CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer, the City
Clerk being absent the Deputy Clerk called the roll with the following result:

Dunlap, Tures and Wolf. Alderman McKay was absent.
APPROVAL OF MINUTES. The motion was made by Alderman Behrel and seconded by Prickett
to approve the minutes of August 1, 1955. The motion was voted upon by acclamation
and the Mayor declared the motion carried.
WELLER CREEK DRAINAGE REPORT. A copy of the Weller Creek Drainage report was placed
on the desk of each alderman for their consideration.
OFFICIAL REPORTS. The Deputy Clerk submitted the report of the
Treasurer for August.
BUILDING PERMIT GRANTED IMMANUAL LUTHERN CHURCH. The motion was made by Alderman
Schubert and seconded by Prickett to grant permission to the Building Commissioner
to issue the building permit to the Immanual Luthern Church. The motion was voted
upon by acclamation and the Mayor declared the motion carried.
AWARD BIDS FOR THREE AUTOS. Alderman McKay appeared at this tine. The motion was
made by Alderman Tures and seconded by Dunlap to purchase the 155 Courier Ford,
Black Sedan Delivery Truck from Holmes Motors for 51,649.00. Tie Mayor put the
question and the Deputy Clerk called the roll with the following results: Ayes:
Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis,
Schubert, Dunlap and Tures. Nays: Alderman Wolf. The Mayor declared the motion

Alderman Tures explained Holmes Motors bid was less expensive, but it seemed only
fair to distribute the bids. The motion was made by Alderman Tures and seconded by
Dunlap to purchase the 1955, #1502, Chevrolet, 2 door sedan from Des Plaines Motor
Sales for $1,545.00. The Mayor put the question and the Deputy Clerk called the
roll with the following result: Ayes: Alderman Behrel, Prickett, Tistle, Davis,
Schubert, Dunlap, Tures, and Wolf. Nays: Alderman Neff, Wexler, Martin, Nelsen
and McKay. The Mayor declared the motion carried.
The motion was made by Alderman Wexler and seconded by Dunlap tp purchase a
1955 Dodge, 6 cylinder, 2 Ton Pick-up Truck from Kuhlman and Nagel, Inc. for
$1,269.70. The Mayor put the question and the Deputy Clerk called the roll with

FIELD DRAIN TILE IN DEXTER ACRES. For the purpose of bringing about discussion and
action Alderman Wolf made the motion which was seconded by Ture to allow the home
at 1833 Dexter Lane to connect temporarily to the Field drain tile, in ri Dexter Acres.
After a lengthy discussion the Mayor put the question and the DeputyClerk called the
roll with the following results: Ayes: Alderman Wolf. Nays: Alderman Neff, Wexler,
Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap and Tures.
The Mayor declared the motion lost. After more discussion a motion was made by

Alderman Wolf and seconded by Prickett to notify Carebuilt Corporation to disconnect
all of their homes from the field drain tile. A motion was made by Alderman Neff
and seconded by ;Martin'. to amend the motion to read,"any and all persons connected
to,disconnect immediately or as soon as feasible". The notion was voted upon by
acclamation and the Mayor declared the motion carried. The amendment was then voted
upon by acclamation and the Mayor declared the amendment carried. The Building
Commissioner was instructed to.inform all persons connected to said field drain tile
to disconnect.
The Mayor read the following letter:
We have received another complaint with respect to the sewer which is located at
Prospect Avenue and Lee Street. We understand that this same sewer receives the
sanitary sewage from the Colonial Trailer Park located outside the corporate limits,
pursuant to an arrangement entered into by the Village and the Trailer Park.
The complaint states that the sewer in question is cracked, permitting offensive odors
to escape and that during storm periods, it backs up at the manholes. The complaint
further states additional homes are being connected to this sewer.

"1 - Three catch basins have been constructed to trap the ditch inlets,
which formerly were open tile running directly into, the manhole.
2 - The open type cover, formerly on said manhole, has been changed to
a solid cover.
3 - The exposed joints in the sewer have been recemented."
"As to the Colonial Trailer Park, I understand that a meeting is to be held
to discuss the possibility of the Trailer Park connecting to a force feed
main as proposed by Butler Brothers to be laid along Oakton Street from
Wolf Road east to Lee Street."
NORTHWEST MOSQUITO ABATEMENT DISTRICT. A motion was made by Alderman Dunlap and seconded
by Wolf to approve a $50.00 expenditures for the Northwest Mosquito Abatement to help
defray cost of petitions for a referendum election. Alderman Dunlap in his report
explained it would initially cost the taxpayer about $.25 per $1,000.00 assessed
valuation. The Mayor then put the question and the Deputy Clerk. called the roll
with the following result: Ayes: Alderman Wexler, Martin, Behrel, Prickett, Tistle,
McKay, Schubert, Dunlap, Tures and Wolf. Nays: Alderman Nelsen, and Davis. Alderman
Neff was absent from the room at this time. The Mayor declared the motion carried.

