The Clerk suggested that the minimum Building Permit fee be referred to Building Control Committee. Henrich' City Clerk MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL, HELD IN THE COUNCIL ROOM, CITY HALL, DES PLAINES, MARCH 5, 1956. AT 8:00 P„M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer with Alder- man Tistle, Nelsen, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Wexler, Martin and Behrel responding to roll call. Alderman Prickett and Dunlap were absent. APPROVAL OF MINUTES. The motion was made by Alderman Behrel and seconded by Tures to approve the minutes of February 20, 1956. At request of Alderman Wolf the minutes were changed in the item on truck bid from the word "somewhat” to "fourteen dollars." The motion was voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the reports of Clerk and Building Commissioner for February. Engineer Fletcher reported of writing letters to the Chicago and Northwestern Railway, Benjamin Electric, Sanitary District and State Highway Depart- ment regarding the installation of larger flumes at Wolf Road and the Chicago and Northwestern Railway. He received notice the State Highway Department would not help pay the cost, but he was going to contact them again. OPEN BIDS FOR ELM TREE AND MOSQUITO SPRAYING. On motion by Alderman Nelsen and second by Schubert the Clerk was instructed to open the spraying bids. One bid from Clarke Outdoor Spraying Company of Riverside was for both sprayings. The following three bids were received for elm tree only: Button Tree Service, Des Plaines; Nels J. Johnson, Evanston; and R. Synnestvedt, Glenview. On motion)by Alderman Tistle and second by Neff the bids were referred to the Sanitation Committee. NORTHWEST MOSgUITO ABATEMENT COUNCIL. Attorney Eley reported on a letter from the above Council regarding a referendum to create a Mosquito Abatement District, Des Plaines to pay $1,500.00 for a proportionate amount of cost. After considerable discussion the motion was made by Alderman Martin and seconded by Tistle to pay $1,500.00 for referendum. The Mayor put the question and the Clerk ,called the roil.: Ayes: Alderman Tistle, McKay, Neff, Wexler and Martin. Nays: Alderman Nelsen, Bell., Davis, Schubert, Tures, Wolf and Behrel. The Mayor declared the motion lost. A Alderman Schubert reported that due to request for subdivision south of Howard Street, there would be a meeting of the Council March 12 as a Committee of the Whole to discuss installation of sewers. LOMMEN EIEY PLAT. Alderman Schubert reported the following: ' Your Committee on Municipal Development has investigated the above and has found: That the Plan Commission has returned the matter to the City Council without any recommendation; that the matter has been before the Connnissionisince February 3, 1955; that the owner of the property has agreed in writing to meet all the require- ments of the City ordinances in regard to improvements of roadways, sewer, water, and street signs; that the owner is not asking for a subdivision as he does not intend to convey by lot number but is only trying to do what has been done many times in the past, which is to convey part of a lot in an existing subdivision. 1 3-5-56 LIEN EIEY PLAT. (Conttd.) We, Your Committee on Municipal Development, therefore recommend: That the plat be accepted in order to permit the Building Inspector (Commissioner) to determine whether the City requirements as to areas are being met; and that the Building Inspector (Commissioner) be instructed to issue the six building permits which have been requested for the erection of houses on this property when the plans and specifications are in order. POLICE DEPARTMENT TO PURCHASE RADAR EQUIPMENT. Alderman McKay reported the following: Your Police Committee has had a demonstration of equipment to check speed of automobiles, both radar and cable -contact. Several other aldermen have been present at these demonstrations. 0 • It is the recommendation of the Police Committee that the City of Des Plaines �.� purchase one set of the radar equipment, at a cost of $850.00. This does not <t include the graph recorder, which would cost an additional $497.25, and purchase of which we do not recommend at this time. Delivery of the equipment can be had in about 6 weeks. 1 1 In the meantime, Marshal Wigham should arrange for necessary license from the F.C.C. and any other details required to put the equipment in use when received. Alderman *der reported on the insurance policy on Fire Station No. 2 and then made the motion which was seconded by Bell that the premium be paid. The Mayor put the question and the Clerk called the roll: Ayes; Alderman Nelsen, Bell, McKay, Schia ert, Tures, Wolf, Neff, Wexler, Martin and Behrel. Nays: Alderman Tistle and Davis. The Mayor declared the motion carried. FIRE CONTRACTS APPROVED. Alderman Wexler reported that he had the signed Fire District Contracts for the year of 1956 from Hawthorne -Rand District for $1,000.00, Park Ridge Manor District for $1,250.00 and Forest Trailer Park, Inc. for $1,000.00, and recom- mended they be approved. The motion was made by Alderman Wexler and seconded by Behrel to approve the contracts. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Tistle, Nelsen, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Wexler, Martin and Behrel. Nays: None. The Mayor declared the motion carried. DRIVEWAYS SEEGERS AND WOLF ROAD SERVICE STATION. Alderman Bell reported on 35 foot driveways for service station and after discussion, on motion by Alderman Schubert and second by Martin, was referred back. to Street Committee. Alderman Bell reported the following on change of house numbers in Northshire Subdivision: Your Committee on Street and Traffic has investigated the above and found: Sufficient cause for complaint on the part of Mr. Matz concerning the way this matter was handled. We, your Committee on Streetand Traffic, therefore recommend: That the City Clerk be instructed to send a letter to each of the houses who's number was changed, informing the residents that if the change is not satisfactory, the numbers will be changed back to their original status. We further recommend that in the future any . changes in numbering made for reasons of convenience be discussed with the home owner before such change is made. (Signed) R. A. Bell On motion by Alderman Bell and seconded by Martin the Council concurred in the report. 0 3-5-56 Alderman Bell read a letter from Riverview Civic Association regarding widening Everett Street in front of South School. On motion by Alderman Bali and second by Martin the item was referred to Superintendent Wernicke and Engineer to see about use of Motor Fuel Gas Tax for the widening of the street. On suggestion of Alderman Tistle, the Clerk was instructed to write Mr. Smaage regarding teachers to park in school parking lot. BLUME SUBDIVISION PLAT. Alderman Wexler reported the following: P. 1. In re Oscar Blume's Subdivision No. 2 - that there would be no appreciable overloading of any existing sewers if lots 1 through 12 inclusive were improved by the subdivider, but that there would be a definite impairment to the Oakton Street sewer if improvements were made on lots 13 to 50. Your committee, therefore, recommends that permission be granted subdivider to construct homes on lots 1 through 12 only, until such further time as he or his engineer may suggest new plans for sewer connections and pending a solution to the existing storm water and sanitary drainoff. After discussion, on motion by Alderman Wexler and second by Behrel that Mr. Blume present a separate plat for Lots 1 through 12 and the Mayor be, authorized to sign same. Mr. Blume to present another plat on balance of subdivision when sewers are''to be provided. The motion was voted upon by acclamation. Alderman Wexler reported the following on cleaning catch basins: P. 2. yin retthe offer of the City Sanitary Sewer Service to clean 500 catch basins - that there is a definite need for cleaning at least 500 catch basins at this time but that because of the proposed cost, approximate]yi$2,800.00, bids be taken through publication so that there my be competitive bidding if possible. Your committee, therefore, recommends that superintendent of public works be instructed to prepare specifications and a published bid for the cleaning of 500 catch basins. On motion by Alderman Wexler and second by Behrel,the Council instructed the Superintendent to advertise for bids to clean 500 catch basins; bids to be in at March 19th meeting. SEWER SURVEY. Alderman Wexler reported the three members of the Sewer Committee each had a separate report regarding a sewer survey. After each member made his report the motion was made by Alderman Tistle and seconded by Wolf that a sewer survey be made to inform the Council of condition of sewers. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Tistle, Bell, McKay, Wolf, Neff, Wexler, Martin and Behrel. Nays: Alderman Nelsen, Davis, Schubert and Tures. The Mayor declared the motion carried. The motion was then made by Alderman Nelsen and seconded by Schubert that the sewer survey be made by Superintendent of Public Works and City Engineer. The Mayor put the question and the Clerk called the roll: Ayes: AldermanlNelsen, Davis, Schu- r,bort, Tures and Behrel. Nays: Alderman Tistle, Bell, McKay, Wolf, Neff, Wexler and Martin. The Mayor declared the motion lost. The motion was made by Alderman Tistle and seconded by Neff to ,advertise bids for a survey. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Tistle, Bell, McKay, Neff, Wexler and Martin. Nays: Alderman Nelsen,Davis, Schubert, Tures, Wolf and Behrel. The Mayor voted nay and declared 'the motion lost. The motion was made by Alderman Wolf and seconded by Bell to award the survey to company which had made the lowest proposal. The motion was then made by Alder- man Martin and seconded by Behrel to table the survey. The Mayor put the question and the Clerk called the roll: Ayes: Alderman McKay, Davis, Schubert, Tures, Neff, Martin and Behrel. Nays: Alderman Tistle, Nelsen, Bell, Wolf and Wexler. The Mayor declared the motion carried. SEPTIC TANK GRANTED 1177 EVERETT LANE. Alderman Wolf reported the Committee investi- gated regarding septic tank at 1177 Everett Lane and recommended installation of tank be granted. On motion by Alderman Wolf and second by Tures the Council con- curred in the recommendation. 1 CD 1 435 3-5-56 Attorney Eley reported of having received the summons on Kuntze case which is to have the Intensity Use of Lot invalidated. An attorney is to be appointed at next meeting. Attorney Eley reported the following: There has been referred to me for the preparation of an Ordinance the petition of John Latousk, et al. for the annexation of Lots 1 to 6 in Knollwood Estates. In connection therewith I note the following: 1. The petition is not sworn to although'the Statute requires a verified petition 2. The petition is signed:by six men each of whom is reported to be the owner of one of the six lots in question. The Statute requires a petition for•annetation under the applicable Section under the Cities and Villages Act be signed by all of the owners and all of the electors residing on the premises. In at least four of the six deeds'by which applicants received title to their respective lots, their respective wives were joined as grantees and if surviving are presently owners and if living on the property are also electors. Inasmuch as the improper showing of title may cause confusion at the time the City of Des Plaines next attempts to sell general obligation bonds, I recommend that the petition for annexation, in its present form at least, be denied. I therefore have not prepared any Ordinance for annexation as directed. (Signed) Damen D. Eley The Attorney was instructed to contact those concerned. TRAFFIC COMMISSION REPORTS. Traffic Committee reported on traffic condition at Ellinwood.and Graceland Avenue and recommended that no left turns be permitted at tee and Ellinwood Streets on Saturdays or other peak traffic times. This is to be in effect for 60 days during which time the Traffic Commission will make an additional survey. The motion was made by Alderman Martin and seconded by Behrel to concur in the report. The Mayor instructed the Clerk to call the roll: Ayes: Alderman Tistle, Nelsen, Bell, Tures, Neff, Wexler, Martin and Behrel. Nays: Alderman McKay, Davis, Schubert and Wolf. The Mayor declared the motion carried. Traffic Commission investigated and recommend four-way stop signs be erected at Graceland and Thacker. On motion by Alderman Behrel and second by Tures the Council concurred in the recommendation. Traffic Commission investigated traffic condition at Cumberland Station, on State Street and Broadway, and recommend no parking signs be erected in front of the train depot. This report was referred to Street Committee. Traffic Commission investigated traffic condition at White and Everett at South School and recommended no change be made in existing traffic regulation. The motion was made by Alderman Bell and seconded by Nelsen the report be over- ruled. The Mayor instructed the Clerk to call the roll: Ayes: Alderman Nelsen, Bell, McKay, Davis, Neff, Wexler, and Martin. Nays: Alderman Tistle, Schubert, Tures, Wolf, and Behrel. The Mayor declared the motion carried. On motion by Alderman Wexler and second by Neff, on suggestion -of Alderman Tistle, to referrto the Street Committee and Traffic Commission about stop signs White, Illinois and Everett Streets. On motion by Alderman Neff and second by Wexler the complaints regarding the bright lights at shopping center at Lee and Algonquin Road was referred to'Street Committee. The Mayor informed the Council there would be a meeting of the Council as a Committee of the Whale, Tuesday, March 13th, on Sales Tax. 336 3-5-56 APPROVAL OF BILLS. Alderman Behrel presented the following res lution:. 