CALL TO ORDER. The meeting was called to order by the City Clerk due to the
Mayor being on vacation. Thefollowing Aldermen responded to roll call: Alderman
Tistle, Massman, Bell,McKay, Callaghan, Rateike, Dunlap, Tures, Wright, Neff,
Wexler, Nartin, Figard and Prickett. The motion was made by Alderman Tures
and seconded by Figard to appoint Alderman Prickett, Mayox•:prd,tee. The motion
was. voted upon by acclamation.
APPROVAL OF MINUTES The motion was made by Alderman Rateike and seconded by Bell
to approve the minutes of April 17, 1958. Alderman McKay requested the following
corrections: Page one - moved by Alderman Belland seconded by Massman that Mayor
and City Clerk be authorized to sign plat upon receipt in writing of satisfactory
agreement concerning park area. Motion adopted by acclamation (Gliech Subdivision)
Third paragraph page five - Moved by McKay seconded by Rateike that the ordinance
be adopted. Page 6 second line should read "Third Avenue east to end" instead of
"west to end". Third line should read "Fourth Avenue east to end" instead "west
to end". Page 6, resolution on maintenance of Arterial streets, line reading,
"Cumberland Parkway from Golf road to Warrington" should read "Golf Road to
Washington Street" Approximate cost $4,000.00. Page 6. Subject "Building Line
variation - Center Street, minutes should show "Notion adopted by acclamation".
The motion was voted upon by acclamation with corrections made.
The Council approved to open the three types of bids on motion by Alderman Tures
and second by Tistle.
SIDEWALK BIDS. There were eight bids low bid $.52 cents per square foot and high
bid $.75 cents. On motion by Alderman Tures and second by Bell the bide were
referred to Street Committee.
FUEL OIL BIDS. There were eight bids with prices of discount from - cent to 2 cents
per gallon. On motion by Alderman Rateike and second by Tistle the bids were,
referred to the Public Building and Grounds Committee.
IMPROVEMENT PARKING LOT NUMBER6. (NORTH SCHOOL): The following three bids were
received:

Milburn Brothers 24,713.00
On motion by Alderman Tistle and second by Tures the bids were referred to
Parking Meter Committee.
OFFICIAL REPORTS. The Clerk submitted the reports of Commissioner Rieck and
City Clerk for April, also, three month report of Chief Kennicott. Chiefs Kolze
and Kennicott reporton on zoning inspections.
Alderman Rateike reported they would advertise bids on remodeling city hall in
June. He said that the Council members would receive a copy of plans.

CUMBERLAND CIRCLE TRAFFIC LIGHTS. Alderman Mc Kay reported he received a letter
from P. T. A. Safety Chairman about installing traffic light at Cumberland Circle
and that the letter should be referred to the Street Committ e regarding making
a traffic survey. The letter was so referred.
Alderman McKay reported the railroad signa have not been installed on Thacker
Street and the Clerk was instructed to write the Soo Line. Railroad.
Alderman McKay requested the City Attorney to amend the downpout;ordinance.
BIDS FOR WATER MAIN DEMPSTER STREET AND TOLL ROAD. Alderman', Tures recommended to
bid for the above main be awarded to Joe B. Divito for $4,910.20. This will
be paid for by the Toll Road Commission. The motion was made by Aldermah Tures
and seconded by Bell to award the bid to Joe B. Divito. The Mayor pro tet put the
question and the Clerk called the roll with the following repults Alderman
Tistle, Massman, Bell, McKay, Callaghan, Rateike, Dunlap, Wright, 'Tures, Neff,

BIDS ON DEMOLISHING PARKING LOT BUILDINGS.
On motion by AldermanlWexler and
second by Neff the Council approved for reject the bids, return the checks and
readvertise bids to include the additional buildings.
CHICAGO AND NORTHWESTERN RAILWAY — CENTER STREET CROSSING. Alderman Wexler
read the following report:
Your special committee on the Center'Street Railroad Crossing composed of -
Charles Forberg, Chairman of the Traffic Commission, Robert Blume, Chairman
of the Safety Council, and Sydney B.Wexler, Councilman, had referred to it
the order entered by the Illinois Commerce Commission on April 16; 1958, ,
denying the petition of the City of Des Plaines for vacation of the Commission's
order of December, 1957, directing the closing of the Center Street crossing.
Your committee has carefully considered this matter and has found that:
1. The effect of the Commission"e order is that the crossing will continue to
remain closed.
2. The city has a right to take an appeal to the Circuit Court of Cook County
and from there, if either party wishes, to the Illinois Supreme Court.
3. The only basis for possible reversal of the Commission's order would be
to convince the Circuit Counrt of Cook County that the Commissions findings
are not supported by substantial ,evidence in the record and that this burden
of proof on the City would be extremely difficult.
4. The City has already expended approximately $1,441.00 on legal fees and
court costs to date and an appeal to the Circuit Court and Supreme Court would
cost approximately three to four thousand dollars in addition.
5. In the event of a reversal of the Commission's order, there is considerable
doubt in the Committee's minds whether the Chicago and North Western Railroad
would comply with the court order inasmuch as the railroad has indicated that
the Center Street crossing is a private crossing on private property.
6. The Illinois Commerce Commission has indicated informally that it has
doubts as to its jurisdiction to compel the railroad to reopen the private crossing.
7. The Committee feels that the order directing the closing was 'lin no way
responsive to the city's original petition seeking the aid of the Commission's
engineering staff and that the order was an admission that the Commission
could either not comprehend the effect of the crossing on the citizens of
Des Plaines or, the alternative, did not understand what was involved.
8. The City has heretofore referred to the Streets and Traffic Committee the
question of a proposed overall traffic survey concerning, amongst other things,
traffic mobility on Ellinwood and Miner Streets.
We, your special committee, therefore recommend that:
a. The City not prosecute an appeal from the Commerce Commission's order.

in abeyance until the Streets and Traffic Committee completes its traffic survey.

