Installation is now under way and should be completed some time Wednesday,

WEIDENAN REPORT ON CIVIL DEFENSE OBSERVATION TOWER. The Mayor read the report
and informed the Council he instructed Mr. Weideman to complete the prodect
which had been estimated at $950.00 but the elimination of some items was
reduced to $200.00.
The Mayor read a report from Mrs. Willer on inspection Mr. Kasbolm, 1340
Lee Street. The Mayor ordered Chief Kennicott to see the fowl were removed.
CIVIL DEFENSE COMMITTEE. On motion by Alderman Prickett and second by
Callaghan the Council approved the Mayor's report of the above new committee.
The City attorney to draft an ordinance.
FOUR-WAY STOP REQUESTED TOUHY AND SCOTT STREETS. On motion by Alderman Bell
and seconded by Massman the City Clerk was instructed to write the State
Highway Department requesting four-way stop or traffic lights at Scott and
Touhy Avenue. Also, lower speed limit between Mannheim and River Roads.
The Mayor referred the complaint of rockets to the Youth Activity Committee.
Alderman Neff requested the stopping of hard ball playing a
School. The Cleft to contact Park District or School Board

CALL TO ORDER. The meeting was called to order by the CitylClerk due to absence
of Mayor with Alderman Massman, Bell, Prickett, Callaghan, Rateike, Dunlap,

motion by Alderman Figard and second by Neff the Council appointed Alderman
McKay, Mayor pro tem.

APPROVAL OF MINUTES. The motion was made by Alderman Dunlap and' seconded by
Tistle to approve the minutes of June 16, 1958. Alderman McKay made one
correction that Sanitary District to dredge Weller Creek from Wolf Road west
to City limits. The motion was voted upon by acclamation with correction made.
OFFICIAL REPORTS. The Clerk submitted_the Clerk's and Building Commissioner's
reports for June and Fire Chiefs six month report.

future annexation by Park Ridge, Park Ridge approves plat. On motion by
Alderman Bell and second by Dunlap the Council approved the plat and authorized
the Mayor and Clerk to sign same.
APPROVE SCHALL'S SUBDIVISION PLAT. Alderman Bell reported the plat is outside
City limits and Plan Commission approved plat. On motion by Alderman Bell
and second by Dunlap the Council approved the plat and authorized the Mayor
and Clerk to sign same.
APPROVE ALTER SUBDIVISION PLAT. Alderman Bell reported the above plat lies
closer to the boundaries of Park Ridge than the City of Des Plaines. Park
Ridge has approved the plat. On motion by A.lderman,Bell and second by Dunlap,
the Council authorized the Mayor to write to necessary parties approving
subdivision and waving jurisdiction in this instance.

CD PREMIER ROSE AND BAUSKE PROPERTY. Alderman Bell made the following report: The
x:10 matter has been referred to Plan Commission. A copy of their recommendation is
attached. J.Emil Anderson is selling 16 acres of this property to the School
Board at less than the cost. Should the Council recommend more residential
zoning than shown in Plan Commission report, the school property could not be
sold for the agreed figure. We recommend'the matter be referred to Zoning
Board with the recommendation that they follow suggestion of Plan Commission except
that only two rows of residential property exist on north end so that homes
will not back up to industrial. The following is Plan Commission recommendation:

The Plan Commission of the City of Des Plaines is making the following report
at the request of the Municipal Development Committee. Since the date of the
Supreme Court decision on the Premier-Bauske property the Plan Commission has
been considering the effect that such a major change in land usage will have
on that section of our City. We have completed a field inspection of the
property in question and the surrounding tracts; have secured and studied
aerial photographs, topographic surveys, tollway plans, proposed highway
improvements, traffic counts, and traffic load predictions; and we have evaluated
such data in regard to the ultimate development of the area generally defined
by the streets Touhy-Lee-Howard-River Road.
The City Council and the citizens of Des Plaines should be aware of the fact .
that the encroachment of even a small area of industrial use in this neighbor-
hood will have a pronounced effect on the economic and practical value of the
surrounding properties. We have been faced by a reluctance of housing developers
and lending agencies to create residential sub -divisions in such close proximity
to O'Hare Field, to the Tollways, to the major traffic routes, and to the
railroad. Ahd the advent of commer d al and industrial usage along Touhy Avenue
has so enhanced the value of adjacent lands that it is now priced out of
reach of the speculative builder of single family homes. To this we add the
Plan Commission's objections to approving residential developments so located
that school children and other pedestrians will have to walk along heavily
travelled streets in an industrial environment on their way to schools, play-
grounds, and shopping.
With these considerations in mind, we are making certain recommendations as to
changes in zoning and as to the City's plans for the ultimate development of
this area. We are submitting herewith a sketch map indicating the Plan
Commission's recommendations for land use and traffic pattern in the area.
We suggest that the major segments as noted be submitted to the Des Plaines
Zoning Board for possible immediate rezoning, thereby clearly defining the
future make-up of this section for all interested property owners, developers,
traffic and utility engineers, and other government bodies.
11R.flgAN,KBNZIPP, Secretary of the Plan Commission, and a professional traffic
engineer, made a thorough analysis of the traffic load to be gererated by these
tracts and the resulting effect of such traffic on local streets. His first
check on the worst condition, which would>:be the use of all 143 acres of
Premier-Bauske for industrial plants, showed melte generation of 2,800 cars
per hour during peak hours. The expected peak hour rate for the tracts as
recommended in this report will be 1,600 vehicle trips per hour for the

industrial tract east of the railroad and approximately 500 vehicles in or
out of the land west of Mannheim Road.
It was noted that traffic increased from 27% to 67% on the important roads
in this vicinity between 1953 and 1956. Future growth will likely be 20%
each three years for the next six years,; giving a gain of 40% by:1962, a date
when these industrial sites might well be completed. It is predicted that
the Tollways might reduce traffic on Mannheim and River Roads by not more
than 20% by 1962.
Using the 1962 conditions and assuming that the Tollways will be in use, it
was determined that the following main traffic intersections will be operating
at the noted percentage over their design capacities due to the indicated
development:

It should be noted that the above overloading will occur at peak hours even
when assuming two-lan approaches on all legs at each. intersection. Industrial
tracts will generate very high peak traffic volumes at certain hours while
other land uses such as residential and commercial tend to spread; their load
over other hours of the day.
With these very accurate estimates in mind the Plan Commission seriously
studied the expected traffic pattern which will develope in this vicinity.
The location of new Schools, parks, playgrounds, and churchs contiguous to
or very near the industrial property creates several definite problems. To
alleviate some of the hazards and to protect the existing residential
neighborhoods, we make the following recommendations or restrictions for the
development of the 89 acre industrial park:
Design restrictions on the Industrial Park:
1. It is important that no industrial traffic be pulled through residential
areas.
2. The industrial tracts, particularly the large area east of the railroad,
should have a complete internal circulation systems with properly sized
heavy-duty streets, adequate off-street parking areas, and efficient
access facilities.
3. Access to the industrial areas should be limited to those points shown
on the attached sketch. These intersections with the primary streets
should be completely signalized and have sufficient resevoir space for
efficient movement in and out.
4. We recommend that Maple Avenue be improved as a local residential street,
but that a 4 foot wide median strip be provided in the center of Maple
to prevent it from becoming an access road for industrial traffic.
The Plan Commission has recommended that the major portion of the industrial
tract be classified as Industrial I-2 (medium) for we feel that the larger,
financially established firms which could be attracted to this area will
construct buildings and maintain landscaping of a more desirable type. A
multitude of small light industrial shops will be more likely to !produce
a blighted area, offer less stable employmeht opportunities, and increase
the likelyhood of certain plants neglecting their housekeeping and landscaping.
It is also recommended that the proposed addition to South Park extend from
White Street to the Soo Line Railroad rather than be a southward projection
of the existing park. This will eliminate a poorly located segment of industrial
land which would remain between the new park and an existing residentialarea.

