REGULAR MEETING OF THE CITY COUNCIL OF
DES PLAINES, ILLINOIS HELD IN COUNCIL
ROOM, CITY HALL,, APRIL 21, 1958
CALL TO ODER. The meeting was called to order by Mayor Herbert H. Behrel the
City Clerk being absent the Deputy Clerk called the roll with the following:
Alderman Tistle, Massman, Bell, McKay, Callaghan, Rateike, Wright, Neff, Wexler,
Figard and Prickett responding to call.
APPROVAL OF MINUTES. The motion was made by Alderman Rateike and second by
Prickett to approve the minutes of April 7, 1958. The motion was voted upon
by acclamation.
On a motion by Alderman Figard and second by Callaghan the bids for Catch Basin
cleaning, Parking lot house wrecking and Radio equipment were opened by the
Deputy Clerk.
Alderman Martin appeared at this time.
CATCH BASIN BID TO CITY SANITARY SERVICE. On a motion by Alderman Prickett and
second by Massman to refer the one bid for cleaning catch basins to the Sewer
LCZ Committee. Alderman Prickett and Massman withdrew their motion in favor of
CD a motion by Alderman McKay and second by Callaghan to award the catch basin
bid to City Sanitary Service, Wilmette, Illinois for $3.85 per basin. The Mayor
put the question and the Deputy Clerk call the roll with the following results:
Ayes: Alderman Tistle, Massman, Bell, Mckay, Callaghan, Rateike, Wright, Neff,
et
Wexler, Martin Figard and Prickett. Nays: None. The Mayor declared the motion
carried.

BIDS FOR DEMOLISHING BUILDING LOT. 35. On a motion by Alderman Tistle and second
by Figard to refer to the Parking Lot and Buildings and Grounds Committee for
inspection and report at next meeting the following bids:

RADIO EQUIPMENT FOR POLICE AND FIRE DEPARTMENTS. Oh a motion by Alderman 'Wright

OFFICIAL REPORTS. The Deputy Clerk presented the City Clerks three month
appropriation expenditures report and City Treasurers April report.
TRAFFIC LIGHTS FOR GOLF AND WOLF ROADS. Engineer Fletcher requested approval
to advertise for bids returnable May 19, 1958 for traffic lights for Golf and
Wolf Roads. On a motion by Alderman McKay and second by Callaghan the approval
was received.
BIDS FOR SERVICE LINE ON DEMPSTER STREET FOR TOLL ROAD. On a motion by Alderman
McKay and second by Rateike, Engineer Fletcher was granted permission to take
bids on service line on Dempster Street for Toll Road, to be paid by Toll Road
Commission and referred to the Water and Finance Committees and City Engineer.
HAUL ROAD DAM BLOCKING DES PLAINES RIVER. On a motion by Alderman Bell and
second by Rateike the attorney and superintendent of public works were instructed
to contact the Toll Road Commission and the Division of Waterways regarding
the haul road dam blocking the Des Plaines River to increase the opening in the
river.
Attorney Dowd presented his legal decision on the Finance Officer or Purchasing
Agent and Alderman Prickett calla meeting for April 23, 1958 at 8:00 P.M. to
discuss further.
G LEICH SUBDIVISION. On a motion by Alderman Bell and second by Massman to
authorize the Mayor and City Clerk to sign plat pending receipt of contract
specifying his intent regarding the park district.

