06/20/19551 MINUTES OF THE RFGULAR MEETING OF THS' CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN COUNCIL ROOM, CITY HALL, JUNE 20, 1955. AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Dunlap and seconded by Tures to approve the minutes of June 6, 1955. Alderman Dunlap requested an addition to item on all night parking to include the parking on Brown and Perry Streets from Graceland to Laurel Avenues be referred to Street Committee. Alderman McKay requested that the mosquito abatement be included with elm tree disease to Sanitation Committee. The motion was then voted upon by acclamation and the Mayor declared the motion carried with corrections made. OFFICIAL REPORTS. The Clerk read a letter from Police Magistrate Sengstock regarding a Court case appealed to Circuit Court and advising that the City Attorney appear to prosecute or assist.. The Mayor referred the letter to the City Attorney. Lr.) Alderman Nelsen made a report on repair to warehouse, and is to get specifications on same. Alderman Nelsen reported on disease in elm trees at City Hall and on suggestion of Alderman Tures the dead branches be removed. Alderman Nelsen also reported of need of another pump on heating system in City Hall. Alderman Martin reported on application for building permit at 1081 Prospect Lane regarding septic tank. On motion by Alderman Martin and seconded by Dunlap the Council approved the application. 1 1 Alderman Prickett reported regarding street lights in Herzogos Northshire Sub- division, that the Street Committee recommended that standard lights be provided in accordance with the disign as recommended by the Public Service Engineering Department and approved by Superintendent of Public Works Wernicke. The motion was made by Alder- man Prickett and seconded by McKay to concur in the report. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: Alderman Tures and Wolf. The Mayor declared the motion carried. Alderman Prickett reported on all night parking and after discussion, on motion by Alderman Prickett and seconded by Martin, was referred to the Council as a Committee of the Whole. Alderman Prickett also requested the vacating of park on Cambridge be referred to the Council as a Committee of the Whole. RODDING MACHINE. Alderman Wolf reported need of sewer rodding machine and then had checked on the equipment. The motion was made by Alderman Wolf and seconded by Wexler to purchase the equipment from the O'Brien Manufacturing Company at a cost of $1,345.75. The Mayor informed the Council the contract must be placed on file seven days. The motion was then made by Alderman Wolf and seconded by Tures to place the contract on file seven days in City Clerks office. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. The Mayor then put the question on the previous motion and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert, and Dunlap. Nays: None. The Mayor declared the motion carried. Alderman Dunlap reported he is getting information on elm tree disease and that he was going to have a meeting on mosquito abatement. A discussion on the mosquito abate- ment followed and the motion was then made by Alderman Wexler and seconded by Neff the City Council engage the Clark Outdoor Spraying Company to the extent of the appropriation of $3,500.00. The Mayor put the question and the Clerk called the roll with the follow- ing result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. Alderman Wexler reported on petition of change of parking time of parking meters on Miner Street. The motion was made by Alderman Wexler and seconded by Neff to concur in the report. There being several items in the report, on request of Alderman Schubert, copies of report will be made for each alderman. The motion and second was withdrawn and report deferred. 254 0 6-20-55 APPROVAL OF BILLS. Alderman Behrel presented the following resolution: BE rr RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, THAT THE FOLLOWING BILIS ARE' DUE AND PAYABLE AND THAT THF IvAYOR AND CITY CLERK BE AND HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. (A schedule of bills placed before each Alderman and affixed to resolution and on file with City Clerk.) Total - $102,459.43. The motion was made by Alderman Behrel and seconded by Prickett to adopt the resolution. The Mayor put thle question and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap. Nays; None. The Mayor declared the motion carried. Alderman Neff reported that the Special Committee on Code revision is receiving services from a group of Des Plaines attorneys and asked Mr. Janes M. Forkins to make a report of what has been done to date. He made a v erbal report. OPEN BIDS ON FIRO STATION. On motion by Alderman Davis and seconded by Behrel the Clerk was instructed to open the bids on fire station. After the Clerk read the bids, on motion by Alderman Prickett and seconded by Wolf the bids wefe referred to the architect, Mr. Chamales, for study. - ADOPT THE FIRST FIVE CHAPTERS OF CITY CODE. The Clerk read for secondcreading the ordinance toalopt the first five chapters of they City Code. The.notion was made by Alderman McKay and seconded by Martin to amend Rule 27 of Section 2.9,Procedure, to read "a majority vote of Aldermen present." The Mayor put the iluestion and the Clerk called the roll with'the following result: Ayes: Alderman Neff, Wexler, Martin, / Prickett, Nelsen, McKay and Dunlap. The Mayor declared tho motion carried. ADOPT RESOLUTION AUTHORIZING THE LEASING OF PARK ON NORTH GOLF CUL DEQ SAC. The Clerk read the resolution to lease the above for 20 years. The Clerk read the resolution to the Des Plaines Park District. The motion was made by Alderman Schubert