01/03/19561 31 a MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL, DES PLA INE S, ILLINOIS, HELD IN COUNCIL ROOM, CITY HALL, JANUARY 3, 1956 AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Prickett, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Martin and Behrel respondong to roll call. Alderman Nalsen, Dunlap and Wexler were absent. Alderman Tistle appeared later in meeting. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Alderman Martin to approve the minutes of December 19, 1955. The motion was voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the report of Building Commissioner Rieck for December. Alderman Schubert reported on several county rezoning hearings. Alderman Wolf made the motion to object to the rezoning on Rand Road, west of Soo Line, for Commercial. The City Plan has this section as residential but the motion was lost for want of a second. Alderman Schubert reported he would attend the January 6,1956, County Zoning hearing to object to rezoning at Rand and Dempster. CD The motion was made by Alderman Prickett and seconded by McKay to grant a permit• ct for driveway Lot 79 on Center Street south of Ellinwood Street. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Bell, McKay, Davis, Neff, Martin and Behrel. Nayes: Alderman Schubert, Tures and Wolf. The Mayor declared the motion carried. APPROVAL OF BILLS. Alderman Behrel presented the following resolution: 1 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES.THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. Total $14,039.29. (A schedule of bills placed before each Alderman, affixed to resolution and on file with City Clerk.) The motion was made by Alderman Behrel and seconded by Prickett to adopt the resolution. The Mayor put the question and the Clerk called the roll. Alderman Neff reported that each Alderman had a copy'of Building Code on their INTENSITY OF USE OF LOT ORDINANCE IN COMMERCIAL AREA NOT ADOPTED. The Clerk read for second reading "An Ordinance Amending Sectionl6 of the Zoning Ordinance." The motion was made by Alderman Neff and seconded by Martin to adopt the ordinance. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Bell, McKay, Neff and Martin. Nays: Alderman Davis, Schubert, Wolf, Behrel and Tures. The.Mayor declared the motion lost. ADOPT 1956 APPROPRIATION ORDINANCE. The Clerk read for second reading the 1956 Appropriation Ordinance. There followed discussions with some changes made on items. The motion was made by Alderman Tistle and seconded by Tures to make an eight per cent increase in salaries of police department. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tistle, Bell, McKay, Schubert, Tures, Neff, and Martin. Nayes Alderman Prickett, Davis, Wolf and Behrel. The Mayor declared the motion carried. The motion was then made by Alderman Davis and seconded by Wolf to increase the Fire Department salaries from five per cent to eight per cent. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Davis, Tures, Wolf and Neff. Nays: Alderman Prickett, Tistle, Bell, McKay, Schubert, Martin and Behrel. The Mayor declared the motion lost. On motion by Alderman Neff and second by Prickett the Council approved to increase the City Clerk's expense acgount to $500.00. -- On motion by Alderman Neff and second by Tistle.:the Council approved to add $2,500.00 for Engineer's equipment and supplies. 318 The motion was made by Alderman Neff and seconded by Martin to increase the Deputy Clerk and Clerk's salaries a total of $ 20.00 per month. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Davis, Tures, Wolf, Neff, Martin and Behrel. Nays: Alderman Bell, McKay, Schubert and Wolf. The Mayor declared the motion carried. The motion was made by Alderman Wolf to eliminate the Assistant Superintendent of Public Works and increase the administration assistance. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Tistle, Davis and Wolf. Nays: Alderman Prickett, Bell, McKay, Schubert, Tures, Neff, Martin and Behrel. The Mayor declared the motion lost. (*and seconded by Martin) The motion was made by Alderman Behrel and seconded by Schubert to include in the appropriation for another assistant deputy. The Mayor put the question and the Clerk called'the roll. Ayes: Alderman Tistle, McKay, Schubert, Wolf, Neff, Martin and Behrel. Nays: Alderman Prickett, Bell, Davis and Tures. The Mayor declared the motion carried. The motion was made by Alderman Schubert and seconded by Prickett to adopt the ordinance. The Mayor put the question and the Clerk called the roll'.. On motion by Alderman Martin and second by Neff the Council approved that the head of each department keep a record of the work done by each employee for report to Council. ADOPT 1956 PAY ROLL ORDINANCE. The Clerk read for second reading the following pro- posed ordinance entitled: AN ORDINANCE DEFINING AND DESCRIBING THE MAX SALARIES AND COMPENSATIONS TO BE PAID TO THE MUNICIPAL OFFICIALS AND EMPLOYEES OF THE CITY OF DES PLAINES, ILLINOIS FOR THE FISCAL YEAR, 1956. The motion was made by Alderman Martin and seconded by Behrel to adopt the ordinance. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Bell, McKay, Schubert, Tures, Neff, Martin and Behrel. Nays: Alderman Davis and Wolf. The Mayor declared the motion carried. J. P. TUTHILL LETTER. The Clerk read 'a letter from J -.J., Tuthill, Highway Engineer, regarding traffic light at Cumberland Station on, Northwest Highway. The Mayor referred the letter to the Traffic Commission and City Engineer. LOMMEN EIEY PLAT ON DES PLAINES AVENUE. The Clerk read the letter from the Plan Commission regarding a plat from Locomen Eley. The Mayor referred the letter and plat to the Municipal Development Committee. ARTHUR J. COLIN GRANTED SEPTIC TANK PERMIT FOR LOT 41 DEXTER ACRES. The Clerk read a letter from Arthur J. Colin requesting a permit for septic tank. On motion by Alderman Martin and second by Tistle the Council granted the permit. SANITARY DISTRICT CONTRACT NO. 1955-247. The Clerkinformed the Council he received a Sewer Permit No. 1955-247 from Sanitary District for sewer on Lege Street from Prospect to Howard. On motion by Alderman Wolf and second by Behrel the Mayor and Clerk were authorized to sign the permit. FIRST READING ELECTRICAL PERMIT r'E i ORDINANCE. The Clerk read for first reading the Electrical Permit Fee Ordinance. The ordinance was placed on file for second reading. FIRST READING ORDINANCE TO RESTRICT HEIGHT OF LUMBER PILES. The Clerk read for first reading an ordinance to restrict the height of lumber piles. The ordinance was placed on file for second reading. FIRST READING ORDINANCE TO REGULATE STREET PARKING. The Clerk read for first reading an ordinance to regulate street parking. The ordinance was placed on file for second reading. FIRST READING ORDINANCE AMENDING DRIVEWAY PERMIT FEE . The Clerk read; for first reading an ordinance amending the driveway permit fee,ordinance. The ordinance was placed on file for second reading. 1 1-3-56 CITY CIERK'S LETTER TO TRANSFER 1954 WATER FUND SURPLUS. The Clerk read the following letter: There is a balance of $57,434.00 in the Water Fund as of December 31, 1954. This money can be transferred to other funds. I recommend the following transfers: Judgment Funding Bond Account $ 1,297182 1936 Funding Bond Account 3,334.82 Fire Protection 52,801.36 The Judgment Funding Bonds have all be redeemed. The last three bonds of 1936 Funding Bonds are payable April t$3,067.50) with no funds. (Signed) Otto W. J. Henrich) The Mayor referred the letter to the Finance Committee. 319 The motion was made by Alderman Prickett and seconded by Neff that the City approve expenditure up to $500.00 for survey and removal of dead wood in elm trees at Center and Thacker Streets. The Mayor put the question and the Clerk called the roll. Ayes: :.1 Alderman Prickett, Tistle, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Martin and CD Behrel. Nays: None. The Mayor declared the motion carried. c APPROVE NORTH AND SOUTH MAINE FIRE DISTRICTS. The motion was made by Alderman Davis and seconded by Martin that the Mayor and Clerk be authorized to sign the fire district d 1 contracts. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Bell, McKay, Davis, Schubert, Tures, Wolf, Neff, Martin and Behrel. Nays: None. The Mayor declared the motion carried. At suggestion of Alderman Neff the Mayor referred the lumber pile height ordinance to the Building Control Committee. TWO ORDINANCES ON CITY ATTORNEY. The Clerk read the two ordinances regarding City Attorney. The ordinances were placed on file for second residing. The Mayor reported receiving a letter regarding a meeting of the Governor's Commission for the study of "The Northeastern Illinois Area Local Governmental Services" to be held January 17, 1956 at 6:15 P.M. in the Ballroom of the North Shore Hotel, Evanston. The Mayor appointed Alderman Tures, Schubert and Wolf as representatives to attend the meeting. COUNCIL APPROVES MAYOR'S APPOINTMENTS. The Mayor requested the Council to confirm the following appointments with terms to end May 7, 1957: Earl Wernicke, Superintendent of Public Works, Raymond Kolze, Fire Marshall, John W. Wigham, Police Marshall, Arthur Rieck, Building Commissioner, Merritt L. Weideman, Building Inspector, E. N. Fletcher, City Engineer, Locomen Eley, City Attorney, Elsie Willer, Secretary Board of Health, On motion by Alderman Davis and second by Schubert the Council approved the appointments. The Mayor informed the Council that he desired to retain Marshall Howard to continue to handle the following cases which are in court: Bauske and Premier Rose Gardens Case, Ramshead Case, Ehardt Case, Herzog-Rieck Case and Trevelier Case, if appealed. Also proceedings on special assessment No. 164 and 166. The motion was made by Alderman Schubert and seconded by Behrel to approve the Mayor's request. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Prickett, Tistle, Bell, Davis, Schubert, Tures, Wolf and Behrel. Nays: Alderman McKay, Neff and Martin. The Mayor declared the motion carried. TREVELIER CASE APPEAL. After discussion about repealing the Trevelier Case, the motion was made by Alderman McKay and seconded by Neff to appeal the case. The Mayor put the ques- tion and the Clerk called the roll: Ayes: Alderman Bell, McKay, Neff and Martin. Nays: IIIAlderman Prickett, Tistle, Davis, Schubert, Tures, Wolf and Behrel.
