MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL, DES PLAINES, ILLINOIS,
HELD IN THE COUNCIL ROOM, CITY HALL,
JUNE 6, 1955, AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided
with Alderman Tures, Wolf, Neff, Wexler, Behrel, Martin, Tistle, Prickett, Nelsen,
McKay, Davis, Schubert and Dunlap.
APPROVAL OF MINUTES. The motion was made by Alderman Wolf and seconded by Behrel to
approve the minutes. Alderman Wolf requested a correction as f011ows, regarding
building permit granted at 1115 Walter Avenue: Alderman Wolf voted no because it
sets a precedent for others to follow and gives special disposition to City Employee.
Alderman Neff requested a correction to her item on liquor stores as follows: a
proposed amendment to the Zoning ordinance prohibiting taverns or liquor stores in
all districts except after approval of such use by the Zoning Board of Appeals
pursuant to public hearing. The motion was then voted upon by acclamation and the
Mayor declared the motion carried with corrections made.
OFFICIAL REPORTS. The Clerk submitted the reports of City Clerk and Building
Commissioner for May. Also report of Attorney Howard that he had received a check
from Sterling Oil Company for three year licenses, result of a lawsuit.

Alderman Behrel reported of two County Rezoning hearings on land at Higgins-
River Road, and Mannheim- Grand"Avenue. He recommended no protest.be made by City.

Alderman Schubert reported on Crescent Lane Plat that the Committee took up
some questions with Plan Commission and are waiting for a reply.
Alderman Schubert reported the owner of Edgebrook Subdivision did not want to
have sidewalks and as the plat has not had final approval by Council, he made the
motion which was seconded by Dunlap to refer the plat back to the Plan Commission.
The motion was voted upon by acclamation and the Mayor declared the motion carried.
Alderman Schubert reported the annexation request at Lee and Howard Streets
was to be held in abeyance for some future time.
PARK LEASFS. On motion by Alderman Schubert and seconded by Davis the Attorney was
instructed to prepare leases,for a term of twenty years with provision for City to
cancel if the City desired to use land for street or other purposes, with Des Plaines
.Park District for parks at Hoffman Parkway, West end Rose Avenue, East end of North
and South Golf Cul de Sac and Memorial Park.
Alderman Martin reported of having a letter from owner at 1120 Jeannette Avenue
requesting a variation to build three feet from lot line in order to have room for
garage. On Mayor's suggestion the Alderman will inform the party to make application
for variation.
Alderman Martin reported owner at 1633 Lee Street desired to build a seven feet
high fence next to Jewel Tea Store. The Alderman, at Mayor's suggestion, will inform
owner to receive permission from Jewel Tea Company to build same.
Alderman Martin reported about permit for Service Station at 1350 Miner Street
and request for driveway. The Mayor referred same to Street Committee.
Alderman Martin informed the Council of the number of service stations and
inquired of Attorney if an ordinance could limit the stations. The Mayor referred
the item to the Attorney.
Alderman Neff reported the following on license for private detective:
1. The city is authorized to license private detectives (Cities and Villages
Act, Ch. 24, §23-91.) Any such licensing ordinance would be for the purpose either
of producing revenue, or of regulating an occupation which is subject to abuses.
2. It is not necessary for the City of Des Plaines to regulate this occupation,
since the State of Illinois required the Department of Registration and Education to
hold written examinations for applicants for this type of work, enforce reasonable
rules and regulations, require a bond and issue licenses. (Criminal Code, Ch. 38,
1 608 el.) The statute sets.up rigorous qualifications for a state license or

certificate. Further, Asset. Supt. Holly of the Department of Registration and
Education stated to the committee chairman last week that his department has its own
staff of investigators and neither requests nor desires local police departments to
assist in enforcing the state licensing requirements.
3. The committee further considers that licensing investigators, private
detectives or night watchmen is unnecessary as a revenue measure. It has not been
shown that enough licenses would be purchased to produce any substantial amount of
revenue over and above the cost of administering the ordinance. Further, a city
license in the suggested amount of $$50 would seem a hardship on persons in this
category, who are already compelled to pay $45 per year to the state for license.;and
annual bond premium. A total licensing cost of $95 per year for a night watchman,
investigator or private detective would seem oppresive since these categories are not
normally considered a high income -group.
We, your Committee on License and Inspection, therefore recommend that the
.Council take no action to license investigators, private detectives or night watchmen.

