THE MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL, DES PLAINES, ILLINOIS HELD
IN THE COUNCIL ROOM, CITY HALL, AUGUST 5,
,957 at 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel who
presided with Alderman Tures, Wright, Wexler, Martin, Figard, Prickett, Tistle,
Nelsen, McKay, Callaghan, Rateike and Dunlap responding to roll call.
APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by
Wright to approve the minutes of July 15, 1957. The motion was voted upon by
acclamation.
OFFICIAL REPORTS. The Clerk submitted the reports of Clerk for July and Building
Commissioner. Also the Clerk's six month report of receipts and disbursements.
Chief Kolze reported on gasoline seepage at Rand and River Road and suggested an
ordinance be drafted regardingsame. He is to confer with Attorney Dowd about
an ordinance.
TO ADVERTISE BIDS FOR TRAFFIC LIGHTS AT WHITE AND 0Al1'ON ST

Fletcher reported that the plans for traffic lights at White and Oakton Streets
have been finally approved and at his request on motion by Tures and second by
Tistle the Council approved to advertise bids to be returned at the September
3, 1957 meeting.
OPEN ROOFING BIDS. On a motion by Alderman Rateike and
Clerk was instructed to open bids on City Hall roofing.

On reconvening the motion was made by Alderman Rateike and seconded by Tistle to
award the bid to the Rosenow Roofing Company. The Mayor put the question and
the Clerk called the roll with the following results: Ayes: Alder}nantRateike,
Dunlap, Wright, Tures, Wexler, Martin, Figard, Prickett, Tistle, Nelsen, McKay,
Callaghan. Nays: None. The Mayor declared the motion carried. The City is
to receive a ten year guarantee.
Alderman Rateike read a letter from Rosenow Roofing Company that they would install
Rockwool insulation for $495.00 while reroofing. The motion was made by Alderman
Rateike and seconded by Nelsen to approve the expenditure of $495.00. The Mayor
put the question and the Clerk called the roll with the following results:

Tistle, Nelsen, McKay, Callaghan. Nays: None. The Mayor declared the motion
carried.
OPEN PARKING METER BIDS. On motion by Alderman Tures and seconded by Nelsen
the Clerk was instructed to open the bids on parking meters. The following two
bids were received:
Parkit-Lockit Company, 77 N. Church St., Newton, Ohio - $ 1,170.00
Park -O -Meter Company Oklahmma City, Oklahoma - $ 3,796.10
On a motion by Nelsen and second by Martin the bids were referred to Parking
Meter and Finance Committee.
OPEN MAINTENANCE OF STREETS BIDS. On motion by Alderman Tistle and seconded by
Tures the Clerk was instructed to open the maintenance of Streets bids. The

On a motion by Alderman Dunlap and second by Callaghan the bids were referred to
the City Engineer and Street Committee to report back August 19th meeting.

OPEN BIDS ON EVERETT STREET SEWER AND PAVING. On motion by Alderman Wright and.
second by Tistle the Clerk was instructed to open the above bids. The following
bids were received:

On motion by Arman Dunlap and second by Callaghan the bids were referred to
Street, Sewer Committees and City Engineer to report back August 19, 1957 meeting.
PARKING METER BIDS. On motion by Alderman Nelsen and second by Prickett the motion
was to award the bid on parking meters to the Parkit-Lockit Company for $1,170.00
with the understanding there will be a 5 percent discount for cash. The Mayor
put the question and the Clerk called the roll with the following results: Ayes:
Alderman Rateike, Dunlap, Wright, Tures, Wexler, Martin, Figard, Prickett, Tistle,
Nelsen, McKay and Callaghan. Nays: None. The Mayor declared the motion carried.
APPROVE ZARI SUBDIVISION PLAT. Alderman1Ex1er made the motion which was seconded
by Dunlap to approve the Zari Subdivision plat and authorize the Mayor and Clerk
to sign same on receipt of bond. The motion was voted,upom by acclamation. A
check for $500.00 for City Engineer inspection service was also deposited.

