04/23/19571 4/1/57 475 Alderman Martin presented ballots from the residents of Rose Avenue regarding making Rose Avenue a 1 -way or 2 -way street, which was referred to the Street and Traffic Committee. Alderman Prickett reported on a stray oat problem to be turned over to the License Committee. Alderman Behrel requested plans and specifications be drawn up by the City Engineer for the northwest corners of Center Street at Oakton Street and Second Avenue at Prairie Avenue for loading and unloading buses. Alderman Martin presented ballots from the near -by residents of Second &venue and Thacker Street favoring or opposing 4 -way stop at that corner which were referred to the Safety Council for consideration. The Mayor called the meeting to order with Alderman Tures, Wolf, Neff, Wexler, Behrel, Prickett, Bell, McKay, Schubert and Dunlap responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Wexler and seconded by Dunlap to approve the minutes of April 1 and adjourned meeting March 25, 1957. Alderman McKay requested that the ordinance for parking fee in No 1 Parking tot failed passage by ruling of City Attorney and Garbage Ordinance,also, on vote, was lost. The motion was then voted upon by acclamation with corrections made. OFFICIAL REPORTS. The Clerk submitted the reports of Clerk and Nurse and Welfare for March. Also Fire Chief Kolze's report for past three months. ATTORNEY ELEY'S REPORT. The Clerk read the following report: On Monday evening on a proposed ordinance the roll call showed 7 ayes and 6 nays. The Mayor was not present and upon being asked by the Mayor pro tem what the situation was, I stated that it was possible that the Mayor had the right to indicate his approval at a date later than the meeting date. I had no recollection of there being any law or cases to permit it but was afraid there might be. I did not wish to see such privilege taken from the Mayor if it existed. I have today checked the statutes and pertinent cases regarding the situation which arose Monday and found nothing except that the' Mayor has the right to vote in case of a tie and when one-half of the aldermen have voted aye. Absent any Court interpretation I feel that to "vote" requires the presence of the Mayor at the meeting and that the Mayor's vote must be cast immediately when it becomes apparent that exactly one-half of the aldermen have voted aye. 476 4-23-57 ATTORNEY ELEY'S REPORT. I conclude, therefore, that the action ordinance lost was correct and further that the appeal from the chair's decision was of of the Mayor pro tem in declaring the the action of the Council in sustaining no effect. /s/ Locomen D. OPEN BIDS ON METER TESTING BENCH. On motion by Alderman Prickett and second by Behrel the Clerk was instructed toopen bids on Meter Testing Bench.' Only one bid was received, which was from Badger Meter Manufacturing Company, Milwaukee, Wisconsin, for $727.32. On motion by Alderman Tutes and seconded by Dunlap the bid was referred to the Water Committee and Superintendent of Public Works. APPROVE ERNST STADE TERRACE SUBDIVISION PIAT. Alderman Schubert reported on the above plat and on motion by Alderman Schubert and second by Dunlap the Council voted to approve the plat and authorized the Mayor and Clerk to sign same. Alderman Martin arrived at this time. PLEASANT MANOR NO. 2 PLAT. Alderman Schubert reported on the Pleasant Manor No. 2 Plat and made the motion that the Council approve the plat and Mayor and Clerk be authorized to sign same. After discussion, on motion by Alderman Nelsen and second. by Wolf it was referred back to committee, due to discussion on land for park and school. Alderman Schubert requested the Clerk write to the Park Board, Des Plaines and Orchard Place School Boards to attend a meeting Monday, April 30, at 8:00 P.M. regarding land to be dedicated in new subdivisions for their districts. Alderman Nelsen appeared at this time. TO ADVERTISE BIDS FOR STREET REPAIRS. On motion by Alderman Bell and second by Prickettt the City Engineer is to advertise for bids to be turned in 8:00 P.M., May 20, 1957, for Jeannette, Walnut, River Drive and Stewart Avenue. H -H ELECTRIC COMPANY AWARDED BIDS FOR INSTALLING TRAFFIC LIGHTS AT THACKER AND IEE STREETS. The motion was made by Alderman Bell and seconded by Wolf to award the bid for traffic lights at Lee and Thacker Streets to the H -H Electric Company for $12,341.10. The Mayor put the question and the Clerk called the roll: Ayes: Alder- man Tures, Wolf, Nelsen, Martin, Behrel, Prickett, Bell, McKay, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. ORCHARD PLACE STREETS. Alderman Bell reported that additional petitions in favor of paving streets in Orchard Place by special assessment. We hereby recommend City Engineer Fletcher be authorized to prepare specifications and plans for paving Orchard Place streets by special assessments. Paving to consist of 18 foot wide asphalt strip 2" thick and 8" deept stone base, 20 feet wide with ditches graded and culverts realigned. On motion by Alderman Belland second by Prickett the Council concurred in the report. 