02/18/1957449 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL, DES PLANES, ILLINOIS, HELD IN COUNCIL ROOM, CITY HALL, FEBRUARY 18, 1957, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert, and Dunlap responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Behrel to approve the minutes of February 4, 1957. The motion was voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the Treasurer's monthly report and the City Clerk's 1956 annual report. Pity Engineer Fletcher reported he had checked the bids for water mains on Busse Highway and recommended the bid of Anthony Giancola for $5,971.80,which was low bid, be accepted and checks for other bidders be returned. The motion was made by Alderman Behrel and seconded by Martin to concur in the report and accept the bid. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. Alderman Tures made his appearance at this time. ATTORNEY LOMMEN EIEY'S REPORT ON ZONING VIOLATION(ROOMING HOUSE). Attorney Eley made the following report: Re: Milton and Beavers, 738 Graceland Avenue, Des Plaines, Illinois On November 5, 1956, the Fire Chief reported to the City Council the existence of a zoning violation at the above address and I was directed to see that the violation was abated. On November 8th I wrote to Mrs. ElsiecB. Milton who was reported to be the owner of said premises and within a few days had a telephone call from Mrs. Milton at which time she reportod that the violation was unwitting on her part as she was in- formed at the time she signed the contract for the purchase of the property that a rooming house was properly operated there. Mrs. Milton agreed in her telephone con- versations with me that she would terminate the improper use of tbe property as soon as possible and that she intended to rent the property to a suitable tenant for use as a single family residence. I, shortly thereafter, received a letter signed by Mrs. Mary Milton, who appears to be the mother of Elsie B. Milton, to the effect that by December 15 the entire second floor of the building would be vacated. After December 15 I suggested that a reinspection be made to see whether or not the violation had ceased. On January 16 the Fire Chief reported that the property was rented by Mr. and Mrs. Robert Beavers who were also running a rooming house with a. number of tenants in excess of that permitted by our ordinances. Again I was directed to take the necessary steps to terminate this violation. Accordingly on January 31 I filed a complaint before the Police Magistrate of Des Plaines against both the Miltons and the Beavers and hearing were set for this Owning. The Miltons were joined in the complaint because it had been indicated to me that the Beavers were not tenants but were only operating the property for the Miltons. This morning the Beavers and the Miltons both were present in the Court represented by Counsel. A lengthy discussion of the situation participated in by the defendents, the Fire Chief, the Health Inspector, the Police Marshal and myself on behalf of the City was mad. It appearing that the Miltons had in fact ceased their operation of the premises and it appearing further that the Beavers had reduced the number of tenants to a number even below that permitted by our ordinances, and they had agreed to comply with the ordinance, I felt that the purpose of the Council could be attained without any protracted trial and appeals. Accordingly I nonsuited the complaint against the Miltons and agreed to permit the suspension of the fines upon a plea of guilty being made by the Beavers. Consequently Judge Sengstock entered a finding of guilty, fined the Beavers $25.00 the minimum penalty by the zoning ordinance and $5.00 the minimum penalty provided by the lodginghouse ordinance and with my consent suspended them. Costs are to be paid by the defendants. 450 2-18-57 ATTORNEY EMS REPORT ON ZONING VIOLATION. (Cont'd.) I have suggested to the various City Officials present this morning the desir- ability of making inspection in the near future of these premises to make certain that the violation doeu not reoccur, have told a neighbor who was present to inform me or any of the City Officials if she suspects a violation and have also suggested an inspection of several other properties in the neighborhoodiwhich in the course of the discussions were said to be also violating one or bothof the ordinances named above. In connection with this matter I would like to ask your careful consideration of our lodging and boarding house ordinance which appears as ections 1002, 1 to 10 of our 1956 compilation of the 1928 Code. There is a great deal of difficulty in interpreting some of the language which should be clarified either by amendment or by the rewriting of the entire ordinance. In addition I would like to point out that the zoning or,inance defines a lodginghouse as one containing five or more lodgers whereas our boardinghouse ordi- nance defines a boarding as one of four or more lodgers. It is thus proper for a resident in a Retidence District A Area to have four lodgers without violating the zoning ordinance and needing a lodging permit. I have instructed the Fire Chief to issue such a permit if