On motion by Alderman Bell and second by Dunlap the matter was referred to
Zoning Board of A ppeals sitting as a Commission to call a hearing.
ORCHARD PLACE STREET SPECIAL ASSESSMENT TO EE DISMISSED. Alderman Bell reported
a fatal defect had been committed in that the cost of the special assessment
had been increased without referral to Municipal Development Committee and
published before passage. The Board of Local Improvements recommend City Attorney
be authorized to draw ordinance directing dismissal of special assessment 168
covering this matter. On motion by Alderman Bell and second by Massman the
Council concurred in the report.
Alderman Tistle reported there will be a meeting of the Fire Committee July 23rd.
Alderman Martin arrived at this time.
FUEL OIL BID. The motion was made by Alderman Rateike and seconded by Wright
to award the fuel oil bid to Marland Oil Company. On inquiry Alderman Rateike
reported the Liberty Oil Company was low bidder but due to color of oil
decided not to award the bid to that company. After discussion the motion and
second was withdrawn. On motion by Alderman Neff and second by Martin, the
matter was tabled so a test could be made of oil of Marland Oil Company, Liberty
E") Oil Company and Lund Brothers.

1) ALTERATIONS MUNICIPAL BUILDING ARCHITECT AGREEMENT. Alderman Rateike read the
following letter:

In reply to your inquiry concerning the Architectural and Engineering fees
involved in the addition and alterations to the Des Plaines Municipal Building,
I am -pleased to offer the following proposal:
The scope of the work involved will be generally that,which was indicated
in our report of June 4, 1958, i.e. the addition of a 'Police Cell Block and
Garage, conversion of the present Library to a Police Headquarters, remodeling
of the. first floor of the main building for various office usages, addition
of two lavatory rooms for the second floor area, sound -proofing of the Council
Chambers, installation of ventilating and airconditioning systems for the
Police dept. wing and also for the main structure, provision for a large
underground fuel oil storage tank, driveways, and other miscellaneous
alterations necessary to place the building in proper operating order. The
exact scope or extensiveness of work and its scheduling can be adjusted readily.
The fees charged for this type of work are slightly higher than those for new
work because of the extra work involved in detailing and engineering remodeling
of an existing building. We propose to perform this commission for a basic
rate of six and one-half per cent (6) of the cost of the work. In addition
we will charge an additional fee of 3% on the heating, ventilating, air-
conditioning, electrical, and plumbing work. All consulting engineering work
will be provided under these fees.
Enclosed herewith are three copies of the Owner and Architect Agreement which
you may want to have checked by the City Attorney. Please call me if you have
any questions or corrections that you may wish to make in this agreement.

PARKING METER TRAF-O-TERIA BOXES. Alderman Wexler reported abouti90 day trial
of above boxes' and on motion by Alderman Wexler second by Martin the Council
approved to retain the boxes.
FIRING MISSILE AND ROCKETS. Alderman Figard recommended the City Attorney draw
up up an ordinance to prohibit the firing of missiles and rockets and the sale
of so-called rocket fuels and combination of chemicals to make propellants, for
use in rockets and guided missiles. On motion by alderman Figard and second
by Martin. The Council concurred in the report.

Alderman Neff reported a meeting of Code Committee Monday July 14' at 8:00 P.M.
"RIGHT TO KNOW" BILL. Alderman Wexler reported the following on the above bill:
Your Judiciary Committee has investiged the above and found: the so-called
"Right to Know" Bill, (Illinois House Bill #699) has not been decided by any
court of law so to the mandatory right of the press and "public to be present
at all committee meetings of the City Council. Letters requesting a legal
opinion were mailed to the Attorney General of Illinois and States Attorney of Cook
County. Both of these public officers refused, for various reasons, to submit
an opinion. We, your committee therefore, recommendthat the legal opinion
of the City Attorney be accepted as the official position of the City namely:
that there is no legal requirement that committee meetings be open to the
press and public but that this right of open meeting be confined to those
meetings where legal action can be taken.
Nother in this recommendation is to be construed as prohibiting the press
or public from attendance. Rather it lies within, the discretion of the
Committee Cairman. The Committee is further mindful that regardless of the
City Attorney's opinion the majority of the Committeewould appear to best
be served by permitting the press and public to be present at all reasonable
times in an effort to keep the public better informed of current city problems.