C REJECT REZONING ON DEVON AVENUE. Alderman Wexler reported the Municipal Development
In Committee had investigated the request to rezone to Commercial the E. A. Peterson
.property north side of Devon Afeenue from Toll Road, west to Higgins. Road. The
% Committee has found that the Zoning. Board recommends residential zoning. No
indication of property use after rezoning thirteen petitioners request rezoning and
over two hundred requested denial of this request. The Municipal Development
Committee recommends the request for rezoning be denied. On motion by Alderman
Wexler and second by Dunlap the Council approved, the report and denied rezoning.
RAND AND RIVER ANNEXATION DENIED. Alderman Dunlap read the following report:
Mayor Behrel and member of Des Plaines City Council:
Gentlemen:
Since I cannot be present at the Aug. 5th meeting, I would like to express my
views concerning the car wash, to be erected if the property on the Northwest corner
of River and Rand Roads is annexed and rezoned.
I am in wholehearted agreement with the theory that this property should be part
of Des Plaines, and also that it should be commercial property. I do not feel so
strongly that I think it should be annexed at ply price,, however, and in this case,
I feel the price is too great. Comparing the amount of water with the total city
usage makes it sound small by comparison, ofcourse, and I should be apalled if'it
were otherwise, but comparing it with other commercial enterprises or even residential
,usage, makes the figure loom considerably larger, and I therefore feel the proponents
of this project are making the figure appear minute in order to further their
arguements.
We have, been told that this water usage would become serious only in case of,a
breakdown or pump failure. Should such a breakdown occur, the City would, of
course, restrict all sprinkling in residential areas, but they could not restrict
the car wash usage, and, in fact, when asked if the petitioners would make any
kind of an agreement to restridt their usage in an emergency, they replied in the
negative.
People building within the city limits have the right to expect city services,
but I am in opposition to the annexation of any property containing a large water
consumer until such time as we have sufficient equipment and facilities to carry
us over an emergency period due to breakdown or other possibilities, which might
curtail usage for existing residents.

Alderman Wexler made a minority report. The Mayor left the Chair andrequested
Alderman Tures to take the Chair. The Mayor then spoke in favor of the annexation.
After returning to the Chair the motion was made by Alderman Dunlap and seconded
by Rateike to concur in the majority report. The Mayor put the question and the
Clerk called the roll with the following results; Ayes: Alderman Rateike, Dunlap,
Tures, Martin, Tistle, McKay and Callaghan. Nays: Alderman Wright, Wexler,

denied.
TO PURCHASE CAMERA FOR FINGER PRINTING. The motion was made by Alderman Nelsen and
seconded by Rateike. to purchase camera to cost not more than $180.00. The Mayor
pub. the question and the Clerk called the roll with the following results: Ayes:
Alderman Rateike, Dunlap, Wright, Tures, Wexler, Martin, Figard, Prickett, Tistle,
Nelsen, McKay, and Callaghan. Nays: None. The Mayor declared the'motion carried.
TO PURCHASE 4.000 CARDS FOR FINGERPRINTING. The motion was made by!Alderman Nelsen
and seconded by Tures to purchase 4,000 cards at $154.90 per 1,000.. The Mayor put
the question and the Clerk called the roll with the following results: Ayes:
Alderman Rateike, Dunlap, Wright, Tures, Wexler, Martin, Figard, Prickett, Tistle,
Nelsen, McKay and Callaghan. Nays: None. The Mayor declared the motion carried.
TO PURCHASE BREATHALIZER. The motion was made by Alderman Nelsen and seconded by
Tures to purchase a breathiizer for the Police Department. The Magor put the question
and the Clerk called the roll with the following results: Ayes: Alderman Rateike,
Dunlap, Wright, Tures, Welder, Martin, Figard, Prickett, Tistle, Nelsen, McKay
and Callaghan. Nays: None. The Mayor declared the motion carried.
STREET WORK ON JEANNETTE AND WALNUT AVENUES. Alderman McKay made the following
report: Mayor and City Council:
With reference to contract for repair and maintenance on Jeannette and Walnut, etc.,
awarded to. Skokie for $6398.55 (estimate $8500.00).
In council meeting of July 15th,. due to Alderman Neff's objection to the amount
of work performed under this contract particularly on Walnut, the matter was
referred to the Streets Committee.
On Saturday August 3rd the Mayor, City Engineer, Supt. Public Works and Chairman
Streets Committee made an inspection on Jeannette and Wal nut.
In reference to Jeannette we feel the street should be considered satisfactory for
the present. As to Walnut it is recommended that the City Engineer and Supt.
Public Works arrange to have the section between Margret and Second set up
for prompt repair as an extra to the contract.awarded Skokie, the work to be paid for
from the difference between the contract price ($6398.55) and the estimate
($8500.00). The work to include filling of cracks and patching of bad spots.
It is also suggested that in the future the Streets Committee be provided with a brief
but accurate description of work included in any bid recommended for acceptance so
this information may be included in the Streets Committee report and Council minutes.

