Social Security.
HOWARD STREET SEWER CONTRACT ORDINANCE. The Council had discussed the contract
with Mr. Wagner and had delayed further discussion until Mr.!Brandel would
arrive. After considerable discussion with the two gentlemen the motion was
made by Alderman Dunlap and seconded by Tistle to adopt the ordinance and
authorize the Mayor and Clerk to sign the renewed contract. The Mayor put
the question and the Clerk called the roll with the following results: Ayes:
Alderman Martin,'Prickett, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap,
Wright, Tures, Neff, Wexler, Nay8 LNone. The Mayor declared the motion carried.

On motion by'Alderman McKay and second by Rateike Superintendent WTarnicke
was instructed to place temporary no parking on one side of Cornell Avenue.

FEBRUARY 3. 1955 AT 5:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Herbert H, Behrel who
presided with Alderman Prickett, Tistle, McKay, Callaghan, Rateike, Dunlap, Tures,
Wright, Neff, Wexler, Martin and Figard responding to roll call.
The Mayor informed the Council that Alderman Bell would not be at the meeting so
the Rand and River Roads, street and alley vacationtwould not) be discussed until
the February 17th meeting.
APPROVAL OF MINUTES. The motion was made by Alderman Prickett and'seconded by
Dunlap to adopt the minutes of January 20th and adjourned meeting of January 27,
1958. Alderman McKay requested a correction that he made the motion instead
of Alderman Neff to suspend the rules and place the ordinance on passage for
Sewer Contract Agreement. The motion was then voted upon by acclamation with
correction made.
OFFICIAL REPORTS. The Clerk submitted the reports of Building Commissioner and
City Clerk for January, also, the Clerk's annual report of receipts and
disbursements and the annual report of Librarian Mrs. Smith.
TO ADVERTISE BIDS FOR POLICE RADIO EQUIPMENT. On motion by Alderman Tures and
second by Tistle the Council approved to advertise bids for police radio
equipment which will be partly paidby the Government for Civilian Defense.

TO APPOINT CROSSING PATROLMAN. On recommendation by the Police Commission and
motion by Alderman Tures which was seconded by Martin the Council 'instructed
the Police Chief to employ a crossing patrolman for Second and Thacker Streets.
TO ADVERTISE BIDS FOR POLICE CAR RENTAL. On motion by Alderman Tures and second
by Callaghan the Police Commission are to prepare specifications and advertise
bids for police car rental to be received for the March 3, 1958 meeting.
TO ADVVERTISE BIDS - STATION WAGON FOR FIRE DEPARTMENT. On recommendation of
Fire Committee and motion by Alderman Tistle and seconded by Rateike the Fire
Committee is to advertise for bids for station wagon which are to be received
at the Maarch 3, 1958, meeting.
Alderman Callaghan made a progress report regarding the survey to have cities sell
State license plates that the Clerk,has written regarding compensation for clerks,

The representative•of Toll Roads presented two ordinances which,are to make
some corrections'on two previous ordinances adopted. The ordinances were placed
on first reading.
The motion was made by Alderman Tures and seconded•by,Duilap requesting Council
permission to purchase Graphotype machine to make up addressograph plate addresses
which was requested by City Clerk. After discussion it was referred back to
Water Committee.
At the request of Alderman Martin the Mayor referred to the Water Committee, City
Engineer and Superintendent for a report on future water supply.
WATER RATE OUTSIDE CITY. Alderman Tures reported the Water Committee investigated
and found the City operates in the black at 33 cents per 100 cubic feet within the
City, therefore, it stands to reason that the City realized a substantial profit
at the 66 cent rate outside the City Limits. They recpmmend no increase in
rates outside the City Limits at the present time. On a motion by Alderman Tures
and second by Tistle the Council concurred in the report.
SPRAYING BID AWARDED TO CLARKE OUTDOOR SPRAYING COMPANY. Alderman Dunlap reported
that as both lowest bidder and the capable company handling the sucessful spraying

and awarded for this work in 1958 at the rate quoted,namely .85 centsper
ygallon
applied. The motion was made by Alderman Dunlap and seconded by Callaghan to
''..� award the contract to the Clarke Outdoor Spraying Company for .85 cents per gallon.

