CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel with Alderman Figard, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap, Tures, Wright, Neff and Wexler responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Rateike and seconded by Tistle to approve the minutes of January 6,, and adjourned meeting of January 13, 1958. The motion was voted upon by acclamation. OPEN BIDS FOR TREE SPRAYING AND TRIMMING. On motion by Alderman Bell and second by Dunlap the Clerk opened, the bids for the above. The following bids were received for spraying: Fowler Tree Surgery Co.,, Elgin, Illinois per gallon $ .90 Reiger Tree Service, Aurbra, Illinois It II .94 Gullian Tree Service -Co., Elmhurst, Illinois it " 1,35 Hargrave Tree& Landscape Service,Barrington,Ill. It It .87 Clark Outdoor Spraying Co., LaGrange, Illinois " It .85 1 1 $ 3.60 3.60 3.30 3.34 3.50 On motion byAlderman Dunlap and second by Callaghan the spraying bids were referred to the Dutch Elm Tree Disease Committee. On motion by Alderman Dunlap and second by Callaghan the tree trimming bids were referred to the Dutch Elm Tree Disease Committee. Both items to be reported on at next Council rotting. OFFICIAL REPORTS. The Clerk submitted the reports of City Treasurer for December and the Annual reports of Chief Kolze and Chief Kennicott. City Engineer Fletcher reported about moving of manhole and 15 feet of sewer regarding Toll Road, which expense would be paid by Toll Road Commission. On motion by Alderman McKay and second by Dunlap, Fletcher was instructed to advertise for bids. Engineer Fletcher reported of his meeting at Springfield with the State Highway Department officials regarding Motor Fuel Tax Funds for Cumberland Street Lights, that the City would receive some fundi but must readvertise for bids which must be approved by the State Highway Department. The Clerk was instructed to return all bids which will be received which were advertised and explain the reason for returning same. On motion by Alderman Callaghan and second by McKay the recommendation was approved. On motion by Alderman McKay and second by Tures the Engineer is to readvertise for bids. RIVER RAND ROADS ANNEXATION. Alderman Bell reported the Municipal Development Committee recommended to approve the annexation of the Northwest corner of River and Rand Roads and that the ordinances for annexation, reqoning and street -alley -vacation be adopted. After discussion the Council voted to approve the recommendation with Alderman Neff voting nay. The Clerk read a letter from Plan Commission recommending the annexation. REZONING SOUTHEAST CORNER OF WOLF AND RAND ROADS. Alderman Bell requested that Alderman Dunlap report on the majority report of the Municipal Development Committee on the rezoning the southeast corner of Wolf and Rand Roads. Alderman Dunlap read the following report: In studying the relative merits involved in this question the entire Municipal Development Committee has listened to many interested persons and given the request for re -zoning much time and careful thought. This is the second time this request has been before the council. The previous request for re -zoning to commercial for a gas station was denied. The protection of existing property and its owners for actions that adversely affect them and selfishly serve only to profit a few is a duty of this Council and its agencies. 58'%31 ;LU/50 We must also exercise our duty to protect the future development of the community in the best way we can. The City Plan is for this purpose. It's land use designations should be changed by Council action only for very compelling reasons. It represents the considered judgement of the Council, Plan Commission, Zoning Board and many other capable authorities who have helped in its preparations as to the highest and best use of land in and close to the city. Likewise, the recommendations of the Zoning Board of Appeals,ehould be reversed only for very compelling reasons. It would be contrary to these principles for the Council to put itself in the. position of approving this re -zoning against the Zoning Boards unanimous denial of it, against the City Plan and against the interests of the existing property owners in one of our most valuable residential sections. The developigent of a gas stat3.on on the property in question will unquestionably create a blight on both existing built up r operty in Cumberland and also on undeveloped highly desirable residential land to the north and east and west. , Des Plaines needs a proper balance of light industry, commercial and residential property. But this does not mean that we need a gas station at the corner of Wolf and Rand Road. Move that request to re -zoning be denied. Alderman Bell then made the following minority report: Wolf Road meets Rand Road at 53 deg. angle. Both Wolf Rd. and Rand Rd. are heavily traveled highways. Corner is wholly unsuitable for. single family residential toning. A court case over so obviously a commercial tract would be an unjust use of public funds. We, your Committee on Municipal Development, therefore recommend: Approval of rezoning as requested to