On motion by Alderman Neff and seconded by Prickett the Council .,oncurred in the
report.
Alderman Prickett reported that the Street Committee recommended that a left
hand signal be incorporated in the new existing signals to permi a left turn.(signal)
into Pearson at Miner Street. On motion by Alderman Prickett an seconded by Schubert
the Council concurred in the report and instructed the City Engi eer to put same in
operation. On suggestion of Alderman Dunlap left turns at Pearson to Miner and Lee
to Miner was referred to the Street Committee.
CHANGE ASHLAND TO EDGEBROOK LANE. Alderman Prickett reported the Street. Committee
recommended that it is still the recommendation of the Committee that the Plan
Commission's report be concurred in and that in Edgebrook Subdivision Ashland Avenue
be changed to Edgebrook Lane. The motion was made by Alderman Prickett and seconded
by McKay to concur in the report. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Alderman Tures, Neff, Wexler, Behrel,
Martin, Prickett, Nelsen, McKay,and Davis. Nays: Alderman Wolf, Tistle, Schubert
and Dunlap. The Mayor declared the motion carried.
Alderman Prickett reported the forms were removed from sidewalk on Illinois
Street but that the sidewalk could serve no one at that place.
Alderman Prickett reported the Street Committee had recomnended the Superin-
tendent of Public Works to remove the dead limbs from trees at 79 Graceland Avenue
immediately.
Alderman Davis reported about fees of Fire Districts and 4n motion by Alderman
Davis and seconded by Wolf, the Clerk was instructed to write the four districts that
they levy a tax the limit of their assessed valuation and remit 90% of tax to the
City each year of the new contract.
Alderman Tures reported the Water Committee investigated and found due to the
rapid growth of Des Plaines and also to the possible development of undeveloped land
lying within the City limit, the committee find it impossible t¢ comply with the
request for water in Linstrom's Subdivision. Water supply is already taxed to its
limits. We do not wish to sell water to outside the City users even if the improve-
ments now nearing competion should prove to give more than an adequate supply. On
motion by Alderman Tures and seconded by Behrel the Council concurred in the
report.
Alderman Wexler reported there would be a public hearing Wednesday, June 8,
1955, at 8:00 P.M., regarding the parking meter hours be change • to 9:00 P.M. week-
days and Sundays at request of Miner Street businessmen.

ORDINANCE. The Clerk read for first
reading the Building Permit Fee Ordinance.
The motion was made by Alderman Wolf and seconded by Prickett to
adopt the ordinance. The Mayor put the question and the Clerk
called the rp31_with following result: Ayes: Alderman Tures,
Wolf, Neff, Wexler,Martin, Behrel, Tistle, Prickett,Nelson, McKay,
Schybert and Dunlap. Nays: None. The Mayor declared the motion
carried.

