MINUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL, DES PLAINES, ILLINOIS,, HELD IN THE
COUNCIL ROOM. DECEMBER 16.,1957 AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel with
Alderman Martin, Figard, Prickett, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap,
Tures, Wright, Neff and Wexler responding to roll call.
APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by
Figard to adopt the minutes of December 2, 1957. The motion was voted upon by
acclamation.
OFFICIAL REPORTS. The Clerk submitted the treasurers report for November.
The Mayor reported that Superintendent Wernicke had contacted the $oo Line
regarding an additional flume by Weller Creek and they will install same, also,
the Soo Line has agreed for removal of the trees along the track on First Avenue.
Alderman Bell reported the Municipal Development Committee had investigated the
rezoning to multiple family at'1522 Ashland Avenue, found no objections and
recommend the approVal of Zoning Board recommendation to rezone property to
"Multi -Family". On a motion by Alderman Bell and second by Dunlap the Council
concurred in the report.
BALLARD GARDENS PLAT. Alderman Bell reported that the Municipal Development
Committee found that two plats must be signed in order to qualify this sub-
division. Water is not from Des Plaines and sewage does not go into Des
Plaines system. The Committee recommended'Concurrence of Plan Commission, to
authorize Mayor and City Clerk to sign both plats. On a motion by,Alderman
Bell and second by Dunlap the Council concurred in the report.
MALEBRANCH PLAT. Alderman Bell reported the Plan Commission approved the above
plat which meets all requirements of property within 1 miles of City. The
Municipal Development Committee recommend the Mayor and Clerk be authorized
to sign plat. On a motion by Alderman Bell dhd Callaghan the Council concurredinthe

FIRST READING - RIVER -RAND ROAD ANNEXATION ORDINANCE. Alderman Bell reported he
had a petition for annexation and ordinance for the Northeast corner River and
Rand Roads and requested the ordinance be placed on first reading., The Clerk
read the ordinance for first reading.
TO CERTIFY TWO ADDITIONAL SERGEANTS FCR POLICE DEPARTMENT. On a•motion by Alderman
Tures and second by Wright the Council approved that the Fire and Police Commission
to certify two additional sergeants. On a motion by Alderman Tures and second by
Wright the City Attorney was instructed to draft an ordinance for the personnel
of Police Department to include one (1) Marshal, one (1) Captain, Three (3)
Lieutenants, Five (5) Sergeants and Thirty (30) Patrolmen.
The motion was made by Alderman Callaghan and second by Martin that the License
Committee recommends to adopt the Liquor Ordinance decreasing taverns to 12 and
council to concur in the recommendation. The mayor put the question and the Clerk
called the roll with the following results: Alderman Martin, Bell', McKay,
Callaghan, Dunlap, Wright, Neff and Wexler. Nays: Alderman Rateike, Tures,
Figard, Prickett and Tistle. The Mayor declared the motion carried.
ADVERTISE BIDS FOR TREE TRIMMING AND REMOVAL. On a motion by Alderman Dunlap
and second by Tures' the Council approved to advertise for bids for, tree trimming
and removal, bids to be returned for January 20, 1958 meeting.
ADVERTISE BIDS FOR DORMANT SPRAYING. On a motion by Alderman Dunlap and second by
Tures to advertise bids'for dormant spraying bids to be returned January 20, 1958,
meeting was approved by Council.
ADVERTISE BIDS FOR TRUCK AND SNOW PLOW. Alderman McKay made,the following report:
It is recommended that the City Clerk be instructed to advertise for bids for
truck and snow plow for Street Department, returnable January 6. Superintendent
of Public Works to arrange to have specifications available.

RIVER*RAND ROADS TRAFFIC. Alderman McKay made the following progress report:
A meeting was held on December 10 in the office of Mr. J. P. Tuthill in connection
with the traffic problem at "five corners". Present: Messrs. Tuthill, Chamales,
Fletcher, Wernicke, Martin, Dunlap, McKay, and several others having property,
interests in the area. After discussion and various suggestions, it was decided
that Messrs. Fletcher and Chamales should study the matter further and bring in a
proposal in time for action by the Council at first meeting in January.