requested and if the property in question meets the require- ments of the ordinance and to note on the license that the licensee would be in violation of the zoning ordinance if five or more tenants live on the premises. It might be well to consider making the two definitions df lodging consistent with one another. The Mayor referred the report to the Building Control and Inspection Committee regarding amending the ordinance. City Attorney Eley presented a certified copy of an order of the Judges of the Circuit Court of Cook County sitting in bank appointing Earl R. Warnicke as the Court's commissioner of the Des Plaines, Mount Prospect, Arlington Heights and Palatine Water Commission for a term of five years. The Mayor ordered same placed on file. C. J. CHAMALES' CONTRACT APPROVED. Alderman Schubert read the letter from Mr. Chamales which was approved as a contract. The motion was made by Alderman Schubert and seconded by Prickett to approve the contract. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert and Dunlap. Nays: Alderman Wolf. The Mayor declared the motion carried. Alderman Schubert reported about the property at Howard and Mt,. Prospect Road. He requested the Clerk write the Zoning Board members to attend a meeting Monday, February 25, 1957, at 8:00 P.M., of Council as a Committee of the Whole, with a representative of the owner of property. Alderman Bell reported the following on paving a part of Birch Street: The Street and Traffic Committee recommend this matter be referred to Board of Local Improvements Committee for recommendation and public hearing, if necessary. The Mayor referred sane to the Board of Local Improvements, on motion by Alderman Bell and second by Martin. EVERETT STREET MADE ARTERIAL STREET. On motion by Alderman Bell and second by Tistle, the Council approved to make Everett Street an arterial street. Alderman Bell reported about paving Everett Street and installing sewer with part use of Motor Fuel Tax funds. The motion was made by Alderman Bell and seconded by Tistle to appro- priate 3150,000 of Motor Fuel Tax funds for this project. After discussion, on motion by Alderman Neff, and second by Dunlap, the matter was deferred until next meeting so the Street Committee could have a written report on the funds. Aldermen Bell reported on all day parking on Laurel Avenue bettaeen Prairie and We bf ord, that the Street Committee recommend 3 hour parking on above street and proper ordinance be drawn. On motion by Alderman Bell and sedond by Martin, the Council concurred in thereport. 451 2-18-57 Alderman Bell reported about installing left turn light at Miner and Des Plaines A venue that the Street and Traffic Committee recommends City Engineer Fletcher be authorized to prepare plans and specifications and estimates of costs for Street Committee. On motion Alderman Bell and second by Schubert the Council concurred in the recommendation. Alderman Bell reported that the Street Committee recommend to vacate the alley at North School property and Attorney draft an ordinance. On motion by Alderman Bell and second by Wolf, the Council concurred in the report. Alderman McKay reported the Police Committee investigated about patrolman at Wolf and Algonquin, that the Police Committee has letter from Safety Council referred to it on January 21, reference to crossing guard for Algonquin and 'Wolf Roads until lights are installed and the Committee recommends that Marshal arrange for crossing guard for school children at this intersection pending installation of lights. On motion by Alderman McKay and second by Tures the Council concurred in the recommenda- tion. Alderman McKay reported he was supposed to have received a report regarding parking at Miner and Western Avenue and thought it was a matter of enforement. The Mayor instructed thief 'iigham to check on this parking. Alderman Prickett reported that the Fire Marshall and Police Chief investigated one side prking on Cora,'White and Center Streets and recommend parking on east side of Center Street from Oakwood Avenue to Oakton Street, Parking on the west side of White Street from Oakwood to Oakton and parking on Cora Street, odd and even years, from Ashland to Oakton Street. On motion by Alderman Prickett and second by Tistle the Council concurred in the report and instructed the Attorney to draft an ordi- nance. Alderman Prickett reported Marshall Kolze had two prices from companies on air compressors which were the same price. The motion was made by Alderman Prickett and seconded by Bell to purchase the compressor from the American La France Corporation for $650.00. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Neff, 'Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert and Dunlap. Nays: Alderman Wolf, who thought they should contact about government surplus. The Mayor declared the motion carried. The motion was made by Alderman Martin and seconded by Neff to advertise for bids regarding Chicago and Northwestern Railway Park for parking lot to be in at the March 18, 1957 meeting. The motion was voted upon by acclamation. APPROVAL OF BILLS. Alderman Behrel presented the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. $23,119.61. (A copy of resolution placed before each Alderman and on file with City Clerk.) Alderman Behrel said that on page 5 the bill of Electric Chemical Company should be changed by deducting $19,00 for discount and page 2 the bill of Roy Wallace, $15.00, be held out at request of Alderman Wexler. The motion was then made by Alderman Behrel and seconded by Bell to adopt the resolution. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. Alderman Prickett made the motion, which was seconded by Tures, to approve the bill of $947.00 of Mr. Chamales which had been held up at last meeting due to absence of Alderman Prickett. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, 'Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. 42 2-18-57 Alderman Behrel reported that the Finance Committee recended to allow $150.00 for the Northwest Family Service Association. The motion was made by Alderman Behrel and seconded by Martin to concur in the report. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, Davis, SchtL_ rt and Dunlap. Nays: None. The Mayor declared the motion carried. Alderman Behrel reported on the request to repeal sales tax that the Finance Committee had investigated and recommended not to repeal the tax. The Council concurred in the report by acclamation. On motion by Alderman Neff and second by Martin that the the Garbage fee was referred to the Finance Committee. question of repealing111 The motion was made by Alderman Wolf and seconded by Wether to include the Garbage levy in the tax levy and be referred to Finance and Garbage Committees. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Tistle, Bell and Davis. Nays: Alderman McKay, Schubert and Dunlap. The Mayor declared the motion carried. OPEN BIDS ON TREE SPRAYING AND TRIMMING. On motion by Alderman Dunlap and seconded by Schubert the Council instructed the Clerk to open the above bids. Several bids were received and the Mayor declared a recess. After reconvening,the motion was made by Alderman Dunlap and seconded by Neff to award the spraying bid to the Clarke Outdoor Spraying Company. After considerable discussion, on motion by Alderman Wolf and second by Tures the bids were referred back to the Sanitation Committee. On motion by Alderman Neff and second by Wexler the Council approved to readvertise for bids on the tree spraying, to be returned at the February 25th meeting. The Clerk read the report of Traffic Commission about traffic condition at Prairie and Second, and Oakton and Center. That we reported on this matter on September 4, 1956. We, at that time, recommended that no parking. be permitted 30 feet from the corner on each of the above mentioned locations. This matter was dis- cussed with the Bus Company and they report they were not aware of any traffic congestion at these locations. The Mayor referred the matter to the Street Committee. The Clerk read the report of Plan Commission which was referred to them about investigating and study about the annexation of the area north of Rand Road, west of the River to City Limits. The Plan Commission recommend proposed City Plan of the City of Des Plaines be used as a basis for the "land Use" concerning the annexation of the area in question. The Clerk read the report of Plan Commission regarding power transmissions and voltage stations in City Limits. The Commission recommend: That no power trans- mission lines be permitted anywhere within the City Limits of Des Plaines. That voltage stations may be permitted within the City Limits of Des Plaines provided the necessary precautions be taken relative to public safety, etc., and that underground cables be used exclusively. On motion by Alderman Neff and second by Martin a reso- lution be sent to Public Service Company regarding the above was approved by Council. ZONING BOARD RECOMMENDATION ON ZONING. The Clerk informed the Council he had several recommendations. Attorney Eley explained the zoning on the west side of River Road from the south side of Bennett Place to the south of Kennicott Court. The Zoning Board recommended the rezoning. On motion by Alderman Schubert and second by Dunlap the zoning was referred to the Municipal Development Committee. Attorney Eley explained the zoning on west side of River Road from approximately Stockton to Birch- wood Avenues, etc., which the Board approved. On motion by Alderman Wolf and second by Schubert it was referred to the Municipal Development Committee. The Clerk read the report on zoning on south side of Prospect Avenue between Fine and Chestnut Avenues,etc., which the Board denied. On motion by Alderman Wolf and second by Bell, this was referred to the Municipal Development Committee. Attorney Eley explained the zoning nnport on north side of Devon Avenue between River Road and Higgins Road, which the Board denied. On motion by Alderman Schubert and second by Dunlap this was referred to ttie Municipal Development Committee. 