PRIMIER ROSE GARDEN LAWSUIT. The city attorney read the following letter:
I wish to advise you that the City has been sued again for the fifth time in the
last month or two in a declaratory judgment action to set asid residential zoning.
This suit has been filed by the,Primier Rose Gardens seeking to knock out the
residential zoning of the City as to parts of their property in the City so that
the property may be used for light industrial purposes.
I have already filed an appearance of the City and picked up and examined a copy of
the complaint. I will appear and file an answer within the next week.
I will keep you posted from time to time as to developments in
this lawsuit.

MEYER FUEL & MATERIAL TO ERECT FENCE. The city attorney read the following letter:
I wish to advise you that at long last it appears as though we have settled the suit
against the Meyer Fuel & Material Company, provided, of course, that, the City is
willing to ratify the actions fo the citizens who live in the neighborhood and whose
wishes are being reflected as far as possible in this settlement. The Meyer people
and the,citizens have come to an agreement in principle at least, on all phases of
settlement.
I have presumed up to this time that the City Council is willing to follow the wishes
of the citizens group, which is most deeply affected, and that the City will concur
in the settlement that has taken place. It may be well, however, before the settle-
mentgets down to fine detail involving the expenditure of considerable amount of
time by the citizens group, their attorney, myself and attorney for the Meyer people
that you ratify this settlement and authorize me to proceed with it.
The main part of the settlement involves construction by Meyer, at his expense, of a
decorative high fence, probably of the stockade type, along the entire length of the
fuel and material yard, shutting the bulk of its activities from the residential
neighborhood to the East. Incidentally, this fence is planned to be 7' or 8' in
height, which is in violation of an existing City ordinance, and installation of the
fence will require special approval by the City.
The gist of the rest of the settlement is merely that Meyer will not extend
the hopper facilities in the sense of putting any additional towering structures
in the fuel and material yard, will promise not to return to the use of the car
shaker, which incidentally has long since been abandoned by theM and will restrict
their hours of work, as least as far as use of the hopper is concerned.
Present plans call for sharing of the cost between the City and, Meyer Fuel & Material
as far as court costs and masters fees are concerned.
I will concede that is is still possible for the settlement to bog down over details,
but at this time would like at least to have the City's approval before spending any
further time on the details.

LETTER REGARDING BORG-WARNER ZONING AND ANNEXATION. The Mayor rad the following letter:
At the meeting of the Municipal Development Committee held in tille City Hall of the
City of Des Plaines on August 9, 1955, a request was made thate furnish a statement
regarding the activities of the Research Center which we propos to construct on the
southwest corner of Algonquin and Wolf Roadsif the property is annexed to the City
of Des Plaines and rezoned for use under the Scientific, Research and Development
classification of the City's zoning ordinance.

The primary purposes in constructing a research center are to provide suitable facilities
for (1) basic research, (2) engineering development and improvement of existing products
of Borg Warner., and (3) testing, analyzing and evaluating new products brought to the
attention of Borg-Warner to determine whether there is an interest in the manufacturing
thereof by one or more divisions of Borg-Warner. We have elected to proceed with the
above plan on the tract of land in question and have requested annexation and rezoning
because we believe that your city is the type of community near Chicago which will offer
the necessary environment for the above mentioned research. We also believe that the
type of buildings:we are proposing to construct - a series of narrow one-story wings
emanating from a central unit - will affordthe type of facilities necessary for out
research and development. This type of structure is contrasted to the modern one-story
square or rectangular building designed by modern architects primarily for manufacturing
purposes.
During our presentations in connection with the annexation and rezoning petitions, we
have pointed out that our present plans will include, to a very limited degree, light
assembly operations of devices for -measuring and testing irradiated material. These
devices are primarily used in medical research programs and are for the most part custom
made to the specifications of the particular research center which will use them.
A great deal of research and development will be carried on before devices of this nature
can be made on a production basis, which production will, when accomplished, require
moving this operation to a factory -type building located elsewhere.
The proposed plans for our Research Center provide that approximately 1C% of the square
footage of the buildings will be devoted to research on these devices and the assembly
of them, and we anticipate no increase in this area. The operation is and will
remain, so long as it is in the Research Center, purely one of assembly line basis,
we fully intend to remove the operations from the Research Center and establish
manufacturing operations in a building suitable for manufacturing. This, of course,
is required by the provisions of your present ordinance establishing the Scientific,
Research and Development Classifications.
We have endeavored to comply in good faith with allxtasonable requests proposed by
the City of Des Plaines and our future neighbors in the community. We sincerely hope
that the above information is in accord with your recent request.

Prospect Avenue between Lee Street and Mannheim Road is a heavyltraveled Arterial
Street. There is a church on the north side of the street between Spruce and Ash
Streets and as a result Sunday parking is a problem.
We are now in the process of paving Ash Street and Spruce Street from Prospedt to
Howard. This is a Special Assessment project and about 560 feet of prospect Avenue
frontage is being assessed in addition to frontage on Ash and Sruce.
I believe it would help the Sunday parking problem and be good public relations to
widen that part of Prospect Avenue which is being assessed for the paving of Ash and
Spruce and which is directly south of the church.
If you agree with this recommendation then you should pass the
Resolution for the appropriation of $5,000.00 for this work. T

REROUTING OF ROUTE 62 TO MT. PROSPECT ROAD DENIED. The following letter was sketched
by the Mayor:

I regret that the Aldermen of your city are not in accord with the relocation of
State Bond Issue Route 62 on Wolf Road. If I construe your letter properly, it is

preferred that the route be placed on.Mt. Prospect Road instead of Wolf Road between
Algonquin Road and Oakton Street.
For the purpose of insuring that we were properly informed relative to the correct
corporate limits of Des Plaines, a representative from our district office met with
your city engineer, Mr. E. N. Fletcher. A map showing the latest boundaries of the
city pertaining to the relocation was delineated at the meeting and used in the
preparation of the description of the revised location. I have pointed this out to
show that we obtained the latest information available concerning this matter.
Our decision, however, to locate the route on Wolf Road was predicated on two other
factors; (a) a long established policy of the Division of Highways, and (b) the future
responsibility of the Division of Highways. A recent report received from our District
Engineer revealed that Wolf Road is paved with portland cement concrete 20 feet in
width on a right-of-way 100 feet wide. Mt. Prospect Road is paved with a flexible
base and a 2 inch bituminous surface course 20 feet in width on a 66 foot right-of-way.
Under Illinois Statutes it is manadatory that the Division of Highways take over for
maintenance all rigid -type pavements donstructed by counties that are designed and
built to approved standards.
0 It is discretionary on the part of the Division of Highways to take over for maintenance
)f pavements of lower design, however, its policy is to refrain from this procedure. Under
these circumstances Wolf Road was accepted for and has been under State maintenance
for some time. Mt. Prospect Road carries much lighter traffic, therefore, Cook County
ezt designed and built this highway to lower standards since it was not intended that it
be subjected to primary route demands. It has not been placed under State maintenance
but is the responsibility of Cook County. If State Bond Issue Route 62 were placed
on this road it would lengthen the mileage of State maintenance and we are confident
in a few years the condition of Mt. Prospect Road would warrant its reconstruction.
We do not believe this action can be justified since presently State maintained Wolf
Road built to accommodate primary highway traffic is available a short distance east.
I trust this information will supply you with the material needed to explain this matter
to your City Council. I assure you than we shall cooperate with you and the city in
every was that is consistent with our long established policies and future responsibilities.
In this instance we do not consider, however, that the Division of Highways can depart
from its justifiable practice.

meeting our warrants that we could justify the installation of vehicle actuated signals
by the City as a Motor Fuel Tax Project. If the City is interested I presume the
necessary resolution will be forthcoming.

write the Traffic Commission for action on the proposed traffic signs at First and
Woodlawn Avenues.

west side of street and four 15 mile per hour signs of east side of street, the
petition was referred to the Traffic Commission.
BUTTING OF RAGWEED ALONG WELLER CREEK. Alderman McKay asked for publicity regarding
cutting of ragweed along Weller Creek by neighbors.
ADJOURNMENT. The motion was made by Alderman Behrel and seconded by Tures to adjourn.
The motion was voted upon by acclamation and the Mayor declared the Motion carried.

CALL TO ORDER. The meeting was called:to order by Mayor Kenneth G. Meyer who presided
with Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis,
Schubert, Dunlap and Wolf responding to roll call. Alderman Tures was absent.
APPROVAL OF MINUTES. The motion was made by Alderman Behrel and seconded by Mtin;to
approve the minutes of August 15, 1955. The motion was voted u on by acclamation and
the Mayor declared the motion carried.
OFFICIAL REPORTS.. The Clerk submitted ti' reports of Building Commissioner and Clerk
for August.
Engineer Fletcher reported need of new transformer at Cater Well and on motion
by Alderman Wexler and seconded by Neff it was referred to Water Committee. The
Mayor referred the leveling gauge for new water tank to Water Committee at request of
Engineer Fletcher.
Alderman Neff reported progress on new City Code.
