10/10/1955296 MINUTFS OF THE ADJOURNED MEETING OF THE CITY COUNCIL, ES PLAINES, ILLINOIS, HELD IN THE COUNCIL .ROOM, CITY HALL, OCTOBER 10. 1955, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor KennethG. Meyer with.Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, avis,' Dunlap and Tures responding to roll call. Alderman Wolf and Schubert were absent. Alderman Wexler had supplied the Council members with the Citizen Sewer Committee report which was read by a Mr. Kerst. A Mr. Nelson made h report on the survey of the return of post cards. During the discussion Mr. Ed Benjamin of Benjamin and Lang told the Council he thought the Sewer Bond Referendum at the same election with the Orchard Place Referendum might cause some complications. Some of the Aldermen with Attorney Howard and Mr. Benjamin will meet with Mr. Cutler of Chapman and Cutler, who approve bond ordinances, for the opinion on such an election. FIRST READING OF SEWER BOND ORD INAZIEE . The Clerk read for first reading the following ordinance entitled: AN ORDINANCE PROVIDING FOR TH SUBMISSION TO THE VOTERS OF THE .CITY OF DES PLAINES, COOK COUNTY, ILLINOIS, THE QUESTION OF ISSUING $ 2,500,000 SEWER BONDS AT A SPECIAL ELECTION TO BE HELD IN AND FOR SAID cry ON THE 19TH DAY OF NOVEMBER, 1955. CITY CODE EXPENSE APPROVED. The motion was made by Alderman Nef a nd seconded by Behrel that the City Council approve to allow Mr. Forkin to spe d up to $150.00 at $1.50 per hour for mimeographing the City Codes. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Dunlap and Tures. Nays: None. The Mayor declared the motion carried. ATTORNEY HOWARDh1:S REPORT ON CITY MANAGER ELECTION. Attorney Howard read the following report: Pursuant to the notice served on the City, I appeared this morning before trudge Otto Kerner, Jr., on the City Manager Referendum hearing. Inasmuch as the City Council voted in effect last week that I take no steps to delay or impede this matter in any way, I explained the circumstances to the Judge and left the entire matter to his discretion. Judge Kerner thereupon accepted the recommendationlIof the attorney for the petitioners that a referendum election shall be held and entered an order finding the petition to be in all respects according to law and agreed that the referendum election should, for the purpose of convenience to the voters and economy to the City, be consolidated with the several other elections planned for November 19, 1955. Accordingly, an order has been entered directing the City of De Plaines to hold an election on this question on November 19, 1955. 1 10-10-55 ATTORNEY' "'HOWARD'S REPORT. . (Cont'd. ) Although the Statute recites that the Judge of the County Court shall hold the election, give notice, etc., it is my opinion that it is incumbent upon the City to follow the spirit of the act and provide by ordinance for the election notices, polling places, names of the judges and clerks, etc. accordingly, I will submit such an ordinance which must be passed in sufficient time so that notice may be published not sooner than on the 20th of October and not later than November 4th. In view of the fact that our first November meeting is on November 7th, this ordinance should be passed today, October 10th, or at any rate not later than nett Monday, Oetober 17th. (Signed) Marshall S. Howard 297 ZONING BOARD RECONNDATION SOUTHEAST CORNER WOLF AND RAND ROAD. The Clerk read the Zoning Board recommendation to rezone the Southeast corner of Wolf and Rand Road from Residential to Commercial. The motion was made by Alderman Tures and seconded by Davis to concur in the recommendation. The motion was made by Alderman Neff and seconded by Dunlap to amend the motion to refer the recommendation to the Municipal Development Committee. The Mayor put the question to amend the motion and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Prickett, Tistle, Nelsen, 0 McKay and Dunlap. Nays: Alderman Behrel, Davis and •Tures. The Mayor declared the 2:0 motion carried. The Mayor put the question on the motion to refer and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay,.Davis, Dunlap and Tures. Nays: None. The r:ayor declared the motion carried. 1 VARIATION - HANNIFIN CORPORATION CARPORT. The Clerk informed the Council he had a copy of report to Building Commissioner from the Zoning Board rejecting petition of Hannifin Corporation variation for carport in Residential zoning. WM. KUNKEL REQUEST FOR VACATION OF REVERE AVENUE. The Clerk read a letter from Wm. Kunkel requesting vacating Revere Avenue. The letter was referred to the Municipal Development Committee. ADOPT ORDINANCE FOR SIXTH WARD ALDERMAN ON DECEMBER 13. 1955. The motion was made by Al- derman Nelsen and seconded by Neff to suspend the rules and adopt the ordinance for Special Election for Sixth Ward Alderman on December 13, 1955. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Dunlap and Tures. Nays: None. The Mayor declared the motion carried. The motion was made by Alderman Nelsen and seconded by Dunlap to adopt the ordinance. The Mayor declared the motion carried. ADOPT 6,000 LOAD LI IT ON ALGONQUIN ROAD. The motion was made by Alderman Prickett and seconded by Martin to suspend the rules and adopt the ordinance. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Dunlap and Tures. Nays: None.