1 4-23-57 DRIVEWAY PERMIT GRANTED 1982 DES PLAINES AVENUE. Alderman Bell reported the Street Committee investigated and recommend a driveway permit be granted, provided drive- ways are black topped. On motion by Alderman Bell and second by Martin, the permit was granted. ROSE AVENUE TO REMAIN TWO-WAY STREET. Alderman Bell reported that the petitions from Rose Avenue favored a two-way street, and recommended the one-way signs be removed. On motion by Alderman Bell and second by Wolf the Councilooncurred. Alderman Bell reported on driveway at Orchard and Oakton, but on motion by Alderman Prickett and second by Wolf, it was referred back to Committee. On motion by Alderman Bell and second by Behrel the 9:00 A.M. to 12 Noon signs should be placed on laurel Avenue for south to north driving on Sundays. On motion by Alderman Bell and second by Wolf the annexation of the south 33 feet of Forest Avenue be referred to the Municipal Development Committee. MAYFIELD SUBDIVISION WATER MAIN LEAKS. Alderman Tures reported the Water Committee recommends the City repair the water main leaks in Mayfield Subdivision but will not In install any new pipes or mains. On motion by Alderman Tures and second by Schubert the Council concurred in the report. 1 1 Alderman McKay read the following letter: Maine Leasing Corporation 1723-43 Busse Highway Des Plaines, Illinois Dentlemen: In reply to your request for a break -down of our Contract to furnish cars for Arlington Heights, we are pleased to furnish you a complete summary of its contents, which is as follows: We furnish three sedans and one Station Wagon. All cars are to be (V-8 Motors) equipped with heaters. We furnish gasoline, oil, $50.00 deductible collision insurance, maintenance, no damage and to replace cars at 25,000 to 30,000 miles. No loaners. The City furnishe8 and pays for the following: 1. All police equipment 2. Furnish, install and maintain radio and police -type generator 3. Liability and property damage insurance ,4. Washing and license 5. All repairs for damage to cars and tires up to $50. 6. Snow tires and chains We believe it has in the past cost Arlington Heights more than $300. per month per car to operate each squad car, which I quote from the Des Plaines Journal, was a "non-profit civic gesture" by the former dealer. Any other information you may desire, we shall be pleased to furnish. /8/ George Poole, President CONTRACT FOR GARBAGE WITH EDWARD DE BOER. Alderman Dunlap made the following report: Your Committee on Sanitation has found: 1) That the present land -fill dump site being used by the City for garbage and refuse disposal is rapidly filling up, and 2) That both an immediate new dump site, and time in which to prepare plans for a permanent disposal facility are needed by the City. Negotiations for a new site were begun by your Committee and Supt. Wernicke in Novem- ber, 1956. Contracts have now been worked out Allah are agreeable to your Committee and provide the following advantages to the City: 477 78 4-23-57 CONTRACT FOR GARBAGE WITH EDWARD DE BOER (Cont'd.) 1.) A site close to the City permitting a short haul for City trucks 2.) Four (4) year guaranteed dump -site availability. 3.) Favorable yardage disposal fee of 35¢ per cu. yd. -- 15-25¢ under going 4.) The City will not have to invest in, maintain or operate the expensive, heavy machinery required in a land -fill operation. This will be provided by the City's license. 5.) Supervision of the site will be performed by Supt. Wernicke and he will also certify the yardage delivered to the dump by City trucks. 6.) The City will have a reliable operator of the fill operation based on experience during the past three (3) years which has proven satisfactory to the City and the owner of the dump site. We your Committee on Sanitation, therefore recommend: 1.) That the attached contracts be approved by the Council and the Mayor and City 'Clerk be authorised to sign them; and 2.) That the Council authorize the expenditure of $500.00 payable to the Sisters of Nazareth for replacement of trees per attached contract. (This will be a "net" expenditure of $500 although the City will give the Sisters $2,000, fifteen hundred of which will be paid to the City by licensee DeBoer.) /s/ Robert M. Dunlap, Chmn. Alderman Behrel presented the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PIAINES THAT TBE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SA . (A copy of resolution placed before each Alderman and on file with the City Clerk.) Total $21,678.63 and $2,637.00. The motion was made by Alderman Behrel and seconded by Prickett to adopt the resolution. Alderman Behrel called the Council's attention that a resolution was at the previous meeting where there was no quorum and that an addition was added to resolution of which they have a copy. Also, he requested the bill of Marshall Howard for $1,843.73 be withheld for more information. The Mayor then put the question and the Clerk called the roll. Proposed installation of fine boxes on parking meters HAYDEN-JORDANEK WATER DISPUTE Your Judiciary Committee has investigated the above and recommends as follows: The Committee had referred to it the notice of Evard Hayden to remove or disconnect water mains lying in the city and servicing residents. Mr Hayden's notice resulted from a dispute with residents of the city concerning an easement. The Committee has held tQo public hearings and advises that (a) the City of Des Plaines should not attempt to adjudicate the equities between the parties (b) that there should be no termination or disconnection of water service without the prior approval of the 1 ® Marshall Howard reported that he has filed his legal Brief with the Supreme 10 Court and that it was thought likely that the case would be argued and a decision ►-► forthcoming in June of 1957. 