Committee and also Traffic Commission, - Under date of June 24 we received
following letter from Mr. E.R.Warnicke:-
"Last Monday night the Mayor referred the matter of eliminating parking on Des
Plaines Avenue from Miner Street to Rand Road,•to the Streets and'Traffic
Committee. Since the referral, the Chief of Police and I have discussed the
matter with the Mayor and we are unanimous in our opinion that parking should
be eliminated on Des Plaines Avenue from Devon Avenue to Rand Road. I have
been asked to inform you of our recommendation so that your committee can
consider the matter."
Insofar as Streets and Traffic Committee is concerned we concur in the recommenda-
tion of the Police Marshal, Supt: Public Works and the Mayor that parking be
eliminated on Des Plaines Avenue from Devon to Rand Road.
Mr. Forberg of the Traffic Commission informs me that the Commission also
recommends elimination of aprking between Devon Ave. & Rand Road.

RIGHT TURNS ON MINER STREET. Alderman McKay made the following report:

With reference to item referred to Streets and. Traffic Committee on June 16,
concerning right turns south on red light from Miner to Graceland, Lee, Pearson
and Des Plaines Avenue. Needless to say there is always the element of risk
and danger as far as pedestrians are concerned, in permitting such turns to fecilitate
traffic flow. •
We recommend that the right turns south from Miner be put into effect at Graceland
and Lee; that the inside lanes be properly and prominently marked; also that the
street corners be properly and prominently marked for both motorist and
pedestrian. That as far as the intersections of Pearson and Des.Plaines Avenue
are concerned action be held in abeyance until it can be learned just how
the arrangement at Graceland and Lee works out.

With reference to proposed improvement of White Street from Everett to Oakton,
we have the following from City Engineer Fletcher:.
"I have made an estimate of the cost of improving White Street from Everett to
Oakton and I find as follows:

To widen street to 28 feet, install curb and gutter and sidewalk where.these
are now missing, and to surface the entire street with 2i inches of asphalt,
total cost will be $28,000.00. If this work is done as a Special Assessment
with half the cost paid by Motor Fuel Tax Funds, the cost to the property
owners would be approximately as follows:
830 feet of frontage that now has both curb and walk
1145 feet that now has walk but not curb
385 feet of frontage that now has neither walk nor curb
$4.20 per ft.
6.20 per ft.
• 9.20 per ft.
The total cost to the property owners would be approximately $14,000.00."
It is recommended this proposal, which involves an estimated cost $28,000.00
(50% by special assessment and 50% by MFT funds) be referred to the Board of
Local Improvement for consideration.

TRAFFIC SURVEY. Alderman McKay made the following progress report:
A meeting of the Streets and Traffic Committee was held June 26 in connestion with
proposed traffic survey. Present: Messrs. Blume and Wieser of the Safety Council
Mr.Lokay of the Chamber of Commerce; Mr. Larsen of the N.W.University Traffic
Institute; Mr. Lannefeld representing Mr. McCleverty of the Cook County Traffic
Safety Commission; also Messrs.Warnicke,Fletcher and McKay.
Mr. Lannefeld explained the County was quite busy making survey of the various
streets and roads under its jurisdiction and which is necessary because of the
new speed limit bill which became effective July 1, 1957. The State, too, has
a similar but more extensive job on its hands. While this work of the County
and State is important and could provide some. data which might be useful in a
local traffic study it is felt it would not be of material assistance to us in
our attempt to solve most of our purely local problems. However, Mr. Lannefeld
offered to loan Supt.Warnicke one or two counters which should prove quite
helpful in some of our studies. Perhaps also, basic traffic datapertaining to
our area could be obtained from the County, State, Chicago Motor lub, and
other sources.

