FIRS READING ORDINANCE REGULATING THE USE OF NON -METERED PORTIONS PARKING LOT NO. 2. The Clerk read for first reading the above ordinance. At request of Alderman Neff the ordinance was referred to the Parking Meter Committee. LADENDORF PLAT APPROVED. Alderman Schubert reported the Plan Commission has examined the plat and approved same. The Municipal Development Committee recommends that the Mayor and City Clerk be authorized to sign the plat and that the plat be approved in accordance with the recommendations of the Plan Commission. On motion by Alderman Schubert and second by Dunlap the Council concurred in the recommendation. TO CERTIFY ONE NEW FI±UMAN. On motion by Alderman Prickett and second by Davis the" Council approved to have the Fire and Police Commissioner certify one fireman from the eligible list. Engineer Fletcher requested the lowering of Well No. 4 be referred to the Water Committee. Alderman Wexler requested that the placing of a stop sign at Forest and Fifth Avenues to stop for Fifth Avenue be referred to the Traffic Commission. ADJOURNMENT. The meeting was called to order by Mayor Kenneth G. Meyer with Alderman Tures, 'Wolf, Neff, Weiler, Martin, Prickett, Tistle, Nelsen, Bell, McKay4 Ebhubert responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Tistle to approve the minutes of February 18 and adjourned meeting of February 25, 1957. The motion was voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the reports of City Clerk, Building Commissioner and Nurse and Welfare for the month of February. ADVERTISE BIDS FOR TRAFFIC LIGHTS THACKER AND IEE STREETS.AT request of Engineer Fletcher the Council approved to advertise for bids for traffic lights at Lee and Thacker Streets, on motion by Alderman Bell and second by Tures. ALDERMAN SCHUBERT REPORTED ABOUT CHURCH PROPERTY ANNEXATION. The Municipal Development Committee investigated and found that the petition is legally connected as attested by the City Attorney. The use does not conflict with the City Plan. The building of a church at this location will be a great asset to the City. Therefore, recommended that the petition for annexation be granted. On motion by Alderman Schubert and second by Tures the Council concurred in the report. Alderman Behrel appeared at this time. 456 3-4,57 CARDELLII SUBDIVISION PLAT APPROVED. Alderman Schubert reported that the Municipal Development Committee had investigated about Cardelli Subdivision plat and found that the proposed subdivision is outside the City Limits, but does meet the City ordinances. That the plat has been approved by the Plan Commission. Therefore, recommend that the plat be approved and the Mayor and Clerk be authorized to sign same. On motion by Alderman Schubert and second by Tures the Council concurred in the report. Alderman Schubert reported the Municipal Development Co]mittee had investigated the Zoning Board's recommendation at Howard and Mt. Prospect Road and found: 1. That the Zoning Board held a public hearing and to our knowledge there were no objectors to zoning the tract for industrial use. 2. That the Zoning Board recommended that the 16 acres west of the new Chicago and Northwestern Railway right of way be zoned for Industrial use and the eastern portion be zoned for Residential. 3. That the City Plan shows this property suitable for Industrial Use any 4. The property 70 acres to the east is now zoned for Industrial Use. The Committee recommends that the entire tract be annexed to the City of Des Plaines and zoned for Industrial 1-2. On motion by Alderman Schubert and second by Wolf the Council concurred in the recommendation. Alderman Schubert reported the Committee investigated the Zoning Board letter regarding property on south side of Prospect between Pine and Chestnut Avenue and found: That the present zoning has been in force for many years. , That the present use of property does not lend itself to residential zoning. That the Zoning Board recommends that the zoning remain as it is. That the recomm ndation of the Zoning Board be concurred in. On motion by Alderman Schubert and second by Wolf the Council concurred in the recommendation. Alderman Schubert reported the Municipal Development Committee investigated the Zoning Board's recommendation on property west side Rive Road between Bennett Place to south of Kennicott Ct. and found that the Zoning Board recommends that Lots 1 thru 5 of Block 6 should be rezoned;from Commercial to Residential. That Lots 1 thru 10 in Block 2 and lots 1 thru 10 in Block 5 should remain Commercial. That the present zoning has been in existance for many years and that the present owners purchased the p .operty because it was zoned commercial. The Committee recommends the Zoning Board's recommendation be approved, to draw the proper ordinances. On motion by Alderman Schubert and second by Behrel the Council concurred in the report. Alderman Schubert reported on Zoning Board recommendation on property west side of River Road from approximately Stockton Avenue to Birchwood Avenue and west on the north side of Howard Avenue, that the Committee investigated and found that the property is primarily in use for residential purposes except for two parcels on which gas stations have been erected; that the Zoning Board recommends that all the property , etcept the gas station properties, be rezoned to residential. The Committee recommends: That the recommendations of the Zoning Board be concurred in and the City Attorney be instructed to draw the proper ordinances. On motion by Alderman Schubert and second by Nelsen the Council concurred in the report. Alderman Schubert reported the Municipal Development Committee investigated about vacation of portion of Chestmut Street and dedication of portion of Prospect and Everett Street ,and found situation as stated in letter ofd petition. The Committee recommends petition be granted as proposed and the Committee concurs in the recommendation of the Street Committee. On motion by Alderman Schubert and second by Bell the Council concurred in the report. CHICAGO DISTRICT PIPE LINE. Alderman Bell reported the Street1 Committee investigated about the 36 inch gas pipeline in Everett Street and recommend to approve the pipe- line permit as requested, with proper bond and supervision being provided by petitioner, and Mayor and City Clerk be authorized to sign the permit. On motion by Alderman Bell and seconded by Tures the Council concurred in the report. 