MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL; DES PLAINES, ILLINOIS,
HELD IN THE COUNCIL ROOM, CITY HALL,
OCTOBER 15. 1956. AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor KennethjG. Meyer who presided
with Alderman Schubert, Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle,
Bell and McKay responding to roll call.
The Mayor informed the Council that Attorney Howard was present to make a report
on the Premier Rose Garden - Bauske case. After the Attorney's report the Council
approved that the Attorney Howard appeal the case, on motion by Alderman Bell and
second by Martin.
Alderman Nelsen appeared at this time. -
APPROVAL OF MINUTES. The motion was made by Alderman Wolf and s4.conded by Martin to
approve the minutes of October 1, 1956. Alderman Schubert requested a correction in
fifth paragraph, "concurred in report and denied disannexation." Alderman Prickett
requested on page two that the Council approves the fire district contracts. The motion
was voted upon by acclamation with corrections made.
OFFIC IAL REPORTS. The Clerk submitted the reports of City Treasurer for September and
the Clerk's nine months reports of receipts and disbursements.
Alderman Davis appeared at this time.
HOUSING AND HOME FINANCE AGENCY FUNDS FOR LIBRARY PLANNING. Alderman McKay presented a
contract from Housing and Home Finance Agency to make an advance of $5,000.00 for
preparation of preliminary plans and specifications of new library building. On motion
by Alderman McKay and second by Prickett the Council approved that the Mayor and Clerk
execute the contract.
The Mayor reported about a $500,.00 claim against Jacob Heinrich On zoning viola-
tion at laurel and Prairie Avenues. The zoning violation having been corrected, the
Mayor requested the City Attorney Eley prepare an order releasing Mr. Heinrich of this
claim. On motion by Alderman Prickett and second by Behrel the Council approved the
Mayor's request.
Alderman Schubert reported on County Zoning hearing regarding Wieboldt store on
Dempster Street. The Alderman reported that the Municipal Development Committee
recommended not to object the rezoning. On motion by Alderman Schubert and second by
Wolf the Council concurred in the recommendation. Alderman Neff did not vote due to
conflict.
On motion by Alderman Schubert and second by Martin the Council instructed Attor-
ney Eley to draft an ordinance on subdivisions regarding the Naperville case.

On motion by Alderman Schubert and second by Martin the City Clerk was instructed
to write a letter to the Plan Commission to refer all subdivision plats which they
approve to the City Council. No plat to be given to subdivider except on approval of
City Council.
A. & P. PARKING LCT DRIVEWAYS. Alderman Bell reported on A. &:P. parking lot driveways
and made the motion to concur in the report which was seconded by Wolf. The amending
motion was made by Alderman Martin and seconded by Schubert that two 20 foot driveways
be constructed on Lee Street: The Mayor put the question and the Clerk called the
roll: Ayes: Alderman Schubert, Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett,
Tistle, Nelsen, Bell, McKay and Davis. Nays: None. The Mayor declared the motion
carried. The motion was made by Alderman Martin and seconded by Neff to refer the
Center Street driveways to the Street and Safety Committee. The Mayor put the question
and the Clerk called the roll. Ayes: Alderman Schubert, Tures, Wolf, Neff, Wexler,
Martin, Behrel, Prickett, Tistle, Nelsen, Bell, McKay and Davis: Nays: None. The
Mayor declared. the motion carried.
ROSE AVENUE NAME CHANGE. Alderman Bell reported the Street Committee recommended to
refer the petition back to petitioners and request them to change the, street to some
other name instead of Rose Drive. On motion by Alderman Bell and second by McKay the
Council concurred in the report.

M to certain property owners whose lots would have to be crossed when the tile was
installed. When this was brought to the attention of the sewer committee the proposal
was made that if the property owners in question would give their written permission
such a letter would be submitted to E. A. Herzog. Letters of.permitsion were secured
by the residents and conference was had with the representatives of the E. A. Herzog
Company. Their position is that the offer to install the six inch drain tile in
accordance with the original map was terminated when they did not obtain permission
of the property owners in the winter of 1954-1955. They have done other work in the
subdivision with the money appropriated for that installation and do not wish to renew
their offer at this time. They aro. aware of the continued flooding of certain lots in
the development but are not inclined to take any affirmative action.
We, your committee on sewers, therefore recommend that a letter be written to
IIIE. A. Herzog & Company criticizing the failure of that organization to install the
necessary drain tile to relieve the area in question. That a copy of this letter be
sent to Northshire residents wholse lots are affected suggesting that they propose a
plan to alleviate the flooding condition.

CITY SALES COMPANY AWARDED BID ON SEWER CLEANING EQUIPMENT. The motion was made by
Alderman Wexler and seconded by Behrel the Council awardthe above bid to the City Sales
Company, 5909 Kenmore Avenue, Chicago, for $2,840.75. The Mayor put the question and
the Clerk called the roll. Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel,
Prickett, Nelsen, Bell, McKay and Davis. Nays: Alderman Schubert and Tistle. The Mayor
declared the motion carried.
NORTHSHIRE DRAINAGE. Alderman Wexler reported the following:
The committee on sewers had referred to it the question of drainage in the North -
shire division of Cumberland. The committee on sewers has investigated the above and
has found that this subdivision, commonly known as Northshire, was developed by the
E. A. Herzog and Company about two years ago. At that time a drainage map was sub-
mitted by the builder to the city engineer. This map show4d all the lots in the sub-
division to be adequately protected for proper drainage in the event of rain or other-
wise. This map particularly showed six inch drain tile across certain lots from 87
North Warrington to 125 N. Warrington. This drain tile was never completed and as a
result rain water has accumulated on certain of the.lots in the subdivision.
Numerous complaints have been made to the E. A. Herzog Company who gave continued
promise to install the tile and later stated that they were unable to obtain permission

On motion by Alderman Wexler and second by McKay a letter of protest is to be written
to the subdivider, E. A. Herzog & Company.
CHANGE OF WARDS. Alderman Nelsen reported on change of wards. The motion was made by
Alderman Nelsen and seconded by Martin to accept the change of Ward one. The motion
and second was withdrawn after discussion. The motion was made by Alderman Wolf and
seconded by Davis to leave the wards as at present except to change the Fifth and
Sixth Wards. The amending motion was made by Alderman Neff and seconded by Wexler
that the Fifth and Sixth Wards be changed according to the recommendation of Alderman
Nelsen. The motion was voted upon by acclamation. The Mayor put the question on
Alderman Wolf's motion and the Clerk called the roll. Ayes: Alderman Schubert, Tures,
Wolf, Behrel, Prickett, Tistle and Davis. Nays: Alderman Neff, Wexler, Martin, Nelsen,
Bell and McKay. The Mayor declared the motion carried and the City Attorney draft the
Wards ordinance.
APPROVAL OF BILLS. Alderman Behrel presented the following resolution:

The Clerk read a letter from Attorney Eley that the case of Value -Balt Homes for
building permits was dismissed.
The Clerk read a letter from Des Plaines Park District that they had not requested
permission or had no intention to trim grass on. State property at Rand and River Roads.
The Mayor ordered the letter placed on file.
LIGHT SIGNALS AND GATES AT PRATT AVENUE. The Clerk read a copy of a letter to Mr.
Tuthill, District Engineer, from Wm. Dutelle, Engineer of Local Roads; and Streets,
regarding the City paying one-fourth of cost of gates. The Mayor referred the letter
to the Street Committee.
AWARD BID CATCH BASIN CLEANING TO CITY SANITARY SERVICE. On motion by Alderman Wexler
and second by Behrel the Clerk was instructed to open the one bid on cleaning catch
basins. The bid was $5.75 a basin for 300 catch basins. The motion was made by
Alderman Wexler and second by Tures to award the bid to City SanitsryiService. The
Mayor put the question and the Clerk called the roll. Ayes: .Alderman Schubert, Wolf,
Tures, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, Bell, McKay and Davis.
Nays: None. The Mayor declared the motion carried.
FIRST READING SOUND TRUCK ORDINANCE. The Clerk read for first reading the Sound Truck
Ordinance. After discussion, the motion was made by Alderman Nelsen and seconded by
Prickett the ordinance be placed on passage. The motion was then made by Alderman
Martin and seconded by Neff to table the ordinance. The Mayor put the question and
the Clerk' called the roll. Ayes: Alderman Schubert, Tures, Wolf, Neff, Wexler,Martin,
Behrel, Tistle and McKay. Nays: Alderman Prickett, Nelsen, Bell and Davis. The Mayor
declared the motion carried.
FIRST READING ORDINANCE ON ANNEXATIONS. The Clerk read for first reading the ordinance
on dedicating land for schools and parks in annexations. The Mayor ordered the ordi-
nance placed on file for second reading.
ARd erman Tistle was excused at this time.
AGREEMENT ON TRAFFIC CONTROL SIGNAIS1 HIGGINS AND DEVON AVENUE. The Clerk informed the
Council he had agreement regarding.City payming electrical energy for, the above traffic
controls. The motion was made by Alderman Schubert and seconded by Bell to authorize
the Mayor and Clerk to sign same. The Mayor put the question and the Clerk called the
roll. Ayes: Alderman Schubert, Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett,
*Nelsen, Bell, McKay and Davis. Nays: None. The Mayor declared the motion carried.
REZONING APPLICATION SOUTHWEST CORNER TOUHY AND RIVER ROAD. The Clerk informed the
Council he had a rezoning application for the above location. On motion by Alderman
Schubert and second by Prickett the application was referred to the Zoning Board of
Appeals to call a hearing sitting as a Commission.
ZONING VARIATION 854 HOLLYWOOD AVENUE. The Clerk informed the Council he had an
application for a zoning variation at the above location. On motion by Alderman Schu-
bert and second by Prickett the application was referred to the Zoning Board of Appeals
sitting as a commission to call a hearing. .
LETTER FROM D. R. MILS, 191 HENRY AVENUE. REGARDING BUILDING PERMIT. The Mayor
referred the letter to the Building Control and Inspection Committee.'
The Mayor reported he had written a letter to the Park District and School Board
for a representative to meeti with the Municipal Development Committee on annexations.
The Mayor's reply from Park District that F. C. Arndt would represent' the Park District.
GABRIEL SUBDIVISION PLAT ON GROVE AVENUE NEAR BALLARD ROAD. The Clerk! informed the
Council he had a plat of Gabriel Subdivision for approval. On motion by Alderman
Schubert and second by Tures the plat was referred to Plan Commission' by the Council.
ZARI'S SUBDIVISION PLAT, TOUHY AND MAPLE STREETS. The Clerk informed the Council he
had a plat of Zari's Subdivision for approval. On motion by Alderman' Schubert and
second by Tures the Council referred the plat to Plan Commission.