and seconded by Davis to adopt the resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Nef,WUxler, Martin, Behrel, Prickett, Tistle, NelseniMcKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. ADOPT RESOLUTION AUTHORIZING LEASING MEMORIAL PARK TO PARK DISTRICT. The Clerk read the resolution to lease for 20 years with cancellation clause Memorial Park to Park District. The motion was made by Alderman Wolf and seconded by Tures to adopt the resolution. The Mayor put the question and the Clerk called the roll with the follow- ing result: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor declared the motion carried. ADOPT RESOLUTION LEASING PARK ON HOFFMAN PARKWAY TO PARK DISTRIC4T. The Clerk read the resolution to lease park,on Hoffman Parkway with cancellation clause to Park -District. The motion was made by Alderman Schubert and seconded by Davis to adopt the resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Martin, Behrel, Prickett, Tistle, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None the Mayor declared the motion carried. 1 3a 6-20®55 PLAN COMMISSION REPORT ON SIDEWALKS IN EDGEBROOK SUBDIVISION. The Clerk read thezeport of Plan Commission that they approved that there would be no sidewalks in Exgebrook Subdivision. After discussion the motion was made by Alderman Wolf and seconded by Neff to refer back to Municipal Deve lopment•Committee. The Mayor put the question and the Olerk called the roll with the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Behrel, Tistle, Davis, Nays: Alderman Martin, Prickett, Nelsen, McKay, Schubert, and Dunlap. The Mayor declared the motion carried. Alderman McKay inquired about report from Consoer, Townsend & Associates. on Weller Creek. On motion by Alderman McKay and seconded by Davis the Clerk was instructed to write that if the Council did not receive the report by June 27, 1955, the Council would cancel the contract. FIRST READING ORDINANCE CONCURRING VOTE FIVE MEMBERS OF BOARD OF APPEALS. The Clerk read for first reading the amending ordinance to change from four to five members concurring vote Board of Appeals. The Mayor ordered the ordered the ordinance placed on file for second reading. pfd ADOPT FIREWORKS ORDINANCE. The Clerk read for first reading the fireworks ordinance. CD The motion was made by Alderman Dunlap and seconded by Wolf to suspend the rules and adopt the ordinance. Nays: Alderman McKay and Schubert. The Mayor de- clared the motion carried. 1 1 LICENSE NO. 13577 WISCONSIN CENTRAL RAILROAD COMPANY. The Clerk informed the Council he had a license, which the Wisconsin Central Railroad Company wanted executed, for water main under tracks at Thacker Street. On motion by Alderman Wolf and seconded by Behrel the Mayor and Clerk were authorized to execute same. HIGHWAY PERMIT, DIVISION OF HIGHWAYS. The Clerk informed the Council he had a Highway Permit for Water Main at Wolf and Oakton. On motion by Alderman Wolf and seconded by Tures the Mayor and Clerk were authorized to execute same. Alderman Tistle reported about low awnings. The Mayor instructed Chief Wigham to have an officer to take a rule and measure height of awning and inform owners of violation. Alderman Neff read a service station ordinance and asked to have same referred to License Committee. The motion was made by Alderman Davis and seconded by Martin to advertise for bids on addition to old fire station to be returned July 18, 1955. After discusssion, Alder- man Martin withdrew his second. The discussion was to have only one bid on the entire construction. The motion was then seconded by Alderman Schubert. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Alderman Tures, Behrel, Tistle, McKay, Davis and Schubert. Nays: Alderman Wolf, Neff, Wexler, Martin, Prickett, Nelsen and Dunlap. The Mayor declared the motion lost. The Fire Committee is to check about the one bid. Alderman Prickett reported about the purchase of a tractor and tar kettle for Street Department. The motion was made by Alderman Prickett and seconded by Tures to advertise bids to purchase a tractor and tar kettle, bids to be in July 18, 1955, at 8:00 P.M. The motion was voted upon by acclamation after a motion by Alderman Schubert and seconded by Dunlap to include in the motion suitable specifications be made by the Street Committee had been approved. Barrett as City Treasurer. On motion by Alderman Wolf and seconded by Davis the resignation was accepted. At request of Alderman Martin, the Mayor referred the item regarding having stop signs placed on First Avenue at Woodlawn to the Traffic Commissson. ADJOURNMENT. The meeting was called to order by Otto W. J. Henrich, City Clerk, due to absence of the Mayor, with Alderman Neff, Wexler, Martin, Behrel, Tistle,'Nelsen, McKay, Davis, Schubert, Dunlap and Tures responding to roll call. Alderman Prickett and Wolf were absent. The motion was made by Alderman McKay and seconded by Schubert to appoint Alderman Tures Chairman pro tem. The motion was voted upon by acclamation and the motion carried. APPROVAL OF MINUTES. The motion was made by Alderman Behrel and seconded by Tistle toa� pprove the minutes of June 20, 1955. The Clerk read the following reports (two) of Attotney Howard: Gentlemen: I wish to report that motions were made, by the attorney for the Plaintiff in the three zoning suits involving, respectively, the Eckhardt property on Des Plaines Avenue, the Ram's Head property on Graceland, and the Bauske acreage on the south side, to have all of said cases set for trial. The Bautke and Ram'.s Head cases were referred to Albert Sheppard and I presume hearings on these case sometime Auring the summer. Master in Chancery, will commence