1: BE it RESOLVED Y THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS,ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (A schedule of bills placed before each Alderman, affixed to resolution and on file with City Clerk.) Total $46,191.30. The motion was made by Alderman Bdli eland seconded by Martin to adopt the resolution. The Mayor declared the, motion carried. TRAFFIC COMMISSION REPORTS. Traffic Commission reported they investigated on traffic condition at West Side Park at Wolf and Greenview and no recommendation be made at this time until the Park Board has time to complete its planned parking facilities. On motion by Alderman Wolf and second by Tures the Council concurred in the report. Traffic Commibsion has investigated light on Northwest Highway at Cumberland Station and report that no change be made until State Highway Department has time to make complete survey, as per their letter of December 30, 1955. On motion by Alderman Wolf and second by Behrel the Council concurred in the report. ADO0 ANNEXATION ORDINANCE LOT 1, ORCHARD ESTATES. The Clerk read for second reading the Lot 1 Orchard Estates Annexation ordinance. The motion was made by Alderman Schubert and seconded by Behrel to adopt the ordinance. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Tistle, Nelsen, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Wexler, Martin and Behrel. Nays: None. The Mayor declared the motion carried. ADOPT ORDINANCE FOR SPECIAL ELECTION ON ANNEXATION OF THE LAND FROM TOUHY TO DEVON AND HIGGINS, RIVER ROAD TO MANNHEIM ROAD. The Clerk read for first reading the election ordinance. The motion was made by Alderman Bell and seconded by Davis to hold the election March 24th. The Clerk read a letter from Louis Nebel, )( Manager, that necessary equipment has been ordered, contract let and will notify as soon as installation of connection to City Sewer. Letter was mailed to Alderman Wexler. RESOLUTION FOR INSTALLING SEWER AND WATER MAINS NORTHWEST HIGAY & CAMBRIDGE ROAD. On motion by Alderman Wolf and second by Tures the Council adopted and authorized the Mayor to sign the resolution for sewer and water mains on Northwest Highway, Cumberland Village. �. 1 3-5-56 ZONING APPLICATION SOUTHEAST CORNER WOLF AND SEEGERS ROAD. The Clerk read a petition to rezone from residential.to Commercial the.Southeast corner of Wolf and Seggers Road. On motion by Alderman Wolf and second by Behrel the application was referred to the Zoning Board of Appeals. to call a hearing. LETTER FROM DALE K. AUCK. The Clerk read a letter from Mr. Auck suggesting the installation of a fire detection system in City Garage. The Mayor referred the letter to Public Buildings and Grounds Committee. Town of Leyden letter and resolution regarding Chicago annexation was read by Clerk and referred to Municipal Development Committee. Safety Committee of Bensenville Chamber of Commerce letter was read by Clerk and referred to Safety Council. EDGEBROOK SUBDIVISION PLAT. The Clerk informed the Council he had a new plat of Edgebrook Subdivision approved by Plan Commission. On motion by Alderman Wolf and second by Neff the plat was referred to the Municipal Development Committee. Lo FIRST READING OF MUNICIPAL RETAILERS' TAX ORDINANCE. The Clerk read for first read- © ing the Municipal Retailers' Tax Ordinance.. The Mayor ordered the ordinance placed 10 on file for second reading. On request of Alderman McKay, stop signs or stop lights at Wolf and Golf Roads ett 1 1 was referred to Traffic Commission. BIDS ON DORMITORY FURNISHINGS FIRE STATION NO. 1. On motion by Alderman Wolf and sefond by Bell the Clerk was instructed to advertise for bids on dormitory furnish- ings Fire Station No. 1, to be returned March 19, 1956. APPLICATION FOR ZONING VARIATION. The Clerk informed the Council he had another 50 foot,Intensity Use of Lot Zoning variation at 235 N. Wolf Road. On motion by Alderman Wolf and second by Tures the application was referred to the Zoning Board of Appeals. The Clerk inquired how long the Council desired to keep the reels on Council proceedings. He said there were thirteen reels. Alderman Wolf said that when°they were all used up to start over with the oldest reel. ERWIN KNOCKE RESIGNS FROM PLAN COMMISSION. Mayor Meyer read the following letter: As you know we are leaving Des Plaines very soon, and it is therefore necessary that I submit to you my resignation as Chairman and member of the Plan Commission. This resignation to take effect March 15th, 1956. I feel that it has been my privilege to have been of service, in a small way, to Des Plaines and I'do regret that all has not been accomplished that I had hoped for during my term. The rewards have been in knowing the various Officials of the City and their cooperation has been all that could have been desired. I therefore leave Des Plaines with considerable regrets, but with the knowledge that it will always be the most pleasant memory to have lived in Des Plaines. My moat sincere good wishes to yourself and all the Aldermen with your efforts to make Des Plaines a still better place in which to live.