PARK TRAILER PARK CASE DISMISSED. Alderman Wexler reported the above case was
dismissed between the City and the Park. On motion by Alderman Wexler and
second by Bell the'Council authorized Attorney Eley to dismiss the case.
YOUTH ACTIVITIES - STOCK CAR RACES. Alderman Figard reported the Stock Car
Races would be held June 6, 1958, and invited the City Officials to attend.
He said County Officials would be present.
TO REDEEM $3 .000.00 WATER REVENUE BONDS. Alderman McKay reported that the
City Council of the City of Des Plaines authorize the City Treasurer to accept
the proposal of the Marietta Research and Investment Company to tender $35,000.00
of the Des Plaines Water Revenue Bonds as outlined in their letter of March 18, 1958.
The motion was made by Alderman McKay and second by Bell to concur in the report.

COMPLAINT OF 16 FAMILIES ABOUT NEIDERT MOTOR SERVICE BUILDING. The Clerk read
the following letter:
We, the tax payers and residents of Des Plaines, residing on Lee St. between
Ashland and Oakwood Aves., and on Oakwood and Ashland Ave., between Lee and
Center Streets, wish to acquaint you with some of the facts which we consider
a violation of the city zoning some of the facts which we consider :a violation of
the city zoning ordinance as well as a nuisance which we have had to put up
with for the past eighteen years. The Niedert Motor Service located at 1300
Oakwood Ave., has ignored the zoning laws and our complaints have been ignored.
This company operates a trucking business that works twenty four hours a day.
The trucks are the large trailor type and about fifty of them are in and out
of the alleys every day and night. The trucks are all loaded at night. The
radio is played all night. Loud talking goes on all night. The adjacent
alleys, 16ft wide are used for parkint of cars and trucks day and night. All
night when trucks are being loaded there is`a loud bang of metal on metal as
the steel dollies are pushed and bumped from loading platfor4► to truck. After
trucks are loaded the cab is attached and because of the size of the trailor
it requires a great deal of manipulation before it can be backed into the
parkinglot. This causes loud racing of motors and screechinglof brakes. This
goes on every night from 8:00 P.M. to about 5:00 A.M. In sixteen foot alleys
these trucks pass each other making deep ruts on private driveways and they
drive over the curbing on private property.
Just recently a truck backed into a garage in the rear of Lee st and knocked it
four feet off the foundation. A high voltage pole in the alley shows marks
where it has been hit by the trucks. What is to prevent them from knocking
this pole down some night. A live wire ignited by the gasolene'could blow
up tte whole neighborhood. When old trailors are being re -Conditioned a sand
blast machine is used to take off the old paint and rust and' this dust blows
all over into the adjoining property. Several of the owners have; applied for
a permit to build a wodden two car garage but were refused as the city ordinance
required a metal or brick building in this zone because of a fireihazard. The
Niedert Co. built a wooden, covered shed that is much larger than a two car
garage. This is attached to the brick building and within a' few feet of a
4,000 gal. gas tank. How did they obtain a building permit.' We know that this
building is for sale and that the Niedert Co. is moving away. The purpose
of this letter is to ask you, the law -makers of our city, just what protection
we may expect from the future owners of this property. Theibuilding is very
large and in the past years part of it has been sub -let to undesireable tenants.
The Molded Products Co. operated a plastic factory in the building for a number
of years. This factory was a nuisance and operated twenty four hours a day.
A printing Co., has rented part of the building. An Auto Repair Shop has
used part of the building, using the alley for a parking lot. If a' new owner
comes in with sugar-coated promises and obtains a license for a 1egitamate
business, will you allow them to rent or use any part of the building without
considering the zoning laws for this particular location. Some of us have
lived in this neighborhood for more than forty years. We have always been
law abiding citizens, paying our taxes and giving our support to the Community
when called upon. We have lived and voted in Des Plaines. 'We appeal to you
for help in maintaining our homes and to give us tshecprbtection that we are
entitled to. An explanation and a copy of the zoning laws in this particular
location will -be appreoi&ted..IRespectfully, signed by 26 persons representing
16 families. After discussion Chiefs Kolze and Kennicott are to!see about and
stop violations. On motion by Alderman Martin and second by Neff the Mayor is
to write to Mr. Niedert informing him to take care and advise the party who he
leases the property that the City will prosecute all violations.

Alderman Neff requested the City Attorney draft an ordinance similar. to Skokie
ordinance on noise after 12:00 mid -night.
LOMMEN ELEY LETTER ON POPPY DAY. The Clerk read the above letter requesting
permission for Poppy Day on May 22, 1958 and the Mayor issue a proclamation.
On motion by Alderman Dunlap and second by Rateike the request was granted.
V.F.W. POST 2922 CARNIVAL. The Clerk read a letter from above Post requesting
permission to hold a carnival on the southwest corner of Sycamore Street and
Oakton Street, June 25th to July 4th, 1958. On motion by Alderman Tures and
second by Massman the request was granted.
CHAMBER OF COMMERCE LETTER. The Clerk read the following letter:
Our Board of Directors at the last meeting on Thursday,"the 17th, asked me to
follow up our January 27th letter regarding the following:
1 -.Recommend tb the City Council of Des Plaines that they endeavor to get
the Northwestern Railroad to extend the pedestrian loading platform East of
Pearson Street toward Des Plaines avenue so that trains could load and unload
passengers without interfering with Lee Street traffic during such periods.

2 - Request the City Council to take steps to remove the "Dog leg" in Miner
Street at its intersection with River Road.