COUNTY REZONING "OAXTON STREET GOLF RANGE". The Council approved sending
Alderman Neff, John Geiger and Christopher Chamales to the county :rezoning
hearing April 24, 1958 on 9 2/3 acres bounded by Oakton Street on the south and
Forest Avenue on the north, approximately 163 feet west of Second Avenue from
F(Farming) to B-2(Business, Tavern & Amusement).representing the city.
The City Clerk was instructed to contact Park district regarding titles to
Lowenberg and Lowenberg and DiMucci properties for proposed parks.
THACKER STREET PARKING. On a motion by Alderman McKay and second by Callaghan
the attorney was instructed to draw proper amendment to the Traffic Code reading
— parking prohibited on the north side of Thacker Street from the easterly
boundary of Junior High School to Des Plaines Avenue between the hours of
8:00 A.M. and 6:00 P.M. except Sundays and holidays. The motion was voted upon
by acclamation.
HAULING GIRTERS FOR TOLL ROAD APPROVED. On a motion by Alderman McKay and second
by Callaghan the council approved the moving of Toll Road girters from railroad
to Toll road with a $100.00 Street Permit.
ORCHARD PLACE DRAINAGE PROBLEM. Alderman McKay read the following letter:
Referring to our report of April 7 which was based on letter fromCity Engineer
and Superintendent of Public Works dated March 3, and in connection with which
the Superintendent was authorized to spend not to exceed $500.00 plus labor and
the use of one city truck, in an effort to afford some prompt drainage relief
in the Orchard Place area; the Pleasant Homes•Development Company to pay for
the grading equipment and to furnish one truck.
In line with the statement of the City Engineer and the Superintendent of
Public Works that the best solution to the Orchard Place Drainage problem would
be to install sewers in Maple, Scott, Craig, Halsey, Nimitz and other streets,
at an estimated cost of $125,000.00, we recommended that the matter be referred
to the Board of Local Improvements to consider the possibility of special
assessment proceedings.
However, the City Engineer informed the Council on April 7 that it would be
feasible to install a 36" storm sewer from Peterson Lake west to Craig Drive, at
a sufficient depth so that it could eventually be extended throughout the
Orchard Place area, as a preliminary installation at an estimated cost of
$10,000.00 plus the use of city forces to ditch from the low area on Pratt,
Nimitz and Halsey to catch basins which would be installed at Craig Drive. The
City Engineer also stated that this $10,000.00 job was authorized and completed
it could be a part of the $125,000.00 comprehensive plan. That being so, it
would seem that the estimated cost of the comprehensive plan should be reduced
by $10,000.00 and the Board of Local Improvements should bear that fact in
mind when considering special assessment proceedings for the comprehensive
project.
It is recommended by the Sewer Committee: That the City Council authorize the
above—described preliminary storm sewer project at estimated cost of $10,000.00
plus the use of city forces for ditching from the low areas entioned to catch
basins at Craig Drive, the $10,000.00 to be taken from the item of $50,000.00
for "sewer extension and rehabilitation" included in the 1958 appropriations.
That inasmuch as this $10,000.00 would come from genera]. city sewer funds, the
Board of Local Improvements should take this into account when considering
apecial assessment proceedings for the comprehensive storm sewer proposal,
and if possible the special assessment should cover all property which benefits
from both the $10,000.00 preliminary project and the $115,000.00 comprehensive
project.

IMPROVEMENT OF -PARKING LOT 6 "OLD NORTH SCHOOL" PROPERTY. On a motion Cy
Alderman Wexler and second by Rateike the council approved advertising for
bids. for grading Parking Lot 6 returnable at the May 5, 1958 meeting.
On a motion by Wexler and second by Prickett the Council approved extension
on vacation of Campany property on Park Place parking lot from April 30, to
May 15, 1958.
LOT 33 PARK PLACE PARKING LOT APPROVED. On a motion by Alderman Wexler and
second by Prickett to approve the purchase of Lot 33 of Park Place parking
lot for $27,225.00 and authorization of Mayor and City Clerk signature pending
necessary signature of parties concerned. The Mayor put the question and the
Deputy Clerk called the roll with the following results: Ayes: Alderman
Tistle, Massman Bell, McKay, Callaghan, Rateike, Wright, Neff, Wexler, Martin,
Figard and Prickett. Nays: None. The Mayor declared the motion carried.

Mayor Behrel appointed Robert Blume, President of 'Safety Council and Charles
Forberg Chairman of Traffic Commission to serve with Alderman Wexler on the

/nAlderman Wright reported the interior supplies of. new Library building will come

by Tistle the Council concurred in the report of the zoning Board of Appeals
to deny petition.
OFF-STREET PARKING AND LOADING FACILITIES. On a motion by Alderman Neff and seond
by Callaghan the Council concurred in the report of the Zoning Board of Appeals
to approve petition.
1100 NORTHWEST HIGHWAY, CELOTEX CORPORATION. On a motion by Alderman Massman
and second by Rateike the Council concurred in the report of the Zoning Board

M. HOWARD LETTER ON BAUSKE AND PREMIER ROSE GARDEN CASE. On a motion by
Alderman Prickett and second by Tistle the following to be included in the
minutes:
I enclose herewith a copy of a dissenting opinion in the Supreme Court in the
recent case of Bauske and Premier.Rose Gardens, Inc. v. City of Des Plaines
in order .to complete the record of this case in the City files. I only last

week received this dissenting opinion and did not know up to this time that
the case had been decided against us by the narrow margin of four to three.
The opinion is brief but vigorous and it gives me some satisfaction at least
to know that our case convinced some of the justices and that the decision was
by such a narrow margin as four to three, rather than the seven to nothing;;
margin which I had heretofore believed.
I regret that the existence of the dissenting opinion does not change the
final result. It is some satisfaction, however, to know that the reasons
which we advanced, both in writing and, upon the oral argument of this case,
are the bases of the dessenting opinion.