Whilesthere has been some felling that we might be able to conduct a traffic
study without the aid and expense of qualified experts, this idea has now been
abandoned. To achieve a worth -while survey -study and sound counsel, we must
have the direct assistance of ma professional service. We are, therefore,

BADE LETTERS ON HOODING METERS ON PRAIRIE AVENUE. The Clerk read the above
letters and they were referred to Street Committee and Chief of Police by the
Mayor. Alderman McKay to invite the Bades and Bank officials to a meeting.
The Mayor, also, referred the hooding of meters on Graceland Avenue from
Prairie Avenue to Ellinwood Street to the Street Committee.

seconded by Massman that the bid for the sewer be awarded to Joe B. Ditito Company
for $14,809.20 and other bi6der's checks be returned. The Mayor put the question

$40,000.00 WATER REVENUE BONDS. Alderman McKay reported for the Finance Committee
regarding the redeeming of $40,000.00 Water Revenue Bonds: That the savings
in interest to the City being in the order of $27,000.00 that we should take
steps to acquire the bonds. The Committee recommends the redemption of these
bonds as stipulated in the offer by American United Life Insurance Company in,•
their letter of May 20, 1958. The motion was made by Alderman McKay and
seconded by Bell to concur in the report. After a discussion about investigating
value on bonds the motion was made by Alderman Martin and second by Neff to
table and refer back to Finance Committee.
APPROVAL OF BILLS. Alderman McKay presented the following resolution:

has been placed on the.list. Also, survey regarding intersection Touhy Avenue
and Scott Street.

for second reading the above ordinance. The motion was made by Alderman

zone on Miner Street. The Mayor referred the letter to the Street Committee and
and Traffic Commission.
P. B. LARSEN LETTER. The Clerk read the above letter: Regarding traffic hazard
at Maple Street and Scott Streets. The Mayor referred the letter to Street
Committee.
ZONING ORDINANCE - COMMERCIAL AREAS. The Clerk read for second reading the above
ordinance. The motion was made by Alderman Neff and seconded by Callaghan to
adopt the ordinance. After discussion the motion &Ed second were withdrawn.
The Council to hold a meeting with Plan Commission, Zoning Board and Mr. Chamales
on July 23rd at 8:00 P.M;
LO OPEN BIDS ON MAINTENANCE NON ARTERIAL AND ARTERIAL STREETS. On motion by Alderman
Figard and second by Tistle the Clerk was instructed to open the bids on
maintenance of streets. The following four bids were received:

On motion by Alderman Rateike and second by McKay the bids were referred to the
Streets and Finance Committee and City Engineer with the Mayor declaring a recess.
After reconvening the motion was made by Alderman McKay and second by Tures
to award the bids to Skokie Valley Asphalt Company and other bidders check's
be returned. The Mayor put the question and the Clerk called the roll with the
following results: Ayes: Alderman Massman, Be711, McKay, Callaghan, Rateike,
Dunlap, 6kight, Tures, Neff, Wexler, Martin, Figard and Tistle. Nays: None.
The Mayor declared the motion carried.

LETTER FROM FRED G. SURIA, 111 W. WASHINGTON STREET, CHICAGO, ILLINOIS. The
Clerk reported about above letter which is a suit filed against the City for
claim of Mrs. Alma Kerber Kuecker for personal injuries from fall on or near
sidewalk and exit drive from the Kroger Company store on Lee Street. The
Mayor referred the letter to Judiciary Committee.
APPROVE $13,000.00 FIRE TRUCK STATEMENT. The motion was made by Alderman Rateike
and second by Tistle to approve payment from Foreign Fire Insurance Tax funds,
the $13,000.00 part payment on fire truck. The Mayor puththe question and the
Clerk called the roll with the following results: Ayes: Alderman;Massman,
Bell, McKay, Callaghan, Rateike, Dunlap, Wright, Tures, Neff, Wexler, Martin,
Figard and Tistle, Nays: None. The Mayor declared the motion carried.
RESOLUTION THACKERSTREET SEWER. The Clerk informed the Council he had a
resolution from Engineer Fletcher on Thacker Street Sewer appropriating $140,000.
of Motor Fuel Tax Funds. The Mayor referred the resolution to Street Committee.
CITY ENGINEER LETTER TO AMEND MUNICIPAL CODE. The following is the letter:
It is the recommendation of your City Engineer that the .following changes in Chapter
7 of the Municipal Code of the City of Des Plaines be referred to the Street
and Traffic Committee and to the Plan Commission for consideration:
Section 212.7 Improvement of Roadway
...(b) A seven (7) inch soil cement base (constructed in accordance with
procedure recommended by the Portland Cement Association) with a 2- inch
asphalt surface. The 2i inch aspahlt surface shall consist of 1 inch of
bituminous concrete binder and 1 inch of Subclass I-11 surface course.
All material and the manner of custruction shall conform to Section 45 of
the Standard Specifications for Road and Bridge Construction, adopted
January 2, 1952.
(c) A water -bound macadam base not less than eight inches in thickness
surfaced with not less than 2i inches of asphalt. The 2i inch asphalt
surface shall be the same as that above specified under item (b).;
The above changes increases the thickness of the asphalt surface required.
To Section 212.8 add the following: 1
All subdividers presenting subdivisions having lots fronting upon'a State
or County Highway, where the width ofthe pavement in the said State or County
Highway is less than forty (40) feet shall be required to widen the .existing
pavement to forty k40) feet and to construct concrete curb and gutter across
the width of the subdivision fronting said highway.
To Section 212.13 add the following:
In addition to the completion bond. The subdivider shall be required to deposit
cash with the City Clerk in the amount of 5% of the estimated cost of the public
improvements where the cost of the improvements is less than $50,000.00, and
a sum of $2,500.00 where the estimated cost of.improvements is more than
$50,000.00.
When the construction of the public improvements have been completed, the City
Engineer shall make an inspection of the work as completed Sind shall report in
writing to the City Council and to the Subdivider any corrections or repairs
that need be made. The subdivider shall have thirty (30) days from the date
of this report to make such repairs or corrections. Any repairs or corrections
not made within thirty (30) days of such report may be made 1)57. the City of Des
Plaines and the -cost deducted from the money on deposit.witY the City.Clerk.

