10/03/19551 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, OCTOBER 3, 1955, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer with Alder- ' man Wexler, Martin, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap,&Tures responding to roll call. Alderman Behrel was absent due to being ill. APPROVAL OF MINUTES. The motion was made by Alderman Martin and seconded by Prickett to approve the minutes of September 19 and the adjourned meeting of September 26, 1955. The motion was voted upon by acclamation. OFFICIAL REPORTS. The Clerk submitted the monthly report of Building Commissioner and nine month report of Chief R. Kolze on Fire Department calls. Alderman Wolf appeared at this time. On motion by Alderman Davis and second by Prickett the Attorney was instructed to draft the four contracts for fire districts for 1956 on annual basis. z-� Alderman Dunlap reported the following are members of the Dutch Elm Disease ® Control Committee: John G. Heiland, Chairman - 1239 Center Street Gilbert Rudiger, 729 Prairie Avenue J. A. Hynes, Jr., 1133 Jeannette Avenue On motion by Alderman Wexler and second by Tures the proposed Parking Lot in Railroad Park was referred to Plan Commission. l 1 ADOPT AMENDING ORDINANCE OF OFFICIAL PLAN ORDINANCE. The Clerk read for second reading the following Ordinance entitled: ORDINANCE TO AMEND THE OFFICIAL PLAN ORDINANCE OF THE CITY OF DES PLAINES AS TO THE PROCEDURE FOR APPROVAL OF A SUBDIVISION PLAT. The motion was made by Alderman Schubert and seconded by Dunlap to adopt the ordinance. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Wexler, Martin, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap, Tures and Wolf. Nays: None. The Mayor declared the motion carried. Alderman Neff appeared at this time. ADOPT ORDINANCE CHANGING EASEMENT FROM 10 FT. TO 5 FT. The Clerk read for second reading the following ordinance entitled: AN ORDINANCE TO AMEND THE OFFICIAL PLAN ORDINANCE OF THE CITY OF DES PLAINES, BEING CHAPTER 70F THE MUNICIPAL CODE OF THE CITY OF DES PLAIDS OF 1928, AS AMENDED, BY CHANGING THE REQUIRE- MENTS FOR EASEMENTS IN SECTION 212.6 OF SAID ORDINANCE. The motion was made by Alderman Schubert and seconded by Martin to a3.opt the ordinance. The Mayor put the question and the Clerk called the roll: Nays: Alderman Neff, Wexler, Martin, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap, Tures and Wolf. Nays: None. The Mayor declared the motion carried. ADOPT WEIGHT LIMIT ORDINANCE ON HARDING AVENUE. The Clerk read for second reading the following ordinance entitled: AN ORDINANCE TO RESTRICT THE WEIGHT OF VEHICTFS OPERATING ON HARDING AVENUE FROM LAUREL TO IEE STREETS On motion by Alderman Dunlap and second by Turdls to put the weight at 6,000 pounds. The motion was then made by Alderman Dunlap and seconded by Schubert to adopt the ordinance. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap,. Tures and Wolf. Nays: None. The Clerk read for second reading the follow- ing ordinance entitled: AN ORDINANCE TO RESTRICT THE PEED OF VEHICLES ON OAK STREET WITH T CITY OF DES PLAINES The option was made by Alderman Dunlap and seconded by Schubert to adopt the ordinance. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Tistle, McKay, Davis, Schubert and Dunlap. Nays: Alderman Prickett, Nelsen, Tures and Wolf. The Mayor declared the motion carried. ADOPT SLING SHOTS, BOWS AND ARROWS ORDINANCE. The Clerk read for second reading the folio ng ordinance entitled: AN ORDINANCE AMENDING ART IC IE VI OF CHAPTER 29 OF THE MUNICIPAL CODE OF THF CITY OF DES PLA INE S OF 19 8 BY ADDING THERETO THE FOLLOWING ROV ISIONS REGULATING THE SALE AND USE OF AIR [ GUNS, SLING SHOTS AND BOWS AND ARROWS On motion by Alderman Nelsen and second by Schubert to amend the minor age to 18 years. The Mayor put the question and the Clerk called the roll: Ayes: Alderman Neff, Wexler, Martin, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap, Tures and Wolf. Nays: None. The Mayor declared the motion carried. INTENSITY USE OF LOT ORDINANCE DEFERRED. The Clerk read for se6ond reading the "Intensity Use of Lot Ordinance:' The motion was made by Alderman Neff and seconded by Tistle that the recommendation of Zoning Board rejecting the a ove ordinance be overruled.. The Mayor put the question and the Clerk called th roll: Ayes: Alderman Neff, Wexler, Martin, Tistle, Nelsen, Schubert and Dunlap. Na s: Alderman Prickett, McKay, Davis, Tures and Wolf. The Mayor declared the motion c rried. On motion by Alderman Wolf and seconded by Tures the Mayor referred the ordinance to the Code Committee and Plan Commission to report back October 17th meeting. APPROVAL OF BILLS. Alderman McKay presented the following reso ution: BE IT RESOLVED BYTE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BIL ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HERTBY AUTHORIZED TO MAID; PAYMENT FOR SAKE. Total $11,368.44. (A schedule of bills placed