington Street (east. of Wolf
Road), or the west side of Garla n d Place.
18. That the remaining area as follows: a/ 2277.9 feet on the east - contiguous
to the railroad ,tracks. b/ 335.12 feet (More or less) on the south contiguous
to recommended "Commercial" area. c/ 2276.6 feet (more or less):on the west -
contiguous to "Single Family Residential". d/ 342.52 feet on the north -
contiguous to the park area is recommended to rezoning to "I-2 Industrial".
19. That the evidence presented was convincing as tothe desirability of
Granting this rezoning from "Residential" to "Industrial" on the above-
described tract of land.

driveway of First National Bank on Center Street granted.
THIRD AVENUE APPROVED ARTERIAL STREET NUMBER 24. The Clerk reported the Highway
Department approved to designate Third Avenue as Arterial Street Number 24.
LOADING ZONE' ORDINANCE. The motion was made by Alderman Prickett and seconded by
Rateike to repeal the "Loading Zone Ordinance". The motion and second was
withdrawn and the ordinance will be,brpught.up at next meeting.
ADOPT STOP SIGNS ORDINANCE MAPLE STREET AND PRATT AVENUE. The Clerk read for
second reading the above ordinance. The motion was made by Alderman Tistle
and seconded by Massman to adopt the ordinance. The Mayor pro tem put the

ADOPT RESOLUTION ON ANNEXING FOREST PRESERVE PROPERTY. The Clerk read the
above resolution. The motion was made by Alderman. Dunlap and seconded by
Rateike to adopt the resolution. The Mayor pro tem put the question and the
Clerk called the roll with the following results: Ayes: Alderman Bell, McKay,
Rateike, Dunlap, Wright, Tures, Neff, Wexler, Prickett, Tistle and Massman. Nays:

LICENSE AGREEMENT WITH CHICAGO AND NORTHWESTERN RAILWAY WATER MAIN. The
Clerk informed the Council he had an agreement from the Chicago and Northwestern
Railway regarding water main under track at Howard Avenue. On motion by
Alderman Dunlap and second by Tures the Council authorized the Mayor and
City Clerk to sign the agreement.
ENGINEER FLETCHER LETTER ON WATER MAIN. The Clerk read the following letter:

The 12 inch watermain in Howard Avenue has been extended west to Wblf Road,
and the 10 inch watermain in Wolf Road has been extended south to within
1337 feet of Howard iivenue.
In order to complete the circuit and thereby improve the distribution system,
we should extend the 10 inch main in Wolf Road south to connect with the
12 inch main in Howard ave.
The estimated cost of this work is $11,000.00 and Butler Bros. will pay
onehalf of it. The main fronts their property but is not essential to them became
of existing mains on two sides of their property. I believe this to be a fair
offer and recommend that it be accepted.
The other side of the street is school property and since the school has
already extended the main to their new building site, I recommend that this
part by paid by the City of Des Plaines.
Please refer this to the Water Committee for study and recommendation.

' PETITION FOR LUXURY HOUSING. The Clerk read the following petition with about
100 names:
On behalf of the residents of the neighbors with property adjoining the
property immediately west of Cumberland Terrace, bounded by Golf Road on
the North, Mt. Prospect Road on the west, Westgate Road on the east and extending
south almost to Dempster Street, I, wish to propose that the property be
considered for the purpose of luxury housing and that it be zoned R-1 for
that purpose.

THOMAS P. CONWAY LETTER. The Clerk received a copy of letter from the
' above, which was addressed Cook County Highway regarding cur and gutter
on Mount Prospect Avenue north of Northwest Highway. The letter Sas referred
to the'Street Committee.
SIGN FOR SQUARE DEAL SHOE STORE. The Clerk received the application for above
sign. The application was referred to Building Control and Inspection Committee.
' ANNEXATION PLAT LOT "C" IN TRIER'S SUBDIVISION. The Clerk stlbmitted the above
plat. On motion by Alderman McKay and seconded by Dunlap the plat was referred
to the Municipal Development Committee.
Alderman McKay reported Chief Kennicott requested to allow Holmes Motor Company
to hood three parking meters for their opening October 17th, 18th and 19th
for showing 1959 models. The request was granted.
ALDERMAN MARTIN'S RESIGNATION. The Clerk read the following:
It has beam my good fortune to have been appointed manager of the Stambaugh
Supply Division of Stambaugh -Thompson Company, Youngstown, Ohio.
This, of course, makes it necessary for me to resign my commission as
Alderman of the 4th ward.
The three and a half years I have served have been a great pleasure and
privilege to me. I regret very much having to leave Des Plaines. I wish
you and the fine people of Des Plaines a most sucessful future.

resignation with regret and the Mayor was requested to write a letter to

1100.00 FOR JUNIOR COUNCIL EXPENSE. Alderman Massman reported that Alderman
Figard requested him to report on Junior Council to be installed November 8,, 1958,
and ask permission to spend $100.00 for badges and other items. The motion was
made by Alderman Massman and•seconded by Rateike to approve the expenditure.
The Mayor pro tem put the question and the Clerk called the roll with the
following results: Ayes: Alderman Bell, McKay, Rateike, Dunlap, Wright, Tures,
Neff, Wexler, Prickett, Tistle and Massman. Nays: None. The Mayor pro tem

PETITION ON VIOLATION. Alderman Bell presented.the following petition signed
by 46 people:
As residents and property owners in the immediate vicinity of the commercially
zoned property on Des Plaines Avenue just South of Oakton Street, we wish to
individually and collectively protest the violations being committed by the
users of that property. These violations, being committed by the Citadel
Construction Company (Thomas W. Glick and Company), 1680 Des Plaines Avenue;
Industrial Gas and Equipment Company, 1634 Des Plaines .Avenue; or Demetre's
Snack Shop, 1640 Des Plaines Avenue and other commercial property owners in
the area are as follows:
1. A Garage is being used for construction of various assemblies while
trucks and construction equipment are•being parked in an open field immediately
adjacent.
2. Roof of a building being used for storage of building materials.
3. Parkways between sidewalks and streets being used a parking spaces, others
being used a parking places on which food is being served.
4. Residential properties in rear of buildings being used as trash dump, ,
driveways and storage areas.
5. Continual sewer odors in front of buildings.
6. A one way street has been started in the middle of a block to servemone
business only. This is city property and must be used to serve the good ,of
all business and residences of a community.
7. Trucks, cars and service vehicles continually driving over curbs and
side walks where no drive ways exist.
8. Old truck trailer in rear of building being used for storage of explosive
type of merchandise.
9. Deliveries and•shipments being made at all hours.of day and night,
disturbing the peace in reaidential area adjacent.
10. The City will not allow the connections of roof drains to the sewers on
new residences while an Auto Shop building now being constructed at Kennicott
and Des Plaines Avenue has a sewer connected directly. Concrete block being
used for the construction of this building is being stored in front of the

TO ADVERTISE BIDS FOR 277 PARKING METERS. On motion by Alderman Wexler and
second by Tures the Council approved to advertise for 277 Parking Meters.
ADJOURNMENT. The motion was made by Alderman Bell and seconded by Tures to
adjourn. .The motion was voted upon by acclamation.