FOUR 35 FOOT DRIVEWAYS RAND AND WOLF ROADS. The Clerk informed the Council
he had a plat for four 35 foot driveways at Rand and Wolf Roads. The Mayor
referred the plat to the Street Committee.

read for first reading the above ordinance. The motion was made by Alderman
Bell and seconded by Martin to place the ordinance on passage. The motion

seconded by Martin to adopt the ordinance. The Mayor put the question and the

CITY COUNCIL, DES PLAINES, ILLINOIS HELD
IN COUNCIL ROOM, CITY HALL, JULY 21, 1958
AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel, with
Alderman Massman, Bell, McKay Callaghan, Dunlap, Wright, Neff, 'Wexler, Martin,
Tigard, Tistle responding to roll call. Alderman Prickett, Tures and Rateike
were absent.
APPROVAL OF MINUTES. The motion was made by Alderman Massman and seconded by
Bell to approve the minutes of July 7, 1958. Corrections made: Eliminate Alderman
Prickett's name and place Alderman McKay's in the roll calls. Remove Lund Oil
Company and add Lake -Cook Farm Supply on test of fuel oil. Remove the dollar
sign regarding 2,000 increase in census. The motion was then voted upon by
acclamation.
BUCKHORN TRAILER SIGN. Commissioner Rieck presented Architects report recommendi ng
permission be granted to the applicant for the Erection of proposed structural
supports and sign. Alderman Martin made the report that the Building Control
and Inspection Committee, also, recommending the installation of sign. The
motion was made by Alderman Martin and seconded by Figard permission be granted.
After discussion the motion was made by Alderman Bell and seconded by Massman
to table to next meeting when alderman Prickett is present. The Mayor put
the question and the Clerk called the roll with the following results: Ayes:
Massman, Bell, McKay, Callaghan, Dunlap, Wright, Neff, Wexler, Martin, Figard,
and Tistle. Nays: None. The Mayor declared the motion carried.
BIDS BE ADVERTISED FOR PARK PLACE PARKING LOT. On motion by Alderman Wexler
and second by Figard to advertise bids to be returned August lath for
improving Park Place Parking Lot.
CLAIM OF MRS. KUECKER. Alderman Wexler reported the Judiciary Committee recommends
the Mayor appoint an attorney to represent the City to make an investigation of
the facts and report his findings within 60 days regarding letter from Attorney
Fred G. Suria on accident claim of Mrs. A. K. Kuecker. The motion was made
by Alderman Neff and seconded by Wexler toapprove the appointment of James J. Dowd.