commercial and multi -family as requested. /s/ R. A. The Mayor put the question and the Clerk called the roll with the following results: Ayes: Alderman Dunlap, Neff, Wexler, McKay and Callaghan. Nays: Alderman Rateike, Wright, Tures, Figard, Tistle and Bell. The Mayor declared the motion lost. The motion was made by Alderman Bell and seconded by Tures to approve the rezoning and the attorney'to draft an ordinance. The Mayor put the question and the Clerk called the roll with the following results: Ayes: Alderman Figard,1Tistle, Bell, Rateike, Wright and Tures. Nays: Alderman Dunlap, Neff, Wexler, McKay and Callaghan. The Mayor declared the motion carried. Alderman Tures reported the Police Committee recommends the Fire and Police Commission certify one additional patrolman. Chief to put police force on 40 hour week on a trial basis to May 15, 1958. Chief Kennicott then reported the set-up for shifts of which each Aldermen received a copy. The motion was made by Alderman Tures and seconded by Callaghan that the Fire and Police Commission certify one additional patrolman and that Chief ofl Police put the 40 hour week on trial basis. Nays: None. The Mayor declared the motion carried. SCHOOL PATROLMAN - SECOND AVENUE AND THACKER STREET. Alderman McKay made the following report: With reference to letter of Safety Council dated November 15th, in which it is recommended the City Council appropriate funds to provide adult crossing guard at Thacker and Second to protect pupils going to and coming from West School. Safety Council also recommends that all school crossing guards be provided with light weight stop signs and Safety Council offers to pay for the signs if the City Council will authorize their use. As this is a matter of policing traffic, and as funds for crossing guards are included in the 1958 appropriation ordinance, it is recommended that the Police Committee have the Police Department make a prompt survey of the intersection in question and inform the City Council whether adult crossing guard should be provided. It is also recommended that the Police Committee give consideration to the matter of equipping all crossing guards with light weight Stop signs. /s/ S. E. McKay /s/ S. E. On motion by Alderman Dunlap and second by Callaghan the Council approved to place a temporary crossing guard at Second Avenue and Thacker Street. Alderman McKay made the following report: With reference to complaint concerning Soo Line crossing at Thacker Street. We are informed this crossing is in the territory of the Soo Line Superintendent located at Stevens Point, Wisconsin. If agreeable to Mayor and Council we will write the Superintendent over the Mayor's signature. /s/ S. E. McKay /s/ S. E. Wexler WATER MAINS ORCHARD PLACE TO BOARD OF LOCAL IMPROVEMENT. On motion by Alderman Tures and second by Wright the installation of water mains in Orchard Place was was referred to Board of Local Improvements. GRANT WATER CONNECTION TO R.E. GEEN. RIVER ROAD AND H. WOLFE, 2256 DEMPSTER STREET. Alderman Tures reported of two requests for use of water for the above. He reported the Council has permitted about ten outside the City water tap -ons during the past year. Requests coming in to frequently, too many commitments inside City, the Committee recommends no further outside City tap -ons be permitted. Anyone requesting water must annex to the City. The motion was made by Alderman ct Tures and seconded by Neff to concurr in the report. After discussion the motion was made by Alderman Bell and seconded by Tures to amend the motion to grant the two requests for water but no more requests for water will be granted for outside. the City. Any party wanting water must annex to the City. This motion was approved by Council Alderman Neff voting Nay. The Council approved the former motion as amended with Alderman Neff voting Nay. At Alderman Neff's request the Mayor referred to the Water Committee to investigate to triple the outside water users rate over City rate. TO ADVERTISE BIDS TO DEMOLISH THREE HOUSES ON PARKING LOT. On motion by Alderman Wexler and second by Figard the Superintendent is to advertise bids for demolishing the three houses on Park Place. RESOLUTION TO PURCHASE FOUR REMAINING LOTS FOR PARKING LOT. The motion was made by Alderman Wexler and seconded by Dunlap to adopt the above resolution. The Mayor put the question and the Clerk called the roll with the following resu;ts: Ayes: Alderman Figard, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap, Wright, Tures, Neff and Wexler. Nays: None. The Mayor declared the motion carried. CONTRACT TO PURCHASE COMPANY PROPERTY. The motion was made by Alderman Wexler and seconded by Callaghan to have the Mayor and Clerk sign the contract for the Company property for parking lot. The Mayor put the question and the Clerk calledthe roll with the rollowing results: Ayes: Alderman Rateike, Dunlap, Wright, Tures, Neff, Wexler, Figard, Tistle, Bell, McKay and Callaghan. Nays: None. The Mayor declared the motion carried. Alderman Wexler said the Superintendent of Public Works is to be instructed to get the Park Place and North School parking lots prepared for parking at soon as possible. APPROVAL OF BILLS: Alderman McKay presented the following resolution:' BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total: $47,196.52. (A copy of resolution placed before each Alderman and on file with City Clerk.) The motion was made by Alderman McKay and seconded by Bell to adopt the resolution. The Mayor informed the Council the Board of Local Improvements would meet Monday January 27, 1958 and the Clerk notify the members. 