HIGH VOLTAGE LINES. Alderman McKay made the following progress report:
Your committee on Streets met with Messrs. Otto and Seitz of the Commonwealth
Edison -Public Service Company on December 11 in connection with the proposed
high-voltage line across northwest Des Plaines.
Certain information was furnished the Committee, and it was decided to call
another meeting of Cumberland Terrace and northwest side representatives and also
a representative of the School Board and the Park Board for 8:00 P.M. December 20
in the City Hall.

BENNETT PLACE ONE-WAY STREe. Alderman Mckay requested a report from Marshal
Kennicott regarding the temporary one-way on Bennett Place. One-way on the street
is to be from the alley west and attorney Dowd was instructed to prepare an
ordinance.

WLLLER CREEK. Alderman McKay reported the following:
In connection with the attached letter (which City Clerk will please reproduce in
minutes) your Flood Control Committee recommends:, That the City concur in the
proposal for an additional six foot flume under Soo Line Crossover of Weller
Creek, at an estimated cost of $4,000.00. Soo Line to pay one-half, Benjamin
Electric one-quarter, City of Des Plaines, one-quarter.
It is further recommended that the Council authorize the allocation of not to •
exceed $1,000.00 for this work.

Benjamin Electric letter:
In connection with the dredging of Weller Creek and the problem presented by the
insufficient outlets under the tracks of the Soo Line at,the eastern edge of
our property, Mr. Raleigh Klipstein informs me that Mr. Johnson of the Soo Line
has advised him that they will put in an additional 6 -foot diameterflume over
one of the existing flumes to act as a further spillway when the creek is at
flood. Reasonable engineering opinion seems to be that this will be sufficient to
take off any volume of water that has ever previously come down the creek and
that there will be spillway capacity to spare.
Mr. Johnson stated that the Soo Line is willing to start this work immediately;
has estimated that its cost will be $4,000.and has offered to pay, half of this
amount. Mr. Klipstein has given me to understand that the City of Des Plaines
will be willing to underwrite half of the balance, or $1,000, if Benjamin
Electric will guarantee the remaining $1,000. Thi.a we are willing to do..
I hear the City Council is meeting Monday December 16, We hope you can notify
Mr. Klipstein at that time of your favorable auction on this matter as we would
like to ask Mr. Johnson to proceed with the work as soon as possible.

BOY SCOUT '.'GANIZATION GRANTED WATER AT 2300 DEMPSTER STREET:, On a motion by
Alderman Tures and second by Prickett the Council approved to grant water
connection at 2300 Dempster Street.
Alderman Martin made a progress report on permits issued for 'buildings.
MC KAY NEALIS VARIATION ROSE AVENUE. Alderman Wexler report the following:
Your Committee on Judiciary, had referred to it the law suit filed by McKay
Nealis Builders, Inc. in the Circuit Court of Cook County against the Zoning
Board of Appeals and the City of Des Plaines. The basis of this law suit arose
out of an original application filed before the Zoning Board of Appeals for a
variation where three (3) residences were sought to be constructed on five (5)
25 foot loks.on Rose Avenue just west of Second Avenue.
The subdivision in which these lots were located was recorded in 1895 and the
petitioner sought to construct three (3) residences on the lots, ;two of which
would have a frontage of 42 feet and one a frontage of 41 feet., The Zoning
Board of Appeals refused to grant the variation under its authority pursuant
to the intensity of lot use ordinance. Whereupon, the McKay Nealis Builders
then files their suit against the City of Des Plaines in the Circuit Court of
Appeals asking that the ordinance be held unconstitutional and asking that the
Zoning Board be reversed. The City of Des Plaines must file its answer or otherwise
plead by December 22, 1957.
Your Committee on Judiciary has considered all the factors in this case pertinent
to the issue and has reviewed the purpose and intent of the intensity of lot use
ordinance and recommends as follows:
1. That one of the qualifications of the ordinance was for a liberal construction
of the variation so as not to impose any undue hardship on previously subdivided
lots within the city.
2. The proposed variation is slight in that it appears to be only a three foot
variation from the forty-five foot lot which could have been permitted.
3. That the proposed construction of three houses would not appear to downgrade
the neighborhood and there was no testimony.at.the Zoning Board hearing to that
effect.
4. The Committee is reluctant to recommend to the City that it expend large
sums of money for legal services to test the validity of its ordinance on this
particular set of facts.
5. The Committee has duly considered the action of the Zoning Board and appreciates
its decision on the matter but feels that it has erred in it's judgment and that
the best purposes of the City would be served by not contesting the case in the
Circuit Court and therefore recommends to the Mayor and City Council that the
City Attorney be instructed to take whatever action is necessary effect a dismissll
of the liw suit and have the permit issue.