On a motion by Alderman McKay and second by Dunlap the Council
accepted the report.
HIGGINS WATER COMPANY. Alderman Tures informed the Council that Attorney Eley
desired to know what area the City Council would want the Higgins Water Company to
serve. The Alderman had a map and explained the area they are now serving. He
also thought the City should serve part of the Orchard Place area. On motion by
Alderman Tures and second by Martin the City Engineer is to prepare a map to
show where the Higgins Water Company is to be allowed to extend as suggested by
Alderman Tures.
Property owners from Cumberland Terrace were in attendance due to storm flooding
The Council discussed same and Mayor Behrel asked the people to select a committee
of about three persons who would be able to go with him to contact State and
County officials.
At Alderman Nelsen's Request the Superintendent is to confer with the City Attorney
about parking lot signs according to the parking ordinance for lot number 2.
APPROVAL OF BILIS. .Alderman Prickett presented the following resolution:
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DES PLAINES THAT THE
FOLLOWING BILLS ARE DUE A PAYABLE
AND THAT THE MAYOR AND CITY CLERK
BE AND ARE HEREBY AUTHORIZID TO MAKE
PAYMENT FOR SAPS.
Total $60,340.84. (A. copy of resolution placed before each Alderman) and on file
with the City Clerk. The motion was made by Alderman Prickett and seconded by Figard

to adopt the resolution. The Mayor put the question and the Clerk called the roll
with the following results: Ayes: Alderman Rateike, Dunlap, Wright, Tures, Wexler,
Martin, Figard, Prickett, Tistle, Nelsen, McKay and Callaghan. Nays: None.
The Mayor declared the motion carried.
On motion by Alderman Prickett and second by Wright the Council approved to transfer
8500.00 from Sales Tax temporarially to the Library Construction Account.
Golf WOLF ROADS SIDEWALK. Mayor Behrel reported that he received a letter that the
property at Golf and Wolf Roads owned by Herzog Construction Company is about to be
sold which would cause a delay in having sidewalk installed. .
The Clerk was instructed to write the Chicago and Northwestern Railway again about
Wolf Road and Western Avenue crossings.
The Clerk informed the Council he received a.letter from the secretary of School
Board that the price of North School property was $85,000.00.
DENY REZONING AT 1564 CORA. The Clerk read the report of Zoning Board denying to
rezone from Commercial to residential at 1564 Cora Street. On motion by Alderman
L McKay and second by Prickett the Council concurred in the report.
The Clerk informed the Council that the•Zoning Board denied the variation to McKay-
Nealis for 3 homes on 5 - 25 foot lots.
Also the Zoning Board granted the variation to Mr. Prassas to permit parking in
residential area on Center Street.
Request for water in Lions Woods- Forest Preserve. TheClerk read a latter from
the Forest Preserve District requesting water for Lions Woods. The Mayor referred
same to the Water Committee.
ADOPT ORDINANCE RESTRICTING PARKING MILL AND RIVER STREETS. The Clerk read for
second reading the ordinance to restrictto 3 hours parking on Mill and River Streets.
The motion was made by Alderman McKay and second by Dunlap to adopt the ordinance.
The Mayor put the question and the Clerk called the roll with the following results:
Ayes: Alderman Rateike, Dunlap, Wright, Tures, Wexler, Martin, Figard, Prickett,
Tistle, Nelsen, Way and Callaghan. Nays: None. The Mayor declared the motion
carried.
J. P. TUTHILL LETTER. The Clerk read the letter from Mr. Tuthill that speed studies
will be made on Touhy Avenue andGolf Road and reports made on same, when completed.
ZONING VARIATION 1735 WICKS AVENUE. The Clerk informed the Council he had a zoning
variation application for 1735 Wicke Avenue. On motion,by Alderman Wexler and
second by Figard the application was referred to Zoning Board sitting as a Commission
to hold a hearing.
SEPTIC INSTALLATION GOLF AND MT. PROSPECT RI DS. The Clerk informed the Council
he had application with County tests for septic installations by George Burgess
at Golf and Mt. Prospect Roads. The Mayor referred same to Sewer Committee.
FIRST READING ORDINANCE ON PARKING. The Clerk read for first reading an ordinance
regarding parking on certain side of street. The Mayor ordered it. placed on file for
second reading.
PUBLIC SERVICE COMPANY TO INCREASE RATES. The Clerk had received a phamplet regarding
increasing rates by Public Service Company. The Company will apply to the Illinois
Commerce Commission for a hearing in the near future. The rates would take effect
sometime next year. The Mayor referred same to Finance Committee.
The Clerk requested to have another assistant deputy appointed which is provided
for in the appropriation. On motion by Alderman Prickett and second by Tures the
request was granted.
FIRST FEDERAL LETTER COMMENDING POLICE DEPARTMENT. The Mayor read the following letter:
Dear Honorable Mayor Behrel:
We want you to know that the help received from the Des Plaines Police Department on
Friday, July 19th, was certainly heart warming. While the hold-up man was in our
office, the alarm sounded and the response by the police was instantaneous. They
arrived about 20 seconds after the bandit had left and he wasn't here long.
The Des Plaines Police Department is certainly to be commended for their good help.