1 453 2-18-57 ,SAFETY COUNCIL LETTER ON SCHOOL BUS CROWDING. The Clerk read a letter from the Safety Council stating they are seeking to give publicity on safety for school children riding buses. The Mayor ordered the letter placed on file. SAFETY COUNCIL LETTER ON'BICYCLE SAFETY PROGRAM. The Clerk read the above letter and the Mayor referred same to the Police Committee. GEORGE W. PRASSAS & COMPANY TETTER ON KROGE:f LOT. The Clerk read a letter which was a reply to letter from Clerk on zoning violation of Kroger parking lot on Center Stere t. The letter was. referred to the Building Control and Inspection Committee. ORDINANCE CHANGING IDE FOR MOVING HOUSES. The Clerk read for second reading the above ordinance, but the ordinance was referred back to the Street Committee. ADOPT ORDINANCE FIXING SALARY OF POLICE MAGISTRATE. The Clerk read for second reading the above ordinance. The motion was made by Alderman Behrel and seconded by Wolf to adopt the ordinance. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Bell, McKay, LCZ Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. ADOPT ORDINANCE REGARDING rtES ON WATER SERVICE PIPES. The Clerk read for second reading the above ordinance. The Mayor declared the motion carried. IIIAlderman Wolf inquired about the Carebuilt Corporation construction of sewer which was installed without City permission. The Mayor referred the item to theCity Engineer to investigate. CHICAGO DISTRICT PIPELINE COMPANY APPLICATION FOR PERMIT. The application to install 36 inch steel natural gas pipeline in Everett Street to west City Limits was referred to the City Engineer, City Attorney and Sewer and Street Committees. V.F.W.N0.2992 APPLICATION FOR CARNIVAL. The Clerk read a letter from V. F. W. asking permission to hold their carnival on the Northeast corner of Maple and Oakton Streets from June 29th to July 4th, 1957. On motion by Alderman Wolf and second by Bell the Council granted the request. 1 FIRST READING ORDINANCE TO VACATE ALLEY. The Clerk read for first reading the ordinance to vacate the alley on North School property. FIRST READING ORDINANCE REZONING ORDINANCE(CHICAGO & NORTHWESTERN RAILWAY AND OTHER PROPERTY AT HOWARD AND MT. PRC&PECT ROAD.) The Clerk read for first reading the above ordinance. FIRST READING STOP SIGN ORDINANCE AT GRACELAND, OAKWOOD AND FIRST AVENUE. The Clerk read for first reading the above ordinance. ;ZEST READINGIANNEXATION ORDINANCE LOT 11 Block Homeland Acres. The Clerk read for first reading the above ordinance. The Mayor referred same to the Municipal Development Committee. CHICAGO AND NORTHWESTERN RAILWAY NUISANCE. Alderman Behrel reported about cinders being unloaded in the Chicago and Northwestern Railway yards north of Fifth Avenue, also about noise from locomotives parked all night. On motion by Aldermen Martin and second by Behrel the Clerk was instructed to write the Chicago and Northwestern Rail- way 454 2-18-57 LADENDORF SUBDIVISION PLAT. The Clerk presented a plat approved by the Plan Commission. The Mayor referred same to the Municipal Development Committee. Alderman Bell reported about autos passing school buses. The Mayor referred the item to the Police Committee. The Clerk inquired about the $75.00 per policeman and fireman in appropriation. The Mayor referred the matter to the Police and Fire Committee . The City Clerk called the meeting to order due to the absence of the Mayor with Alderman Wolf, Neff, Wexler, Martin, Prickett, Bell, McKay, Davis, Schubert and Munlap responding to roll call. On motion by Alderman Schubert and second by Dunlap the Council appointed Alderman McKay Mayor pro tem. BISHOIP TREE SERVICE AWARDED BID ON TREE TRIMMING. Alderman Dunlap made the following report: Your Committee on Dutch Elm Disease Control has investigated the bids on tree trimming and removal and has found: 1. That three quotation were received: Synnestvedt & Assoc.,Glenview 3.60 per man per hour Bishop Tree Service, Chicago 3.50 per man per hour) McGuinn Tree Expert Company, Pk.Rigege 3.27 per man per hour 2. That your committee has investigated the qualifications of the bidders to fulfill the needs of the City's elm disease control program. 3. That based on our investigation and favorable experience with work performed during the past year your committee has determined that the lowest bidder quali- fied to handle the requirements of the City's Elm Disease control program is Bishop Tree Service. We, your Committee on Dutch Elm Disease Control, therefore recommend: that Bishop Tree Service be designated as the firm to handle the tree trimming and removal work during 1957, under the direction of this -Committee, the Supt. of Public Works and/or City Forester, expenditures for this work to be within the limits of,the 1957 Appro- priation ppro-- priation Ordinance. On motion by .'Alderman Dunlap land second by Schubert the bids were referred to the Elm Tree Disease Control'Committee. The Mayor pro tem declared a recess. After reconvening, Alderman made the following report: Your Committee has investigated and Saund that Clerke Outdoor Spraying bid of DDT -.95 Dendrol .58, as the lowest bidder qualified to perform the services required under the Elm Disease Control program. We; therefore recommend awarding contract to Clarke Outdoor Spraying Company, bid attached, to perform dormant spraying under direction of this Committee, Supt. of Public Works and/or City Forester, expenditures to be within the limits of the 1957 Appropriation Ordinance.