MUNICIPAL PROPERTY ON TAX ROLL. Alderman Wexier reported the following:
Your Committee on Judiciary, had referred to it the question of Municipally
owned property still remaining.on.the public tax roll. The Committee investigated
the above and recommends that within the next four (4) months the, City Attorney
compile a list of all municipally owned property yet remaining on the tax roll
and recommend what procedure is necessary to remove it therefrom.

POLICE LIABILITY INSURANCE. Alderman Wexler reported the following:
Your Committee on Judiciary, had referred to it the recently enacted state
legislation providing that a municipality of less than 500,000 population must
reimburse policemen up to 50,000.00 for judgments obtained against them for
injury of the person or property of another if the policeman was engaged in the
performance of his duties and without his willful misconduct.
The Committee has studied the Statute and recommends that the Police Committee
recommend insurance to cover probable liability for judgments against city police.

In FRANCES FREI INJURY CLAIM. Alderman Wexler made 'the following report:
et Your Committee on Judiciary, Had referred to it notice of claim for personal
injuries incurred on the public sidewalk by Frances Frei, a resident of this
community. The Committee has investigated the c]$im and recommends that the Mayor
appoint an attorney to represent the city in this cause and to take whatever
steps are necessary to make a proper examination and evaluation of the claim
and make a further report to the. council.

Mayor appoint an attorney to handle the claim. The motion was made by Alderman
McKay and seconded by Prickett to approve the Mayor's appointment of James Dowd.

RAILROAD CROSSING. Alderman Wexler reported about the closing of the Chicago
and Northwestern crossing at the station. The motion was mmde by Alderman
Dunlap and seconded by Callaghan that Lommen Eley be retained to file petition'
for rehearing before the Illinois Commerce Commission. The Mayor put the question
and the clerk called the roll.with the _following results: Alderman Martin,
Figard, Prickett, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap, Wright,
Tures, Neff and Wexler. Nays: None. The Mayor declared the motion carried.
The Mayor appointed Jean M. Keneipp as member of Special Committee for.the
Chicago and Northwestern crossing, Alderman Wexler is Chairman. Harry Kinser -
ts member.
CHICAGO AND NORTHWESTERN RAILWAY CROSSING CLOSED. The motion was made by
Alderman Dunlap and seconded by Callaghan that attorney Eley file petition for
rehearing of Illinois Commerce Commission order to close the Chicago and North-
western Railway crossing at the station. The Mayor put the question and the
Clerk called the roll with the following results: Ayes:_ Alderman Martin,
Figard, Prickett, Tistle, Bell, McKay, Callaghan, Rateike, Dunlap, Wright,
Tures, Neff, and Wexler. Nays: None., The Mayor declared -the motion carried.
The Clerk was instructed to contact Mr. J. M. Kaneipp to see if he will serve
on the special committee with Alderman Wexler and Harry Kinser regarding the closed
crossing.
APPROVAL OF BILLS. Alderman Prickett presented the following resolution:

CITY PLANNER CHAMALES: Alderman Prickett reported on considering employing Mr.
Chamales on part time basis. On a motion by Alderman Dunlap and second by
Callaghan the Council approved to have Alderman Prickett negotiate with Mr.
Chamales on a per month and per hour basis.