TREE TRIMMING BID AWARDED BISHOP'S TREE SERVICE. Alderman Dunlap made the
following report:
Your Committee on Elm Disease Control has investigated the above and has found:
that five bids were received as follows: Hargrave - 3.30/ man hr., Button -
3.34/man hr., Bishop - 3.50/man hr., Synnesvedt - 3.60/man hr., Fowler - 3.60/
man Hr. Your Committee and Mr. Warnicke held two meetings in which careful
consideration was given to the qualifications of the Hargrave company, the
Button company and the Bishop company. The Bishop company has been handling
the City's forestry work under the Elin Disease Control program for the past
two years. Your committee interviewed both Mr. Hargrave and Mr. Button in
person to to obtain the fullest possible picutre of their qualifications to
handle this important program. We, your committee on Elm Disease Control, there=
fore recommend: Based upon the unprecedented success of the program using the
workmanship of the Bishop company together with the Clarke company, your committee
has felt that any contractor replacing these companies, recommend approval of
the Bishop Tree & Landscape Service bid of $3.50 per man hour, the same rate
paid in 1957, for tree trimming'and removal under the supervision of the Supt.

After discussion the motion was made by Alderman Dunlap and seconded by
Callaghan to award the bid to the Bishop Tree Service at $3.50 per man per hour.

results: Ayes: Alderman McKay, Callaghan, Rateike, Dunlap, Neff, Wexler,
Martin and Figard. Nays: Alderman Wright, Tures, Prickett and Tistle.
The Mayor declared the motion carried.
Alderman Wright reported the Library roof was leaking Alderman Rateike said he
had been informed and when the snow would begone that Rosenow Roofing Company
would investigate and repair.
The motion was made by Alderman Wexler and seconded by Dunlap to approve the
Mayor's appointment of Locomen Eley for the Chicago and Northwestern Railway
zoning case.
APPROVAL OF BILIS. Alderman Prickett presented the' following resolution:

THE CITY OF DES PLAINES THAT THE FOLLOWING
BILLS ARE DUE AND PAYABLE AND THAT THE

on file with the City Clerk). The motion was made by Alderman Prickett and
seconded by Martin to adopt the resolution. At the request of Alderman Martin
two bills in the Building Control and Inspection Department be held out. Elmhurst
Firestone - tires - $49.78. A. Rieck - expense - $27.25. The Mayor put the
question and the Clerk called the roll with the following results: Ayes:

Neff, Wexler, Martin and Figard. Nays: None. The Mayor d'eclared the motion
carried with the two items withdrawn.
MARSHALL HOWARD LETTER - PREMIER ROSE GARDENS. The Clerk read the following
letter:
I regret very much to inform you that the Supreme,Court has denied my
petition for rehearing in the case of Bauske and Premier Rose Gardens Corporation
vs. City of Des Plaines. In denying petitions for rehearing no reasons are
given or opinion rendered. I can therefore give you no reasons other than
those contained in the original opinion. I am sincerely sorry that the
tremendous amount of time, both of myself and innumerable others who cooperated
with me in the matter, has been spent to no avail.
It is my opinion that there is nothing further which can be done' in the courts
to prevent this entire area from becoming industrial. I do, believe, however,
that there are a number of things which are extremely important in this
connection and which ought to be done and should like the opportunity of,
consulting with the Mayor or the appropriate committees or 'members of the
City Council with reference to such recommendations.

PLAN COMMISSION LETTER - PLANNING AND ZONING MAP. The Clerk read the following
letter:
Your Plan Commission has approved the'planning and zoning map to be •
known as the "COMPREHENSIVE CITY PLAN OF DES PLAINES, ILLINOIS, AND ENVIRONS"
at our meeting on February 3, 1958. This map, as prepared by Christopher
Chamales and Associates has been thoroughly studied and checked by the Plan
Commission.
Over fifty modifications and/or corrections have been made since the first
preliminary prints were issued in November - 1957: We genuinely appreciate
the interest shown by the aldermen in assisting in the final check on this map.
We recommend that the City Council approve the map and that the Mayor and
City Clerk sign it at theearliest"possible date. It should be pointed out
that ten to fifteen days will be required to reproduce theimap for public
distribution after it is approved. "

PLAN COMMISSION LETTER - NEW ZONING ORDINANCE. The Clerk read the following
letter.
Your Plan Commission is submitting herewith our recommendations for a
complete new ordinance to be known as "THE ZONING ORDINANCE OF THE CITY OF
DES PLAINES". This proposed ordinance was approved at the Plan Commission
meeting of February 3, 1958.
The zoning requirements and restrictions as presented are the result of detailed
study and analysis by the City Planner and your Plan Commission. This ordinance
should be considered as complementing the new zoning map as presented on this
date.
We recommend that this ordinance be referred to the proper City!Council

Committees for stbdy and approval and that the resulting "ordinance be adopted by
the.City Council as soon as possible. The new regulations embodied therein will
do much to protect our community and to effect a more orderly development of
vaca t tracts.
The Plan Commission will be happy to consider recommendations from Council
Committees for modifications of this ordinance which will improve it legally and
practically.