Alderman Behrel requested the bill of $2,641.00 of the Housing and Home
Finance Agency be referred back to the Finance Committee.
APPROVAL OF BILLS. Alderman Behrel presented the following resolution:
BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF DES PLAINES, THAT THE
FOLLOWING BILLS ARE DUE AND PAYABLE
AND THAT THE MAYOR AND CITY CLERK
BE AND HEREBY AUTHORIZED TO MAKE
PAYMENT FOR SAME.
Total $17,938.39. (A schedule of bills placed before each Alderman and affixed to
resolution and on file with City Clerk.) The motion was made by Alderman Behrel and
seconded by Prickett to adopt the resolution. Alderman Wolf requested an explanation
of $321.63 bill for street sweeper. After the bill had been checked the Mayor put
the question and the Clerk called the roll with the following result: Ayes: Alderman
Tures, Wolf, Neff, Wexler, Behrel, Martin, Tistle, Prickett, Nelsen:, McKay, Davis,
Schubert and Dunlap. Nays: None. The Mayor thereupon declared the motion carried.
ADOPT BUILDING PERMIT FEE ORDINANCE. The Clerk read for first reading the Building
Permit Fee Ordinance. The motion was made by Alderman Prickett and seconded by
Martin to suspend the rules and to adopt the ordinance. The Mayor put the question
and the Clerk called the roll with the following result: Ayes: Alderman Tures, Wolf,
Neff, Wexler, Martin, Behrel, Tistle, Prickett, Nelsen, McKay, Schubert and Dunlap.
Nays: None. The Mayor declared the motion carried. *
ADOPT RESOLUTION REROUTING ALGONQUIN ROAD TO OAKTON STREET. The Clerk read the
resolution providing for re-routing of Algonquin Road to Oakton Street. There was a
discussion by the public and Aldermen after which the Mayor put the question and
the Clerk called the roll with the following result: Ayes: Alderman Tures, Neff,
Wexler, Behrel, Martin, Prickett, Nelsen, McKay, Schubert and Dunlap. Nays: Alderman
Wolf, Tistle and Davis. The Mayor declared the motion carried.
ADOPT DAYLIGHT SAVINGS TIME ORDINANCE. The Clerk read for first reading the Daylight
Savings Time Ordinance. The motion was made by Alderman Wolf and seconded by Davis
to suspend the rules. The Mayor put the question and the Clerk called the roll with
the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Behrel, Martin,
Tistle, Prickett, Nelsen and Davis. Nays: Alderman McKay, Schubert and Dunlap.
The motion was made by Alderman Wolf and seconded by Davis to adopt the ordinance.
The motion was made by Alderman McKay and seconded by Dunlap to amend the ordinance
to read to 2:00 A.M. October 30. The Mayor put the question and the Clerk called the
roll with the following result: Ayes: Alderman Tures, Wolf, Neff, 1;rexler, Behrel,
Martin, Tistle, Prickett, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None.
The Mayor put the question on the previous motion and the Clerk called the roll with
the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Behrel, Martin,
Tistle, Prickett, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None. The Mayor
declared the motion carried.
APPLICATION FOR REZONING SCIENTIFIC RESEARCH AND DEVELOPMENT DISTRICT. The Clerk
read an application from Henry Karnatz, Jr. to rezone the southwest corner of Algon-
quin and Wolf Roads for Borg-Warner Scientific Research and Development District.
On motion by Alderman Schubert and seconded by Tures the Council referred the appli-
cation to the Zoning Board of Appeals sitting as a Commission to have a hearing. The
motion was voted upon by acclamation and the Mayor declared the motion carried.
APPLICATION FOR ZONING VARIATION MEDICAL AND DFNTAL OFFICE. The Clerk read a zoning
variation for a medical and dental office at 1195 Jeannette and Algonquin Road. The
motion was made by Alderman Behrel and seconded by Davis to refer the variation to
the Zoning Board of Appeals sitting as a Commission to call a hearing. The motion
was voted upon by acclamation and the Mayor declared the motion carried.
HEINRICH PETITION TO ANNEX TIT' SOUTHEAST CORNER OF OAKTON AND WOLF. The Clerk read a
petition from Elmer and Loretta Heinrich to annex the Southeast corner Oakton and
Wolf Road. The Mayor referred the petition to the Municipal Development Committee.