SOO LINE LETTER. The Clerk read a letter f. om Mr. Sparks of tha Soo Line Railway

from the Plan Commission making a 25 foot building line.
CLASSIFICATION AND COMPENSATION ORDINANCE. The Clerk read. for second reading the
above ordinance. The motion was made by Alderman Prickett and seconded by Dunlap
to adopt the ordinance. After Alderman Prickett informed the Council several
changes should be made in the classifications the motion and second were with-
drawn so the Committee could discuss these changes.
CITY ADMINISTRATOR ORDINANCE =ADOPTED. The Clerk read for second reading the
above ordinance. On a motion by Alderman McKay and second by Dunlap to amend
the ordinance to read Administrator -Comptroller was approved'by the Council. The
motion was made by Alderman Martin and seconded by Neff to amend the ordinance
regarding qualifications. The Mayor putthe question and the Clerk called the
roll with the following results: Ayes: Adlerman Martin, Figard, Tistle, Bell,

by Alderman Neff and seconded by Prickett to approve the transfer of $45,000.00
Sales Tax Money to the Fire Account and $93,000.00 to the Corporate Account.

After the Council's discussion the motion was made by Alderman Neff and seconded
by McKay to allow the public to speak. The Mayor put the question and the clerk
called the roll with the following results: Ayes: Alderman Martin, Bell,
McKay, Dunlap, Wright, Neff and Wexler. Nays: Alderman Rateike, Tures, Figard
Prickett and Tistle. The Mayor declared the motion carried. Charles Frisbie
spoke in favor of decraasing,the number of license. S. C. Wessell and William
G. Buganis Apposed the decreasing. Alderman Callaghan arrived during the
discussion. The Council approved to take the ordinance off the table by a motion
of Alderman Prickett and second by Figard. The motion was made by Alderman
Prickett which was seconded by Figard to adopt the ordinance: The motion was
made by Alderman Martin`,.:, which was seconded by Neff'toamend the ordinance
to 13 tavern license. The Mayor put the question and the Clerk called the roll
with the following results: Ayes: Alderman Martin, Prickett, Bell, McKay,
Callaghan, Dunlap, Wright, Neff and Wexler. Nays: .Alderman;Rateike and Tures
figard and Tistle. The Mayor declared the motion carried. On the previous
motion to adopt the ordinance as amended. The Mayor put thelquestion and the
Clerk called the roll with the following results: Ayes: Alderman Martin,
Bell, McKay, Callaghan, Dunlap, Wright and Neff, Nays: Alderman Rateike, Tures,
Wexler, Figard, Prickett and Tistle. The Mayor voted Nay. The Mayor declared
the motion not carried and said he would have vetoed the ordinance if passed.
Alderman Prickett reported that Mr. Chamales agreed to servelas part time
City Planner at $75.00 a month and $15.00 an hour on additional duties. At
a request of Aderman Prickett the Mayor referred to the City Attorney to prepare
the agreement to be from Jannaty 1, 1958 to March 31, 1958 and to make copies
for the Aldermen.
COMMONWEALTH EDISON COMPANY AGREEMENT ON WELLER CREEK. Alderman McKay read the
above agreement in regard to the above cogpany sharing costs on the dredging of
Weller Creek. The motion was made by Alderman Mc Kay and seconded by Dunlap.the
Mayor and Clerk be authorized to sign the agreement. The Mayor put:•the questioh
and the Clerk called the roll with the following results: Ayes: Alderman
Martin, Figard, Prickett,,Tistle, Bell, McKay, Callaghan, Rateike, Dunlap,
Wright, Tures, Neff and Wexler. Nays: None. The Mayor declared the motion
carried.