WISCONSIN CENTRAL RAILROAD COMPANY LICENSE -HOWARD STREET S Dr., The Clerk
informed the Council he had received two license forms for Howard Street sewer
under the railroad property. On motion by Alderman Dunlap and second by
Rateike the Mayor and City Clerk were authorized to execute the permit.
AGREEMENTS FOR LIGHTS AND GATES AT PROSPECT AVENUE. The Clerk had received five
copies of agreement between City of Des Plaines, the State of Illinois and the
CD Wisconsin Central Railroad, covering the installation of flashing signals and
gates at Prospect,Avenue in Des Plaines to be executed by the City and forwarded
to Mr. Dutelle at Springfield for final execution by the State. On motion by
C Alderman Tistle and second by Prickett the Mayor and Clerk were authorized to
execute same.

ILLINOIS COMMERCE COMMISSION RESOLUTIONS. The Clerk informed the Council he
had received two certified resolutions from the Commerce Commission authorizing
the Soo Line to change in protection at Oakton Street and Prospect Avenue
crossings.
REZONING APPLICATION NORTHEAST CORNER GRACELAND AND OAKWOOD AVENUES. The Clerk
presented the above rezoning application. On motion by Alderman Figard and
second by Prickett the application was referred to the Zoning Board sitting as
a commission to call a hearing.•
REZONING APPLICATION WEST SIDE OF GRACELAND AVENUE AT OAKWOOD AVENUE. The%Clerk
presented the above rezoning application. On motion by Alderman Figard and
second by Prickett the Application was referred to the ;Zoning Board sitting as
a Commission to call a hearing.
RESOLUTION REGARDING CHICAGO AND NORTHWESTERN RAILWAY INCREASED RATES. The Clerk
presented the resolution regarding the increase in Chicago and Northwestern Rail-
way rates. The motion was made by Alderman Wright and seconded by Callaghan
to adopt the resolution. A discussion on some of the items in resolution after
which the Mayor referred the resolution to City Attorney to redraft and the
Aldermen to contact the .Attorney regarding changes.
FIRST READING ZONING -ORDINANCE SOUTHWEST CORNER RAND AND WOLF ROADS. The Clerk read
for first reading the above ordinance.
KENNETH MEYER LETTER -SCHOOL LAND: The Clerk read the following letter:
The Board of Education of School District 62 has authorized me to contact you
with respect to acquiring a portion of the Westfield School site located
northerly of the water softening plant.
From the survey in my office, it would appear that the portion you are interested
in is a tract 330 ft. running East and.West by 140.22 Ft. running North and
South. This area comprises 46,272 sq. ft. or 1.06 acres.
The School Board is willing to sell this tract to you at the same price per
acres that they paid for it, namely, $3025 per acre. Therefore, on the basis
of 1.06 acres, the Board of Education would expect $3206.50 on the parcel
in question.
For a School Board to sell land to a City, certain specific steps must be taken
by the Board as well as the City, Therefore, if the price mentioned above is
satisfactory to the City and they wish to accept this offer, please let me know
so that I can have the School Board adopt the proper resolution. The City
Attorney should then of course prepare the necessary ordinances required to
be passed by the City Council. Awaiting your further advice in this matter,

The Clerk read a letter from Soo Line that the Algonquin Road crossing was
repaired January 14, 1958.
PLAT AT SOUTHWEST CORNER WOLF AND CENTRAL ROAD. The Clerk submitted a plat at
the above location. The Mayor referred the plat to Plan Commission.
TRAIN SWITCHING AT THACKER STREET WEST OF WOLF ROAD BELT LINE. The Ma'yor
referred to the Street Committee regarding the switching on Belt Line on Thacker
Street West of Wolf Road.
CHICAGO AND NORTHWESTERN RAILWAY STATION CROSSING. The motion was made by
Alderman Wexler and seconded by Wright to give a vote of confidence to Attorney
Lommen Eley ,nd Mayor regarding opening the crossing at Chicago and Northwestern
Railway Station. On motion by Alderman McKay and second by Prickett the motion was
amended to insist on automatic gates or some other device. The original motion
was amended was voted upon by acclamation.

CALL TO ORDER: The meeting was called to order by Mayor Herbert H. Belrel with

Martin and Figard responding to roll call. Alderman Tures and Callaghan were
absent.
APPROVAL OF MINUTES: The motion was made by Alderman Prickett and seconded by
Figard to approve the minutes of February 3, 1958. The motion was voted upon
by acclamation.
CANVASS BALLOTS OF SIXTH WARD ELECTION. The Mayor told the Council as a new
Alderman had been elected that he thought the Alderman should be installed so
to be in attendance at the entire meeting. On a motion by Alderman Rateike and
second by Dunlap the Council approved to canvass the ballots. The Mayor appointed
Alderman Prickett, Martin and Wright to canvass. The Mayor, called a recess and
after reconvening Alderman Prickett report the following ballots cast:
