07/02/1956378 MINUTES OF THE REGULAR MEETING QF THE CITY COUNCIL, DES PLAINES, ILLINOIS, !HELD IN THE COUNCIL ROOM, CITY HALL. !JULY 2. 1956 AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by City Clerk Henrich'With-Alderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Wexier, Martin, Bekirel, Prickett, Nelsen and Bell responding to roll call. The Clerk informed the Council the;Mayor would be absent and a Mayor pro tem must be appointed. On motion by Alderman Martin and second by Prickett the Council approved the appointment of Alderman Bekirel as Mayor pro tom. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Tistle to approve the minutes of May 21, 1956. Alderman McKay requested the correct name of seconded motion on Higgins Water Company hearing and Alderman Bell seconded the motion. Alderman Martin requested the addition of "Garbage collection fee be.diacontinued December 31, 1956.and payment be made from Corporate Fund", regarding!Tax Levy on Garbage Collection. The motion was then voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the reports of City Clerk and Building Commission er for June and the Fire Chief's six month report. Chief Wigham reported they were operating the radar. Alderman Schubert reported about four County Zoning hearings to be held July 5, 1956 in the City Hall. SRODULSKI'S SUBDIVISION PLAT APPROVED. Alderman Schubert reported he had several plats from Plan Commission but received no letters regarding same. The Clerk had received no letters and had no record of the plats. Alderman Schubert reported one plat of Srodulski's Subdivision had been approved by the Plan Commission and he had informa- tion on that plat. The Municipal Development Committee recommended the plat be approved and the Mayor and Clerk be authorized to sign same. On'l.motion by Alderman Schubert and second by Dunlap the Council concurred in the repor. POLICE DEPARTMENT TO PURCHASE BATTERY AND SET OF CABLES FOR RADAR. Alderman McKay reported the Police Department was in need of an additional battery and set of cables for radar equipment. On motion by Alderman McKay and second by Tures the Council approved the purchase of same. Alderman Dunlap reported on Elm Tree disease, that one tree had been found infected. He has requested the City Attorney to prepare an ordinance regarding removing trees on private property if tree is infected. I •Alderman Bell reported on truck limit ordinance on some streets in Cumberland Terrace and recommended that the traffic be limited in accordance with ordinance. On motion by.Alderman Bell and second by McKay the Council concurred in the report and to have first reading of ordinance. Aderman Bell reported he had a petition to vacate an alley,and after discussion, on motion by Alderman Tistle and second by Prickett, it was referred to the Street Committee. On motion by Alderman Bell and second by Martin the City Attorney was instructed to draft an alley vacation ordinance on above petition. • REDEKER GARDENS WATER SERVICE. The motion was,made by Alderman Tures and seconded by Tistle that the request for water for Redeker Gardens be denied.1 On motion by Alder- man Martin and second by Wexler the matter was referred back to Water Committee. CHICAGO AND NORTHWESTERN LICENSE FOR STORM SEWER WELLER CREEK. Alderman Wexler report- ed he had received the Chicago and Northwestern Co. license Weller Creiek storm sewer and on motion by Alderman Wexier and second by Wolf the Council approved to authorise the Mayor and Clerk to Sign the license. CASSIDY COMPANY CONTRACT APPROVED. The motion was made by Alderman Wexier and seconded by Wolf to authorize the Mayor and Clerk to sign the Cassidy Company contract for sewer under Chicago and Northwestern in Weller Creek. The Mayor pro tem put the question and the Clerk called the roll: Ayes: Alderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Wexler, Martin, Behrel, Prickett, Nelsen and Bell. 'Nays:! Alderman Tistle. The Mayor pro tem declared the motion carried. the property east of Alderman Wexler reported that a subdivider is interested in Soo Line Railway between Thacker and Algonquin for residential. SEPTIC TANK 195 THACKER STREET. On motion by Alderman Wolf and elicond,by Tures the Council approved the application for septic tank at 195 Thacker Street. 1 7-2-56 PRASSAS SIGN. The motion was made by Alderman Wolf and seconded by Tures to approve the Prassas sign. The motion and second was withdrawn and the motion was made by Alderman Martin and seconded by Wolf to repeal the sign ordinance. After discussion, the motion was made by Alderman McKay and seconded by Schubert to table the item until next meeting and the Attorney prepare a new sign ordinance. The Mayor pro tem put the question and the Clerk called the roll: Ayes: Alderman McKay,, Davis, Schubert, Dunlap, Tures, Wexler, Behrel and Prickett. Nays: Alderman Wolf, Martin, Tiwtle, Nelsen and Bell. The Mayor pro tem declared the. motion carried. MOVING HOUSE TO 1252 BROWN STREET. Alderman Wolf reported on house being moved to 1252 Brown Street and the Committee recommends that .Building Conmissioner.:IsiLthat ill the requirements be rigidly adhered to. On motion. by Alderman Wolf and second by Prickett the Council concurred in the report. 379 PARKING METERS LOT NO. 2.' Alderman Nelsen reported the following on purchase of parking meters for ?Parking Lot No. 2: The Committee feels that the City should install 23 meters along the north wide of Prairie Avenue east to Lot 2. We should wait until the lot is surfaced to install meters along the west side of the lot. The meters along Prairie should be quarter meters. The Committee recommends the City Engineer be Lo authorized to draw up plans and specifications by the next meeting for the purpose of 0) advertising for bids on lighting, surfacing and car stops. The No. 1 motion was made 110 by Alderman Nelsen and seconded by Tistle to purchase 23 Park -O -Meter quarter meters. • Alderman Schubert made an amending motion which was seconded by Dunlap to purchase two S hour meters; No. 2 motion . No. 3 motion was made by Alderman Martin and seconded by Wexler to refer back to the Committee. The Chair ruled there will be a v ete on the No. 3 motion. Alderman Wolf appealed for a roll call, that the Chair was out of order ore ruling that a vote must be had on referring back to Committee because it had been referred back to Committee at a previous meeting. The Clerk called the roll: Ayes: Alderman McKay, Davis, Tures, Behrel, Prickett, Tistle, Nelsen and Bell. Nays: Alderman Schubert, Dunlap, Wolf, Wexler and Martin. The Mayor pro tem declared the motion carried and the Mayor sustained. The Clerk was instructed to call the roll on motion to refer back to Committee: Ayes: Alderman Schubert, Dunlap,Wolf, Wexler, Martin,& Behrel. Nays: Alderman McKay, Davis, Tures, Prickett, Tistle, Nelsen and Bell. The Mayor pro tem declared the motion lost. The Clerk then called the roll on motion No. 2: Ayes: IIIAlderman Schubert, Dunlap and Martin. Nays: Alderman McKay, Davis, Tures, Wolf, Wexler, Behrel, Prickett, Tistle, Nelsen and Bell. The motion was lost. The motion was then made by Alderman Martin and seconded by Wolf to advertise for bids on purchase of meters. The Mayor pro tem put the question and the Clerk called the roll: Ayes: Alderman Wolf, Wexler and Martin. Nays: Alderman McKay, Davis, Schubert, Dunlap, Tures, Behrel, Prickett, Tistle, Nelsen and Bell. The motion was lost. Back to the original motion, after about a half hour, the Mayor pro tem ordered the Clerk to call the roll: Ayes: Alderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Behrel, Prickett, Nelsen and Bell. Nays: Alderman Wexler, Martin and Tistle. The Mayor declared the motion carried. ENGINEER TO DRAFT PLANS AND SPECIFICATIONS. On motion by Alderman Nelsen and second by Prickett the City Engineer was instructed to draft plans and specifications for lighting, surfacing and car stops. APPROVAL OF BILLS. Alderman McKay presented the following resolution: E 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES FLUKES, THAT THE FOLLOWING BILIS ARE DUE AND PAYABIE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total $10,282.72. (A schedule of bills placed before each Alderman and on file with City Clerk.) The motion was made by Alderman McKay and seconded by Bell to adopt the resolution. The Mayor pro tem put the question and the Clerk called the roll: Ayes: Alderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Wexler, Martin, Behrel, Tistle, Nelsen and Bell. Nays: None. The Mayor pro tem declared the motion carried. ATTORNEY M. S. HOWARD REPORT. The Clerk read a report from Attorney M. S. Howard on Bauske'- Premier Rose Gardens cane in which he requested $250.00 additional for the Master in Chancery Sheppard. The Council had approved a check for this amount in the resolution on bills. The letter was referred to the Municipal Development Committee. 380 7-2-56 ZONING BOARD REPORT ON ORCHARD PLACE TWO HEARIN(S FROM RIVER ROAD TO EAST SID OF S00 LINE. The Zoning Board made no recommendation, only.stated thatiit is predominantly residential. The City Attorney informed the Council he had a residential zoning ordinance which would be up .for first reading. TRAFFIC COMMISSION REPORTS. The Clerk read the Traffic Commission report on stop sign at First and Graceland. They recommend that at the corner of'Graceland and First Avenue a stop sign be erected on southeast corner. Parking on Cora Street from Algonquin to Oakton, the Traffic Commission recommends that Parking Ordinance be changed to allow parking on odd and even sides owing to the fact it is now used as a race track. The reports were referred to the Street Committee. S00 LINE GATES AT TOUHY AND AT OAKTON. A reply from the Soo Line Railway on gates at the two crossings stated they would noteppose the installation of the gates if the Illinois Commerce Commission deems it essential and provided that the Railroad would not be required to bear more than fifty percent of the cost of such gate installation. On motion by Alderman' Wolf and second by Bell the Clerk was instructed to write to the commerce commission. CHICAGO AND NORTHWESTERN RAILWAY LETTER ON CUMBERLAND STATION. The Clerk read the letter'•fr ' `Chicago and Northwestern Railway and they said they were going to install heat in the brick building on the north side of tracks and did not intend to build a new station. On motion by Alderman Davis and second by McKay the Clerk was instructed to write to Illinois Commerce Commission to investigate regarding a station. ADOPT 6,000 POUND TRUCK LIMIT ORDINANCE WILLOW AVENUE. The Clerk read! for second read- ing the above ordinance. The motion was made by Alderman Dunlap and seconded by Schubert to adopt the ordinance. The Mayor pre tem put the question and the Clerk called the roll: Ayes: Alderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen and Bell. Nays: None. The Mayor pro tem declared the motion carried. ADOPT ZONING ORDINANCE ORCHARD PLACE AREA. The Clerk read for second reading the Zoning Ordinance to Commercial the area between Touby Avenue and Higgins Road, Mann- heim Road and the west side of Soo Line Railway. The motion was made by Alderman Wolf and seconded by Bell to adopt the ordinance. The Mayor pro tem put the tueation and the Clerk called the roll: Ayas:s.aAlderman McKay, Davis, Schubert, Dunlap, Tures, Wolf, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen and Bell. Nayslr None. The Mayor pro tem declared the motion carried. STATE MAINTENANCE OF STREETS TO JUNE 30, 1957. The Clerk informed the Council he had the annual Agreement for Maintenance of Streets from the State Highway Department. On motion by Alderman Wolf and second by Tures the Council authorized the Clerk and Mayor to sign same. PETITION TO ERECT,1460 OAKTON ST 'T. The Clerk informed the Council he had a petition from property owners requesting the Council to allow Lawndale Concrete Com- pany to erect board fence. On motion by Alderman Martin and second by Prickett it was referred to the Building Control Committee. TRI - COUNTRY HOME RULE ASSOCIATION LETTER. The Clerk read a letter from G. D. Wilson, president of the above association, regarding the possibility of a bill being presented next session of the State Legislature to create a metropolitan law enforcement agency in Cook County. The letter was referred to the Police Committee. PARK DISTRICT IETTER-TRAFFIC BUSSE AND MINER STREETS. The Clerk read a letter from Park District regarding traffic hazard for children going to Rand Park at Busse and Miner Street. The letter was referred to Safety Council and Traffic Commission. 1 COMPLAINT ALGONQUIN - IEE SHOPPING DISTRICT. The Clerk reported of complaint of steam pipe from clothing store in above district. It was referred to Building Commissioner to investigate. 1, 7-2-56 381 T. B. GRAY LETTER ON INCINERATOR PROPERTY. The Clerk read a letter from Mr. Gray on several complaints of damage to his property by the burning of rubbish and rubbish being pushed on his property at incinerator. The letter was referred to Superintendent of Public Works. FRANK K. FOSTER LETTER ABOUT DUMPING RUBBISH IN ALLEY BETWEEN LINDEN AND WHITE STREET' NORTH OF RIVERVIEW AVENUE. The Clerk read the above letter and the letter was referred to Superintendent of Public Works. IIIR. STAUBER AND ASSOCIATES LETTER ON PARKING IN THE 700 BLOCK NORTHWEST HIGHWAY. The Clerk read the above letter in which a request is for. establishing 3 hour parking limit on the north side of the Highway. Remove existing concrete lamp posts which are un - repairable and unsightly. Install new street lights on existing utility company poles. The letter was referred to the Street C wunittee. W. F. IEVANDER LETTER FOR MAYFIEID PROPERTY OWNERtS ASSOCIATION. The Clerk read the letter from Mr. Levander regarding who is responsible for repair and maintnenance of water mains in Mayfield Estates Subdivision. The letter was referred to Water Com- mittee and City Attorney. ET. ALLEY VACATION IN l00 BLOCK OF VAN BUREN AND ALGONQUIN. The Clerk informed the Council he had a petition for alley vacation above with 100% signatures. The petition was referred to Street Committee. FIRST READING ZONING ORDINANCE ORCHARD PLACE AREA EAST OF S00 LINE RESIDENTIAL. The Clerk read for first reading the above Zoning Ordinance. The ordinance was placed on file for second reading. IIIAPPLICATION DRIVEWAY PERMIT A. & P. STORE IEE STREET. Superintendent Wernicke informed the Council he had en application for driveway permit. The permit was referred to Street Committee. ADOPT TRUCK LIMIT ORDINANCE FOR STREETS IN CUMBERLAND TERRACE EAST OF WOLF ROAD. The Clerk read for second reading the above ordinance. The motion was made by Alderman McKay and seconded by Dunlap to adopt the ordinance.