588 1/2o/58 At request of Superintendent Warnicke the Mayor referred to the Water Committee the items of selling the equipment at Normal Well. The Clerk informed the Council he had a copy of letter from Soo Line to the County and State Highway Departments about euipinguadditional side light assemblies at a cost of $275.00 each at Prospect Avenue and Touhy Avenue gates. The Clerk informed the Council he has a copy of letter from Zoning Board granting variation to build two homes at 1700 and 1708 Van Buren Street. Alderman Wexler had reported that the City Clerk had received the three titles to property for Park Place parking lot'and that the City attorney to take proceedings to cause this property to be shown tax exempt for1958and subsequent years. ADOPT ZONING ORDINANCE TO MULTIPLE FAMILY NORTHEAST CORNER CORA STREET AND ASHLAND AVENUE. The Clerk read for second reading the above ordinance. The motion was made by Alderman Wexler and second by Callaghan to adopt the lordinance. The Mayor put the question and the Clerk called the roll with they following results: Ayes: Alderman Figard, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap, Wright, Tures, Neff and Wexler. The Clerk reported Illinois Commerce Commission hearing on Chicagoland Northwestern Railway rate increase hearing March 12, 1958 at 10:00 A.M. The Clerk had received a letter from Mt. Prospect's Village manager inquiring if the City Council was taking any action. The 'City Attorney was instructed to contact the Manager to inform him about resolutions which Park Ridge Attorney was preparing. i The Mayor referred a letter from South School Principal regarding black topping Everett Stre'et'at the school to the Street Committee. A letter from Glen -Plaines Civic Association requesting lights at Iris Lane and Estes Avenue was referred to the Superintendent to report back,next week. The Clerk read for first reading the above ordinance to vacate streets and alleys in the property on northwest corner Rand and River Roads. The Motion was made by Alderman Bell and seconded by Tures to suspend the rules and adopt the ordinance!. After considerable discussion the Council decided to adjourn the meeting'to next Monday to give the Aldermen an opportunity to investigate where the streets are located, at which,time they will vote on the motion. ORDINANCE TO ENTER INTO A SEWER CONTRACT AGREEMENT. The Clerk read for first reading the above ordinance. The Ordinance is to change the time limit to February 28, 1958 from January 15, 1958. The motion was made by Alderman Neff and seconded by Tistle to suspend the rules and adopt the ordinance. On a motion by Alderman McKay and second by Callaghan the Council referred to the L{) Zoning Board of Appeals sitting as a Commission to call a hearing to rezone the Chicago and Northwestern Railway property south of Cumberland Station to Commercial. Q MCKAY AND NEALIS PLAT. The Mayor referred the McKay and Nealis Plat to the Plan Commission. 1 NORTHWEST HIGHWAY PLAT PLAN. The Mayor referred the above plat to Plan Commission}. ADJOURNMENT. Henrich City Clerk THE ADJOURNED MEETING OF THE CITY COUNCIL DES PLAINES, ILLINOIS HELD JANUARY 27,1958 AT_8:30 P.M. CALL TO ORDER. The meeting was called to order by Mayor Herbert Behrel who presided with Alderman Martin, Prickett, Tistle, Bell, McKay, Callaghan, Dunlap, Wright, Neff and Wexler. The Mayor informed the Council that the meeting was regarding the vacation of streets and alleys at the Northwest corner of Rand and River Roads, and the contract ordinance on Howard :Avenue .sewer. After discussion about vacating the streets and alleys for which there were two propertyowners objecting, the Council agreed to a committee meeting, including the objectors, on Tuesday, January 28. . Alderman Rateike and Tures arrived during the discussion. Alderman McKay read a report on Broadway,Avenue blacktoping and regarding parking which had been referred to the Street Committee from Parking Meter Committee. On motion by Alderman McKay and second by Callaghan the report was concurred in and referred back to the Parking Meter Committee. On motion by Alderman McKay and second by Callaghan the attorney received the information to draft an ordinance on parking hours on streets in the Northwest Highway and Broadway area. The Mayor had received a plat regarding the change of traffic at Rand Road, Lee Street and River Road and he referred the plat to the Streets Committee and Engineer. Attorney Dowd presented a Court summons regarding the Chicago and Northwestern Railway property south of Cumberland station. The Mayor referred the summons to the Judiciary Committee.
