The Clerk informed the Council he had a Sewer Permit from Sanitary District at request of Engineer Fletcher for sewer extension in Chestnut and Riverview Avenue. On motion by Alderman Behrel and seconded by Dunlap the Mayor and Clerk were authorized to sign same. Alderman Davis presented the check for 5692.23, the balance of the Des Plaines Mozquito Abatement Association,to the City. On motion by Alderman Martin and seconded by Dunlap the Council accepted the check. The motion was made by Alderman Dunlap and seconded by Martin that the Mayor and Clerk be authorized to pay for one more spraying with the above funds. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Neff, Wexler, Martin, Behrel, Tistle, Nelsen, McKay, Davis, Schubert, Dunlap, Tures and Wolf. Also the Clerk's six months report of receipts and disbursements. ,The Clerk read the following two reports of Attorney Howard: I wish to report that at the request of the Council and of Police Magistrate Sengstock I appeared before Judge Richard Austin of the Criminal Court on the appeal of one Robert Ryan who was found guilty by Judge Sengstock of being under the influence of liquor. Police Officers Grupe and Volberding went down with me and appeared as witnesses. Assistant State's Attorney Shapiro tried the appeal on behalf of the State and City, and in spite of the fact that all police officers told a sound, true story, the judge found the defendant not guilty upon the appeal. I might add that the defendent produced a couple of witnesses at the Criminal Court hearing that he did not have when found guilty by Judge Sengstock. (Signed) Marshall S. Howard 268 8-1-55 I wish to report that two of the cases challenging our zoning, namely Ramshead vs City of Des Plaines, involving property at Graceland and the Soo Line Tracks and Bauske vs City of Des Plaines, involving the large greenhouse' acreage, have been set for trial on August 8th and 9th respectively before Master of Chancery Albert Sheppard. Trial of cases before a Master in Chancery is usually done piece meal and stretches out over a considerable •period of time. I will keep you advised of developments. I also wish to advise you that I have filed an appearance on behalf of the City Building Commissioner, who is being sued in the Base of Philip 4. Schloss Jr. and many other plaintiffs vs. Arthur Rieck as Building Commissioner, E. A. Herzog Construction Company, Herzog-Kuntze Realty Company and Herzog Building Corporation. This is a claim for damages arising out of flood conditions of last Fall in w hich it is alleged that the basement floors of the plaintiffs were less than 4 inches thick as prescribed by the plans and specifications and the alleged warranties of Herzog. It is alleged that because the floors were substantially less than the 4 inches each of the plain- tiffs suffered substantial damages ranging from $2,495 up to$3,752, due to cracking and heaving of the basement floors. The aggregate amount of damages fought is in the neighborhood of 375,000. I frankly fail to see any legal liability on the part of the City or the City's building commissioner, but it is never safe to guarantee any re+ults in a law suit. I have prepared a motion to dismiss this case against the building commissioner on the ground that there is no liability against him or the City under any circumstances. (Signed) Marshall S. ALDERMAN MCKAY REPORTED THE FOLLOWING: The Police Committee met July 21st and con- sidered the request of Captain Spyrison of the Police Reserve for approval of an addition to the Reserve's Rules and Regulations covering membership requirements. Marshal Wigham and Capt. On motion by Alderman McKay and seconded by Tistle the report was concurred in. 1 1.0 1 269 8.1-55 ALDERMAN MCKAY REPORTED THE FOLLOWING: During the meeting of the Police Committee on July 21st, the matter of enforce- ment of parking meter regulations on Monday and Friday evenings, 6 to 9 pm, was considered. Marshal'Wigham present. It is the recommendation of the Police Committee that as soon as WARNING tickets can be prepared the Marshal cause same to be affixed to the cars of violators on Monday evenings for two successive weeks, after which period of grace (which we feel should be granted because of the long-standing lack of enforcement on Monday evenings) arrest tickets be issued. The same warning procedure to be followed on Friday evenings, as soon as ordi- nance becomes effective and meter plates are corrected to include the information as to hours parking charges are effective on Fridays under the amended ordinance. It is suggested the WARNING tickets read about as follows: WARNING Parking meter charges are in effect until 9:00 P.M. on Mondays and Fridays. ALDERMAN MCKAY REPORTED THE FOLLOWING: During the Police Committee meeting of July 21 at which Police Marshal Wigham, Capt. of Police Reserve Spyrison and Alderman Tistle were present, the matter of need of traffic regulation at Mannheim and Prospect during Sunday morning church activities was considered. Three churches are involved. It was decided, with approval of Marchal Wigham, that Capt. Spyrison would under - Iake to relieve the situation through use of the Police Reserve. Submitted as information. ALDERMAN MCKAY REPORTED THE FOLLOWING: One of the items considered during Police Committee meeting of July 21st was Radar Traffic Control. Alderman Martin and Marshal Wigham present in addition to Committee Representatives. It was agreed by the Committee and Messrs. Martin and Wigham that it would undoubtedly improve our traffic control problems by being an effective deterrent to speeders, if we could acquire the radar equipment for Des Plaines. It was further agreed that the Marshal will assemble information on the equip- ment available, including cost data, and have it ready for consideration by the time the Council undertakes the consideration of appropriations for 1956. ALDERMAN MCKAY REPORTED THE FOLLOWING: In the Police Committee meeting of July 21st the matter of regulating the sale, use, etc. of bows and arrows in the City of Des Plaines was one of the subjects con- sidered. McKay being A -prevision of our sling -shot and air -gun ordinance to include bows and arrows, was submitted to the Committee and Ald. The motion was made by Alderman Wolf and seconded by Tistle that the Carebuilt Corporation be ordered to disconnect their sewer from their buildings from drain tile in Dexter Acres. After discussion Alderman Wexler requested it be referred to Sewer Committee Thursday and asked the press to publicize same. Alderman Wolf requested the public be allowed to speak and a roll call was requested. The Clerk read With respect to the Ordinance entitled: the following letter: An ordinance to regulate, limit and restrict the place of building gasoline and oil service stations and of gasoline storage tanks and otherequipment for the handling of gasoline within the City of Des Plaines. which received a majority vote of the City Council at the meetirg of July 18, I wish to advise that I wish to exercise my right Of veto with respect to this ordinance. My reasons for vetoing are as follows: 271 8-1-55 MAYOR VETOES GASOLINE SERVICE STAT ION ORDINANCE. (C ont' d . ) 1) I fully agree that there is an over abundance of filling stations in the City of Des Plaines, however, I do not believe that we have the power by a so-called frontage consent ordinance to prohibit there erection in a properly zoned area. 2) I do concur in Section 1 of the ordinance, which is inserted from a fire safety point of view; however, in every growing city, and especially Des Plaines, there is bound to be some residential area contiguous to or in close proximity to commercially IIIzoned lands, and I do not think it is constitutional to permit residentially zoned property owners to say "yes" or "no" to the use to which commercially zoned prpperty may be put. 3) The ordinance in question makes it possible for owners of property within 300 feet of the proposed gasoline filling stations to withhold consent for selfish reasons, which have no bearing on the public health or safety question. I am strongly swayed in my decision to veto the said ordinance by what was said by the United States Supreme Court in the case of Yick Wo vs. Hopkins, 118US356, wherein a frontage consent ordinance was involved. In that case the Court said: CD "The very idea that one man may be compelled to hold his life or the means of living or any material right essential to the enjoyment of life, at the mere will of another seems to be intolerable in any country where freedom prevails, as being the essence of slavery itself." I fully appreciate the fact that supporters of the ordinance in question are endeavoring to do something to reduce the number of gasoline filling stations, however, I cannot with a clear conscience, sign the ordinance and thereby be a party to depriving someone of his constitutional rights. Accordingly, the said Ordinance is vetoed and is before you again for further consideration, and it will not become effective unless it receives a favorable vote of at least nine aldermen. The Clerk informed the Council he had the annual agreement of Maintenance from State Highway Department. On motion by Alderman Wolf and seconded by Tistle the Council authorized the Mayor and Clerk to execute same. LETTER FROM ROSENBERG & ORANSKY ON BUILDING PERMITS IN WESTFIELD GARDENS. The Clerk read the above letter regarding four building permits in Westfield Gardens which are being held up. The letter was referred to Building Control and Inspection Committee. ZONING VARIATION APPLICATION 1520 WICKE. The Clerk submitted a zoning variation from single family to two dwelling at 1520 Wicke, Eric A. Nemetz.
