11/05/19564( MINUTES OF THE !REGULAR MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS,iHELD .IN COUNCIL ROOM, CITY HALL, NOVEMBER 5, 1956, AT 8:00 P.M.I CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Schubert, Dunlap, Tures, Wolf, Neff, Martin, Behrel, Tistle, Nelsen, McKay and Davis responding to roll call. Alderman Bell was absent. APPROVAL OF MINUTES. The motion was made by Alderman Wolf and seconded by Behrel to approve the minutes of October 15, 1956. The motion was voted upon by acclamation. OFFICIAL REPORTS. The City Clerk submitted the monthly reports of City Clerk and Building Commissioner. The Mayor requested the Clerk call the roll regarding the annexation of land at Howard and Lee if the subdivider installed storm and sanitary sewers'. The ayes were Alderman Schubert, Dunlap, Tures, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay and Davis. Nays: Alderman Wolf. Alderman Neff desired more information and did not vote. JORDAN ROOF - WAREHOUSE. Alderman Davis reported about the Jordan roof, that t} Superintendent Warnicke had investigated and that it should be roofed, which would cost about $700.00. The motion w as made by Alderman Davis and 'seconded by Schubert to reroof at a cost of $700.00. After discussion, the Mayor put the question and the Clerk called the roll. Ayres: Alderman Schubert, Dunlap, Tures, Nelsen and Davis. Nays: Alderman Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle and McKay. The Mayor declared the motion lost. din motion by Alderman Behrel and second by Wexler the Council approved to advertise for bids to reroof. KELLEY LCT - CENTER STREET. Alderman Wolf reported the Building Control Committee had investigated the Kelley lot and found that to deny the variation could create a hard- ship on said petitioner for building permit and recommend that the variation be granted. The City Attorney informed the Council that the Zoning Board had denied a variation under the old ordinance and had advised the petitioner to file application under the new ordinance. The Mayor said the Council could not grant a variation, that the petitioner must apply for a variation for a Zoning Board hearing. ROOMING HOUSE, 738 GRACELAND. Alderman Wolf read a report from Chief R. Kolze of an investigation Mrs. Willer, Health Officer, and he made at 738 Graceland for a request for a rooming house permit. On motion by Alderman Wolf and second by Neff the Council approved that Attorney Eley take action to abate the violation in the single family area. Chief Kolze to sign the complaint. Alderman Martin reported about purchasing a used grader for $700.00. The motion was made by Alderman Martin and seconded by Behrel to purchase the grader for $700.00. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Wolf, Neff Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay and Davis. Nays: None. The Mayor declared the motion carried. On motion by Alderman Martin and second by Tures the Mayor is to write to Hannifin Corporation and Des Plaines Park District to construct a sidewalk on Wolf Road. On motion by Alderman Martin and second by Neff the Clerk was instructed to write the State Highway Department to post 25 M.P.H. signs on Wolf Road from Oakton Street to Chicago and Northwestern Belt Line and to reroute the trucks from Wolf Road. A. AND P. DRIVEWAYS ON CENTER STREETI. Alderman Martin reported on A. & P. driveways on Center Street. The motion was made by Alderman Martin and seconded by Neff not to issue permits for driveways at present on Center Street. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Dunlap, Tures, Neff, Martin, McKay and Davis. Nays: Alderman Schubert, Wolf, Wexler, Behrel, Prickett, Tistle and Nelsen. The Mayor declared the motion lost. Alderman Neff made the motion to refer back to the Committee but the Mayor ruled her out of order. The motion was then made by Alder- man Wolf and seconded by Schubert to issue the street permits. The motion was made by Alderman Martin and seconded by Tures to table the matter. The Mayor put the question and the Clerk called the roll; Ayes: Alderman Dunlap, Tures, Neff, Wegler, Martin, McKay and Davis. Nays: Alderman Schubert, Wolf, Behrel, Prickett, Tistle and Nelsen. The Mayor declared the motion carried. 