The meeting was called to order by Mayor Herbert H.Behrel with Alderman Tistle, Massman, Bell, McKay, Callaghan, Dunlap, Tures, Wright, Neff, Wexler, Martin, Figard and Prickett responding to roll call. Alderman Rateike was on vacation. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Tistle to approve the minutes of May 5, 1958. The motion was voted upon by acclamation. Commissioner Rieck reported on Judson Realty Corporation using residence as office. The Clerk read a letter from the Judson Company that the home would be used until December 31, 1958. City Attorney is to check the City Code on lenghth of time use for office. City Attorney Dowd Report: Relating to the Re -zoning of property without the limits of the City of Des Plaines and the Annexation of same property. A question arose at the -last City Council meeting of May 5, 1958, about the legal propriety of the City of Des Plaines re -zoning property without its limits, prior to the annexation of said property, and the City's act of annexing said property thereafter. Your attention is directed to the last paragraph of Sec. 14-C on p. 20b of.the Revised Zoning Ordinance of the City of Des Plaines, which reads as follows: "All territory hereafter annexed to the City of Des Plaines shall be and the same is hereby classified for zoning purposes as RESIDENCE,.AREA DISTRICT 'A', unless at the same time that the annexation ordinance is enacted, it is otherwise zoned." In the case of Whitehead et al. vs. the Village of Lombard et al., 3 I11.2d,464, 121 N. E. 2d, 745, the Supreme Court of the State of Illinois held at the Village of Lombard, which has the above provision in its Zoning Ordinance, could re -zone property without the limits of its village and then annex the property thereafter. There are other questions of law decided in this Whitehead vs. Lombard case; but I understand, since this decision by the Supreme Court, there is no longer any question about the authority of the city or village to first re -zone property without its limits, and then to annex same property thereafter. /s/ James J. Dowd, City Attorney Mayor Behrel reported 'the delay of opening Council meeting was due to a meeting regarding the Chicago and Northwestern Railway case about lumber yard at Cumberland Station. Mr. Scheer who plans a shopping center at Wolf and Golf Roads was in attendance. Lommen Eley requested to be released as attorney in this case due to his opinion on the rezoning. The Mayor requested approval of the appointment of John Burke for the case. The motion was made by Alderman Neff and seconded by Wexler to approve the appointment. Alderman McKay has authority to invite any person to attend meeting who may be an assist to the Committee. City it LimNorth East section Alderman Bell reported the Municipal Development Committee had a meeting regarding the Plan Commission report on the City Limits of the northeast section. At the meeting Mr. Prassas appeared and explained his plans for a shopping center. The Committee agreed on the Plan Commission report and recommend the approval. On motion by Alderman Bell and second by Prickett the Council approved the report. Alderman Bell requested that action should be taken to annex all the Forest Preserve and Catholic Church property. The Mayor referred to the City Attorney and Engineer the preparation of annexation ordinance. Also, to the Superintendent of Public Works and Engineer regarding information for the areas about sewer and water. 19/58 AWARD BID ON POLICE AND FIRE RADIO. Alderman Tures madethe following report: Your Committee On Police has inveatigated,and found: Bids were received from three companies on two different types of equipment namely, Vibrator and transistor types, the figures are as follows: G.E. Vibrator $3,184.70,Transistor $3,288.90, Bendix, Vibrator $3,720.10, transistor $3,920.00, and Motorola vibrator $3,648.47, transistor $4,245.41. Our specifications did not include installation costs becaase the committee felt that this dx uld be done by Mr. Melka our regular maintenance man at a cost of $380.00, one bidder voluntilarly submitted an installation bid of $460.00 which is =0.00 more than Mr. Melka's. No one on the police Committee has had experience in radio so it was necessary to call on Mr. Melko and Mr. Heimbrook of Civil defense. Both agreed that transistor equipment should be acquired. We, your Committee on Police, therefore, recommend: That the contract be awarded to General Electric for $3,288.90 and be installed by Mr. Melka for $380.00 subject to approval by Civil Defense which is to pay 50% of the total cost. 1 /8/ Ray Tures /s/ L. Alderman Tures made the following report: Your Committee on Fire has investigated and foundz The ambulance is fully, insured and will be on 24 hour call for the Police and Fire Department at no cost to the city. The ambulance is to be operated by (4) four Red 'Cross Instructors. Alderman McKay made the following report: Street and Traffic Committee held a meeting on this subject on May:15th, which while not too well -attended numerically did attract a representative group of interested citizens, including Messrs. Blume, Weiser and Bauer of the Safety Council; Messrs„ Lokay and Smith .of the Chamber of Commerce; Mr. Forberg of the Traffic Commission; Mr. Ben Eidemiller of B. F. Eidamiller & Co.;. Mr. Keneipp of the Flan Commission (and who is also connected witha traffic organization); Mr. Iarsenlof the Traffic Institute of NW University (and a des Plaines resident); Mr. Wernicke, Supt. of Public Works; Mr. Fletcher, City Engineer; also Ald. Wright, Prickett, Dunlap, Massman and all three members of the Streets and Traffic Committee: The concensus of the group, without one negative expression, was to the effect we should endeavor to arrange for a comprehensive survey, including the effect of the toll road on local traffic, one-way streets .in the buainessi section, conditions on Miner and Ellinwood and Prairie south of Lee, 5 corners, Mannheim north of Algonquin, the desirability of requiring subdividors and other promoters to arrange for a traffic study to be submitted when they ask for plat approvals, the survey to show the effect their projects will have on the local traffic picture, etc. It is understood automobile parking facilities, or rather the lack thereof must come in for particular attention in any traffic survey. 1 The Streets and Traffic Committee wili7have to arrange for another, meeting or two before it is ready to release a letter of invitation for proposals. To assist us we request the Mayor and City Council appoint ajspecial Traffic Survey sub -committee consisting of: Mr. Robert Blume of the Safety! Alderman McKay made the following report: Concerning suggestion of Miss Neff in our meeting of May 5th that the Streets and Traffic Committee give consideration to the possibility of placing a crossing guard at Thacker Street and the Belt Line crossing. It is recommended that this matter be referred to the Safety Council with request the City Council be given the benefit of its advice after it has developed through the West School PTA: The number of school children enrolled from the Westfield Gardens area. How many of these are brought to the school and called for by their parents. How many go tome arid return at luncheon time. How many use the bus ,.� service which operate along Thacker Street. It is also recommended that the Mayor write Mr. H. T. Fleisher, Assistant Engineer of the C&NW, reminding him we already have before him the matter of unsatisfactory general operations at this crossover, and request that something be done promptly to safeguard the public, particularly school children. /s/ S. The Clerk submitted the Chicago and Northwestern Railway agreement for dredging Weller Creek which had been requested November 26, 1957. On motion by Alderman Pridkett and second by Wright the Council authorized the Mayor and Clerk to execute the agreement. ADOPT ORDINANCE AUTHORIZING PURCHASE OF SCHOOL PROPERTY.