1 1 1 457 3-4-57 EVERETT STREET PAVING AND SEWER. Alderman Bell reported that he is submitting the following report from Engineer Fletcher: In answer to your letter of February 19, I submit the following: 1. On the City map, I have shown in blue the location and sizes of the sewer. I have also shown the Blume Subdivision. If we consider only the Blume Subdivision, the maximum sewer size required will be 15". 2. I now have in my possession signed bids by reliable contractors for the sewer and pavement for Everett Street in Blume's Subdivision. These bids are as follows: Sewer $16,378.50 Pavement $15,743.40 $32,121.90 The above total is th4 amount of money the subdivider will contribute. 3. We are asking approval of a 36" sewer. The subdivider would require only iC a 15". The difference in cost between the sewer required for tne..subdi- vision and the one we propose, is $58,000.00, according to my estimate }1� based on current prices. Q 4. We estimate the cost of paving that part of Everett Street on which the subdivider nas no obligation, at $$42,500.00. 5. As to the cost or installing sewer in that part of Everett Street over which the subdivider has no obligation, I believe we have to refer back to Item 3 above. Either we approve only Bluwe's Suodivision with a 15" sewer, or we install the 36" sewer from the river to Maple. 1 1 6. Number of families who will be benefited by the street part of the project. a. If the City portion is not completed, there are nine lots in the Blume Subdivisiontich front on this street. b. If the entire project is completed, it will serve all the people south of Caxton, north of Howard and east of the Soo Line Railroad. 7. Number of families benefited by tiie sewer. If the City's portion is not completed, it will serve the 49 lots in the Blume Subdivision. b. If the City's portion is completed, it will benefit the area shown on the attached map or 480 acres. Assuming four lots per acre, the sewer will benefit 1920 lots. I would estimate that this area is 80% developed and will probably be 100% developed within the next five years. 8. If less than $150,000.00 is to be furnished from Motor Fuel Tax FundstAhy l.'s it necessary to earmark $150,000.00? The Council can ask for less than $150,000.00 if you so desire. Our preliminary estimate of cost is $135,000.00. This has been before the City Council now for six months. It will be another six months at least before the work can be done. Regardless of what we appropriate we will only receive from the State the exact amount of the contract. Should the Council appropriate less than the contract price, it will mean another resolution for additional funds. We prefer to have a surplus rather than a deficiency. From conferences I have had with State Engineers, I doubt if they will approve our full request in so far as the sewer is concerned. The amount they will pay will be a subject of negotiation, and for this reason I feel that we should make our request as high as possible. Since the questions you have asked are the ones that all the Aldermen are interested in and are in line with the report I was instructed to prepare, I am considering this as my report and sending copies to Bell, ti•Iexler, Schubert, Tistle and the Mayor. I know of no other project that will benefit so many people for so small a sum of money. (Signed) E. N. Fletcher 3-4-57 EVERETT STREET PAVING AND SEWER, (Cont' d. ) The Street Committee recommend the approval of resolution for Gas Tax funds for 0150,000 to cover City's share of the project. The motion was 'made by Alderman Bell and seconded by Prickett to concur in the report. On motion by Alderman Bell and second by Martin the Council approved, to grant applica- tion as shown to be situated as approved by Building Commissioner. HNRSAL CONSTRUCTION COMPANY AWARDED BID ON REPAIRING WATER 'ANK AT PRICE OF $27,904. Alderman Tures reported the above company was low bidder and then made the motion, which was seconded by Schubert, to award the bid to the Univeral Construction Company, 1129 Udell Street, Indianapolis 23, Indiana, and bonds of other bidders be returned. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, Bell, N.cKay and Schubert. Nis: None. The Mayor declared the' motion carried. ADVERTISE BIDS ON CLEANING 500 CATCH BASINS. On motion by Alderman Wexler and second by Behrel the Council approved to advertise bids to clean 500 catch basins to be returned March 18, 1957. PARKING IAT NO. 2 ORDINANCE. On motion by Alderman Nelsen and second, by Bell the ordinance on use of non -metered portions of Lot No. 2 was referred to City Attorney. APPROVAL OF BILLS. Alderman Behrel presented the following resolution: HE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total 024,195.04. (A copy of resolution placed before each Alderman and on file with City :Clerk.) The motion was made by Alderman Behrel and seconded by Prickett to adopt the resolution. Alderman Behrel reported that Alderman Dunlap, Chairman of Elm Tree Committee, was absent and bill for $1,474.38 of Bishop Tree Trimming Company was not approved. The Mayor said Alderman Neff was vice -Chairman but she requested the check held out. The motion was made by Alderman Martin and seconded by Neff to hold out the Jacobs Company check for $337.57 until the final report is received. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Wolf, Neff, Wexler, Martin, Tistle, Bell, McKay and Schubert. Nays: Alderman Tures, Behrel, Prickett and Nelsen. Alderman Neff started to read why she voted to award Elm Tree Spraying and the Mayor ruled her out of order, stating she should bring the item up later. Alderman Neff requested a roll call to over -rule the Mayor. The Mayor instructed the Clerk to call the roll: Ayes: Alderman Neff, Wexler, Martin and McKay. 1 Nays: Alderman Tures, Wolf, Behrel, Prickett, Tistle, Nelsen, Bell and Schubert. The Mayor declared the motion lost. CUMBERLAND STATION PARKING LOT. Alderman Nelsen reported on above parking lot, that the Parking Meter Committee investigated and Atbornye Eley reports that no use of the property is permitted without a lease with a cost per car comparable with the lease we now have on the Chicago and Northwestern Railway right of way between Pearson and Des Plaines Avenue. Therefore recommend that the cost appears prohibitive at this time, but continued effort will be given this plan with the hope than an equitable program can be worked out. Alderman Neff requested that the City Clerk check to see how many copies of the codes were on hand in order that more copies may be ordered. Alderman Neff then read her statement why she voted to award the tree spraying to a company which was not low bidder. 1 Lc CD 1 1 3-4-57 The Clerk read a letter from Attorney Eley regarding the sume of $50.00 to be paid to the Water Commission. On motion by Alderman Wolf and second by Prickett the letter was referred to the Finance Committee. ZONING VIOLATION 1576 FOREST AVENUE. The Clerk read a report of Chief R. Kolze of inspection at above address. Approximately 100 garments were on storage racks at time of his inspection which were picked up for cleaning. The Mayor instructed Chief Kolze sign a complaint. The Mayor informed the Council he had received a report from Marshall Howard about the Meyer Coal Company case and copies of this report were placed on the Alderments desk. The letter was held over for next meeting so that all involved would receive a copy of letter. The Clerk read a letter from Dr. H. H. Heller regarding the parking on Laurel Avenue between Webford and Prairie Avenues. He desires no parking on that part of Laurel Avenue. The Clerk informed the Council he received a reply from the Chicago and North- western Railway regarding unloading cinders and the noise of locomotives parked all night in their yards. They will investigate and eliminate any further cause of complaint. FIRE DEPARTMENT TO ADVERTISE BIDS TO BE RETURNED APRIL 2, 1957. On motion by Alder- man Prickett and second by Tures the Council approved to advertise for bids for fire hose, bids to be in by April 1, 1957. ADOPT ORDINANCE VACATING SCHOOL ATT,FY. The Clerk read for second reading: "Ordinance Vacating Public Alley' The motion was made by Alderman Wolf and seconded by Prickett to adopt the ordinance. The Clerk was instructed to place the following letter in the minutes: We desire the good will of the officials and the people as a whole of Des Plaines, so supplementing our request for zoning the property on the south side of Howard Street, between the Railroad and Mt. Prospect Road, we agree to the following: Since we do not have a definite client for the east portion of our property, which lies between the due north and south track, and the track running southwest, we agree if the property is zoned light industry now, with the west portion, that we will not sell, or build on the property, unless the industry is first approved by.the City Council of Des Plaines. This provision can even be incorporated in the zoning of the east portion of the property. Again, we say we want the good will of the officials of Des Plaines and only by co-operation can we hope to get it and enjoy it. As explaines before, all industrialists shy away from propertj:es not zoned, because they feel the zoning and annexing will be a long drawn out affair, but if it only required approval or disapproval of the Des Plaines.City Council, we are sure duly prospect we may have will go along. The Clerk read a letter from Plan Commission recommending purchase of a case and maps for water mains, sewers and,zoning to be hung in the Mayor's office. The motion was made by Alderman Behrel and s;conded by Martin that the City purchase the maps and case which the Plan Commission had requested. The Mayor declared the motion carried. Alderman Martin suggested that 30 copies of the survey report be purchased and a copy be given to each candidate and to the papers. The cost would be x$41.00 and each candidate to pay $$1.50 per copy. The motion was made by Alderman Martin and seconded by Neff to purchase the 30 copies. The Mayor received a letter from Mr. Reeves requesting him to accept his resignation from the Plan Commission. On motion by Alderman Schubert and second by Tures the Council instructed the Clerk to write to Mr. Reeves commending him upon his service as a member of the Commission. The Mayor will allow new Mayor to make appointment of a Commissioner. JOHN H. G ICER APPOINTED CHAIRMAN PLAN COMMISSION. The Mayor requested approval of his appointment of John H.