PETITION FROM MERCHANTS RESUESTING TO AMEND FIREWORKS ORDINANCE. The Clerk read a
petition Des Plaines merchants requesting the Council to amend fireworks ordinance
to allow sale of caps and cap guns. The motion was made by Alderman Wolf and
seconded by Prickett that the Attorney draft an amending ordinance allowing the sale
of caps and cap guns. The Mayor put the question and the Clerk called the roll with
the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Behrel, Martin,
Tistle, Prickett, Nelsen, Davis and Dunlap. Nays: Alderman McKay and Schubert. The
Mayor declared _the motion carried. Alderman Martin requested the Air Rifle and Sling
Shot Ordinance be referred to the Police Committee to study,regarding the shooting
of arrows.
WALTER H. PRELL LETTER REGARDING MIDGET AUTO TRACK. The Clerk read a letter from
W. H. Prell and from J. F. Engle requesting permission for a children's midget auto
track. The Mayor referred the item to Alderman Martin's Special Committee.
P. J. FINLAND LETTER ON HERZOG PROPERTY WOLF AND. SEEGERS,: ROADS. The Clerk read a
letter which was written to Alderman McKay by P. J. Finland, 495 Seegers Road,
regarding Mr. Herzog filling in the land higher than the Finland property, which may
cause the flooding of the basements in Finland area. The Superintendent of Public
Works was instructed to investigate.
LETTER ON ALL NIGHT PARKING. The Clerk informed the Council he received a letter
signed "disappointed new residents." The letter was about all night parking and in
front of driveways. Also stating at Mt. Prospect, Arlington Heights,and Palatine
all night parkers are fined. The Mayor referred the parking to the Street Committee.
The Attorney said he would work with the Committee.
The Mayor referred to the Traffic Commission the investigation about traffic
lights on Oakton Street.
RESOLUTION FOR MAINTENANCE OF STREETS WITH MOTOR FUEL TAX FUNDS. The Clerk read the
resolution for maintenance of streets with Motor Fuel Tax Funds for January 1, 1955
to December 31, 1955. The motion was made by Alderman Wolf and seconded by Davis
to adopt the resolution. The Mayor put the question and the Clerk called the roll
with the following result: Ayes: Alderman Tures, Wolf, Neff, W4xler, Behrel,
Martin, Tistle, Prickett, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None.
The Mayor declared the motion carried.
ADOPT RESOLUTION MAINTENANCE OF ARTERIAL STREETS. The Clerk read a resolution for the
maintenance of arterial streets with Motor Fuel Tax Funds for January 1, 1955 to
December 31, 1955. The motion was made by Alderman Wolf and se onded by Davis to
adopt the resolution. The Mayor put the question and the Clerk called the roll with
the following result: Ayes: Alderman Tures, Wolf, Neff, Wexler, Behrel, Martin,
Tistle, Prickett, Nelsen, McKay, Davis, Schubert and Dunlap. Nays: None. Tje
Mayor declared the motion carried. '
PETITION FOR REFERENDUM ELECTION MOSQUITO ABATEMENT AND SPRAYING FOR ELM DISEASE.
alderman Davis read a petition for the above referendum. On motion by Alderman Davis
and seconded by Martin the Council voted to hold the referendum!at the next special
election. -On motion by Alderman McKay and seconded by Schubert the item on Elm
Disease was referred to the Sanitation Committee.
Alderman Neff read the following: Resolved, that the two members of the City
Council who are lawyers in general practice, Aldermen Neff and Wexler, be and they
hereby are authorized and directed to assemble and index all the city ordinances,
prepare,them for publication as the City Code, Revised; and suggest necessary or
desirable revisions thereof for consideration by. the Council. After discussion, the
Mayor qDpointed Alderman Neff, Chairman, with Wexler, Schubert and McKay as a Committee
to revise the City Code.

BIDS TO BE ADVERTISED FOR WIDENING THACKER STRFET. At request of Engineer Fletcher, on
motion by Alderman Tures and seconded by Tistle the Council approved to advertise for
bids to widen Thacker Street, bids to be returned July 5, 1955, at 8:00 P.M.'
Alderman Wexler read a petition requesting something be done about low flying
planes. The Mayor instructed the Clerk to write Co. Johnson of O'Hare Airport to
contact Alderman Wexler.