TIPTON CASE APPEALED. On motion by Alderman Tures and second by Wolf the Council
approved that Attorney Eley be the attorney in Tipton Case which was appealed.
CUMBERLAND LIGHTS. The motion was made by Alderman Davis and seconded by Wolf that the
City spend 0356166 to repair Cumberland lights. The Mayor put the question and the
Clerk called the roll. Ayes: Alderman Schubert, Tures, Wolf, Neff, Weller, Martin,
Behrel, Prickett, Nelsen, Bell, McKay and Davis. Nays: None. The Mayor declared the
motion carried.
CUMBERLAND STATION PARKING IAT. Alderman Nelsen reported that the Committee investi-
gated and found the Railroad right of way southwest of Cumberland Station. would be
well suited for a commuter parking lot. The Committee recommends the City Attorney
be directed to negotiate with the Northwestern Railroad for a leaae on a meter basis
and also on the basis of improving the land for free off the street commuter parking.
The Attorney was so instructed.
ADOPT ORDINANCE RESTRICT PARKING ON NORTHWEST HIGHWAY. The Clerk read for second
reading the above ordinance. The motion was made by Alderman McKay and seconded by
Behrel to adopt the ordinance.Alderman McKay requested the 1200 feet be changed to
CD 1015 feet. The Mayor put the question with the change made in ordinance. The Clerk .
LD called the roll: Ayes: Alderman Schubert, Wolf, Tures, Martin, Behrel, Prickett,
Nelsen, Bell, McKay and Davis. Nays: Alderman Neff and Wexler. The Mayor declared
the motion carried.

SECOND READING ORDINANCE RESTRICT PARKING ON NORTHWEST HIGHWAY,STATE AND BROADWAY.
The Clerk read for second reading the above ordinance. The motion was made by Alder-
man McKay and seconded by Davis to table the ordinance. The Mayor put the question
and the Clerk called the roll. Ayes: Alderman Schubert, Wolf, Tures, Martin, Behrel,
Prickett, Nelsen, Bell, McKay and Davis. Nays: Alderman Neff and Wexler... The.Mayor
declared the motion carried.
SAFETY COUNCIL IETTER, SECOND AND ROSE AVENUE, ONE-WAY STREETS. tlderman Martin read
a letter from Safety Council regarding making Rose and Second Avenues one-way streets.
On motion by Alderman Martin and second by Wexler the letter was referred to the
Traffic Commission.
ADJOURNMENT. The motion was made by Alderman Tures and seconded by Wolf to adjourn.