4-23-57 JUDICIARY COMMITTEE REPORT: (Cont'd.) Superintendent of Public Works (c) that because of the peculiar circumstances and necessity of protecting the city's interest in water main easements, the plat heretofore submitted by Mr. Hayden but never executed by the Mayor because the performance bond was never forthcoming by the building, should be recorded. ECKHARDT vs= CITY OF DES PLAINES This matter arises out of Alvina Eckhardt's attempt to strike down the residen- tial zoning on the corner of River Road and River Street. The plaintiff has intro- duced her proof and pleadO&1her case. The Committee, after a consultation with Marshall Howard attorney for the city in this matter and a review of the factors involved recommends that Marshall Howard be instructed to place in evidence the city's position of maintaining the propriety of residential zoning at River Road and River Street. PREMIER BAUSKE. -vs - CITY OF DES PLAINES - Progress Report 1 1 MEYER COAL COMPANY - Progress Repoirt On the suggestion of Alderman McKay, the Committee will hold this matter in abeyance until the next regular meeting. KROGER PARKING LOT The Committee is of the opinion that the Kroger Parking Lot is in conflict with the city zoning law in that the residential zoning does not provide for commercial parking. The Committee therefore recommends that the City Clerk be instructed to send a letter to Mr. Prassas advising him that he is in conflict with the city law and that he may apply to the Zoning Board for a variation as a possible remeo4. PROPOSED INSTALLATION OF FThE BOXES ON PARKING METERS The Committee does not feel that this matter is within its jurisdiction and should be decided upon by Parking Lots and Meters Committee and that•it should be referred to its Chairman. This being the final report of the Committee under the present administration, the Chairman wants to thank his fellow members for the cooperation in setting precedent for this new Committee and wants to extend personal thanks to Alderman McKay who, although not a member of the Judiciary Committee, has attended every meeting since its inception. /s/ Sydney B. On motion by Alderman Wexler and second by Martin that the City Clerk instruct Mr. Prassas toepply for zoning variation for Kroger parking lot. On motion by Alderman Wexler and second by Martin that the matter of fine boxes on parking meters be referred to Parking Meter Committee. 479 480 4-23-57 JUDICIARY COMMITTEE REPORT. (Cont'd.) The motion was made by Alderman Prickett and seconded by Behrel that City Attorney file suit on two dangerous buildings but the motion and second were with- drawn. The motion was then made by Alderman Prickett and seconded by Behrel that the Superintendent board up the buildings, which was approved by Council. The two County ordinances for No Parking on Dempster and ordered placed on file with no action taken. on River Road were The Clerk read the Plan Commission's report for their suggestion if the North School property was suitable for parking. Their report was that the North School site is too far from our existing business district to be suitable for parking for shoppers. Its main value as a parking site would be for any future development along Des Plaines Avenue and Lee street, but such new commercial buildings will require their own on-site parking facilities. /s/ John Geiger On motion by Alderman Martin and second by Behrel it was referred back to the Plan Commission to see what they thought about commuter parking. Mr. Geiger, Chairman of the Plan Commission, informed the Council they were working with Mr. Chamalas regarding parking and thought in about two months would be ready with a report. The motion was made by Alderman Neff and seconded by Martin that City Attorney draft an ordinance similar to an Evanston ordinance on parking in Commer- cial areas(new commercial). The Aayor declared the motion carried. REZONE 1928-96 CHESTNUT TO "MULTIPLE FAMILY." The Clerk read the Zoning Board report on the above and on motion by Alderman Wolf and second by Martin the Council concurred in the recommendation. The Clerk read a letter from J. P. Tuthill, District Engineer, about speed on Wolf Road north of Oakton, that 40 per cent were disregarding the speed limit. The Chief of Police is to place the radar on Wolf Road to reduce the speedings. Request for water at River Road and Rand Road by Sun Oil Company, Kiwanis Club, Bowling Alley and Standard Oil Company was referred to Water Committee. The Clerk read a letter from Director of Chamber of Commerce that they voted unanimously in opposition to charging non-residents $25.00 annual parking fee for off street parking. CHANGE NAME OF CERTAIN ORCHARD PLACE STREETS. The Clerk read his letter suggesting to change names of three Orchard Place Streets. The Mayor referred same to Street Committee. SPEER AND SONS COMPANY LETTER. The Mayor informed the Council he had received a letter from Speer and Sons Company who had purchased the first parking meter bonds. They say the City can issue at least $200,000 additional bonds. The Mayor referred the letter to the Parking Meter Committee.