1 1 417 11-5-56 Alderman Dunlap read a report on .!R Dutch Elm Disease" which included expenditures for this year. The motion was made by Alderman Dunlap and seconded by Neff to approve the report. The motion was made by Alderman Wolf and seconded by Schubert to refer the report to Finance and Sanitation Committees. The motion was voted upon by acclamation and the Mayor declared a recess so the Finance Committee could check the funds with the Clerk. After reconvening, Alderman Behrel reported that with past years unappropriated funds total of $14,000.00, which was reappropriated, that their would be sufficient funds. The motion was made by Alderman Behrel and seconded by Tures that the $14,300.00 be transferred from the other Street items to the tree removal item. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Neff, Martin, Behrel, Tistle, Nelsen, McKay and Davis. Nays: Alderman Wolf, Wexler and Prickett. The Mayor declared the motion carried. The motion was made by Alderman Dunlap and seconded by Martin that the City spend $4,000.00 for tree trimming and removal and $10,300 for spraying. The Mayor put the question. and the Clerk called the roll. Ayes: Alderman Dunlap, Tures, Neff, Martin, Behrel, Nelsen, McKay and Davis. Nays: Alderman Schubert, Wolf, Wexler, Prickett and Tistle. The Mayor informed the Council he may veto the item. Alderman Dunlap read the following report: Your Committee on Sanitation wishes to make the following report: 1. Acting on a proposal by Supt. Wernicke your committee has approved a new service to made available to Des Plaines residents: regular open -truck trash pickup, to begin at an early date. There has long been a need for residents to dispose Of much refuse too large to be handled by our packer trucks. This refuse collects in basements, attics, garages and yards resulting in fire and safety hazards and unsightly conditions. This service should encourage every -resident to keep his premises safe and clean. Our plan is. to have an open truck follow one day behind the regular garbage pickup on a designated week each month. Further details andxegulations will be announced soon. Personnel and equipment presently provided for will handle the job by pooling manpower and equipment from the Sanitation, Street and Sewer departments. 2. The Sanitation Committee is also giving consideration to the future dumpsite requirements of the city. We need to plan now for dependable future disposal facilities. Alderman Wexler read the following letter: At your suggestion this letter is being written in an effort to get decent drainage for our property. The undersigned property owners, five in all, agree to share the cost of approximately 500 feet of 6 inch drain tile, which on the current market sells for 22¢ per foot. The share per property owner shall not exceed twenty-five dollars ($25.00)•and the labor of installing same is to be borne by the City of Des Plaines. It is further understood, said tile to be installed shall connect up with existing tile at the rear of 87 North Warrington Road continuing through property at 125 North Warrington Road, where it shall terminate. All of the property owners, through whose property this tile is to run, have given their consent to its installation in a letter to you dated Sept. 19, 1956 and they are: Fred Stocke, 87 N. APPROVAL OF BILLS. Alderman Behrel presented the following resolution: HE IT RESOLVED BY THE CITY COUNCIL OF THE. CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total $29,140.61. (A copy of resolution placed before each Alderman and on file with City Clerk.) The motion was made by Alderman Behrel and seconded by Prickett to adopt the resolution. Alderman Nelsen requested the bill of C. H. Thompson Company for $297.50 be withheld. The Mayor put the question and the Clerk called, the roll. Attorney Eley read a letter from M. S. Howard regarding a fee of $500.00 for Matter in Chancery Sheppard regarding Oak Park Trust and Savings Bank' case. The motion was made by Alderman Prickett and seconded by Schubert that the fee be paid. The Mayor put the question and the Clerk called the roll. Ayes: Alderman; Schubert, Dunlap, Tures, Wolf, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay and Davis. Nays: Alderman Neff. The Mayor declared the motion carried. ATTORNEY EIEY REPORT. The Attorney read the following report: For sometime I have been considering the desireability of a method of procuring advice from the City Council as well as authority to make commitments' on behalf of the City yet avoid the discussion of legal problems before the full Council. It will very probably continue to be desireable to consider settling damage claims against the City and also possibly injunction suits or other Chancery matters in connection with enforcement of the Building Code and Zoning Code of the City. Other Cities and Villages have such a Committee, frequently called a Judiciary Committee to which all problems of this nature and probably also routine problems of the City Attorney or Attorneys for the City Are referred. I have therefore a feeling that the Council may wish to follow this suggestion and have prepared an ordinance amending the City Code creating such a committee as a standing committee of the Council, and am enclosing copies of said proposed ordinance. /s/ Lomme n D. Eley 1 419 11-5-56 The Clerk read a copy of letter to J. J. Cullen from the Chicago and Northwestern Railwayyregarding a new station at Cumberland. The Clerk was instructed to write to State Commerce Commission regarding the station and mail copy to the Chicago and North- western Railway. The Clerk read a letter from State Highway Department that a survey would be made of traffic at Touhy between River Road and Mannheim Road regarding speed limit. SECOND READING SOUND TRUCK ORDINANCE. The Clerk read for second reading the above ordinance. The motion was made by Alderman Behrel and seconded by Davis to adopt the ordinance. The motion was made by Alderman Neff and seconded by Dunlap to table the ordinance. until next meeting because there was another ordinance for first reading on public address systems. The Mayor declared the motion carried. PRATT =NEGATES. The Clerk informed the Council he had the State Highway Agreement and resolution for Motor Fuel Tax Funds for gates at Pratt Avenue. On motion by Alder- man Martin and second by Behrel the items were referred to the Street Committee. CD FIRST READING OF ORDINANCE ON NON -METERED PARKING IAT NO. 2. The Clerk read for first reading the above ordinance. The ordinance was referred to the Parking Meter Committee, on motion by Alderman Schubert and second by Martin. 1 1 FIRST READING OF WATER COMMISSION ORDINANCE. The Clerk read for first reading the following ordinance entitled: AN ORDINANCE PROVIDING FOR THE JOINT ACQUISITION OF A COMMON SOURCE OF WATER SUPPLY FOR THE CITY OF DES PLAINES, THE VILLAGE OF ARLINGTON HEIGHTS, THE VILLAGE OF MOUNT PROSPECT AND THE VILLAGE OF PALATINE, AND THE FORMATION OF A PROPOSED WATER COMMISSION TO BE KNOWN AS THE NORTHWEST SUBURBAN WATER COMMISSION. The Mayor ordered the ordinance placed on file for second reading. The Council approved the motion of Alderman Martin which was seconded by Behrel that the Mayor write to the Park Ridge officials regarding this water commission. ASSISTANT SUPERINTENDENT OF SCHOOLS, G. RUDIGER, TETTER. The Clerk read the following letter: The Board of Education, Consolidated School District No. 62, requests you to install a street on Fifth Avenue between Golf Road and the property line of the Cumberland School. The construction on Fifth Avenue will require curbs and gutters, 8 -inch sub -base and a tar mat. The construction of Fifth Avenue is needed as an entrance to the school property and also to complete the Cumberland School site. The Clerk read a letter from Safety Council on hazard for 95 childred.crossing.Chicago and Northwestern Railway tracks on Thacker Street west of Wolf Road. The Clerk was instructed to write to the signal engineer of the Chicago and Northwestern Railway for a conference. RESOLUTION TRAFFIC LIGHT OAKTON AND WHITE STREET. The Clerk read a resolution for expenditure of $15,000.00 for traffic lights at ()Elkton and White Streets. The motion was made by Alderman Nelsen and seconded by Tistle to adopt the resolution. The Mayor received a reply to his letter from School Board that the above would represent them on the Plan Commission. DRIVEWAY APPLICATION FOR GAS SERVICE STATION AT RAND AND GRACELAND. The Clerk informed the Council he had an application for driveways at above address. The Mayor referred same to Street Committee. GABRIEL SUBDIVISION PLAT.