AMERICAN DA.Y - SEPTEMBER 1� 1 The Mayor received a proclamation which he
requested the Clerk to give both papers the annual "I Am An American Day".
CHARLES.H. BENTLEY APPOINTED TO CIVIL SERVICE COMMISSION.L On a motion by Alderman
Martin and second by Figard the Council approved the appointment of Charles H. Bentley
to theCivil Service Commission to fill the vacancy created by resignation of Ed
Murphy. The Clerk was instructed to write a letter to Mr. Murphy commending him
upon his service.
CAREBUILT COMPANY - BIRCHWOOD SUBDIVISION. The Mayor referred the above plat to
the Plan Commission.
HERZOG'S WAYCINDEN PARK SUBDIVISION. The Mayor referred the above subdimision to
the Plan Commission. .
CUMBERLAND PARK RESUBDIVISION. The Mayor referred the above plat to the Municipal
Develdpment Committee the plat having been approved by Plan Commission.
ADJOURNMENT. The motion was made by Alderman Wexler and seconded by Tures at 11:55 P.M.
The motion was voted upon by acclamation.

CALL TO ORDER. The meeting was called to order by Mayor Herbert H. Behrel, who
presided with Alderman Wright, Neff, Wexler, Martin, Figard, Prickett, Tistle,
Nelsen, Bell, McKay, Callaghan, Rateike and Dunlap responding to roll call.
Alderman Tures was absent. The City Clerk being absent the Deputy Clerk was
present. .
APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by
Wright to approve the minutes of August 5, 1957. The motion was noted upon by
acclamation and carried.
OFFICIAL REPORTS. The Deputy Clerk submitted the report of the City Treasurer
for July.
The Superintendent of Public Works reported on the progress of the talks with
Benjamin Electric for the dredging of Weller Creek.
PURCHASE BR.FATHALIZER. Police Marshal Kennicott reported the purchase of the
breathalizer, and stating every man was schooled on its correct operation.
OPEN LIME HANDLING EQUIPMENT BIDS. On a motion by Alderman Dunlap and second
by Callaghan the Deputy Clerk was authorized to open the bidi,for the Lime
Handling Equipment, which was as follows:•
George. H. Knight Company, Des Plaines for $19,700.00
On a motion by Alderman Dunlap and second by Rateike the bid! was referred to the
City Engineer, Superintendent of Public Works and the Water Committee. The
motion was voted upon by acclamation and carried.
FALSE ARREST INSURANCE. Alderman Nelsen requested the Judiciary Committee and
the Police Committee to investigate the possibility of insurance to protect the
city against false arrest suits.
CHARM HOUSE DISPOSAL. On a motion by Alderman Rateike and second;by Tistle, the
report of the Buildi:n and Grounds. Committee to dispose of the Charm House as
inexpensively as possible was accepted by acclamation.