BAUSKE & PREMIER ROSE GARDENS, INC. v. CITY OF DES PLAINES
MR. JUSTICE SCHAEFER, dissenting:
By its decree the trial court rezoned for factory uses an area of, 138 acres
in the city of Des Plaines. The entire tract is vacant except for the green-
houses which, with their boiler plants and other improvements occupy 17 acres
along the western boundary. The railroad that is said to "traverse" the
property is actually its western boundary. A careful reading of the opinion
shows that the surrounding area is conceded to be residential. The record
shows that within a radius of 350 feet from the center of this tract (and
of course much closer to its borders) there are 1016 residential buildings.
It may be that a legislative body could reasonably decide tIa t a portion of
the tract near to the railroadand next to that part now used for greenhouses
could properly be reclassified. But it is hard to believe that a responsible
legislature would rezone the entire area so that factories would be placed
in close proximity to the residences that have been built around its borders.
It is even harder to believe that this court would sustain such a legislative
rezoning if the question came before it.
The opinion reaches the result that it does by repeated characterization of
the neighboring residences as "moderately priced". But the protection of
zoning is not restricted to high priced property (See Kennely v. City of
Chicago, 11 I11.2d 302,308.) The opinion does not mention the losses that the
many owners of•these moderately priced homes will suffer when factories,
with facilities for parking 2900 cars, are put in their midst. Yet the testimony
of many witnesses was that the aggregate loss would total a minimum of $2,000,000.
It would be hard to find in Cook County any area nearly 1/2 a square mile
whose borders do not lie close to some important highways., Yet the opinion
reaches out to discuss the two toll roads that lie 3/4 of a mile and more
distant from this property. The influence of the airport upon the property
is, in my opinion, exaggerated in the same fashion.
I think that in this case there has been a gross usurpation of the legislative
function, and so I dissent.
DAVIS, C.J., and HERSHEY, J., join in this dissent.

Prickett and second by Wexler the Council approved tabling off-street parking
ordinance to May 5, 1958 meeting.
INCREASE STREET APPROPRIATION ORDINANCE. The Deputy Clerk read for second reading
the above ordinance. On a motion by Alderman McKay and second by Prickett to
adopt the ordinance increasing the Street Fund appropriation number 6 to
$32,683.00. The Mayor put the question and the deputy Clerk called the roll
with the following results: Ayes: Alderman Tistle, Massman, Bell;, McKay,
Callaghan, Rateike, Wright, Neff, Wexler, Martin, Figard and Prickett. Nays:

The letter from the Maine Township Squadron of Civil Air Defense letter
regarding ambulance was referred to the Police and Fire Committees.
BUILDING LINE VARIATION CENTER STREET. On a motion by Alderman Prickett and
second by Massman to refer to the Zoning Board of Appeals sitting as a
Commission the above zoning variation.
MEMORIAL DAY WREATH. On a motion by Alderman Martin and second by Figard to
approve the presentation of a wreath for the Memorial Day Ceremonies. The
Mayor put the question and the Deputy Clerk called the roll with the following
results: Ayes: Alderman Tistle, Massman, Bell, McKay, Callaghan, Rateike,

Zoning violation at Oakton Street and Soo Line Railway was referred to the Police
Department and building Department for inspection and report.

was referred to the Police Department for inspection and report.

Third paragraph page five - Moved by McKay seconded by Rateike that the ordinance
be adopted. Page 6 second line should read "Third Avenue east to end" instead of
"west to end". Third line should read "Fourth Avenue east to end" instead "west
to end". Page 6, resolution on maintenance of Arterial streets, line reading,
"Cumberland Parkway from Golf road to Warrington" should read "Golf Road to
Washington Street" Approximate cost $4,000.00. Page 6. Subject "Building Line
variation - Center Street, minutes should show "Notion adopted by acclamation".
The motion was voted upon by acclamation with corrections made.
The Council approved to open the three types of bids on motion by Alderman Tures
and second by Tistle.
SIDEWALK BIDS. There were eight bids low bid $.52 cents per square foot and high
bid $.75 cents. On motion by Alderman Tures and second by Bell the bide were
referred to Street Committee.
FUEL OIL BIDS. There were eight bids with prices of discount from - cent to 2 cents
per gallon. On motion by Alderman Rateike and second by Tistle the bids were,
referred to the Public Building and Grounds Committee.
IMPROVEMENT PARKING LOT NUMBER6. (NORTH SCHOOL): The following three bids were
received:
Skokie Valley Asphalt Company $ 26,377.00
Black Top Roads Company 25,750.00
Milburn Brothers 24,713.00
On motion by Alderman Tistle and second by Tures the bids were referred to
Parking Meter Committee.
OFFICIAL REPORTS. The Clerk submitted the reports of Commissioner Rieck and
City Clerk for April, also, three month report of Chief Kennicott. Chiefs Kolze
and Kennicott reporton on zoning inspections.
Alderman Rateike reported they would advertise bids on remodeling city hall in
June. He said that the Council members would receive a copy of plans.