before each Ald rman;and affixed to resolution and on file with the City Clerk.) The motion was made by Alderman McKay and seconded by Prickett to adopt the resolution. The Mayor declared the motion carried. OPEN BIDS ON CATER WELL FENCE. On motion by Alderman Tures and second by Tistle, the Clerk was instructed to open bids on fence for transformer. The following bids were received: Flynn Fence Co., Hillside, Illinois Illinois Fence Co., Chicago Illinois Fence Co., Chicago Chicago Fence & Equipt.,Chicago Chain Link Fence Corp., Chicago - Fence only $ 878.00 - Fence only 868.00 - Complete with grading 1,278.00 - Complete with grslding 1,395.00 - Qomplete with grading 1,581.00 The Mayor referred the bids to the Water Committee. FOREST TRAILER PARK REQUEST FOR FIRE PROTECTION. The Clerk react a letter from Forest Trailer Park requesting fire protection. The Mayor referred the letter to the Fire Committee. DO ALL COMPANY REQUEST FOR DRIVEWAY. The Clerk informed the Council he had a letter from Do All Company for application of 25 foot driveway on Harding Avenue. The Mayor referred the letter to Street Committee and Superintendent War icke 236 10-3-55 HUGO J. THAI LETTER ABOUT QUIT CLAIM DEED. The Clerk read a letter from Hugo J. Thal requesting information for quit claim deed. The Mayor referred the letter to the Finance Committee. CITY MANAGER PETITION TO COUNTY COURT NOTICE. The Clerk informed the Council he had received notide of petition for City Manager Form of Municipal Government having been filed in County Court of Cook County October 10, 1955. The motion was made by Alderman Davis and seconded by Nelsen that Attorney Howard appear before the County Court to ask for time that petitions for a policy ballot for other forms of govemn- ment may be circulated. After discussion, the Mayor put the Ayes: Alderman Prickett, Tistle, Nelsen, Wexler, Martin, Davis, Dunlap, Tures and question and the Clerk called the roll: McKay and Schubert. Nays: Alderman Neff, Wolf. The Mayor declared the motion lost. SAFETY COUNCIL LETTER. Alderman Neff read a letter from Des Plaines Safety Council about speed limit signs for Oakton and Wolf Roads. On motion by Alderman Neff and second by Martin the Clerk is to refer the letter to State Highway Department. Alderman Neff reported they had contacted the State Highway Department about rerouting Oakton Street from Wolf Road to Mt. Prospect Road and that they would request certain conditions from the City. On motion by Alderman Neff and second by Martin the Clerk is to write Mr. Tuttle and request the conditions they require. FIRST READ LNG STOP SIGN ORDINANCE ALGONQUIN AND CENTER STREET. The Clerk read for first reading an ordinance for stop sign on Algonquin at Center Street. The Mayor ordered the ordinance placed on file for second reading. FIRST READING ORDINANCE ONE-WAY ON OAK STREET. The Clerk read for first reading an ordinance for one-way traffic on Oak Street. The Mayor ordered the ordinance placed on file for second reading. FIRST READING ORDINANCE TO CHANGE AWNINGS FROM EIGHT FEET TO SEVEN FEET. The Clerk read for first reading the ordinance to change frame work of awnings height of eight feet to seven feet. The Mayor ordered the ordinance placed on file for second reading. ORDINANCE CALLING FOR ALDERMAN SPECIAL EIECTION. The Clerk read for first reading an ordinance calling for special election for Alderman of Sixth Ward. The Mayor ordered the ordinance placed on file for second reading. ZONING APPLICATION RAND ROAD AT SOO LINE. The Clerk read a letter from Locomen D. Eley regarding his application for rezoning on Rand Road at Soo Line Railroad, which if rezoning would be made then the petition to annex is to be considered. On motion by Alderman Wolf and second by Schubert the application was referred to the Zoning Board to call a hearing. FIRST READING ORDINANCE ALGON UIN ROAD WEIGHT LIMIT. The Clerk read for first reading the ordinance weight limit of vehicles on Algonquin Road east from the east line of Wolf Road. On motion by Alderman Wolf and second by Dunlap the Council approved the 6,000 pound load limit. The Mayor ordered the ordinance placed on file for second reading. HOWARD HIGHLANDS PLAT. The Clerk.read a letter from Plan Commission approval of Howard Highlands Plat. The Mayor referred the plat to the Municipal Development Committee:. MAYOR'S REQUEST TO EXPIDITE COUNCIL MEETINGS. The Mayor informed the Council in order to expidite Council meetings, that if the Aldermen would present items in advance to the Mayor or Clerk he could refer some items to departments in advance. On motion by Alderman Nelsen and seconded by Neff the Council instructed the Attorney to draft an election ordinance on Orchard Place annexations. ADJOURNMENT. The motion was made by Alderman Prickett and seconded by Tistle to adjourn.to Monday, October 10, 1955, at 8:00 P.M. in order to take up the Sewer Referendum Ordinance.
